En caso de incumplimiento de no estar registrados ante el SFE, se actuará conforme a lo estipulado en la Ley de Protección Fitosanitaria N' 7664, sus reglamentos y legislación conexa.\n\nArtículo 15°- Del incumplimiento de la normativa o recomendaciones técnicas o procedimentales. Cuando se incumplan las normas emitidas y las recomendaciones técnicas basadas en normativa dadas por un funcionario del SFE con competencia en la materia, la oficina regional del SFE con competencia podrá ordenar la clausura total o parcial del sitio de propagación o establecimiento vía resolución administrativa, esto provocará la inmovilización del material vegetal propagativo del área clausurada.\n\nLos sitios de propagación llevarán un libro de actas en que se anotarán las visitas de los funcionarios del SFE, el mismo debe estar disponible para los funcionarios y en un lugar que permita su resguardo, el libro será proporcionado por el órgano competente del SFE que será el propietario del mismo.",

  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 33927\n\n                        Reglamento de Viveros, Almácigos, Semilleros y Bancos de Yemas\n\nTexto Completo acta: 133E04\nNº 33927\n\nNº 33927\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AGRICULTURA Y GANADERÍA\n\nEn uso de las facultades que le confiere el artículo 140, incisos 3) y 18)\nde la Constitución Política y los artículos 2 inciso a) y b), y el artículo 5°\nincisos a), b), f) ñ) y el artículo 22 de la Ley de Protección Fitosanitaria,\nLey N° 7664 del 8 de abril, publicada en La Gaceta N° 83 del 2 de mayo\nde 1997, Ley N° 7064 del 29 de abril de 1987, Ley de Fomento a la Producción\nAgropecuaria y Orgánica del Ministerio de Agricultura y Ganadería, artículo 28\ninciso b) de la Ley General de Administración Pública.\n\n \n\nConsiderando:\n\n1º-Que le corresponde al Estado por medio del Servicio Fitosanitario del\nEstado, proteger la condición fitosanitaria de las plantas, sus productos y\nsubproductos.\n\n2º-Que es de interés del Estado proteger la producción de plantas en\nviveros o almácigos, bancos de yemas y de laboratorio de manera que se obtenga\nuna buena condición fitosanitaria.\n\n3º-Que la producción y el comercio de estas plantas sin control\nfitosanitario, se puede constituir en un medio de propagación de plagas, que\ndebe evitarse.\n\n4º-Que conociendo los daños económicos que ha originado la utilización de\nplantas de viveros y bancos de yemas, de mala calidad fitosanitaria en otros\npaíses y en el nuestro, es de urgente necesidad el establecimiento de\ndisposiciones fitosanitarias dirigidas a establecer los procedimientos técnicos\nde observancia obligatoria para los productores.\n\n5º-Que a la fecha se cuenta con el Decreto Ejecutivo Nº 27065- MAG, que es\nel Reglamento de Viveros, publicado en el Diario Oficial La Gaceta número\n178 del 11 de setiembre de 1998, sin embargo, se hace necesario ajustar las\nregulaciones a las nuevas prácticas de producción de plantas para plantar y\ndisminuir requisitos para facilitar el registro y costos al administrado. Por\nlo que se debe emitir una nueva reglamentación en esta materia. Por tanto,\n\nDECRETAN:\n\nReglamento de Viveros, Almácigos,\n\nSemilleros y Bancos de Yemas\n\nCAPÍTULO I\n\nDe las definiciones\n\nArtículo 1º-Para los efectos de este Reglamento, se define como:\n\nActa: Documento mediante el cual se dan recomendaciones de carácter técnico y\nconstancia del cumplimiento o no de esas recomendaciones, o bien de la\nejecución de medidas fitosanitarias de acuerdo con la Ley de Protección\nFitosanitaria y sus reglamentos.\n\nAlmácigo: Área determinada donde se localiza material vegetal en desarrollo que\nserá seleccionado para su traslado al vivero o campo definitivo.\n\nBanco de Yemas: Conjunto de plantas de origen, identidad genética\ny calidad fitosanitaria reconocidas, que se destinan a la obtención de yemas\npara la reproducción.\n\nCalidad fitosanitaria: Es la condición física y sanitaria de toda\nplanta producida en un vivero, semillero, almácigo o banco de yemas.\n\nCertificación fitosanitaria: Uso de procedimientos fitosanitarios\nconducentes a la expedición de un certificado fitosanitario.\n\nCertificado: Documento oficial que atestigua el estatus\nfitosanitario de cualquier envío sujeto a reglamentaciones fitosanitarias.\n\nCertificado fitosanitario: certificado diseñado según los modelos de\ncertificado de la Convención Internacional de Protección Fitosanitaria (CIPF).\n\nDesvitalización: Procedimiento que elimina la capacidad de\ngerminación, crecimiento o reproducción posterior de las plantas o productos\nvegetales.\n\nDisposiciones Técnicas: Todas las medidas que las autoridades\nfitosanitarias de la Dirección recomienden para obtener una buena calidad\nfitosanitaria del material vegetal producido.\n\nFrutales: Se ubican dentro de este concepto los árboles y arbustos que produzcan\nfrutas, todos los cítricos y el aguacate.\n\nGermoplasma: Plantas destinadas para uso en programas de\nmejoramiento o conservación. (Organización de las Naciones Unidas para la Agricultura\ny la Alimentación, siglas en inglés FAO, 1990),\n\n(Así adicionada la definición anterior por el artículo 2° del decreto ejecutivo N° 42167  del 29 de\noctubre de 2019)\n\nMaterial de Reproducción: Son plantas o partes de ellas destinadas a la\npropagación.\n\nMedida Fitosanitaria: cualquier legislación reglamento o\nprocedimiento oficial que tenga el propósito de prevenir la introducción y/o\ndiseminación de plagas cuarentenarias o de limitar las repercusiones económicas\nde las plagas no cuarentenarias reglamentadas (Normativa Internacional para\nMedidas Fitosanitarias- NIMF N° 5).\n\n(Así\nadicionada la definición anterior por el artículo 2° del decreto ejecutivo N° 42167 del 29 de\noctubre de 2019)\n\nPatrón: Plantas que proporcionan el soporte del injerto.\n\nPlaga:\nCualquier\nespecie, raza o biotipo vegetal o animal o agente patógeno dañino para las\nplantas o productos vegetales (FAO, 1990: revisado FAO, 1995; CIPF, 1997)\n\n(Así reformada la definición\nanterior por el artículo 1° del decreto ejecutivo N° 42167 del 29 de octubre de\n2019)\n\nPlanta Madre: Planta utilizada como productor de semilla o\npartes vegetales destinadas a la reproducción.\n\nPlantas: Plantas vivas y partes de ellas, incluidas\nlas semillas y el germoplasma\n\n(Así\nadicionada la definición anterior por el artículo 2° del decreto ejecutivo N° 42167 del 29 de\noctubre de 2019)\n\nPlantas para plantar: plantas destinadas a permanecer plantadas, a\nser plantadas o replantadas (Normativa Internacional para Medidas\nFitosanitarias-NIMF N° 5).\n\n(Así\nadicionada la definición anterior por el artículo 2° del decreto ejecutivo N° 42167 del 29 de\noctubre de 2019)\n\nProductor Comercial: Se refiere a toda persona física o jurídica que\nse dedique a la producción o comercialización de material vegetal.\n\nPrograma Nacional de Material Vegetal\nPropagativo: órgano\ncompetente en materia de administración del registro y responsable de llevar a\ncabo el procedimiento administrativo del mismo.\n\n(Así adicionada la definición anterior por el artículo 2° del decreto ejecutivo N° 42167 del 29 de\noctubre de 2019)\n\nSemillas: Clase de producto básico correspondiente a las semillas para plantar o\ndestinadas a ser plantadas y no al consumo o elaboración (véase grano)\n(Organización de las Naciones Unidas para la Agricultura y la Alimentación,\nsiglas en inglés FAO, 1990), revisado por el Comité Internacional de Medidas\nFitosanitarias- CIMF, 2001.\n\n(Así\nadicionada la definición anterior por el artículo 2° del decreto ejecutivo N° 42167 del 29 de\noctubre de 2019)\n\nVariedades: Todo material vegetal que se utiliza para su\npropagación, debidamente seleccionado por sus características genéticas\npermanentes.\n\nVivero: Sitio donde se ubican las plantas procedentes de almácigos o germinadores\npara ser injertados o recreados.\n\nVigilancia: Un proceso oficial, mediante el cual se\nrecoge y registra información sobre la presencia o ausencia de una plaga\nutilizando encuestas, monitoreo u otros procedimientos (Normativa Internacional\npara Medidas Fitosanitarias-NIMF N° 5).\n\n(Así\nadicionada la definición anterior por el artículo 2° del decreto ejecutivo N° 42167 del 29 de\noctubre de 2019)\n\nSemillero: Área determinada donde se localiza material\nvegetal en germinación.\n\nYemas: Brote de una planta a partir del cual se desarrollan las ramas, las hojas\ny las flores.\n\nArtículo 2º-Para los efectos de este Reglamento, se utilizarán las\nsiguientes abreviaturas.\n\nSFE: Servicio Fitosanitario de Estado.\n\nDOR: Departamento de Operaciones Regionales\n\n(Así reformada la\nabreviatura anterior por el artículo 1° del decreto ejecutivo N° 42167 del 29 de octubre de 2019)\n\nPNMVP:\nPrograma\nNacional de Material Vegetal Propagativo\n\n(Así reformada la\nabreviatura anterior por el artículo 1° del decreto ejecutivo N° 42167 del 29 de octubre de 2019)\n\nMAG: Ministerio de Agricultura y Ganadería.\n\nUOR: Unidad Operativa Regional\n\n(Así adicionada la\nabreviatura anterior por el artículo 2° del decreto ejecutivo N° 42167 del 29 de octubre de 2019)\n\nCAPÍTULO II\n\n \n\nDe la Organización Administrativa\n\nArtículo 3°-Créase\nel Programa Nacional de Material Vegetal Propagativo que establece las normas,\nlos requisitos y procedimientos fitosanitarios para regular a los productores que\nproducen y a su vez comercializan material vegetal propagativo, de acuerdo a lo\nestipulado en el artículo 22 de la Ley 7664, como parte de las funciones del\nDepartamento de Operaciones Regionales del SFE, con las siguientes funciones:\n\na) Dar los lineamientos\ny políticas en materia fitosanitaria relacionada con el manejo y trazabilidad\ndel material vegetal propagativo a nivel nacional, desde la etapa de producción\nhasta su establecimiento en el campo.\n\nb) Establecer y\ndar seguimiento a los procedimientos técnicos y administrativos para el\nregistro y control fitosanitario de los sitios que se dedican a la producción y\ncomercialización de material vegetal propagativo.\n\nc) Coordinar y\nsupervisar la programación y desarrollo de actividades técnicas, fitosanitarias,\nlegales y administrativas del Programa, en coordinación con las Unidades\nOperativas Regionales, así como con otros Departamentos del SFE u otras\ninstancias del Sector agropecuario.\n\nd) Establecer las\nmedidas técnicas fitosanitarias, mecanismos de control, inspección y\ntrazabilidad de sitios destinados a la producción y comercialización de\nmaterial vegetal propagativo.\n\ne) En colaboración\ncon las Unidades Operativas Regionales, mantener actualizado el registro de los\nestablecimientos destinados a la producción y comercialización de material\nvegetal propagativo.\n\n(Así reformado por el artículo 1° del decreto\nejecutivo N° 42167 del 29 de octubre de 2019)\n\nCAPÍTULO III\n\nDEL REGISTRO\n\nArtículo 4º-Sujetos que deben inscribirse\nen el registro del Programa Nacional de Material Vegetal Propagativo: Este\nreglamento establecerá control fitosanitario sobre: los laboratorios de reproducción\nsexual y asexual de vegetales, semilleros, almácigos, viveros, bancos de\ngermoplasma, campos de producción de semillas u otros materiales de\npropagación. En caso de incumplimiento de no estar registrados ante el\nSFE, se actuará conforme a lo estipulado en la Ley de Protección\nFitosanitaria N' 7664, sus reglamentos y legislación conexa.\n\n(Así reformado por el artículo\n1° del decreto ejecutivo N° 42167\ndel 29 de octubre de 2019)\n\nArtículo 5°-Para la inscripción en el\nregistro del Programa Nacional de Material Vegetal Propagativo: Las\npersonas físicas o jurídicas deberán cumplir con los siguientes\nrequisitos:\n\na) Presentar solicitud\nformal de inscripción ante la Unidad Operativa Regional del SFE conforme a la\nubicación territorial detallada en dicha solicitud.\n\nb) Para persona\nfísica, presentar cédula de identidad para su verificación. En el caso de\npersona extranjera debe presentar el documento de identidad migratoria para\nextranjeros (DIMEX).\n\nc) Para persona\njurídica, presentar personería jurídica vigente para su verificación.\n\nd) Encontrarse al\ndía con las obligaciones de la Caja Costarricense del Seguro Social. Las mismas\nse verificarán a lo interno.\n\ne) Indicar las\nespecies y variedades a reproducir.\n\nf) Presentar plano\nde ubicación del sitio de producción.\n\ng) En casos en que\nel inmueble donde se desarrolla la actividad se encuentre en condición de\narriendo o préstamo, debe presentar contrato de arriendo o préstamo con fecha\nde vencimiento y autenticado por un notario público.\n\nh) Presentar\ncomprobante de pago previo a la entrega de la resolución de aprobación.\n\n(Así reformado por el artículo 1° del decreto\nejecutivo N° 42167 del 29 de octubre de 2019)\n\nArtículo 6°-De la solicitud de\ninscripción: Se pueden presentar en las oficinas regionales del SFE o en la\nsede central, donde se revisará el contenido de la misma, de estar incompleta emitirán\nun apercibimiento al interesado para que subsane la inconformidad, de no\nsubsanarse en un plazo de 10 días hábiles según el artículo 60 de la Ley N°\n8220, se archivará la solicitud. Una vez verificada la información y si está\ncompleta calificaran por el fondo la información, y realizarán una visita al\nsitio, esto en un plazo máximo de 10 días hábiles y emitirán un informe técnico\ndentro de ese plazo, en el que se testimonia lo dicho en la solicitud y si\nexiste regulación con medidas fitosanitarias especificas para una o varias de\nlas especies que se reproducen en el sitio, deberá indicar la conformidad o no\nde estas con lo normado, luego remitirán el expediente a oficinas centrales,\npara su aprobación y registro.\n\n(Así reformado por el artículo\n1° del decreto ejecutivo N° 42167 del\n29 de octubre de 2019)\n\nArtículo 7°-De la inscripción en el registro: Se hará por\nresolución administrativa, tendrá una vigencia de cinco años y se emitirá un\ncertificado que acredita la inscripción del establecimiento.\n\nEl registro podrá ser renovado una vez finalizado el periodo de\nvigencia. Para el proceso de renovación del registro, el usuario deberá cumplir\ncon lo que se solicita el en artículo 6 de este reglamento.\n\nSólo se permitirá un registro por persona física(*) o jurídica.\nSi el interesado posee más de una unidad productiva a nivel nacional, se\nregistran bajo el mismo código en un único expediente, pero deberá contar con\nun libro de actas, en cada una de las unidades productivas para que el\ninspector fitosanitario realice las anotaciones de cada visita de inspección.\n\n (*) (Corregido mediante Fe de Erratas y\npublica en La Gaceta N° 34 del 20 de febrero del 2020, página N° 84)\n\n (Así reformado por el artículo 1° del decreto\nejecutivo N° 42167 del 29 de\noctubre de 2019)\n\nArtículo 8°-De los costos de inscripción\nal registro del Programa Nacional de Material Vegetal Propagativo. Serán\ncancelados previo a la entrega de la resolución de aprobación. El costo\ndel servicio de inscripción al registro del Programa Nacional de Material\nVegetal Propagativo será de conformidad con el Decreto Ejecutivo N°\n27763-MAG vigente. \"Fijación de tarifas de los servicios del Ministerio\nde Agricultura y Ganadería.\n\n(Así reformado por el artículo\n1° del decreto ejecutivo N° 42167 del\n29 de octubre de 2019)\n\nArtículo 9°-De las\nsuspensiones del registro. El SFE a través del Departamento de\nOperaciones Regionales, mediante las Unidades Operativas Regionales, suspenderá\nel registro en los siguientes casos:\n\na) Cuando exista un riesgo\nfitosanitario que ponga en peligro el patrimonio vegetal del estado.\n\nb) Cuando el propietario u\nocupante, mediante oficio, declare un cese temporal de la actividad.\n\nc) No reportar los cambios en\nlos requisitos indicados en la solicitud de registro.\n\n (*)d) Por incumplimiento de las recomendaciones técnicas.\n\nEl Departamento de Operaciones Regionales, mediante el\nPrograma Nacional de Material Propagativo, podrá suspender el registro en el\nsiguiente caso:\n\n(*) (Corregido mediante Fe de Erratas y publica en La\nGaceta N° 34 del 20 de febrero del 2020, página N° 84)\n\ne) Cuando el contrato de\narrendamiento de las instalaciones declaradas en el registro haya expirado y no\nse haya presentado un nuevo contrato de ampliación del plazo.\n\nLa suspensión del registro será posterior a la notificación\nenviada al representante legal del establecimiento mediante una resolución\nadministrativa emitida por las Unidades Operativas Regionales o en su efecto\npor el encargado del Programa Nacional de Material Propagativo, en donde se\ndetalla el porqué de la misma y se dará un plazo de tres días hábiles para el\ndescargo, antes de emitir la resolución respectiva.\n\n (Así reformado por el artículo 1° del decreto\nejecutivo N° 42167 del 29 de\noctubre de 2019)\n\nArtículo 10.-Del levantamiento de la\nsuspensión. La suspensión será levantada mediante la emisión de una\nresolución administrativa una vez que se hayan subsanado las deficiencias que\nhan dado origen a la misma.\n\n(Así reformado por el artículo 1°\ndel decreto ejecutivo N° 42167 del\n29 de octubre de 2019)\n\nArtículo 11°-De la cancelación del\nregistro. El SFE a través del Departamento de Operaciones Regionales,\nmediante el encargado del Programa Nacional de Material Vegetal Propagativo,\npodrá cancelar la inscripción del registro en los siguientes casos:\n\na) A solicitud de parte.\n\nb) Cuando hayan transcurrido tres meses de\nsuspendido el registro y no se haya realizado la gestión para reactivar el\nmismo o subsanar las situaciones que dieron lugar a la suspensión.\n\nEl Programa Nacional de Material Vegetal\nPropagativo, competente en materia de administración del registro, será el\nresponsable de llevar a cabo el procedimiento administrativo para la\ncancelación del registro.\n\n(Así reformado por el artículo\n1° del decreto ejecutivo N° 42167 del\n29 de octubre de 2019)\n\nArtículo 12.-De las\nmodificaciones al registro. Cualquier declaración hecha al registro puede\nmodificarse a solicitud de parte, y aprobada o denegada vía resolución\nadministrativa. Se puede transferir los derechos de registro por cesión.\n\n(Así reformado por el\nartículo 1° del decreto ejecutivo N°\n42167 del 29  de octubre de 2019)\n\nArtículo 13.-De la actualización del expediente. Las\npersonas físicas o jurídicas registradas deberán de informar al órgano\ncompetente del registro los cambios que hayan ocurrido en(*) las\ndeclaraciones realizadas en la solicitud.\n\n(*)\n(Corregido mediante Fe de Erratas y publica en La Gaceta N° 34 del 20 de\nfebrero del 2020, página N° 84)\n\n (Así reformado por el artículo 1° del decreto\nejecutivo N° 42167 del 29 de\noctubre de 2019)\n\nArtículo 14.-Excepciones\nal registro. (Derogado por el\nartículo 1° del decreto ejecutivo N° 45194 del 23 de junio de 2025)\n\nCAPÍTULO IV\n\nDel procedimiento\n\nArtículo 15°-Del incumplimiento de la\nnormativa o recomendaciones técnicas o procedimentales. Cuando se incumplan\nlas normas emitidas y las recomendaciones técnicas basadas en normativa\ndadas por un funcionario del SFE con competencia en la materia, la\noficina regional del SFE con competencia podrá ordenar la clausura total o\nparcial del sitio de propagación o establecimiento vía resolución\nadministrativa, esto provocará la inmovilización del material vegetal\npropagativo del área clausurada.\n\nLos sitios de propagación llevarán un libro\nde actas en que se anotarán las visitas de los funcionarios del SFE, el mismo\ndebe estar disponible para los funcionarios y en un lugar que permita su\nresguardo, el libro será proporcionado por el órgano competente del SFE que\nserá el propietario del mismo.\n\nEn el caso de aquellas plagas reglamentadas\ncuarentenarias o no cuarentenarias, el establecimiento estará en la\nobligatoriedad de acatar las medidas técnicas y legales emitidas por el SFE,\nentre las cuales se establece la producción del material vegetal propagativo\nbajo un ambiente protegido, con el fin de minimizar el riesgo de diseminación\nde una plaga.\n\n(Así reformado por el artículo\n1° del decreto ejecutivo N° N° 42167\ndel 29 de octubre de 2019)\n\nArtículo 16.-Acceso a la información: En caso de solicitar\nacceso a la información de los expedientes de registro que resguarda el\nPrograma Nacional de Material Vegetal Propagativo, el solicitante solo podrá tener\nacceso a aquella información del expediente que sea de carácter público, de\nacuerdo a lo establecido en la Ley 7975 Información no divulgada así como la\nLey 9097 Ley de Regulación del Derecho de Petición, para lo cual deberá\npresentar solicitud formal ante dicha área, quien valorará la admisibilidad de\nla solicitud.\n\n(Así adicionado\npor el artículo 1° del decreto ejecutivo N° 42167 del 29 de octubre de 2019)\n\nArtículo 17.-Deróguese el Decreto Ejecutivo N° 27065-MAG, del 27 de abril\nde 1998, publicado en La Gaceta N° 178 del 11 de setiembre de 1998.\n\n(Así modificada su numeración por el artículo 1° del\ndecreto ejecutivo N°\n42167 del 29 de octubre de 2019, que lo traspaso del\nantiguo artículo 16 al 17)\n\nArtículo 18.-Rige a partir de su publicación.\n\n(Así modificada su numeración por el artículo 1°\ndel decreto ejecutivo N°\n42167 del 29 de octubre de 2019, que lo traspaso del\nantiguo artículo 17 al 18)\n\nDado en la Presidencia de la República.-San José, a los dos días del mes de\njulio del dos mil siete.\n\nTransitorio único: Los propietarios u ocupantes por cualquier título de\nestablecimientos de propagación y comercialización de material vegetal\npropagativo, contarán con un plazo de hasta seis meses, a partir de la publicación\ndel presente decreto para su registro, de acuerdo con los lineamientos\nestablecidos en los procedimientos administrativos y técnicos emitidos por el\nSFE, con base en este Decreto.\n\n(Así adicionado\npor el artículo 3° del decreto ejecutivo N° 42167 del 29 de octubre de 2019)",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 33927\n\n                        Regulation for Nurseries, Seedbeds, Germination Beds, and Budwood Banks\n\nComplete Text of act: 133E04\nNo. 33927\n\nNo. 33927\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF AGRICULTURE AND LIVESTOCK\n\nExercising the powers conferred by Article 140, subparagraphs 3) and 18) of the Political Constitution and Articles 2, subparagraphs a) and b), and Article 5, subparagraphs a), b), f), ñ) and Article 22 of the Law of Phytosanitary Protection, Law No. 7664 of April 8, published in La Gaceta No. 83 of May 2, 1997, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural and Organic Production of the Ministry of Agriculture and Livestock, Article 28, subparagraph b) of the General Law of Public Administration.\n\n \n\nConsidering:\n\n1º-That it is the responsibility of the State, through the State Phytosanitary Service, to protect the phytosanitary condition of plants, their products, and byproducts.\n\n2º-That it is in the State's interest to protect the production of plants in nurseries (viveros) or seedbeds (almácigos), budwood banks (bancos de yemas), and laboratories so that a good phytosanitary condition is obtained.\n\n3º-That the production and trade of these plants without phytosanitary control can become a means of pest (plaga) dissemination, which must be avoided.\n\n4º-That knowing the economic damages caused by the use of plants from nurseries (viveros) and budwood banks (bancos de yemas) of poor phytosanitary quality in other countries and in our own, it is urgently necessary to establish phytosanitary provisions aimed at establishing mandatory technical procedures for producers.\n\n5º-That to date, Executive Decree No. 27065-MAG exists, which is the Regulation for Nurseries, published in the Official Gazette La Gaceta number 178 of September 11, 1998; however, it is necessary to adjust the regulations to the new practices of plant production for planting and reduce requirements to facilitate registration and costs for the citizen. Therefore, a new regulation on this matter must be issued. Therefore,\n\nTHEY DECREE:\n\nRegulation for Nurseries, Seedbeds,\n\nGermination Beds, and Budwood Banks\n\nCHAPTER I\n\nDefinitions\n\nArticle 1.-For the purposes of this Regulation, the following are defined as:\n\nAct (Acta): Document by which recommendations of a technical nature and certification of compliance or non-compliance with those recommendations, or of the execution of phytosanitary measures (medidas fitosanitarias) in accordance with the Law of Phytosanitary Protection and its regulations, are given.\n\nSeedbed (Almácigo): A defined area where developing plant material is located, which will be selected for transfer to the nursery (vivero) or definitive field.\n\nBudwood Bank (Banco de Yemas): A group of plants of recognized origin, genetic identity, and phytosanitary quality (calidad fitosanitaria), destined for obtaining budwood (yemas) for reproduction.\n\nPhytosanitary Quality (Calidad fitosanitaria): It is the physical and health condition of every plant produced in a nursery (vivero), germination bed (semillero), seedbed (almácigo), or budwood bank (banco de yemas).\n\nPhytosanitary Certification (Certificación fitosanitaria): Use of phytosanitary procedures leading to the issuance of a phytosanitary certificate.\n\nCertificate (Certificado): Official document that attests to the phytosanitary status of any shipment subject to phytosanitary regulations.\n\nPhytosanitary Certificate (Certificado fitosanitario): Certificate designed according to the certificate models of the International Plant Protection Convention (IPPC).\n\nDevitalization (Desvitalización): Procedure that eliminates the capacity for germination, growth, or subsequent reproduction of plants or plant products.\n\nTechnical Provisions (Disposiciones Técnicas): All measures that the phytosanitary authorities of the Directorate recommend to obtain a good phytosanitary quality (calidad fitosanitaria) of the produced plant material.\n\nFruit Trees (Frutales): Trees and shrubs that produce fruit, all citrus trees, and avocado are included within this concept.\n\nGermplasm (Germoplasma): Plants intended for use in improvement or conservation programs. (Food and Agriculture Organization of the United Nations, FAO, 1990),\n\n(Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019)\n\nReproduction Material (Material de Reproducción): It is plants or parts of them intended for propagation.\n\nPhytosanitary Measure (Medida Fitosanitaria): Any legislation, regulation, or official procedure that has the purpose of preventing the introduction and/or dissemination of quarantine pests or limiting the economic repercussions of regulated non-quarantine pests (International Standards for Phytosanitary Measures - ISPM No. 5).\n\n(Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019)\n\nRootstock (Patrón): Plants that provide the support for the graft.\n\nPest (Plaga): Any species, race, or biotype of plant or animal, or pathogenic agent harmful to plants or plant products (FAO, 1990: revised FAO, 1995; IPPC, 1997)\n\n(Thus reformed the previous definition by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nMother Plant (Planta Madre): Plant used as a producer of seed or vegetative parts intended for reproduction.\n\nPlants (Plantas): Living plants and parts thereof, including seeds (semillas) and germplasm (germoplasma)\n\n(Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019)\n\nPlants for Planting (Plantas para plantar): Plants intended to remain planted, to be planted, or replanted (International Standards for Phytosanitary Measures-ISPM No. 5).\n\n(Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019)\n\nCommercial Producer (Productor Comercial): Refers to any natural or legal person engaged in the production or commercialization of plant material.\n\nNational Program for Propagative Plant Material (Programa Nacional de Material Vegetal Propagativo): The competent body for registration administration and responsible for carrying out the administrative procedure thereof.\n\n(Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019)\n\nSeeds (Semillas): Class of basic commodity corresponding to seeds for planting or intended to be planted and not for consumption or processing (see grain) (Food and Agriculture Organization of the United Nations, FAO, 1990), revised by the Interim Commission on Phytosanitary Measures - ICPM, 2001.\n\n(Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019)\n\nVarieties (Variedades): Any plant material used for propagation, duly selected for its permanent genetic characteristics.\n\nNursery (Vivero): Site where plants from seedbeds (almácigos) or germinators are located to be grafted or recreated.\n\nSurveillance (Vigilancia): An official process by which information on the presence or absence of a pest (plaga) is collected and recorded using surveys, monitoring, or other procedures (International Standards for Phytosanitary Measures-ISPM No. 5).\n\n(Thus added the previous definition by Article 2 of Executive Decree No. 42167 of October 29, 2019)\n\nGermination Bed (Semillero): A defined area where germinating plant material is located.\n\nBudwood (Yemas): Shoot of a plant from which branches, leaves, and flowers develop.\n\nArticle 2.-For the purposes of this Regulation, the following abbreviations will be used.\n\nSFE: State Phytosanitary Service (Servicio Fitosanitario de Estado).\n\nDOR: Department of Regional Operations (Departamento de Operaciones Regionales)\n\n(Thus reformed the previous abbreviation by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nPNMVP: National Program for Propagative Plant Material (Programa Nacional de Material Vegetal Propagativo)\n\n(Thus reformed the previous abbreviation by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nMAG: Ministry of Agriculture and Livestock (Ministerio de Agricultura y Ganadería).\n\nUOR: Regional Operational Unit (Unidad Operativa Regional)\n\n(Thus added the previous abbreviation by Article 2 of Executive Decree No. 42167 of October 29, 2019)\n\nCHAPTER II\n\n \n\nOn Administrative Organization\n\nArticle 3.-The National Program for Propagative Plant Material (PNMVP) is created, which establishes the phytosanitary standards, requirements, and procedures to regulate producers who produce and, in turn, commercialize propagative plant material, in accordance with the provisions of Article 22 of Law 7664, as part of the functions of the Department of Regional Operations (DOR) of the SFE, with the following functions:\n\na) Provide guidelines and policies on phytosanitary matters related to the management and traceability of propagative plant material at the national level, from the production stage to its establishment in the field.\n\nb) Establish and follow up on the technical and administrative procedures for the registration and phytosanitary control of sites dedicated to the production and commercialization of propagative plant material.\n\nc) Coordinate and supervise the programming and development of technical, phytosanitary, legal, and administrative activities of the Program, in coordination with the Regional Operational Units (UOR), as well as with other Departments of the SFE or other instances of the agricultural sector.\n\nd) Establish the technical phytosanitary measures, control mechanisms, inspection, and traceability of sites intended for the production and commercialization of propagative plant material.\n\ne) In collaboration with the Regional Operational Units (UOR), keep the registry of establishments intended for the production and commercialization of propagative plant material updated.\n\n(Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nCHAPTER III\n\nON REGISTRATION\n\nArticle 4.-Subjects that must register in the registry of the National Program for Propagative Plant Material: This regulation will establish phytosanitary control over: sexual and asexual plant reproduction laboratories, germination beds (semilleros), seedbeds (almácigos), nurseries (viveros), germplasm banks (bancos de germoplasma), seed production fields, or other propagation materials. In case of non-compliance for not being registered with the SFE, action will be taken in accordance with the provisions of Law of Phytosanitary Protection No. 7664, its regulations, and related legislation.\n\n(Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 5.-For registration in the registry of the National Program for Propagative Plant Material: Natural or legal persons must comply with the following requirements:\n\na) Submit a formal registration application before the Regional Operational Unit (UOR) of the SFE according to the territorial location detailed in said application.\n\nb) For a natural person, present an identity card for verification. In the case of a foreign person, they must present the migratory identity document for foreigners (DIMEX).\n\nc) For a legal person, present a valid legal standing for verification.\n\nd) Be up to date with the obligations of the Costa Rican Social Security Fund (Caja Costarricense del Seguro Social). These will be verified internally.\n\ne) Indicate the species and varieties (variedades) to be reproduced.\n\nf) Present a location map of the production site.\n\ng) In cases where the property where the activity is carried out is under a lease or loan condition, a lease or loan agreement must be presented with an expiration date and authenticated by a notary public.\n\nh) Present proof of payment prior to the delivery of the approval resolution.\n\n(Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 6.-On the registration application: They can be submitted at the SFE regional offices or at the central headquarters, where the content of the application will be reviewed; if it is incomplete, a warning will be issued to the interested party to correct the non-conformity; if it is not corrected within a period of 10 business days according to Article 60 of Law No. 8220, the application will be archived. Once the information is verified and if it is complete, they will qualify the information based on its substance and will conduct a site visit, this within a maximum period of 10 business days, and will issue a technical report within that period, which certifies the content of the application, and if there is regulation with specific phytosanitary measures (medidas fitosanitarias) for one or several of the species reproduced on the site, it must indicate whether or not these conform to the regulations, then the expediente will be sent to the central offices for approval and registration.\n\n(Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 7.-On registration in the registry: It shall be done by administrative resolution, shall have a validity of five years, and a certificate attesting to the registration of the establishment shall be issued.\n\nThe registration may be renewed once the validity period has ended. For the registration renewal process, the user must comply with what is requested in Article 6 of this regulation.\n\nOnly one registration per natural(*) or legal person shall be allowed. If the interested party has more than one productive unit at the national level, they are registered under the same code in a single expediente, but each productive unit must have an act book (libro de actas) so that the phytosanitary inspector can make the notes of each inspection visit.\n\n (*) (Corrected by means of an Erratum and published in La Gaceta No. 34 of February 20, 2020, page No. 84)\n\n (Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 8.-On the costs of registration in the registry of the National Program for Propagative Plant Material. They shall be paid prior to the delivery of the approval resolution. The cost of the service for registration in the registry of the National Program for Propagative Plant Material shall be in accordance with the current Executive Decree No. 27763-MAG. \"Setting of tariffs for the services of the Ministry of Agriculture and Livestock.\"\n\n(Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 9.-On the suspensions of registration. The SFE, through the Department of Regional Operations (DOR), by means of the Regional Operational Units (UOR), shall suspend the registration in the following cases:\n\na) When there is a phytosanitary risk that endangers the plant heritage of the state.\n\nb) When the owner or occupant, by official letter, declares a temporary cessation of the activity.\n\nc) Not reporting changes in the requirements indicated in the registration application.\n\n (*)d) For non-compliance with technical recommendations.\n\nThe Department of Regional Operations (DOR), through the National Program for Propagative Material, may suspend the registration in the following case:\n\n(*) (Corrected by means of an Erratum and published in La Gaceta No. 34 of February 20, 2020, page No. 84)\n\ne) When the lease agreement for the facilities declared in the registration has expired and a new agreement extending the term has not been presented.\n\nThe suspension of the registration will be subsequent to the notification sent to the legal representative of the establishment by means of an administrative resolution issued by the Regional Operational Units (UOR) or, where appropriate, by the person in charge of the National Program for Propagative Material, detailing the reasons for it, and a period of three business days for the defense statement will be granted, before issuing the respective resolution.\n\n (Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 10.-On the lifting of the suspension. The suspension shall be lifted by issuing an administrative resolution once the deficiencies that gave rise to it have been corrected.\n\n(Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 11.-On the cancellation of registration. The SFE, through the Department of Regional Operations (DOR), by means of the person in charge of the National Program for Propagative Plant Material (PNMVP), may cancel the registration in the following cases:\n\na) At the party's request.\n\nb) When three months have elapsed since the registration was suspended and no action has been taken to reactivate it or to correct the situations that led to the suspension.\n\nThe National Program for Propagative Plant Material (PNMVP), competent in matters of registration administration, will be responsible for carrying out the administrative procedure for the cancellation of registration.\n\n(Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 12.-On the modifications to the registration. Any declaration made to the registry may be modified at the party's request, and approved or denied via an administrative resolution. Registration rights may be transferred by assignment.\n\n(Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 13.-On the updating of the expediente. Registered natural or legal persons must inform the competent body of the registry of any changes that have occurred in(*) the declarations made in the application.\n\n(*) (Corrected by means of an Erratum and published in La Gaceta No. 34 of February 20, 2020, page No. 84)\n\n (Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 14.-Exceptions to registration. (Repealed by Article 1 of Executive Decree No. 45194 of June 23, 2025)\n\nCHAPTER IV\n\nOn the procedure\n\nArticle 15.-On non-compliance with the regulations or technical or procedural recommendations. When the issued standards and the technical recommendations based on regulations given by an SFE official with competence in the matter are breached, the SFE regional office with competence may order the total or partial closure of the propagation site or establishment via an administrative resolution, which will cause the immobilization of the propagative plant material in the closed area.\n\nPropagation sites shall keep an act book (libro de actas) in which the visits of SFE officials shall be recorded; it must be available to the officials and in a place that allows its safekeeping; the book shall be provided by the competent body of the SFE, which shall be its owner.\n\nIn the case of those regulated quarantine or non-quarantine pests, the establishment shall be obligated to comply with the technical and legal measures issued by the SFE, among which is the production of propagative plant material under a protected environment, in order to minimize the risk of pest (plaga) dissemination.\n\n(Thus reformed by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 16.-Access to information: In case of requesting access to the information of the registration expedientes guarded by the National Program for Propagative Plant Material, the applicant may only have access to that information in the expediente that is of a public nature, in accordance with the provisions of Law 7975 on Undisclosed Information as well as Law 9097 Law Regulating the Right of Petition, for which they must submit a formal application before said area, which will assess the admissibility of the request.\n\n(Thus added by Article 1 of Executive Decree No. 42167 of October 29, 2019)\n\nArticle 17.-Repeal Executive Decree No. 27065-MAG, of April 27, 1998, published in La Gaceta No. 178 of September 11, 1998.\n\n(Thus modified its numbering by Article 1 of Executive Decree No. 42167 of October 29, 2019, which transferred it from former Article 16 to 17)\n\nArticle 18.-It shall enter into force upon its publication.\n\n(Thus modified its numbering by Article 1 of Executive Decree No. 42167 of October 29, 2019, which transferred it from former Article 17 to 18)\n\nDone at the Presidency of the Republic.-San José, on the second day of July two thousand seven.\n\nSole Transitory Provision: The owners or occupants by any title of establishments for the propagation and commercialization of propagative plant material shall have a period of up to six months from the publication of this decree for their registration, in accordance with the guidelines established in the administrative and technical procedures issued by the SFE, based on this Decree.\n\n(Thus added by Article 3 of Executive Decree No. 42167 of October 29, 2019)"
