Por tanto,\n\n \n\nSE ACUERDA:\n\n \n\nEmitir\nlas siguientes,\n\n \n\nMEDIDAS DE ORDENAMIENTO PARA EL ESTABLECIMIENTO\n\nDE\nRELACIONES ENTRE LAS ACTIVIDADES DE LA PESCA\n\nCOMERCIAL,\nLA PESCA DEPORTIVA\n\n \n\nArtículo\n1º-Deróguese el acuerdo A.J.D.I.P/177-2002.\n\nArtículo 2º-Para efectos de este acuerdo\nse considera:\n\n \n\nPesca Comercial: Aquella actividad\npesquera que se realiza para obtener beneficios económicos producto de la venta\nen puerto de los productos pesqueros capturados.\n\n \n\nPesca Deportiva: Aquella actividad\npesquera que se realiza sin fines de lucro y con propósito de deporte,\ndistracción, placer, recreo, turismo o pasatiempo.\n\n \n\nPesca Turística: actividad pesquera que\nrealizan personas físicas nacionales o extranjeras, con el fin de capturar, con\nun aparejo de pesca personal apropiado para el efecto, recursos acuáticos\npesqueros en aguas continentales, jurisdiccionales o en la zona económica\nexclusiva, con fines comerciales y propósitos exclusivamente turísticos,\nllevados a cabo de forma permanente.\n\nArtículo\n3º-Establézcase una zona de exclusión para la captura de carnada viva, por\nparte de embarcaciones, según la siguiente demarcación y características, dada\npor la siguiente demarcatoria:\n\n \n\na. En el Golfo Dulce a partir de una línea\nimaginaria comprendida entre Cabo Matapalo y Punta Banco, y de esta línea aguas\nadentro, a embarcaciones cuya eslora sea superior a los ocho metros.\n\n \n\nb. En el Golfo de Nicoya partir de una línea\nimaginaria comprendida entre Cabo Blanco a Isla Herradura, y de esta línea\naguas adentro, a embarcaciones cuya eslora sea superior a los diez metros.\n\n \n\nc.      \nEn el Golfo de Papagayo a partir\nuna línea imaginaria comprendida entre Cabo Velas a Punta Blanca, y de esta\nlínea aguas adentro, a embarcaciones cuya eslora sea superior a los diez\nmetros.\n\nArtículo\n4º-Establézcase una zona de exclusión permanente para el ejercicio de la pesca\ncomercial no turística, utilizando palangre (long line), dirigida a los picudos\ncon carnada viva y portando viveros a bordo, en el Océano Pacífico\nCostarricense, según lo señalado en el artículo 73, de la Ley de Pesca y\nAcuicultura, a partir de las 30 millas contadas desde las líneas imaginarias\nestablecidas en los incisos a, b, y c, del artículo 3 y de esas líneas\nimaginarias hacia aguas a fuera.\n\nArtículo 5º-Cuando se realice la captura\nde las especies de picudos por pescadores deportivos y turísticos o\nincidentalmente por parte de pescadores comerciales no turísticos y el pez esté\naún con vida, este será liberado cortando el reinal o la línea lo más cercano\ndel anzuelo, sin sacar del agua el espécimen capturado.\n\nArtículo 6º-En aquellas áreas en donde\nla pesca deportiva, turística y comercial no turística, coincidan en sus faenas\nde pesca, le estará permitido a la pesca comercial no turística el uso de\ncuerdas y palangre reglamentario sin mediar el uso de carnada viva, mientras\nque a la pesca tanto deportiva como turística le estará permitido el uso de\ncañas, carretes, curricán (troleo).\n\nArtículo 7º-En caso de producirse pesca\nincidental de Pez Vela en la actividad de pesca comercial no turística, sin que\nhubiere sido posible la devolución al mar del ejemplar aún vivo; se permitirá\nla comercialización del producto en estado fresco o congelado para consumo\nhumano en el mercado nacional o internacional. Para efectos de lo anterior, la\npesca incidental no podrá exceder el 15% de la captura total de la embarcación\npor cada viaje de pesca comercial no turística realizado.\n\nSe autoriza la exportación de pez vela\nhasta por un 30% de los desembarques totales registrados en el trimestre\ninmediato anterior, de acuerdo al orden de prioridad de la solicitud.\nEntiéndase que para efectos de esta medida el año tendrá cuatro trimestres definidos\ncronológicamente.\n\nArtículo 8º-Para los efectos de la\naplicación de lo dispuesto en el artículo 7, se considera pesca incidental,\naquella en la cual los ejemplares de Pez Vela sean capturados utilizando\npalangre, siempre que, no correspondan a más del 15% de la captura total de la\nembarcación por cada viaje de pesca comercial no turística realizada. La\ninfracciones a este reglamento se aplicará de conformidad con lo establecido en\nla Ley de Pesca y Acuicultura.\n\nArtículo 9º-Cuando se detecten valores que\nexcedan el porcentaje de captura de Pez Vela permitido como pesca incidental,\nel INCOPESCA procederá al decomiso del producto y dispondrá del mismo según lo\nestablecido en el ordenamiento jurídico pesquero.\n\nArtículo 10.-El INCOPESCA en\ncoordinación con el Servicio Nacional de Guardacostas, será el encargado de\ndivulgar y velar por la aplicación de los alcances del presente acuerdo.\n\nArtículo 11.-Para la descarga de las\ncapturas incidentales de Pez Vela, las embarcaciones estarán obligadas a\nsolicitar la respectiva inspección por parte del INCOPESCA. Siguiendo para esto\nlos procedimientos establecidos por el INCOPESCA.\n\nArtículo 12.-Para el transporte y\ncomercialización de Pez Vela en el territorio nacional, los vehículos de\ntransporte estarán obligados a portar y presentar a las autoridades; la copia\nde la autorización de descarga del producto entregada por el INCOPESCA y la\nfactura de venta del producto emitida por el recibidor o transportista. Therefore,\n\n \n\nIT IS AGREED:\n\n \n\nTo issue the following,\n\n \n\nMANAGEMENT MEASURES FOR THE ESTABLISHMENT OF RELATIONS BETWEEN COMMERCIAL FISHING AND SPORT FISHING ACTIVITIES\n\n \n\nArticle 1.-Repeal agreement A.J.D.I.P/177-2002.\n\nArticle 2.-For the purposes of this agreement, the following is considered:\n\n \n\nCommercial Fishing: That fishing activity carried out to obtain economic benefits from the sale in port of the captured fishery products.\n\n \n\nSport Fishing: That fishing activity carried out without profit and for the purpose of sport, distraction, pleasure, recreation, tourism, or pastime.\n\n \n\nTourist Fishing: Fishing activity carried out by national or foreign natural persons, with the aim of capturing, with appropriate personal fishing tackle for the purpose, aquatic fishery resources in continental, jurisdictional waters, or in the exclusive economic zone, for commercial purposes and exclusively tourist purposes, carried out on a permanent basis.\n\nArticle 3.-Establish a zone of exclusion for the capture of live bait by vessels, according to the following demarcation and characteristics, given by the following demarcation:\n\n \n\na. In Golfo Dulce from an imaginary line between Cabo Matapalo and Punta Banco, and from this line seaward, for vessels with a length overall exceeding eight meters.\n\n \n\nb. In the Gulf of Nicoya from an imaginary line between Cabo Blanco to Isla Herradura, and from this line seaward, for vessels with a length overall exceeding ten meters.\n\n \n\nc. In the Gulf of Papagayo from an imaginary line between Cabo Velas to Punta Blanca, and from this line seaward, for vessels with a length overall exceeding ten meters.\n\nArticle 4.-Establish a permanent zone of exclusion for the exercise of non-tourist commercial fishing, using longline (palangre, long line), targeting billfish with live bait and carrying live wells (viveros) on board, in the Costa Rican Pacific Ocean, as indicated in Article 73 of the Fisheries and Aquaculture Law, from 30 miles measured from the imaginary lines established in subsections a, b, and c of Article 3, and from those imaginary lines seaward.\n\nArticle 5.-When the capture of billfish species is carried out by sport and tourist fishers, or incidentally by non-tourist commercial fishers, and the fish is still alive, it shall be released by cutting the leader (reinal) or the line as close to the hook as possible, without removing the captured specimen from the water.\n\nArticle 6.-In those areas where sport, tourist, and non-tourist commercial fishing coincide in their fishing operations, non-tourist commercial fishing shall be permitted the use of handlines (cuerdas) and regulated longline without the use of live bait, while both sport and tourist fishing shall be permitted the use of rods, reels, and trolling (curricán, troleo).\n\nArticle 7.-In the event of incidental catch of sailfish in non-tourist commercial fishing activity, where it was not possible to return the still-living specimen to the sea, the commercialization of the product in fresh or frozen state for human consumption in the national or international market shall be permitted. For the purposes of the foregoing, incidental catch shall not exceed 15% of the total catch of the vessel for each non-tourist commercial fishing trip conducted.\n\nThe export of sailfish is authorized for up to 30% of the total landings recorded in the immediately preceding quarter, according to the order of priority of the request. Understand that for the purposes of this measure, the year will have four chronologically defined quarters.\n\nArticle 8.-For the purposes of applying the provisions of Article 7, incidental catch is considered that in which the sailfish specimens are captured using longline, provided that they do not correspond to more than 15% of the total catch of the vessel for each non-tourist commercial fishing trip conducted. Violations of this regulation shall be sanctioned in accordance with the provisions established in the Fisheries and Aquaculture Law.\n\nArticle 9.-When values are detected that exceed the percentage of sailfish catch permitted as incidental catch, INCOPESCA shall proceed to confiscate (decomiso) the product and shall dispose of it according to the provisions established in the fisheries legal framework.\n\nArticle 10.-INCOPESCA, in coordination with the National Coast Guard Service, shall be responsible for disseminating and ensuring the application of the scope of this agreement.\n\nArticle 11.-For the landing of incidental catches of sailfish, vessels shall be obliged to request the respective inspection by INCOPESCA, following the procedures established by INCOPESCA for this purpose.\n\nArticle 12.-For the transport and commercialization of sailfish within the national territory, transport vehicles shall be obliged to carry and present to the authorities the copy of the product landing authorization delivered by INCOPESCA and the sales invoice for the product issued by the receiver or transporter, when it is sold in fractions.\n\nArticle 13.-Non-compliance with the provisions established in this agreement shall be sanctioned in accordance with current fisheries legislation.\n\nArticle 14.-Any other prior provision that contradicts this agreement is hereby repealed upon its entry into force.\n\nArticle 15.-It shall be effective as of its publication in the Official Gazette La Gaceta." }
