  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 33826\n\n                        Ratifica Plan de Desarrollo Forestal 2001-2010 (PNDF)\n\nTexto Completo acta: E1C92\nDECRETOS\n\nDECRETOS\n\n \n\nNº 33826-MINAE\n\n \n\nEL PRESIDENTE DE\nLA REPÚBLICA\n\nY EL MINISTRO DEL\nAMBIENTE Y ENERGÍA\n\n \n\nEn uso de las facultades que les\nconfieren los incisos 3) y 18) del artículo 140 y 146 de\nla Constitución\n Política, la\n Ley Forestal y sus reformas, Nº 7575, publicada en\nLa Gaceta Nº 72 de 16\nde abril de 1996 y el artículo 27 de\nla Ley General de\nla Administración\n Pública, Nº 6227, de 2 de mayo de 1978, y\n\n \n\nConsiderando:\n\n \n\nPrimero.-Que el artículo 1º de\nla Ley Forestal Nº 7575,\nestablece como función esencial y prioritaria del Estado, velar por la\nconservación, protección y administración de los bosques naturales y por la\nproducción, aprovechamiento, industrialización y fomento de los recursos\nforestales del país.\n\nSegundo.-Que el Estado cuenta con\nun instrumento de planificación nacional, denominado Plan Nacional de\nDesarrollo Forestal 2001 - 2010. \n\nTercero.-Que este Plan Nacional\nde Desarrollo Forestal 2001 - 2010, incorpora políticas ambientales globales de\nCosta Rica, definidas por el Ministerio del Ambiente y Energía, oficializadas\nen el año 2001, inspirado en los principios forestales internacionales\npromovidos por la\n Organización de las Naciones Unidas.\n\nCuarto.-Que el Plan Nacional de\nDesarrollo Forestal 2001 -2010 y sus planes futuros, se constituyen como\nelementos primordiales fortalecer un compromiso con el ambiente Nacional de\nDesarrollo, a través del Gobierno en ejercicio fortalece un compromiso con el\nambiente. \n\nQuinto.-Que para cumplir con este\ncompromiso, se requiere conformar y oficializar una Comisión Interinstitucional\nde Seguimiento al Plan Nacional de Desarrollo Forestal, con el fin de dar\nseguimiento y evaluar las acciones tomadas por las instancias gubernamentales. \n\nSexto.-Que como parte de las\nmetas del Plan Nacional de Desarrollo Forestal 2001 -2010 y sus planes futuros,\nse quiere contribuir con la creación e implementación de herramientas\ntecnológicas que promuevan el desarrollo de un sistema de información que\nagilice y garantice una adecuada gestión de la información relacionada al\nsector forestal. \n\nSétimo.-Que en virtud de lo\nanterior, se requiere crear y oficializar un Sistema de Información de los\nRecursos Forestales de Costa Rica, definido en el Plan Nacional de Desarrollo\nForestal 2001 -2010, para garantizar el libre y fácil acceso a la información\nforestal, tanto a las entidades del sector forestal como a la sociedad civil,\nconforme a lo estipulado en el artículo 30 de nuestra Constitución Política. Por\ntanto,\n\nDECRETAN:\n\n    Artículo 1º-Téngase al Plan Nacional\nde Desarrollo Forestal 2011 - 2020, denominado en adelante PNDF, y sus planes\nfuturos, como instrumento oficial de planificación para uso, manejo y protección\nde los recursos forestales del país, en el cual se establecen las directrices y\nlineamientos a desarrollar en el territorio nacional\n\n(Así reformado por el artículo 1° del decreto\nejecutivo N° 36945 del 12 de diciembre del 2011)\n\nArtículo 2º-Créase\nla Comisión\n Interinstitucional de Seguimiento del PNDF, en adelante\ndenominada Comisión de Seguimiento, como una instancia adscrita al Sistema\nNacional de Áreas de Conservación (SINAC), a la cual le corresponderá\nrecomendar, formular, gestionar y dar seguimiento a las acciones definidas en\nel PNDF y sus planes futuros. La misma, estará bajo la supervisión y respaldo\nde diversas instancias, tales como el SINAC, el Fondo Nacional de\nFinanciamiento Forestal (FONAFIFO) y\nla Oficina Nacional\nForestal (ONF).\n\nArtículo 3º-Constitúyase y declárase\nde interés público, el Sistema de Información de los Recursos Forestales de\nCosta Rica, denominado en adelante SIReFOR, al cual\ncorresponderá recopilar, procesar, analizar, sistematizar y publicar periódicamente\nregistros oficiales actualizados sobre la situación de los recursos y\nactividades forestales de Costa Rica, por medio de herramientas tecnológicas\nque faciliten el uso y acceso automatizado de la información forestal a todas\nlas instituciones competentes y a sociedad civil, específicamente, a través de\nun sitio Web bajo dominio gubernamental, denominado www.sirefor.go.cr.\n\n \n\n(Corregido mediante Fe de\nErratas publicada en el Alcance N° 20 a La Gaceta N° 142 del 24 de julio del\n2007).\n\nArtículo\n4º-La Comisión Interinstitucional de Seguimiento del Plan Nacional de\nDesarrollo Forestal (PNDF) estará conformado por los siguientes miembros\nacreditados:\n\na) Un representante\ndel SNAC que coordinará la Comisión de Seguimiento.\n\nb) Un\nrepresentante del FONAFIFO.\n\nc) Un\nrepresentante de la ONF.\n\nd) Un\nrepresentante del Colegio de Ingenieros Agrónomos de Costa Rica.\n\n(Así\nreformado por el artículo 1° del decreto ejecutivo N° 40698 del 31 de agosto\ndel 2017)\n\nArtículo\n5º-Las instituciones que integran la Comisión Interinstitucional de Seguimiento\ndel PNDF, nombrarán un representante suplente, quien podrá acompañar al titular\nen las sesiones de trabajo o representarlo en caso de ausencia.\n\n(Así reformado por el\nartículo 1° del decreto ejecutivo N° 40698 del 31 de agosto del 2017)\n\nArtículo\n6º-Los representantes institucionales que conforman la Comisión de Seguimiento\npodrán hacerse acompañar por funcionarios especialistas de apoyo en los\ndiferentes temas a tratar. Los mismos tendrán voz más no voto en las sesiones\ncorrespondientes.\n\n(Así\nreformado por el artículo 1° del decreto ejecutivo N° 40698 del 31 de agosto\ndel 2017)\n\nArtículo 7º-\nLa Comisión de\nSeguimiento deberá establecer las comisiones o grupos consultivos que considere\nnecesario, para someter a análisis temas o problemas específicos relacionados a\nlas acciones definidas por el PNDF.\n\nArtículo 8º-Con el fin de cumplir\ncon las políticas estipuladas por el PNDF y sus planes futuros,\nla Comisión de\nSeguimiento tendrá que definir en un plazo de seis meses a partir de la publicación\ndel presente Decreto, un reglamento interno tanto para su funcionamiento como\npara efectos de cumplir con el objetivo definido para el SIReFOR en el artículo\n3, asegurando la precisión de las funciones y responsabilidades de cada una de\nlas instituciones involucradas, para lo cual cada una de éstas deberá incluirlo\nen sus respectivos planes de acción institucionales dentro de la estructura\nfuncional, administrativa y financiera correspondiente.\n\nArtículo 9º-El SIReFOR estará\nbajo la responsabilidad de\nla Administración Forestal\ndel Estado y será establecido dentro del SINAC como un Programa Nacional, para\nlo cual deberá asegurar una adecuada implementación técnica dentro de su\nestructura funcional, administrativa y financiera, en un plazo no mayor a los\ndoce meses a partir de la publicación de este Decreto. En virtud de lo\nestablecido en este artículo, el SINAC deberá procurar la asignación o\ncontratación de un Coordinador de Programa que tendrá la facultad de solicitar\na todos los entes y órganos públicos; información, estudios y datos que\nrequiera, para el mejor cumplimiento de sus funciones. Para ello, todas las\noficinas públicas, deberán facilitar la información que éste requiera.\n\nArtículo 10.-Tanto las acciones\ntécnicas y administrativas del Plan Nacional de Desarrollo Forestal, como las\nde la Comisión\nde Seguimiento y del SIReFOR, podrán ser financiadas por fondos de los\nMinisterios, entidades del Estado, Municipalidades, así como de otros fondos\nprovenientes de la cooperación nacional e internacional, rigiéndose por lo\nestipulado por Ley en lo concerniente a donaciones.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 33826\n\n                        Ratifies the Forest Development Plan 2001-2010 (PNDF)\n\nFull Text of record: E1C92\nDECREES\n\nDECREES\n\n \n\nNº 33826-MINAE\n\n \n\nTHE PRESIDENT OF\nTHE REPUBLIC\n\nAND THE MINISTER OF\nENVIRONMENT AND ENERGY\n\n \n\nExercising the powers conferred upon them by subsections 3) and 18) of article 140 and 146 of the\nPolitical Constitution,\nForestry Law No. 7575 and its amendments, published in\nLa Gaceta No. 72 of 16\nApril 1996, and article 27 of\nthe General Law of Public\nAdministration, No. 6227, of 2 May 1978, and\n\n \n\nConsidering:\n\n \n\nFirst.—That article 1 of\nForestry Law No. 7575,\nestablishes as an essential and priority function of the State to ensure the\nconservation, protection, and administration of natural forests and the\nproduction, utilization (aprovechamiento), industrialization, and promotion of the country's forest\nresources.\n\nSecond.—That the State has\na national planning instrument called the National\nForest Development Plan 2001 - 2010. \n\nThird.—That this National\nForest Development Plan 2001 - 2010 incorporates Costa Rica's global environmental policies\ndefined by the Ministry of Environment and Energy, formalized\nin 2001, inspired by international forestry principles\npromoted by the\nUnited Nations Organization.\n\nFourth.—That the National\nForest Development Plan 2001 -2010 and its future plans are constituted as\nfundamental elements to strengthen a commitment to the environment with the National\nDevelopment Plan, through which the sitting Government strengthens a commitment to the\nenvironment. \n\nFifth.—That to fulfill this\ncommitment, it is required to form and formalize an Inter-institutional\nMonitoring Commission for the National Forest Development Plan, in order to\nmonitor and evaluate the actions taken by governmental bodies. \n\nSixth.—That as part of the\ngoals of the National Forest Development Plan 2001 -2010 and its future plans,\nit is desired to contribute to the creation and implementation of technological\ntools that promote the development of an information system that\nstreamlines and guarantees adequate management of information related to\nthe forestry sector. \n\nSeventh.—That by virtue of\nthe foregoing, it is required to create and formalize a Forestry Resources\nInformation System of Costa Rica, defined in the National Forest Development\nPlan 2001 -2010, to guarantee free and easy access to forest\ninformation for both forestry sector entities and civil society,\nin accordance with the provisions of article 30 of our Political Constitution. Therefore,\n\nTHEY DECREE:\n\n    Article 1.—Let the National Forest\nDevelopment Plan 2011 - 2020, hereinafter referred to as PNDF, and its future\nplans, be held as the official planning instrument for the use, management, and protection\nof the country's forest resources, which establishes the directives and\nguidelines to be developed in the national territory.\n\n(Thus amended by article 1 of executive decree\nNo. 36945 of 12 December 2011)\n\nArticle 2.—Create\nthe Inter-institutional\nMonitoring Commission for the PNDF, hereinafter\nreferred to as the Monitoring Commission, as a body attached to the\nNational System of Conservation Areas (SINAC), which shall be responsible for\nrecommending, formulating, managing, and monitoring the actions defined in\nthe PNDF and its future plans. It shall be under the supervision and support\nof various bodies, such as SINAC, the National Forest\nFinancing Fund (FONAFIFO), and\nthe National Forestry\nOffice (ONF).\n\nArticle 3.—Constitute and declare\nof public interest the Forestry Resources Information System of\nCosta Rica, hereinafter referred to as SIReFOR, which\nshall be responsible for compiling, processing, analyzing, systematizing, and periodically publishing\nupdated official records on the status of forest\nresources and activities in Costa Rica, through technological\ntools that facilitate the automated use and access of forest information to all\ncompetent institutions and civil society, specifically, through\na website under a government domain, called www.sirefor.go.cr.\n\n \n\n(Corrected by Erratum\npublished in Supplement No. 20 to La Gaceta No. 142 of 24 July\n2007).\n\nArticle\n4.—The Inter-institutional Monitoring Commission for the National Forest\nDevelopment Plan (PNDF) shall be composed of the following accredited\nmembers:\n\na) A representative\nof SINAC who shall coordinate the Monitoring Commission.\n\nb) A\nrepresentative of FONAFIFO.\n\nc) A\nrepresentative of ONF.\n\nd) A\nrepresentative of the College of Agricultural Engineers of Costa Rica.\n\n(Thus\namended by article 1 of executive decree No. 40698 of 31 August\n2017)\n\nArticle\n5.—The institutions that comprise the Inter-institutional Monitoring Commission\nfor the PNDF shall appoint an alternate representative, who may accompany the principal\nin work sessions or represent them in case of absence.\n\n(Thus amended by\narticle 1 of executive decree No. 40698 of 31 August 2017)\n\nArticle\n6.—The institutional representatives that make up the Monitoring Commission\nmay be accompanied by specialist support officials in the\ndifferent topics to be addressed. They shall have a voice but no vote in the\ncorresponding sessions.\n\n(Thus\namended by article 1 of executive decree No. 40698 of 31 August\n2017)\n\nArticle 7.—\nThe Monitoring Commission\nshall establish the committees or advisory groups it deems\nnecessary to submit for analysis specific topics or problems related to\nthe actions defined by the PNDF.\n\nArticle 8.—In order to comply\nwith the policies stipulated by the PNDF and its future plans,\nthe Monitoring Commission\nshall define, within six months from the publication\nof this Decree, internal regulations both for its operation and\nfor the purpose of fulfilling the objective defined for SIReFOR in article\n3, ensuring the precision of the functions and responsibilities of each of\nthe institutions involved, for which each one of these must include it\nin their respective institutional action plans within the corresponding\nfunctional, administrative, and financial structure.\n\nArticle 9.—SIReFOR shall be\nunder the responsibility of\nthe State Forest\nAdministration and shall be established within SINAC as a National Program, for\nwhich it must ensure adequate technical implementation within its\nfunctional, administrative, and financial structure, within a period not exceeding\ntwelve months from the publication of this Decree. By virtue of what is\nestablished in this article, SINAC must seek the appointment or\nhiring of a Program Coordinator who shall have the authority to request\nfrom all public entities and bodies the information, studies, and data\nrequired for the better fulfillment of its functions. To this end, all\npublic offices must provide the information it requires.\n\nArticle 10.—Both the technical\nand administrative actions of the National Forest Development Plan and those\nof the Monitoring Commission\nand SIReFOR may be funded by funds from\nMinistries, State entities, Municipalities, as well as from other funds\nfrom national and international cooperation, governed by what is\nstipulated by Law regarding donations. Likewise, all\nactions may participate financially with other entities in joint programs or\nprojects, provided that it is a matter of fulfilling the objective of article\n3. \n\nArticle 11.—By virtue of the\nforegoing article, all public entities and bodies are authorized,\nparticularly those that comprise\nthe Monitoring Commission, to designate and\nauthorize the necessary economic and technical resources to coordinate, support,\nand execute the actions related to the PNDF and its future action plans,\nincluding those of SIReFOR.\n\nArticle 12.—It shall enter into force\nupon its publication. \n\n \n\nIssued at\nthe Presidency of\nthe Republic.—San\nJosé, on the fifteenth day of the month of February of the year two thousand seven.\n\n \n\nÓSCAR ARIAS SÁNCHEZ.—"
