  "body_es_text": "en la totalidad del texto\n\n                    -\n\nTexto Completo Norma 013\n\n                        Convenio de delegación de acueducto y alcantarillado de Asociación\nAdministradora del Acueducto y Alcantarillado Sanitario de Veracruz, Cuajiniquil, Santa Cruz,\nGuanacaste\n\nTexto Completo acta: B5B40\n\nNº 2008-013\n\nNº 2008-013\n\n \n\nASUNTO:  Convenio de delegación de acueducto y\nalcantarillado de Asociación Administradora del Acueducto y Alcantarillado\nSanitario de Veracruz, Cuajiniquil, Santa Cruz, Guanacaste.\n\n \n\nConoce\nesta Junta Directiva de la\n Solicitud de Delegación de\nla Administración del\nSistema de Acueductos y Alcantarillados.\n\n \n\nResultando:\n\n \n\nI.-Que\nde conformidad con el artículo 50, 129 de\nla Constitución Política,\nel Estado debe procurar el mayor bienestar a los ciudadanos, planificando la\nproducción hacia un ambiente sano ecológicamente equilibrado.\n\nII.-Que\nde conformidad con los artículos 11, 21, 129 y 169 de la Constitución Política,\ncorresponde a las Municipalidades velar por los intereses locales, y la Sala\nConstitucional en reiterados pronunciamientos se ha manifestado en el sentido\nde que se garantiza la inviolabilidad de la vida cuando se suministra agua\npotable y saneamiento ambiental en los términos del artículo 297 de la Ley\nGeneral de Salud, por lo que resulta imperativo que la Municipalidad coadyuve\nen especial en lo relativo a los reglamentos de zonificación, desarrollo\nurbanístico, con la organización administradora de los sistemas comunales, como\ninstrumento de desarrollo sostenible social, económico, industrial,\nempresariales, agrario, turístico y de asentamientos humanos que proporcionan\nlos sistemas de acueductos y alcantarillados.\n\nIII.-Que\nde conformidad con los artículos 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 y 23 de la\nLey Constitutiva del AyA, artículo 264 de la Ley General de Salud Pública,\nartículos 17, 32, 33, 148 y siguientes de la Ley de Aguas Nº 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de la Asociaciones\nAdministradoras de los Sistemas de Acueductos y Alcantarillados Comunales Nº\n39529-S-MINAE, publicado en La Gaceta Nº 150 del 5 de agosto de 2005, se\nestablece que AyA es el ente Rector en todo lo relativo a los Sistemas de\nAcueductos y Alcantarillados en todo el territorio Nacional, y se encuentra\nfacultado en delegar la administración de tales sistemas en organizaciones debidamente\nconstituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que\nla participación de la comunidad o sociedad civil, constituye uno de los\ninstrumentos eficaces para lograr la consecución del desarrollo sostenible en\nCosta Rica, por lo que AyA, desde 1976 ha venido delegando en las\ncomunidades la administración de aquellos sistemas en las que las ventajas\ncomparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las\npoblaciones, resulte más adecuado asignar en las comunidades su administración.\n\nII.-Que\nla comunidad Veracruz de Cuajiniquil de Santa Cruz, con aporte de la comunidad,\nde AyA y del Estado, se ha construido un sistema de acueductos comunales, para\nel abastecimiento de una población de habitantes.\n\nIII.-Que\nen Asamblea general de vecinos celebrada, dispusieron constituir la\norganización y solicitar al AyA, que delegue la administración de los sistemas\nen dicha organización.\n\nIV.-Que\npor las características del sistema, es procedente delegar la administración en\nla organización comunal constituida al efecto, denominada Asociación\nAdministradora del Acueducto y Alcantarillado Sanitario de Veracruz,\nCuajiniquil, Santa Cruz, Guanacaste, cédula jurídica tres-cero cero\ndos-quinientos un mil quinientos nueve, que se encuentra debidamente inscrita\nen el Registro de Asociaciones del Registro Nacional bajo el tomo número\nquinientos setenta y uno Asiento número doce mil cuatrocientos trece.\n\nV.-Que\npara los efectos de lo dispuesto en el Reglamento, la Dirección de la Región\nChorotega mediante el memorando Nº RCH-2007-847 del día 3 de diciembre de 2007,\nasí como la Dirección Jurídica en el memorando Nº DJ- 2007-4787 del día 6 de\ndiciembre de 2007, recomiendan a la Gerencia proceder a la Delegación de la\nAdministración del sistema en la respectiva organización.\n\nVI.-Que\nmediante el dictamen legal Nº DJ-SC-0069-2007 del día 6 del mes de diciembre de\n2007, la Asesoría Legal de Sistemas Comunales de la Dirección Jurídica, emitió\ncriterio, estableciendo que cumplidos los trámites técnicos, es jurídicamente\nprocedente delegar la administración de dicho sistema.   "body_en_text": "in the entirety of the text\n\n                    -\n\nFull Text of Rule 013\n\n                        Agreement for the Delegation of the Aqueduct and Sewerage System of the Administrative Association of the Veracruz Aqueduct and Sanitary Sewerage System, Cuajiniquil, Santa Cruz, Guanacaste\n\nFull Text of Record: B5B40\n\nNo. 2008-013\n\nNo. 2008-013\n\n \n\nSUBJECT:  Agreement for the delegation of the aqueduct and sewerage system of the Administrative Association of the Veracruz Aqueduct and Sanitary Sewerage System, Cuajiniquil, Santa Cruz, Guanacaste.\n\n \n\nThis Board of Directors reviews the Request for Delegation of the Administration of the Aqueduct and Sewerage Systems.\n\n \n\nWhereas (Resultando):\n\n \n\nI.- That in accordance with Articles 50 and 129 of the Political Constitution, the State must seek the greatest well-being for its citizens, planning production towards an ecologically balanced, healthy environment.\n\nII.- That in accordance with Articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to look after local interests, and the Constitutional Chamber, in reiterated pronouncements, has stated that the inviolability of life is guaranteed when potable water and environmental sanitation are supplied under the terms of Article 297 of the General Health Law. Therefore, it is imperative that the Municipality cooperates, especially regarding zoning regulations and urban development, with the administrative organization of the communal systems, as an instrument for the sustainable social, economic, industrial, business, agricultural, tourism, and human settlement development provided by aqueduct and sewerage systems.\n\nIII.- That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148 et seq. of the Water Law No. 276 of August 24, 1942, the General Potable Water Law, and the Regulation for Administrative Associations of Communal Aqueduct and Sewerage Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Body in all matters relating to Aqueduct and Sewerage Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for that purpose.\n\n \n\nConsidering (Considerando):\n\n \n\nI.- That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica. Therefore, AyA, since 1976, has been delegating to communities the administration of those systems where the comparative advantages of immediacy, effectiveness, efficiency, cost, and benefit to the populations make it more suitable to assign their administration to the communities.\n\nII.- That the community of Veracruz in Cuajiniquil, Santa Cruz, with contributions from the community, AyA, and the State, has built a communal aqueduct system to supply a population of inhabitants.\n\nIII.- That in a general Assembly of residents held, they decided to constitute the organization and request AyA to delegate the administration of the systems to said organization.\n\nIV.- That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named Asociación Administradora del Acueducto y Alcantarillado Sanitario de Veracruz, Cuajiniquil, Santa Cruz, Guanacaste, legal ID number tres-cero cero dos-quinientos un mil quinientos nueve, which is duly registered in the Registry of Associations of the National Registry under volume number five hundred seventy-one, Entry number twelve thousand four hundred thirteen.\n\nV.- That for the purposes of the provisions of the Regulation, the Directorate of the Chorotega Region, via memorandum No. RCH-2007-847 of December 3, 2007, and the Legal Directorate, via memorandum No. DJ-2007-4787 of December 6, 2007, recommend to the General Management to proceed with the Delegation of the Administration of the system to the respective organization.\n\nVI.- That through legal opinion No. DJ-SC-0069-2007 of December 6, 2007, the Legal Advisory Office for Communal Systems of the Legal Directorate issued its criterion, establishing that, the technical procedures having been completed, it is legally appropriate to delegate the administration of said system.
