  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 0\n\n                        Procedimiento para tramitar por parte de las Municipalidades Costeras, la\naplicación del artículo 59 de la Ley N° 6043\n\nTexto Completo acta: B2D88\nINSTITUTO COSTARRICENSE DE TURISMO\n\nINSTITUTO COSTARRICENSE DE TURISMO\n\n \n\nLa Junta Directiva\ndel Instituto Costarricense de Turismo, en sesión ordinaria N° 5480, artículo\n5, inciso XIII, celebrada el día 31 de julio del 2007.\n\n \n\nACUERDA\n\n \n\na)         Aprobar\nla Propuesta del\nProcedimiento para tramitar por parte de las municipalidades costeras, la\naplicación del Artículo 59 de la\n Ley N° 6043, mismo que se establece de la siguiente manera:\n\nLa Municipalidad\ninteresada en solicitar la autorización de parte del Instituto Costarricense de\nTurismo para la aplicación del Artículo 59 de\nla Ley de\nla Zona Marítimo\nTerrestre, deberá demostrar que no existen compromisos de mejoras por realizar\nen la zona marítimo terrestre y que no hayan compromisos pendientes de amojonar\nsectores, realizar planes reguladores de sectores determinantes para el\ndesarrollo del cantón, para ello debe aportar la siguiente documentación:\n\n \n\n1.   Presentar por medio de un Acuerdo de Concejo\nla solicitud expresa de aplicar el Artículo 59 de\nla Ley N° 6043, en el Acuerdo se\ndeberá indicar lo siguiente:\n\n \n\n·        \nLas necesidades en las que se requiere invertir\nlos recursos por concepto de canon.\n\n·        \nEl monto solicitado.\n\n·        \nLa justificación del porqué los ingresos por\nconcepto de canon, no serán utilizados para el desarrollo de la zona marítimo terrestre.\n\n \n\n2.   Presentar un Plan de las Inversiones que se han realizado que refleje\nlo siguiente:\n\n \n\n·        \nCertificación de los ingresos obtenidos por\nconcepto de concesiones (no se deben tomar en cuenta montos que no sean estrictamente\npor este concepto).\n\n·        \nInversiones en la zona marítimo terrestre en los\núltimos dos años.\n\n·        \nSectores costeros donde se ha invertido en las\nmejoras señaladas en el Artículo 59 de\nla Ley (en los años anteriores).\n\n·        \nTipo de mejoras realizadas.\n\n·        \nMonto de los dineros invertidos por cada sector.\n\n \n\n3.   Un Programa de la inversión estimada para dar\ncumplimiento al plan de mejoras que señala el Artículo 59, consignando los compromisos\npara la implementación de los Planes Reguladores ya aprobados y oficializados\nen La Gaceta,\ndeberán incluir:\n\n \n\n·        \nPlanes Reguladores de reciente aprobación y\noficialización, los cuales serán objeto de implementación, asignando los\nrecursos respectivos, indicando que obras se realizarán en apertura de caminos,\nmejoramiento de vías de acceso a sectores costeros, entre otros.\n\n·        \nMejoras programadas para la zona marítimo\nterrestre con el plazo de ejecución.\n\n·        \nMonto presupuestado para las mejoras.\n\n \n\n4.   Para establecer los adecuados Mecanismos de\nControl en la verificación del adecuado uso y manejo de los recursos autorizados,\nla Municipalidad\ndeberá aportar lo siguiente:\n\n \n\n·        \nDocumentación donde se establezca por parte del\nConcejo Municipal, el Mecanismo de Control que será utilizado para la administración\ndel o los recursos que se autorizan. De esta forma el ICT se reserva el derecho\nde hacer cualquier observación.\n\n·        \n\nLa Auditoría Interna de\nla Municipalidad\ncorrespondiente, deberá emitir anualmente y enviar a\nla Gerencia del ICT;\ncriterio sobre la razonabilidad de la aplicación del procedimiento de control establecido\ny aprobado por el Concejo. \n\n \n\nLa veracidad de la documentación aportada es responsabilidad\nde la Municipalidad,\nuna vez aportada la documentación, se procederá a valorar la viabilidad de la\nautorización, para remitir a\nla Junta Directiva del Instituto Costarricense de\nTurismo la recomendación del caso.\n\n \n\nb)         Autorizar a\nla administración la comunicación del Acuerdo tomado a\nla Municipalidades\nque administran zona marítimo terrestre.",

Submit, by means of a Council Agreement, the express request to apply Article 59 of Law No. 6043; the Agreement must indicate the following:\n\n· The needs for which the resources from the lease fee (canon) are required to be invested.\n· The amount requested.\n· The justification for why the income from the lease fee will not be used for the development of the maritime terrestrial zone.\n\n2. Present an Investment Plan for the investments that have been made, reflecting the following:\n\n· Certification of the income obtained from concessions (amounts not strictly from this concept should not be taken into account).\n· Investments in the maritime terrestrial zone in the last two years.\n· Coastal sectors where investments have been made in the improvements indicated in Article 59 of the Law (in previous years).\n· Type of improvements carried out.\n· Amount of money invested per sector.\n\n3. An estimated investment program to comply with the improvement plan indicated in Article 59, setting out the commitments for the implementation of the Regulatory Plans already approved and officialized in La Gaceta, must include:\n\n· Recently approved and officialized Regulatory Plans, which will be subject to implementation, assigning the respective resources, indicating which works will be carried out for the opening of roads, improvement of access routes to coastal sectors, among others.\n· Improvements scheduled for the maritime terrestrial zone with the execution timeframe.\n· Budgeted amount for the improvements.\n\n4. To establish adequate Control Mechanisms for verifying the proper use and management of the authorized resources, the Municipality must provide the following:\n\n· Documentation establishing, by the Municipal Council, the Control Mechanism that will be used for the administration of the resource(s) that are authorized. In this way, the Costa Rican Tourism Board reserves the right to make any observation.\n· The Internal Audit Department of the corresponding Municipality must issue annually and send to the Management of the Costa Rican Tourism Board a report on the reasonableness of the application of the control procedure established and approved by the Council.\n\nThe veracity of the documentation provided is the responsibility of the Municipality; once the documentation is provided, the viability of the authorization will be assessed in order to submit the relevant recommendation to the Board of Directors of the Costa Rican Tourism Board.\n\nb) To authorize the administration to communicate the Agreement reached to the Municipalities that administer the maritime terrestrial zone."
