  "body_es_text": "en la totalidad del texto\n\n                    -\n\nTexto Completo Norma 005\n\n                        Convenio de delegación de acueducto y alcantarillado de Asociación\nAdministradora del Acueducto y Alcantarillado Sanitario de Caimitos y San Francisco\n\nTexto Completo acta: B5B34\n\nNº 2008-005\n\nNº 2008-005\n\n \n\nASUNTO: Convenio de delegación de acueducto y\nalcantarillado de Asociación Administradora del Acueducto y Alcantarillado\nSanitario de Caimitos y San Francisco.\n\n \n\nConoce\nesta Junta Directiva de la solicitud de delegación de la administración del Sistema\nde Acueductos y Alcantarillados.\n\n \n\nResultando:\n\n \n\n1º-Que\nde conformidad con el artículo 50, 129 de\nla Constitución Política,\nel Estado debe procurar el mayor bienestar a los ciudadanos, planificando la\nproducción hacia un ambiente sano ecológicamente equilibrado.\n\n2º-Que\nde conformidad con los artículos 11, 21, 129 y 169 de la Constitución Política,\ncorresponde a las Municipalidades velar por los intereses locales, y la Sala\nConstitucional en reiterados pronunciamientos se ha manifestado en el sentido\nde que se garantiza la inviolabilidad de la vida cuando se suministra agua\npotable y saneamiento ambiental en los términos del artículo 297 de la Ley\nGeneral de Salud, por lo que resulta imperativo que la Municipalidad coadyuve\nen especial en lo relativo a los reglamentos de zonificación, desarrollo\nurbanístico, con la organización administradora de los sistemas comunales, como\ninstrumento de desarrollo sostenible social, económico, industrial,\nempresariales, agrario, turístico y de asentamientos humanos que proporcionan\nlos sistemas de acueductos y alcantarillados.\n\n3º-Que\nde conformidad con los artículos 1º, 2º, 3º, 4º, 5º, 11, 18, 19, 21, 22 y 23 de\nla Ley Constitutiva del AyA, artículo 264 de la Ley General de Salud Pública,\nartículos 17, 32, 33, 148 y siguientes de la Ley de Aguas Nº 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de la Asociaciones\nAdministradoras de los Sistemas de Acueductos y Alcantarillados Comunales Nº\n39529-S-MINAE, publicado en La Gaceta Nº 150 del 5 de agosto del 2005,\nse establece que AyA es el ente Rector en todo lo relativo a los Sistemas de\nAcueductos y Alcantarillados en todo el territorio nacional, y se encuentra\nfacultado en delegar la administración de tales sistemas en organizaciones\ndebidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que\nla participación de la comunidad o sociedad civil, constituye uno de los\ninstrumentos eficaces para lograr la consecución del desarrollo sostenible en\nCosta Rica, por lo que AyA, desde 1976 ha venido delegando en las comunidades\nla administración de aquellos sistemas en las que las ventajas comparativas de\ninmediatez, eficacia y eficiencia; costo y beneficio a las poblaciones, resulte\nmás adecuado asignar en las comunidades su administración.\n\nII.-Que\nla comunidad Caimitos y San Francisco, con aporte de la comunidad, de AyA y del\nEstado, se ha construido un sistema de acueductos comunales, para el\nabastecimiento de una población de habitantes.\n\nIII.-Que\nen asamblea general de vecinos celebrada, dispusieron constituir la organización\ny solicitar al AyA, que delegue la administración de los sistemas en dicha\norganización.\n\nIV.-Que\npor las características del sistema, es procedente delegar la administración en\nla organización comunal constituida al efecto, denominada Asociación\nAdministradora del Acueducto y Alcantarillado Sanitario de Caimitos y San\nFrancisco, cédula jurídica número tres-cero cero dos-cuatrocientos noventa y\nsiete mil ciento uno, que se encuentra debidamente inscrita en el Registro de\nAsociaciones del Registro Nacional bajo el tomo número quinientos setenta y\nuno, asiento número treinta y un mil setenta y uno.\n\nV.-Que\npara los efectos de lo dispuesto en el Reglamento, la Dirección de la Región\nhuetar Norte mediante el memorando Nº RHN-DAR-07-144 del día 14 de noviembre\ndel 2007, así como la Dirección Jurídica en el memorando Nº DJ-2007-4787 del\ndía 6 de diciembre del 2007, recomiendan a la Gerencia proceder a la Delegación\nde la Administración del sistema en la respectiva organización.\n\nVI.-Que\nmediante el dictamen legal Nº DJ-SC-0061-2007 del día 6 del mes de diciembre\ndel 2007, la Asesoría Legal de Sistemas Comunales de la Dirección Jurídica,\nemitió criterio, estableciendo que cumplidos los trámites técnicos, es\njurídicamente procedente delegar la administración de dicho sistema.   "body_en_text": "in the entirety of the text\n\n                    -\n\nFull Text of Norm 005\n\n                        Delegation Agreement for the Aqueduct and Sewer System of the Administrative Association of the Aqueduct and Sanitary Sewer System of Caimitos and San Francisco\n\nFull Text of Record: B5B34\n\nNo. 2008-005\n\nNo. 2008-005\n\n \n\nSUBJECT: Delegation Agreement for the aqueduct and sewer system of the Administrative Association of the Aqueduct and Sanitary Sewer System of Caimitos and San Francisco.\n\n \n\nThis Board of Directors is reviewing the request for delegation of the administration of the Aqueduct and Sewer Systems.\n\n \n\nWhereas:\n\n \n\n1º-That in accordance with Articles 50 and 129 of the Political Constitution, the State must seek the greatest well-being for its citizens, planning production towards an ecologically balanced and healthy environment.\n\n2º-That in accordance with Articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to look after local interests, and the Constitutional Chamber, in repeated pronouncements, has stated that the inviolability of life is guaranteed when drinking water and environmental sanitation are supplied under the terms of Article 297 of the General Health Law, making it imperative that the Municipality contributes, especially regarding zoning regulations and urban development, with the administrative organization of communal systems, as an instrument of sustainable social, economic, industrial, business, agricultural, tourism, and human settlement development provided by aqueduct and sewer systems.\n\n3º-That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 24, 1942, the General Drinking Water Law, and the Regulation of the Administrative Associations of Communal Aqueduct and Sewer Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Body in all matters relating to Aqueduct and Sewer Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for this purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica, for which reason AyA, since 1976, has been delegating to communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\nII.-That the community of Caimitos and San Francisco, with contributions from the community, AyA, and the State, has built a communal aqueduct system to supply a population of inhabitants.\n\nIII.-That in a general assembly of residents held, they decided to constitute the organization and request AyA to delegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named the Administrative Association of the Aqueduct and Sanitary Sewer System of Caimitos and San Francisco, legal identification number three-zero zero two-four hundred ninety-seven thousand one hundred one, which is duly registered in the Associations Registry of the National Registry under volume number five hundred seventy-one, entry number thirty-one thousand seventy-one.\n\nV.-That for the purposes of the provisions of the Regulation, the Directorate of the Huetar Norte Region, through memorandum No. RHN-DAR-07-144 of November 14, 2007, as well as the Legal Directorate in memorandum No. DJ-2007-4787 of December 6, 2007, recommend to Management to proceed with the Delegation of the Administration of the system to the respective organization.\n\nVI.-That through legal opinion No. DJ-SC-0061-2007 of December 6, 2007, the Communal Systems Legal Advisory of the Legal Directorate issued a criterion, establishing that, having completed the technical procedures, it is legally appropriate to delegate the administration of said system.
