y 50 y 146 de\nla Constitución Política,\nla Ley de Conservación\nde la Vida Silvestre\nNº 7317, publicada en La\n Gaceta Nº 235 del 7 de diciembre de 1995,\nla Ley de Biodiversidad, Nº 7788,\npublicada en La Gaceta Nº\n101 del 27 de mayo de 1998, los artículos 6º y 2º incisos b) y c) de\nla Ley Orgánica del\nAmbiente Nº 7554, publicada en La\n Gaceta Nº 215 de 13 de noviembre de 1995, y el artículo\n27 de la Ley General\nde la\n Administración Pública, Nº 6227, del 2 de mayo de 1978.\n\n \n\n \n\nConsiderando:\n\n \n\n \n\n1º-\nLa Constitución Política\nde la República\nde Costa Rica, establece en su numeral cincuenta que el Estado costarricense\ndebe velar por el derecho constitucional de todo ciudadano a un ambiente sano,\necológicamente equilibrado y ambientalmente sostenible, entendido como el\ndesarrollo que satisface las necesidades humanas básicas sin comprometer las\nopciones de las futuras generaciones.\n\n2º-Que es función del Estado\nvelar por la conservación de los recursos naturales renovables especialmente\naquellos que impliquen el bienestar y mejor desarrollo social, económico, político\ny ecológico de los pobladores de la región.\n\n3º-Que las comunidades de Gandoca, Manzanillo y Puerto Viejo, actualmente son\nreconocidas como poblaciones a nivel nacional, por lo que es de importancia\ninsoslayable el desarrollo de dichas comunidades, a fin de que los pobladores\nde las mismas sean capaces de responder a las necesidades del presente, sin que\nesto signifique atentar contra el derecho de las generaciones futuras de\nsatisfacer las suyas; debiendo ser en forma sostenible y de la mano con la protección\nde los recursos naturales. \n\n4º-Con la normativa vigente,\nexisten obstáculos reales para que se pueda desarrollar sosteniblemente las\náreas de las comunidades de Gandoca, Manzanillo y\nPuerto Viejo; por lo que es menester ejecutar un cambio en nuestra legislación\na fin de no impedir que las necesidades actuales puedan ser suplidas;\ngarantizando el fortalecimiento para la conservación de toda el área restante\ncomprendida dentro del Refugio de Vida Silvestre Gandoca\nManzanillo.\n\n5º-\nLa Ley Nº 7906 aprueba\nla Convención Interamericana\npara la Protección\ny Conservación de las Tortugas Marinas, cuyo objetivo es promover la\nprotección, conservación y recuperación de las poblaciones de tortugas marinas\ny de los hábitat de los cuáles dependen, basándose en los daños científicos más\nfidedignos disponibles y considerando las características ambientales,\nsocioeconómicas y culturales de los países. \n\n6º-Que mediante Decreto Ejecutivo Nº 16614-MAG, del 1º de julio de 1985, publicado en La Gaceta Nº\n206, del 29 de octubre de 1985, se creó el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo,\npartiendo de la necesidad de protección y conservación de los recursos naturales de valor único\nexistentes en la zona, que incluye manglares, bosques, arrecifes coralinos, máxime por ser una playa\nde anidación de la tortuga marina Baula.\n\n7º-Con la ratificación por parte\ndel Gobierno de Costa Rica de\nla Convención Ramsar en el año 1991, los principales\nhumedales en dicho Refugio quedaron incluidos dentro de la lista de Humedales Ramsar\nde Importancia Internacional por sus particulares características biofísicas,\nsu flora (vegetación dominante: yolillo, orey, palma\nreal, mangle colorado, cativo, gavilán, sangrillo, cerillo, caobilla, fruta dorada, garrobo, bala\nde cañón, pasto de tortuga) y fauna es de gran diversidad, (peces, aves,\nreptiles y mamíferos, corales, moluscos, crustáceos, cambute, langosta, jaiba,\ncangrejo de tierra, pargo, róbalo, mojarra, halcón peregrino, pelícano pardo,\nmono congo, pizote, mapache, martilla, tepezcuintle, guatusa, saíno, oso\nhormiguero, león breñero, especies endémicas\n(mojarra, olomina), amenazadas (iguana verde, caimán, cocodrilo, águila\npescadora, mono araña, mono cara blanca, nutria, danta, chacho\nde monte, serafín del platanar, venado cola blanca) y en peligro de extinción\n(manatí, jaguar, puma, manigordo).\n\nAdicionalmente, llegan a desovar\na playas costarricenses seis especies de quelonios marinos: tortuga carey (Eretmochelys imbricata),\ntortuga caguama (Dermochelys\ncaretta), tortuga lora (Lepidochelys\nolivacea), tortuga baula\n(Dermochelys coriacea),\ntortuga verde del Caribe (Chelonia mydas), verde del Pacífico (Chelonia\nagassizii), todas estas especies en situación\ncrítica por su explotación sin control.\n\n8º-Debido a que una de las\nprincipales causas de mortalidad de tortugas adultas, se debe a su\nentrampamiento en redes colocadas en el paso hacia las playas de anidación o\nsitios de alimentación; se reconoció la necesidad y el deber de modificar los\nlímites del Refugio en su parte marítima, con el fin de brindar una mayor\nprotección mar adentro, contra las acciones humanas que tiendan a perjudicar a\nlas especies de tortugas marinas.\n\n9º-Que de conformidad con el\nartículo 32º de la Ley\n Orgánica del Ambiente, Nº 7554 y el artículo 82º de\nla Ley de Conservación de\nla Vida Silvestre, Nº\n7317, los recursos naturales comprendidos dentro de los Refugios Nacionales de\nVida Silvestre quedan bajo la competencia y manejo exclusivo de\nla Dirección General\nde Vida Silvestre del Ministerio de Recursos Naturales, Energía y Minas,\nactualmente Sistema Nacional de Áreas de Conservación del Ministerio del\nAmbiente y Energía, en virtud del artículo 22 de\nla Ley de Biodiversidad, Nº 7788.\nPor tanto,\n\n \n\n \n\nDECRETAN:\n\n \n\n \n\nArtículo 1º-Ratifíquese el\ndecreto original de creación de Refugio de Vida Silvestre Gandoca-Manzanillo\nNº 16614-MAG del 1º de julio de 1985, publicado en\nLa Gaceta Nº 206, del\n29 de octubre de 1985; exceptuando el artículo 5º.\n\n \n\n(\nLa Sala Constitucional\n mediante resolución N° 1056 de 28 de enero de 2009, anuló\npor conexidad este artículo\n \"únicamente en tanto no excluye\nademás\nel artículo 6\ndel decreto original de creación de Refugio de Vida Silvestre\nGandoca-Manzanillo, Nº 16614-MAG del 1º de julio de 1985\").\n\n \n\n Ficha articulo\n\nArtículo 2º-Modifíquese el\nartículo 1º del Decreto de Creación del Refugio de Vida Silvestre\nGandoca-Manzanillo Nº 16614-MAG del 1º de julio de 1985, publicado en La\nGaceta Nº 206, del 29 de octubre de 1985, ampliándose los límites de dicho\nRefugio, quedando el área comprendida dentro de los siguientes linderos: según\nel mapa básico Sixaola 3644 I, escala 1:50000 del Instituto Geográfico\nNacional. Partiendo de un punto situado 100 metros al noreste de la\ndesembocadura del río Cocles sobre la línea de marea. Continúa de ese punto y\nsiempre paralelo 100 metros al río Cocles con rumbo suroeste hasta alcanzar la\ncarretera actual entre Puerto Viejo y Manzanillo. Sigue por esa carretera con\nrumbo este hasta 100 metros antes del puente sobre la quebrada Ernesto en donde\ntoma una línea paralela de 100 metros a dicha quebrada aguas arriba, hasta su\nnacimiento. En su nacimiento toma la curva del nivel de los 40 metros y se va\npor dicha curva hasta alcanzar la intersección entre las coordenadas 609.000 E\ny 395.000 N. De ese punto sigue una línea de 300 metros, con este franco para\nbuscar posteriormente otra línea que se ubique 100 metros antes del nacimiento de\nla quebrada Milla. De ese punto sigue aguas abajo una línea paralela de 100\nmetros a dicha quebrada hasta llegar a un punto situado en la costa a 200\nmetros antes de la línea de marea. Luego continúa con rumbo sureste paralelo\n200 metros a la costa hasta un punto situado a 300 metros antes de la primera\nboca de la laguna Gandoca (hoy cerrada) y toma esa línea paralela 300 metros al\nrío Gandoca aguas arriba, hasta un punto situado entre la coordenada 617.000 E\ny la coordenada 391.400 N. De ese punto toma rumbo sur franco hasta el río\nSixaola, en donde luego toma aguas abajo por la margen izquierda hasta su\ndesembocadura. De ese punto de la desembocadura, se toma una línea\nperpendicular a la playa de 2.500 metros y\ncontinúa bordeando la costa con rumbo noreste y en forma paralela a ésta a una\ndistancia de 2.500 metros hasta una línea\nimaginaria perpendicular 2.500 metros al punto\ninicial de la presente descripción situado 100 metros al noreste de la\ndesembocadura del río Cocles. therefore, it is necessary to execute a change in our legislation\nso as not to prevent current needs from being met;\nguaranteeing the strengthening of conservation for the entire remaining area\ncomprised within the Gandoca-Manzanillo Wildlife Refuge.\n\n5º-\nLaw Nº 7906 approves\nthe Inter-American Convention\nfor the Protection\nand Conservation of Sea Turtles, whose objective is to promote the\nprotection, conservation, and recovery of sea turtle populations\nand of the habitats upon which they depend, based on the most reliable\nscientific evidence available and considering the environmental,\nsocioeconomic, and cultural characteristics of the countries.\n\n6º-That by means of Executive Decree Nº 16614-MAG, of July 1, 1985, published in La Gaceta Nº\n206, of October 29, 1985, the Gandoca-Manzanillo National Wildlife Refuge was created,\nbased on the need for protection and conservation of the uniquely valuable natural resources\nexisting in the area, which includes mangroves, forests, and coral reefs, especially because it is a nesting\nbeach for the Baula sea turtle.\n\n7º-With the ratification by\nthe Government of Costa Rica of\nthe Ramsar Convention in 1991, the main\nwetlands in said Refuge were included in the list of Ramsar Wetlands\nof International Importance due to their particular biophysical characteristics,\ntheir flora (dominant vegetation: yolillo, orey, palma\nreal, red mangrove (mangle colorado), cativo, gavilán, sangrillo, cerillo, caobilla, fruta dorada, garrobo, bala\nde cañón, pasto de tortuga) and fauna is of great diversity, (fish, birds,\nreptiles and mammals, corals, mollusks, crustaceans, cambute, lobster (langosta), jaiba,\ncangrejo de tierra, pargo, róbalo, mojarra, peregrine falcon (halcón peregrino), brown pelican (pelícano pardo),\nmono congo, pizote, raccoon (mapache), martilla, tepezcuintle, guatusa, saíno, oso\nhormiguero, león breñero, endemic species (endémicas)\n(mojarra, olomina), threatened (amenazadas) (green iguana (iguana verde), caimán, cocodrilo, osprey (águila\npescadora), mono araña, mono cara blanca, nutria, danta, chacho\nde monte, serafín del platanar, white-tailed deer (venado cola blanca)) and endangered (en peligro de extinción)\n(manatí, jaguar, puma, manigordo).\n\nAdditionally,\nsix species of marine turtles arrive to nest\non Costa Rican beaches: hawksbill turtle (tortuga carey) (Eretmochelys imbricata),\ncaguama turtle (Dermochelys\ncaretta), olive ridley turtle (tortuga lora) (Lepidochelys\nolivacea), leatherback turtle (tortuga baula)\n(Dermochelys coriacea),\nCaribbean green turtle (tortuga verde del Caribe) (Chelonia mydas), Pacific green turtle (Chelonia\nagassizii), all these species in critical\nsituation due to uncontrolled exploitation.\n\n8º-Because one of the\nprincipal causes of mortality for adult turtles is due to their\nentanglement in nets placed in the passage towards nesting beaches or\nfeeding sites; the need and duty to modify the\nlimits of the Refuge in its maritime part was recognized, in order to provide greater\nprotection offshore, against human actions that tend to harm\nsea turtle species.\n\n9º-That in accordance with\nArticle 32 of the Organic\n Environmental Law, Nº 7554 and Article 82 of\nthe Wildlife Conservation\nLaw, Nº\n7317, the natural resources comprised within the National Wildlife\nRefuges fall under the exclusive competence and management of\nthe General Directorate\nof Wildlife of the Ministry of Natural Resources, Energy and Mines,\ncurrently the National System of Conservation Areas of the Ministry of the\nEnvironment and Energy, by virtue of Article 22 of\nthe Biodiversity Law, Nº 7788.\nTherefore,\n\n \n\n \n\nTHEY DECREE:\n\n \n\n \n\nArticle 1º-Ratify the\noriginal decree creating the Gandoca-Manzanillo Wildlife Refuge\nNº 16614-MAG of July 1, 1985, published in\nLa Gaceta Nº 206, of\nOctober 29, 1985; excepting Article 5.\n\n \n(The Constitutional Chamber\n through resolution N° 1056 of January 28, 2009, annulled\nthis article by connection\n \"solely insofar as it does not also exclude\nArticle 6\nof the original decree creating the Gandoca-Manzanillo Wildlife Refuge,\nNº 16614-MAG of July 1, 1985\").\n\n \n\n Ficha articulo\n\nArticle 2º-Modify\nArticle 1 of the Decree Creating the Gandoca-Manzanillo Wildlife Refuge\nNº 16614-MAG of July 1, 1985, published in La\nGaceta Nº 206, of October 29, 1985, expanding the boundaries of said\nRefuge, the area comprised within the following boundaries being: according\nto the basic map Sixaola 3644 I, scale 1:50000 of the National Geographic\nInstitute. Starting from a point located 100 meters northeast of the\nmouth of the Cocles River on the tide line. It continues from that point and\nalways parallel 100 meters to the Cocles River heading southwest until reaching the\ncurrent road between Puerto Viejo and Manzanillo. It follows that road heading\neast up to 100 meters before the bridge over the Ernesto Creek where\nit takes a line parallel 100 meters to said creek upstream, to its\nspring (nacimiento). At its spring it takes the curve of the 40-meter level and follows\nsaid curve until reaching the intersection between coordinates 609,000 E\nand 395,000 N. From that point it follows a line of 300 meters, with this clear line to\nsubsequently seek another line that is located 100 meters before the spring of\nMilla Creek. From that point it follows a line parallel 100 meters\nto said creek downstream until reaching a point located on the coast at 200\nmeters before the tide line. It then continues heading southeast parallel\n200 meters to the coast to a point located 300 meters before the first\nmouth of the Gandoca Lagoon (now closed) and takes that parallel line 300 meters to\nthe Gandoca River upstream, to a point located between coordinate 617,000 E\nand coordinate 391,400 N. From that point it takes a clear south heading to the Sixaola\nRiver, where it then follows downstream along the left bank to its\nmouth. From that point of the mouth, a line\nperpendicular to the beach of 2,500 meters is taken and\nit continues bordering the coast heading northeast and parallel to it at\na distance of 2,500 meters to an imaginary\nline perpendicular 2,500 meters to the initial\npoint of the present description located 100 meters northeast of the\nmouth of the Cocles River.
