su Reglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de\nenero de 2006 y sus reformas; la\n Ley Nº 5222, Ley de Creación del Instituto Meteorológico\nNacional de 26 de junio de 1973 y su reforma; el Decreto Ejecutivo Nº\n32868-MINAE de 24 de agosto de 2005; el Decreto Ejecutivo Nº 32452-H de 29 de\njunio de 2005 y su reforma y el Decreto Ejecutivo Nº 32973-H de 1° de marzo de\n2006 y sus reformas.\n\n \n\nConsiderando:\n\n \n\nI.-Que\nla Ley Nº 5222, Ley de Creación\ndel Instituto Meteorológico Nacional, publicada en\nLa Gaceta Nº 127 de 7\nde julio de 1973, en su artículo 1° crea al Instituto Meteorológico Nacional,\ncomo \"entidad adscrita\" al Ministerio de Agricultura y Ganadería, con jerarquía\nde Dirección General y con jurisdicción en toda\nla República.\n\nII.-Que posteriormente, con\nla Ley Nº 7152, publicada en\nLa Gaceta Nº 117 de 21 de\njunio de 1990, se reforma parcialmente\nla Ley Nº 5222, modificando tácitamente con su\nartículo 4, el artículo 1° de la\n Ley Nº 5222 aludida, en el sentido de adscribir dicho\nInstituto al Ministerio de Ambiente y Energía, como un órgano técnico\nespecializado y encargado de brindar servicio meteorológico a todo el país.\n\nIII.-Que el Instituto\nMeteorológico Nacional, solicita incrementar el gasto presupuestario máximo\npara el presente año en ¢206.950.000,00 (doscientos seis millones novecientos\ncincuenta mil colones sin céntimos), con el fin de mejorar parcialmente\nla Red de Estaciones\nMeteorológicas para prevenir futuras emergencias por cambios climáticos; de\nforma tal que se garantice el manejo eficiente e integral de la cuenca\nhidrográfica con mejores herramientas tecnológicas que permitan su operación y\nsu desarrollo.\n\nIV.-Que la erogación descrita en\nel considerando anterior, se incorporará en las subpartidas\npor objeto del gasto, equipo de transporte, equipo y mobiliario, equipo de\ncómputo y maquinaria y equipo diverso, y se financiará con superávit libre.\n\nV.-Que mediante el Decreto\nEjecutivo Nº 32452-H y su reforma, publicado en\nLa Gaceta Nº 130 de 6\nde julio de 2005, se emitió el \"Lineamiento para la aplicación del artículo 6º\nde la Ley Nº\n8131 de la\n Administración Financiera de\nla República y Presupuestos\nPúblicos y la regulación de la clase de ingresos del Sector Público denominada\nFinanciamiento\".\n\nVI.-Que con respecto al superávit\nlibre, el artículo 7° del decreto supra citado,\npermite financiar gastos que se refieran a actividades ordinarias de la\nentidad, atendiéndose el interés de la colectividad y el servicio público,\nsiempre que no tengan un carácter permanente o generen una obligación que\nrequiera financiarse a través del tiempo, tal y como sucede en el presente\ncaso.\n\nVII.-Que en el Decreto Ejecutivo\nNº 32973-H y sus reformas, publicado en\nLa Gaceta Nº 64 de 30 de marzo de 2006,\nla Autoridad Presupuestaria\nformuló las Directrices de Política Presupuestaria de 2007, las cuales fueron\nconocidas por el Consejo de Gobierno y aprobadas por el Poder Ejecutivo,\nestableciendo en el artículo 1° del citado Decreto, el límite de gasto\npresupuestario del año 2007, para las entidades cubiertas por el ámbito de ese\nÓrgano Colegiado.\n\nVIII.-Que el artículo 2º inciso\nb) del Decreto Ejecutivo citado en el considerando 7 de este decreto, establece\nexclusiones de algunos montos de gasto máximo autorizado, relacionados con el\naccionar de las entidades. \n\nIX.-Que adicionalmente solicita que se le excluyan del gasto presupuestario máximo establecido, las\ntransferencias que realiza al Fondo Nacional de Financiamiento Forestal (FONAFIFO) y al Sistema\nNacional de Áreas de Conservación (SINAC), producto del 50% del total recaudado por concepto del\ncanon a cobrar por el Departamento de Aguas del Instituto Meteorológico Nacional, debido al\notorgamiento de las concesiones para el aprovechamiento de aguas superficiales y subterráneas; según\nlo dispuesto en el artículo 14 del Decreto Ejecutivo Nº 32868-MINAE, publicado en La Gaceta Nº 21 de\n30 de enero de 2006.\n\nX.-Que mediante el oficio\nSTAP-0768-06 de 4 de abril de 2006, se le comunicó al Instituto Meteorológico\nNacional el gasto presupuestario máximo fijado para el año 2007 en la suma de\n¢309.400.000,00 (tres cientos nueve millones cuatrocientos mil de colones sin\ncéntimos), el cual no contempla los recursos que el Instituto requiere\nincrementar. \n\nXI.-Que\ncon el oficio DM-860-2007 de 17 de julio de 2007, el señor Ministro de Ambiente\ny Energía en su condición de rector del sector ambiente, energía y\ntelecomunicaciones, avala la solicitud planteada por el Instituto Meteorológico\nNacional.\n\nXII.-Que por lo anterior, se hace\nnecesario ampliar el gasto presupuestario máximo fijado al Instituto\nMeteorológico Nacional para el año 2007 y excluir del límite de ese gasto, las\ntransferencias al Fondo Nacional de Financiamiento Forestal y el Sistema\nNacional de Áreas de\n\nConservación. its Regulation, Executive Decree No. 32988-H-MP-PLAN of January\n31, 2006, and its amendments;\n Law No. 5222, the Law Creating the National Meteorological\nInstitute of June 26, 1973, and its amendment; Executive Decree No.\n32868-MINAE of August 24, 2005; Executive Decree No. 32452-H of June\n29, 2005, and its amendment, and Executive Decree No. 32973-H of March 1,\n2006, and its amendments.\n\n \n\nConsidering:\n\n \n\nI.-\nThat Law No. 5222, the Law Creating\nthe National Meteorological Institute, published in\nLa Gaceta No. 127 of July\n7, 1973, in its article 1, creates the National Meteorological Institute,\nas an \"attached entity\" to the Ministry of Agriculture and Livestock, with the rank\nof General Directorate and with jurisdiction throughout\nthe Republic.\n\nII.- That subsequently, through\nLaw No. 7152, published in\nLa Gaceta No. 117 of June\n21, 1990, Law No. 5222 was partially amended,\ntacitly modifying, through its\narticle 4, article 1 of the\n aforementioned Law No. 5222, in the sense of attaching said\nInstitute to the Ministry of Environment and Energy, as a specialized technical\nbody responsible for providing meteorological service to the entire country.\n\nIII.- That the National Meteorological\nInstitute requests an increase in the maximum budget expenditure\nfor the current year of ₡206,950,000.00 (two hundred six million nine hundred\nfifty thousand colones, no céntimos), in order to partially improve\nthe Meteorological Station Network (Red de Estaciones Meteorológicas) to prevent future emergencies due to climate changes; in\nsuch a way as to guarantee the efficient and comprehensive management of the hydrographic basin (cuenca hidrográfica) with better technological tools that enable its operation and\nits development.\n\nIV.- That the expenditure described in\nthe preceding considering clause will be incorporated into the sub-items\nby object of expenditure: transportation equipment, equipment and furniture,\ncomputer equipment, and diverse machinery and equipment, and will be financed with free surplus (superávit libre).\n\nV.- That through Executive\nDecree No. 32452-H and its amendment, published in\nLa Gaceta No. 130 of July\n6, 2005, the \"Guideline for the application of article 6\nof Law No.\n8131, the\n Financial Administration of\nthe Republic and Public Budgets\n Law, and the regulation of the class of public sector revenues called\nFinancing\" was issued.\n\nVI.- That regarding free surplus (superávit libre), article 7 of the above-cited decree,\nallows financing expenditures that refer to the ordinary activities of the\nentity, attending to the interests of the community and the public service,\nprovided they do not have a permanent character or generate an obligation that\nrequires financing over time, as is the case in the present\ninstance.\n\nVII.- That in Executive Decree\nNo. 32973-H and its amendments, published in\nLa Gaceta No. 64 of March 30, 2006,\nthe Budgetary Authority (Autoridad Presupuestaria)\nformulated the 2007 Budget Policy Guidelines, which were\nmade known to the Government Council and approved by the Executive Branch,\nestablishing in article 1 of said Decree, the budget expenditure limit\nfor the year 2007, for the entities covered by the scope of that\nCollegiate Body.\n\nVIII.- That article 2, subsection\nb) of the Executive Decree cited in considering clause 7 of this decree, establishes\nexclusions of certain amounts from the maximum authorized expenditure, related to the\noperations of the entities.\n\nIX.- That additionally, it requests that the transfers it makes to the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO) and the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), resulting from 50% of the total collected for the fee to be charged by the Water Department of the National Meteorological Institute, due to the granting of concessions for the use of surface and groundwater, be excluded from the established maximum budget expenditure; pursuant to the provisions of article 14 of Executive Decree No. 32868-MINAE, published in La Gaceta No. 21 of January 30, 2006.\n\nX.- That through official communication STAP-0768-06 of April 4, 2006, the National Meteorological Institute was informed of the maximum budget expenditure set for the year 2007 in the sum of ₡309,400,000.00 (three hundred nine million four hundred thousand colones, no céntimos), which does not contemplate the resources that the Institute requires to increase.\n\nXI.- That\nthrough official communication DM-860-2007 of July 17, 2007, the Minister of Environment\nand Energy, in his capacity as head of the environment, energy, and\ntelecommunications sector, endorses the request made by the National Meteorological\nInstitute.\n\nXII.- That, due to the foregoing, it is\nnecessary to expand the maximum budget expenditure set for the National\nMeteorological Institute for the year 2007 and to exclude from that expenditure limit the\ntransfers to the National Forest Financing Fund and the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC).\n\nConservation Areas. Therefore;\n\n \n\nTHEY DECREE:\n\n \n\nArticle 1.- The maximum budget expenditure for the year 2007, established in Executive Decree No. 32973-H and its amendments, published in La Gaceta No. 64 of March 30, 2006, is hereby amended for the National Meteorological Institute, with the maximum budget expenditure set at the sum of ₡516,350,000.00 (five hundred sixteen million three hundred fifty thousand colones, no céntimos) for this period.\n\nArticle 2.- It is the responsibility of the active administration of the National Meteorological Institute to comply with Executive Decree No. 32452-H, published in La Gaceta No. 130 of July 6, 2005, as well as the provisions of article 6 of Law No. 8131, the Financial Administration Law of the Republic and Public Budgets, published in La Gaceta No. 198 of October 16, 2001.\n\nArticle 3.- The transfers to the National Forest Financing Fund (Fondo Nacional de Financiamiento Forestal, FONAFIFO) and the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) are hereby added to subsection b) of article 2 of Executive Decree No. 32973-H and its amendments, published in La Gaceta No. 64 of March 30, 2006, as exclusions from the budget expenditure for the National Meteorological Institute.\n\nArticle 4.- It shall become effective upon its publication.\n\n \n\nIssued at\nthe Presidency of\nthe Republic, on the\ntwenty-first day of the month of September of the year two thousand seven."
