Se inicia a las siete horas, treinta minutos y concluye a las\ndieciséis horas, sin perjuicio de los cambios y ajustes que sean necesarios\nrealizar en las distintas dependencias del Instituto, debido a la naturaleza\ndel trabajo que se realiza.\n\nDentro de esa jornada, los servidores\ndisfrutarán de un lapso de cuarenta y cinco minutos para el almuerzo, además de\nquince minutos en la mañana y quince minutos en la tarde para un refrigerio,\ndebiendo ajustarse en todo momento a las pautas dadas por la Sección de\nRecursos Humanos.\n\nLos Jefes serán los responsables de la forma\nen que su respectivo personal haga uso de estos descansos, como responsable\ndirecto de la buena marcha de la dependencia a su cargo.\"\n\n3º-Que en ese mismo giro el artículo 27 de ese\ncuerpo de ley, faculta al Instituto para modificar los horarios establecidos en\nel artículo anterior.\n\n4º-Que conforme a lo dispuesto por el Poder\nEjecutivo, dentro del marco de las políticas de ahorro energético, la\nPresidencia Ejecutiva del INCOPESCA giró las directrices necesarias de\nacatamiento obligatorio para minimizar en lo posible el consumo de\nelectricidad, estableciendo, entre otras cosas, la utilización de aires\nacondicionados y luz eléctrica a partir de las ocho y treinta horas.\n\n5º-Que ha quedado claro que las condiciones\nambientales de las ciudades costeras en las cuales el INCOPESCA tiene sus\nsedes, hacen difícil la prestación de servicios sin la utilización de las\nunidades de aire acondicionado, en el período comprendido entre las siete y\ntreinta horas a las ocho y treinta horas, tanto para los funcionarios como para\nlos usuarios; así como el efecto nocivo que ello representa para los equipos\ninformáticos destacados en cada una de las dependencias institucionales.\n\n6º-Que en acatamiento de las disposiciones\nseñaladas en el punto cuarto anterior; el Jerarca del Ente Rector del Sector\nAgropecuario, al cual está adscrito el INCOPESCA, estableció una modificación\nal horario de servicio en el Ministerio de la Producción, variando la hora de\ningreso de las siete y treinta horas a las ocho horas de lunes a viernes.\n\n7º-Que consientes con lo anterior un grupo\nimportante de funcionarios presentaron a consideración de la Presidencia\nEjecutiva una solicitud expresa para modificar la hora de inicio de la jornada\nordinaria de trabajo, de manera tal que se igualara a la establecida para los\nfuncionarios del Ministerio de la Producción.\n\n8º-Que consecuente con los considerandos señalados, la Junta Directiva, considera factible y\nprocedente establecer una variación a lo establecido en el artículo 26 del Reglamento supra, para\nque en lo sucesivo se lea de la siguiente manera: \"La jornada ordinaria de trabajo para los\nservidores del Instituto será acumulativa y contínua, de lunes a viernes. It begins at seven-thirty and concludes at\nsixteen o'clock, without prejudice to the changes and adjustments that may be necessary\nto make in the different offices of the Institute, due to the nature\nof the work performed.\n\nWithin that working day, the servants\nshall enjoy a period of forty-five minutes for lunch, in addition to\nfifteen minutes in the morning and fifteen minutes in the afternoon for a coffee break,\nand must at all times adjust to the guidelines given by the Human Resources\nSection.\n\nThe Heads shall be responsible for the manner\nin which their respective staff makes use of these breaks, as the directly\nresponsible party for the smooth operation of the office under their charge.\"\n\n3º-That in this same vein, article 27 of that\nbody of law empowers the Institute to modify the schedules established in\nthe previous article.\n\n4º-That pursuant to the provisions of the Executive\nBranch, within the framework of energy saving policies, the\nExecutive Presidency of INCOPESCA issued the necessary mandatory\ndirectives to minimize electricity consumption as much as possible,\nestablishing, among other things, the use of air\nconditioning and electric lighting starting at eight-thirty.\n\n5º-That it has become clear that the environmental\nconditions of the coastal cities in which INCOPESCA has its\nheadquarters make the provision of services difficult without the use of\nair conditioning units, in the period between seven-thirty and eight-thirty, both for the employees and for\nthe users; as well as the harmful effect this represents for\nthe computer equipment located in each of the institutional offices.\n\n6º-That in compliance with the provisions\nindicated in the fourth point above; the Head of the Governing Body of the\nAgricultural Sector, to which INCOPESCA is attached, established a modification\nto the service schedule at the Ministry of Production, changing the\nentry time from seven-thirty to eight o'clock, Monday through Friday.\n\n7º-That in agreement with the above, a significant\ngroup of employees submitted to the consideration of the Executive\nPresidency an express request to modify the start time of the ordinary\nworking day, so that it would match the one established for the\nemployees of the Ministry of Production.\n\n8º-That consistent with the cited recitals, the Board of Directors considers it feasible and\nappropriate to establish a variation to the provisions of article 26 of the aforementioned Regulation, so\nthat henceforth it shall read as follows: \"The ordinary working day for the Institute's\nservants shall be cumulative and continuous, Monday through Friday.
