industrial,\nempresariales, agrario, turístico y de asentamientos humanos que proporcionan los\nsistemas de acueductos y alcantarillados.\n\n3º-Que\nde conformidad con los artículos 1º, 2º, 3º, 4º, 5º, 11, 18, 19, 21, 22 y 23 de\nla Ley Constitutiva del AyA, artículo 264 de la Ley General de Salud Pública,\nartículos 17, 32, 33, 148 y siguientes de la Ley de Aguas Nº 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de la Asociaciones\nAdministradoras de los Sistemas de Acueductos y Alcantarillados Comunales Nº\n39529-S-MINAE, publicado en La Gaceta Nº 150 del 5 de agosto del 2005,\nse establece que AyA es el ente Rector en todo lo relativo a los Sistemas de\nAcueductos y Alcantarillados en todo el territorio nacional, y se encuentra\nfacultado en delegar la administración de tales sistemas en organizaciones\ndebidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que\nla participación de la comunidad o sociedad civil, constituye uno de los\ninstrumentos eficaces para lograr la consecución del desarrollo sostenible en\nCosta Rica, por lo que AyA, desde 1976 ha venido delegando en las\ncomunidades la administración de aquellos sistemas en las que las ventajas\ncomparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las\npoblaciones, resulte más adecuado asignar en las comunidades su administración.\n\nII.-Que\nla comunidad Rancho Redondo de Goicoechea, con aporte de la comunidad, de AyA y\ndel Estado, se ha construido un sistema de acueductos comunales, para el\nabastecimiento de una población de habitantes.\n\nIII.-Que\nen asamblea general de vecinos celebrada, dispusieron constituir la organización\ny solicitar al AyA, que delegue la administración de los sistemas en dicha\norganización.\n\nIV.-Que\npor las características del sistema, es procedente delegar la administración en\nla organización comunal constituida al efecto, denominada Asociación Administradora\ndel Sistema de Acueducto de Rancho Redondo de Goicoechea, cédula jurídica\nnúmero tres-cero cero dos-cuatrocientos ochenta y un mil novecientos setenta y\nsiete, que se encuentra debidamente inscrita en el Registro de Asociaciones del\nRegistro Nacional bajo el tomo número quinientos sesenta y nueve, asiento\nnúmero setenta y tres mil novecientos cuarenta y tres.\n\nV.-Que\npara los efectos de lo dispuesto en el Reglamento, la Dirección de la Región\nMetropolitana mediante el memorando Nº DGRM-351-2007del día 27 de setiembre del\n2007, así como la Dirección Jurídica en el memorando Nº DJ-2007-4787 del día 6\nde diciembre del 2007, recomiendan a la Gerencia proceder a la Delegación de la\nAdministración del sistema en la respectiva organización.\n\nVI.-Que\nmediante el dictamen legal Nº DJ-SC-0064-2007 del día 6 del mes de diciembre\ndel 2007, la Asesoría Legal de Sistemas Comunales de la Dirección Jurídica,\nemitió criterio, estableciendo que cumplidos los trámites técnicos, es\njurídicamente procedente delegar la administración de dicho sistema. Comuníquese y publíquese.\n\n \n\nAcuerdo\nfirme.\n\n \n\nAcuerdo\nNº 2008-008, adoptado por la\n Junta Directiva del Instituto Costarricense de Acueductos y\nAlcantarillados en el inciso d), del artículo 6º, de la sesión ordinaria Nº\n2008-002, celebrada el 8 de enero del 2008.\n\n \n\nSan\nJosé, 21 de enero del 2008.-", "body_en_text": "of the entire text\n\n -\n\nFull Text of Regulation 008\n\n Delegation Agreement for the Aqueduct and Sewerage of the Administrative Association\nof the Rancho Redondo de Goicoechea Aqueduct System\n\nFull Text of record: B5B31\n\nNº 2008-008\n\nNº 2008-008\n\n \n\nSUBJECT: Delegation Agreement for the Aqueduct and\nSewerage of the Administrative Association of the Rancho\nRedondo de Goicoechea Aqueduct System.\n\n \n\nThis\nBoard of Directors is reviewing the request for delegation of the administration of the\nAqueduct and Sewerage Systems.\n\n \n\nWhereas:\n\n \n\n1º-That\nin accordance with articles 50 and 129 of\nthe Political Constitution,\nthe State must ensure the greatest well-being for citizens, planning\nproduction towards a healthy and ecologically balanced environment.\n\n2º-That\nin accordance with articles 11, 21, 129, and 169 of the Political Constitution,\nit is the responsibility of the Municipalities to look after local interests, and the\nConstitutional Chamber, in repeated pronouncements, has stated that\nthe inviolability of life is guaranteed when potable water and environmental sanitation are supplied under the terms of article 297 of the General\nHealth Law, making it imperative that the Municipality cooperate,\nespecially regarding zoning regulations and urban\ndevelopment, with the administrative organization of communal systems, as\nan instrument of sustainable social, economic, industrial,\nbusiness, agricultural, tourist, and human settlement development provided by\nthe aqueduct and sewerage systems.\n\n3º-That\nin accordance with articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of\nthe Constitutive Law of AyA, article 264 of the General Public Health Law,\narticles 17, 32, 33, 148 and following of the Water Law Nº 276 of August 24,\n1942, the General Potable Water Law, and the Regulation of the Administrative\nAssociations of Communal Aqueduct and Sewerage Systems Nº\n39529-S-MINAE, published in La Gaceta Nº 150 of August 5, 2005,\nit is established that AyA is the Governing Body in all matters relating to Aqueduct and Sewerage Systems throughout the national territory, and is\nempowered to delegate the administration of such systems to organizations\nduly constituted for that purpose.\n\n \n\nConsidering:\n\n \n\nI.-That\nthe participation of the community or civil society constitutes one of the\neffective instruments for achieving sustainable development in\nCosta Rica, and therefore AyA, since 1976, has been delegating to\ncommunities the administration of those systems where the\ncomparative advantages of immediacy, effectiveness, and efficiency, and cost and benefit to the\npopulations, make it more appropriate to assign their administration to the communities.\n\nII.-That\nthe Rancho Redondo de Goicoechea community, with contributions from the community, from AyA, and\nfrom the State, has built a communal aqueduct system for\nsupplying a population of inhabitants.\n\nIII.-That\nin a general assembly of residents held, they decided to constitute the organization\nand request that AyA delegate the administration of the systems to said\norganization.\n\nIV.-That\ndue to the characteristics of the system, it is appropriate to delegate the administration to\nthe communal organization constituted for that purpose, called the Administrative Association\nof the Rancho Redondo de Goicoechea Aqueduct System, legal identification\nnumber tres-cero cero dos-cuatrocientos ochenta y un mil novecientos setenta y\nsiete, which is duly registered in the Associations Registry of the\nNational Registry under volume number quinientos sesenta y nueve, entry\nnumber setenta y tres mil novecientos cuarenta y tres.\n\nV.-That\nfor the purposes of the provisions of the Regulation, the Directorate of the\nMetropolitan Region, through memorandum Nº DGRM-351-2007 of September 27,\n2007, and the Legal Directorate, through memorandum Nº DJ-2007-4787 of December 6,\n2007, recommend that Management proceed with the Delegation of the\nAdministration of the system to the respective organization.\n\nVI.-That\nthrough legal opinion Nº DJ-SC-0064-2007 of December 6,\n2007, the Legal Advisory Office for Communal Systems of the Legal Directorate\nissued a criterion, establishing that, the technical procedures having been completed, it is\nlegally appropriate to delegate the administration of said system.
