El ITCO quedó obligado a someter los traspasos a particulares a las restricciones de su Junta Directiva y a la Ley Forestal, respetando las zonas de aptitud forestal. El decreto fue derogado en 2008 por el decreto ejecutivo 34415.",

11363-A\n\n \n\nEL PRESIDENTE DE\nLA REPUBLICA\n\nY EL MINISTRO DE\nAGRICULTURA Y GANADERIA,\n\n \n\nDe conformidad con las leyes números 5064\nde 22 de agosto de 1972, 2825 de 14 de octubre de 1961 y sus reformas y la 4465\nde 25 de noviembre de 1969, y\n\n \n\nConsiderando:\n\n \n\n1°-Que el Instituto de Tierras y\nColonización ha llegado a constatar que más de un veinte por ciento de las\ntierras comprendidas en el cantón de Turrialba, quinto de la provincia de\nCartago, y en Limón, Pococí, Siquirres, Matina y Guácimo, que corresponden a los\ncantones primero, segundo, tercero, quinto y sexto; todos de la provincia de\nLimón, se encuentran sin inscribir en el Registro de la Propiedad y dado que es\ninterés del Estado que los poseedores de esos terrenos cuenten con su título,\ndebidamente inscrito en el citado Registro para que puedan desarrollar\nplenamente sus fincas.\n\n2°-Que la Junta Directiva del Instituto de\nTierras y Colonización en el artículo décimo de la sesión dos mil trescientos\nseis del día once de setiembre de 1979, declaró los terrenos que luego se\ndescribirán en la parte dispositiva, zona de titulación y solicitó al Poder\nEjecutivo el traspaso de los mismos a su favor, con el objeto de proceder luego\na realizar los trámites catastrales y de Registro Público que se requieren para\nsu titulación.\n\nPor tanto.\n\n \n\nDECRETAN:\n\n \n\nArtículo 1°-\n\nTraspásese\nen forma gratuita al Instituto de Tierras y Colonización en tanto no estén\ncomprendidas dentro de las excepciones que indican las leyes números 2825 de 14\nde octubre de 1961 y sus reformas y 4465 de 25 de noviembre de 1969 y sus\nreformas, o se trate de terrenos de dominio privado o que por otras causas\nlegales no puedan ser traspasados los terrenos ubicados en los cantones\nV-Turrialba de la provincia de Cartago; I-Limón, II-Pococí, III-Siquirres,\nV-Matina y VI-Guácimo, todos de la provincia: de Limón y comprendidos dentro\nde la siguiente demarcación:\n\n \n\nA\npartir del punto de coordenadas 559,540-229,760, que es la intercepción del río\nMercedes con el lindero de la Reserva Forestal de la Cordillera Volcánica\nCentral se sigue aguas abajo del río Mercedes hasta su confluencia con el río\nToro Amarillo en el punto de coordenadas 557,750-234,080, para continuar luego\naguas abajo del río Toro Amarillo hasta llegar al puente localizado sobre el\ncamino carretero que comunica a Guápiles con las tierras' de Río Frío, en el\npunto de coordenadas 557,700-238,540, se continúa por este camino hacia el\nnorte, con rumbo a Guápiles hasta el punto de coordenadas 558,585-240,630, se\nsigue con rumbo este franco hasta interceptar el cauce del río Guápiles, en el\npunto de coordenadas 558,770-240,620, se continúa aguas abajo de este río\nhasta el punto de coordenadas 566,250-257,380 para continuar luego por una\nsucesión de líneas rectas cuyas distancias y coordenadas son:\n\n \n\n3270 metros\n566,560-260,600\n\n1000 ײ\n567,540-260,540\n\n2780 ײ\n567-,340-257,790\n\n \n\nEste\núltimo vértice se ubica sobre el cauce del río Guápiles, por el que se\ncontinúa aguas abajo hasta el punto de coordenadas 568,200-258,040, de aquí\nparte una línea recta de 2 600 metros que intercepta el cauce del río\nTortuguero en el punto de coordenadas 268,370-260,600, se sigue aguas abajo de\neste río' hasta llegar a su confluencia con el río Guápiles en el punto de\ncoordenadas 570,660-261,780 se continúa aguas arriba del río Guápiles hasta\nla intercepción de una vereda en el punto de coordenadas 570,450-261,410, se\ncontinúa por esta vereda con rumbo general norte-sur hasta su entronque con el\nRamal del Tranvía Buenos Aires en La Curia en las coordenadas 570,730-259,210\nse sigue por este Tranvía, con rumbo general suroeste hasta llegar a la\nintercepción del cauce del río Esperanza, coordenadas 270,250-258,280, se\nsigue aguas abajo de este río hasta interceptar el Tranvía de La Esperanza,\ncoordenadas 577,290-260,000, se continúa luego por este Tranvía con dirección\nsuroeste-sur hasta llegar al cauce del río Indio en el punto de coordenadas\n577,530-258,650, se sigue aguas abajo de este río, el que más abajo se\ndenomina río Aguas Gatas, hasta llegar a su desembocadura en el río Jiménez,\ncoordenadas 583,440-253,640, se continúa aguas abajo de este río hasta\nalcanzar el límite de las tierras de administración de JAPDEV A en el punto de\ncoordenadas 590,960-253,620, a partir de este' vértice se continúa a lo lo largo de la costa en una línea equidistante\ndoscientos metros de la misma hasta alcanzar el perímetro de la ciudad de Limón,\na su paso por esta ciudad, el lindero de la zona será la 'línea de la costa\nhasta llegar a la desembocadura del Estero Cieneguita al mar Caribe, coordenadas\n642,400-219,360, de este punto se sigue con rumbo sur-sureste con una línea\nequidistante. doscientos metros de la costa hasta interceptar la ca­rretera Limón-La\nBomba, coordenadas 645,700-212,620, se continúa por esta carretera con rumbo\ngeneral suroeste hasta llegar a un punto cuyas coordenadas son: 645,530-212,210,\nse sigue luego por una línea equidistante quinientos metros de la margen\nderecha, aguas arriba, del río Banano y en una distancia de diez kilómetros\nhasta alcanzar un punto cuyas coordenadas son: 636,500-211,460 de aquí,\nmediante una línea recta de quinientos metros se llega al cauce del río Banano\nen las coordenadas 636,650-211,000, de este punto se continúa aguas arriba del\nrío mencionado hasta llegar a la confluencia con el río Segundo, en las\ncoordenadas 626,000-207,500, se sigue aguas arriba del río Segundo hasta\ninterceptar el lindero de la Reserva Indígena de Chirripó, coordenadas\n621,150-208,090, se sigue a lo largo de este lindero, trazando una línea de 700\nmetros para interceptar el cauce del río Peje en las coordenadas\n621,760-208,460, siguiendo aguas abajo de este río hasta llegar a la\nconfluencia de una quebrada pequeña en las coordenadas 621,190-211,110, a\ncontinuación el lindero es una sucesión de líneas rectas cuyas distancias
