administradora de los sistemas comunales, como\ninstrumento de desarrollo sostenible social, económico, industrial,\nempresariales, agrario, turístico y de asentamientos humanos que proporcionan\nlos sistemas de acueductos y alcantarillados.\n\n3º-Que\nde conformidad con los artículos 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 y 23 de la\nLey Constitutiva del AyA, artículo 264 de la Ley General de Salud Pública,\nartículos 17, 32, 33, 148 y siguientes de la Ley de Aguas Nº 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de la Asociaciones\nAdministradoras de los Sistemas de Acueductos y Alcantarillados Comunales Nº\n39529-S-MINAE, publicado en La Gaceta Nº 150 del 5 de agosto del 2005,\nse establece que AyA es el ente Rector en todo lo relativo a los Sistemas de\nAcueductos y Alcantarillados en todo el territorio nacional, y se encuentra\nfacultado en delegar la administración de tales sistemas en organizaciones\ndebidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que\nla participación de la comunidad o sociedad civil, constituye uno de los\ninstrumentos eficaces para lograr la consecución del desarrollo sostenible en\nCosta Rica, por lo que AyA, desde 1976 ha venido delegando en las\ncomunidades la administración de aquellos sistemas en las que las ventajas\ncomparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las\npoblaciones, resulte más adecuado asignar en las comunidades su administración.\n\nII.-Que\nla comunidad San Rafael de San Ramón de Alajuela, con aporte de la comunidad,\nde AyA y del Estado, se ha construido un sistema de acueductos comunales, para\nel abastecimiento de una población de habitantes.\n\nIII.-Que\nen asamblea general de vecinos celebrada, dispusieron constituir la\norganización y solicitar al AyA, que delegue la administración de los sistemas\nen dicha organización.\n\nIV.-Que\npor las características del sistema, es procedente delegar la administración en\nla organización comunal constituida al efecto, denominada Asociación\nAdministradora del Acueducto y Alcantarillado Sanitario de San Rafael, cantón\nde San Ramón, provincia de Alajuela, cédula jurídica número tres-cero cero\ndos-trescientos sesenta y siete mil setecientos cincuenta y ocho, que se\nencuentra debidamente inscrita en el Registro de Asociaciones del Registro\nNacional bajo el tomo número quinientos veinticinco, asiento número once mil\nochocientos cincuenta.\n\nV.-Que\npara los efectos de lo dispuesto en el Reglamento, la Dirección de la Región\nPacífico Central mediante el memorando Nº RPC-2007-1053-M del día 18 de octubre\ndel 2007, así como la Dirección Jurídica en el memorando Nº DJ-2007-4787 del\ndía 6 de diciembre del 2007, recomiendan a la Gerencia proceder a la Delegación\nde la Administración del sistema en la respectiva organización.\n\nVI.-Que\nmediante el dictamen legal Nº DJ-SC-0066-2007 del día 6 del mes de diciembre\ndel 2007, la Asesoría Legal de Sistemas Comunales de la Dirección Jurídica,\nemitió criterio, estableciendo que cumplidos los trámites técnicos, es\njurídicamente procedente delegar la administración de dicho sistema. Comuníquese y publíquese.\n\n \n\nAcuerdo\nfirme.\n\n \n\nAcuerdo\nNº 2008-010, adoptado por la\n Junta Directiva del Instituto Costarricense de Acueductos y\nAlcantarillados, en el inciso f), del artículo 6, de la sesión ordinaria\nNº  2008-002, celebrada el 8 de enero del\n2008.\n\n \n\nSan\nJosé, 21 de enero del 2008.", "body_en_text": "in the entirety of the text\n\n -\n\nComplete Text of Norm 010\n\n Request for delegation of the administration of the community's Water Supply and Sanitary Sewerage System, to the Asociación Administradora del Acueducto y Alcantarillado Sanitario de San Rafael, canton of San Ramón, province of Alajuela\n\nComplete Text of record: B5D45\n\nThis Board of Directors hears the request for delegation of the administration of the Water Supply and Sanitary Sewerage Systems\n\nThis Board of Directors hears the request for delegation of the administration of the Water Supply and Sanitary Sewerage Systems.\n\n \n\nWhereas:\n\n \n\n1º-That in accordance with Article 50, 129 of the Political Constitution, the State must ensure the greatest well-being for citizens, planning production towards a healthy, ecologically balanced environment.\n\n2º-That in accordance with Articles 11, 21, 129 and 169 of the Political Constitution, it is the responsibility of the Municipalities to look after local interests, and the Constitutional Chamber in repeated pronouncements has stated that the inviolability of life is guaranteed when potable water and environmental sanitation are supplied under the terms of Article 297 of the General Health Law, for which reason it is imperative that the Municipality contribute, especially regarding zoning and urban development regulations, with the administrative organization of community systems, as an instrument of sustainable social, economic, industrial, business, agricultural, tourism, and human settlement development that the water supply and sewerage systems provide.\n\n3º-That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 24, 1942, the General Potable Water Law and the Regulation of the Administrative Associations of Community Water Supply and Sewerage Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Body in all matters relating to Water Supply and Sanitary Sewerage Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for that purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica, for which reason AyA, since 1976, has been delegating to communities the administration of those systems in which the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\nII.-That the community of San Rafael de San Ramón de Alajuela, with contributions from the community, from AyA and from the State, has built a community water supply system, to supply a population of inhabitants.\n\nIII.-That in a general assembly of neighbors held, they decided to constitute the organization and request AyA to delegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics of the system, it is appropriate to delegate the administration to the community organization constituted for that purpose, named Asociación Administradora del Acueducto y Alcantarillado Sanitario de San Rafael, canton of San Ramón, province of Alajuela, legal identification number three-zero zero two-three hundred sixty-seven thousand seven hundred fifty-eight, which is duly registered in the Associations Registry of the National Registry under volume number five hundred twenty-five, entry number eleven thousand eight hundred fifty.\n\nV.-That for the purposes of the provisions of the Regulation, the Directorate of the Central Pacific Region, through memorandum No. RPC-2007-1053-M of October 18, 2007, as well as the Legal Directorate in memorandum No. DJ-2007-4787 of December 6, 2007, recommend to the General Management to proceed with the Delegation of the Administration of the system to the respective organization.\n\nVI.-That through legal opinion No. DJ-SC-0066-2007 of December 6, 2007, the Legal Advisory Office for Community Systems of the Legal Directorate, issued its criteria, establishing that, having completed the technical procedures, it is legally appropriate to delegate the administration of said system.
