2007 y\nsus reformas.\n\n \n\nConsiderando:\n\n \n\n1º-Que la Ley Orgánica del Ambiente\nNº 7554, publicada en La Gaceta Nº 215 del 13 de noviembre de 1995,\nestablece que el Estado debe velar por la utilización racional de los elementos\nambientales, con el fin de proteger y mejorar la calidad de vida de los\nhabitantes del territorio nacional. Asimismo, está obligado a propiciar un\ndesarrollo económico y ambientalmente sostenible, entendido como el desarrollo\nque satisface las necesidades humanas básicas, sin comprometer las opciones de\nlas generaciones futuras.\n\n2º-Que el Fondo de Vida Silvestre creado mediante Ley Nº\n7317, Ley de Conservación de la Vida Silvestre, publicada en La Gaceta\nNº 235 del 7 de diciembre de 1992, está administrado por el Sistema Nacional de\nÁreas de Conservación, según lo establecido en la Ley de Biodiversidad Nº 7788,\npublicada en La Gaceta Nº 101 del 27 de mayo de 1998.\n\n3º-Que el Fondo de Vida Silvestre, solicita incrementar el\ngasto presupuestario máximo para el año 2008 en ¢32.490.000,00 (treinta y dos\nmillones cuatrocientos noventa mil colones con cero céntimos), para cubrir\nnecesidades de equipo que son importantes para el cumplimiento de las metas\ninstitucionales, materiales de resguardo y seguridad, cachadores, redes, varas\ncon lazo, jaulas, cámaras fotográficas digitales, rifles y pistolas con dardos,\nentre otros.\n\n4º-Que la erogación descrita en el considerando anterior, se\nincorporará en las subpartidas por objeto del gasto, servicios, materiales y\nsuministros, maquinaria y equipo diverso y se financiará con superávit libre.\n\n5º-Que mediante el Decreto Ejecutivo Nº 32452-H y sus\nreformas, publicado en La Gaceta Nº 130 del 6 julio de 2005, se emite el\n\"Lineamiento para la aplicación del artículo 6º de la Ley Nº 8131 de la\nAdministración Financiera de la República y Presupuestos Públicos y la\nregulación de la clase de ingresos del Sector Público denominada\nFinanciamiento\".\n\n6º-Que el artículo 7º del Decreto supracitado, dispone que\nlos recursos provenientes del superávit libre forman parte del patrimonio de\nlos órganos y las entidades y pueden utilizarlos en períodos subsiguientes para\nfinanciar gastos que se refieran a su actividad ordinaria, con los cuales se\natienda el interés de la colectividad, el servicio público y los fines\ninstitucionales, que como los aquí incluidos no tienen carácter permanente ni\ngeneran una obligación que requiera financiarse a través del tiempo.\n\n7º-Que mediante el Decreto Ejecutivo Nº 33646-H y sus\nreformas, publicado en La Gaceta Nº 58 de 22 de marzo de 2007, se\nemitieron las Directrices Generales de Política Presupuestaria para el 2008, estableciéndose\nen el artículo 1º del citado Decreto, el gasto presupuestario máximo del año\n2008 para las instituciones cubiertas por el ámbito de\n\nla\n Autoridad Presupuestaria.\n\n8º-Que con el oficio STAP-0558-07 de 29 de marzo de 2007, se\ncomunicó al Fondo de Vida Silvestre el gasto presupuestario máximo autorizado\npara el año 2008, por un monto de ¢7.100.000,00 (siete millones cien mil\ncolones sin céntimos), el cual no contempla los gastos adicionales que la\ninstitución requiere realizar.\n\n9º-Que el señor Ministro Rector del Sector Ambiente, Energía\ny Telecomunicaciones, mediante el oficio Nº DM-1187-07 de 25 de setiembre de\n2007, avala la solicitud planteada por el Fondo.\n\n10.-Que por lo anterior, se hace necesario modificar el\ngasto presupuestario máximo fijado al Fondo de Vida Silvestre para el año 2008.\nPor tanto,\n\n \n\n \n\nDecretan:\n\n \n\nArtículo 1º-Modifícase para el Fondo de Vida Silvestre, el\ngasto presupuestario máximo del 2008, establecido en el Decreto Ejecutivo Nº\n33646-H y sus reformas, publicado en La Gaceta Nº 58 del 22 de marzo de\n2007, quedando el límite de gasto presupuestario en la suma de ¢39.590.000,00\n(treinta y nueve millones quinientos noventa mil colones con cero céntimos)\npara ese período.\n\nArtículo 2º-Es responsabilidad de la administración activa\ndel Fondo de Vida Silvestre, el cumplimiento del Decreto Ejecutivo Nº 32452-H y\nsus reformas, publicado en La Gaceta Nº 130 del 6 de julio de 2005, así\ncomo lo dispuesto en el artículo 6º de la Ley Nº 8131 y sus reformas, publicada\nen La Gaceta Nº 198 del 16 de octubre de 2001.\n\nArtículo 3º-La presente modificación al gasto presupuestario\nmáximo del año 2008 del Fondo de Vida Silvestre, para efectos de la formulación\ndel presupuesto, rige a partir de su publicación y para su ejecución, rige a\npartir del 1º de enero de 2008.\n\n \n\nDado en la Presidencia de la\nRepública, a los cuatro días del mes de diciembre del año dos mil siete.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Norm 34174\n\n Modifies the Maximum Budgetary Expenditure for 2008 for the Wildlife Fund\n\nComplete Text of record: B6D4D\nNº 34174\n\nNº 34174\n\n \n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF FINANCE\n\n \n\nBased on the powers granted to them by articles 140, subsections 3) and 18) and 146 of the Political Constitution; articles 25, subsection 1); 27, subsection 1) and 28, subsection 2), paragraph b) of Law Nº 6227, General Public Administration Law of May 2, 1978 and its amendments; Law Nº 8131, Financial Administration of the Republic and Public Budgets Law of September 18, 2001 and its amendments; Law Nº 7788, Biodiversity Law of April 30, 1998; Executive Decree Nº 32452-H of June 29, 2005 and its amendments and Executive Decree Nº 33646-H of March 9, 2007 and its amendments.\n\n \n\nConsidering:\n\n \n\n1st-That the Organic Environmental Law Nº 7554, published in La Gaceta Nº 215 of November 13, 1995, establishes that the State must ensure the rational use of environmental elements, in order to protect and improve the quality of life of the inhabitants of the national territory. Likewise, it is obligated to promote economic and environmentally sustainable development, understood as development that satisfies basic human needs, without compromising the options of future generations.\n\n2nd-That the Wildlife Fund (Fondo de Vida Silvestre) created by Law Nº 7317, Wildlife Conservation Law, published in La Gaceta Nº 235 of December 7, 1992, is administered by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC), as established in the Biodiversity Law Nº 7788, published in La Gaceta Nº 101 of May 27, 1998.\n\n3rd-That the Wildlife Fund requests to increase the maximum budgetary expenditure for the year 2008 by ¢32,490,000.00 (thirty-two million four hundred ninety thousand colones with zero céntimos), to cover equipment needs that are important for the fulfillment of institutional goals, security and safeguard materials, catchers, nets, catch-poles, cages, digital photographic cameras, dart rifles and pistols, among others.\n\n4th-That the expenditure described in the preceding considerando will be incorporated into the sub-items by object of expenditure, services, materials and supplies, diverse machinery and equipment and will be financed with free surplus (superávit libre).\n\n5th-That by means of Executive Decree Nº 32452-H and its amendments, published in La Gaceta Nº 130 of July 6, 2005, the \"Guideline for the application of article 6 of Law Nº 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing\" is issued.\n\n6th-That article 7 of the above-cited Decree provides that resources from the free surplus form part of the equity of the bodies and entities and may be used in subsequent periods to finance expenses that refer to their ordinary activity, with which the interest of the community, the public service, and institutional purposes are served, which, like those included herein, do not have a permanent nature nor generate an obligation that requires financing over time.\n\n7th-That by means of Executive Decree Nº 33646-H and its amendments, published in La Gaceta Nº 58 of March 22, 2007, the General Budgetary Policy Guidelines for 2008 were issued, establishing in article 1 of the cited Decree, the maximum budgetary expenditure for the year 2008 for the institutions covered by the scope of the Budgetary Authority (Autoridad Presupuestaria).\n\n8th-That by official letter STAP-0558-07 of March 29, 2007, the Wildlife Fund was notified of the authorized maximum budgetary expenditure for the year 2008, in the amount of ¢7,100,000.00 (seven million one hundred thousand colones without céntimos), which does not contemplate the additional expenses that the institution needs to carry out.\n\n9th-That the Minister Rector of the Environment, Energy and Telecommunications Sector, by official letter Nº DM-1187-07 of September 25, 2007, endorses the request raised by the Fund.\n\n10.-That due to the foregoing, it is necessary to modify the maximum budgetary expenditure set for the Wildlife Fund for the year 2008. Therefore,\n\n \n\n \n\nThey Decree:\n\n \n\nArticle 1-The maximum budgetary expenditure for 2008 for the Wildlife Fund, established in Executive Decree Nº 33646-H and its amendments, published in La Gaceta Nº 58 of March 22, 2007, is hereby modified, leaving the budgetary expenditure limit at the sum of ¢39,590,000.00 (thirty-nine million five hundred ninety thousand colones with zero céntimos) for that period.\n\nArticle 2-It is the responsibility of the active administration of the Wildlife Fund to comply with Executive Decree Nº 32452-H and its amendments, published in La Gaceta Nº 130 of July 6, 2005, as well as the provisions of article 6 of Law Nº 8131 and its amendments, published in La Gaceta Nº 198 of October 16, 2001.\n\nArticle 3-For the purposes of budget formulation, this modification to the maximum budgetary expenditure for the year 2008 of the Wildlife Fund takes effect upon its publication, and for its execution, it takes effect as of January 1, 2008.\n\n \n\nIssued at the Presidency of the Republic, on the fourth day of the month of December of the year two thousand seven." }
