  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 34163\n\n                        Reglamento de Uso Público del Parque Nacional Marino Ballena\n\nTexto Completo acta: B7DC8\nNº 34163\n\nNº 34163\n\n \n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DEL AMBIENTE Y ENERGÍA\n\n \n\nEn ejercicio de las facultades que nos confieren los\nincisos 3) y 18) del artículo 140 y 146 de la Constitución Política, la Ley del\nServicio de Parques Nacionales, Nº 6084 del 24 de agosto de 1977, la Ley\nOrgánica del Ambiente, Nº 7554 del 4 de octubre de 1995, publicada en La\nGaceta Nº 215 del 13 de noviembre de 1995, la Ley de Conservación de la\nVida Silvestre, Nº 7317 del 30 de octubre de 1992, publicada en La Gaceta\nNº 235 del 7 de diciembre de 1992 y su reglamento, Decreto Ejecutivo Nº\n32633-MINAE, publicado en La Gaceta Nº 180 del 20 de setiembre del 2005,\nla Ley de Biodiversidad, Nº 7788 de 30 de abril de 1998, publicada en La\nGaceta Nº 101 del 27 de mayo de 1998, la Ley de Pesca y Acuicultura, Nº\n8436 de 1º de marzo de 2005, publicada en La Gaceta Nº 78 del 25 de\nabril de 2005 y el artículo 27 de la Ley General de la Administración Pública,\nNº 6227, del 2 de mayo de 1978, y según acuerdo firme de la Sesión Ordinaria Nº\n10 del 15 y 16 de mayo del 2007 del Consejo Nacional de Áreas de Conservación (CONAC).\n\n \n\nConsiderando:\n\n \n\nI.-Que es obligación del Estado proteger los\necosistemas marinos de la costa pacífica de nuestro país, los cuales presentan\ngran diversidad biológica a lo largo de todo su litoral especialmente en áreas\ncomo el Tómbolo de Uvita, Isla Ballena, rocas Tres Hermanas y las formaciones\ncoralinas que se encuentran en sus cercanías.\n\nII.-El\nParque Nacional Marino Ballena del Área de Conservación Osa, fue creado mediante\nDecreto Ejecutivo Nº 21294-MIRENEM publicado en La Gaceta Nº 136 del 17\njulio de 1992, siendo el objetivo principal de su creación proteger los\necosistemas marino-costero como manglares, estuarios, playas arenosas,\nacantilados e islotes, que constituyen sitios de gran belleza escénica y valor\nnatural. Así como un refugio temporal para los cetáceos como la ballena\njorobada y el delfín nariz de botella, entre otros.\n\nIII.-Que\nel Parque Nacional Marino Ballena por sus características especiales y la gran\nriqueza biológica, geológica e hidrográfica, es un lugar de gran atractivo\nturístico y científico.\n\nIV.-Que\nesta área silvestre protegida no cuenta en la actualidad con instrumentos de\nplanificación que establezcan las diferentes zonas de uso del Parque, y en las\nque se haya realizado estudios de impacto o de capacidad de carga turística.\n\nV.-Que\ndebido a los potenciales impactos ambientales negativos que genera la actividad\nturística en las áreas silvestres, se hace necesario regular el uso del Parque\npor parte del público, con el fin de asegurar su conservación y mínimo\ndeterioro de los ecosistemas marino costeros que protege el Parque Nacional.\n\nVI.-Que\nesta área protegida históricamente ha mantenido una especial relevancia social\nen términos económicos, recreativos y prácticas culturales. Por tanto,\n\n \n\nDecretan:\n\n \n\nReglamento de Uso Público del\n\nParque Nacional Marino Ballena\n\n \n\nCAPÍTULO I\n\nAspectos generales\n\n \n\nArtículo 1º-El objetivo del presente reglamento es\nestablecer la normativa sobre las actividades de uso público que\nconsecuentemente permita apoyar los objetivos de manejo del área protegida,\nhasta que se pueda contar con el plan de manejo debidamente oficializado.\n\nTodas\nlas actividades que se realicen dentro del Parque deberán ajustarse a las\ndisposiciones del plan de manejo, al presente reglamento de uso público, a la\nsectorización establecida, a las directrices e instrucciones técnicas y\nadministrativas emanadas por el Sistema Nacional de Áreas de Conservación y en\ngeneral a la normativa jurídica vigente a nivel nacional e internacional en\nmateria ambiental.\n\nArtículo\n2º-Este reglamento será de acatamiento obligatorio para todos los visitantes,\nguías, operadores de turismo, investigadores, residentes, funcionarios\npúblicos, voluntarios, y demás personas que ingresen al Parque. La colaboración\ny acatamiento de las siguientes regulaciones ayudarán a la protección de los\necosistemas naturales y al manejo de los recursos por parte de los funcionarios\ndel Parque.\n\nEl\nincumplimiento de las instrucciones, disposiciones o de las normas de\nseguridad, tanto escritas como verbales, facultará a los funcionarios del\nParque para expulsar al infractor y, de ser el caso, presentar denuncia en la\ninstancia judicial o administrativa correspondiente, de acuerdo con la\nnormativa jurídica vigente.\n\nArtículo\n3º-Es obligatorio para todo visitante reportar su ingreso en las casetas\noficiales de admisión ubicadas en los sectores de Playa Colonia, Playa Uvita,\nPlaya Piñuela y Playa Ballena, y cancelar la cuota diaria de admisión y los\ndemás rubros por concepto del disfrute de otros servicios dentro del Parque.\n\nEl\nvisitante siempre deberá conservar el tiquete de admisión durante su\npermanencia en el área, como comprobante de pago en caso de ser requerido por\nalgún funcionario del Parque.\n\nArtículo\n4º-Con el fin de promover el conocimiento sobre la biodiversidad existente en\nel Parque y el acercamiento de las comunidades vecinas, se exonerará del pago\nde entrada al Parque a los pobladores nacionales y extranjeros residentes que\nviven permanentemente en las comunidades de Ojochal, Piñuelas, Ballena, Bahía,\nUvita centro, Playa Hermosa, La Unión, San Josecito, debidamente identificados\ny verificados según el mecanismo que la Administración del Parque disponga.\n\nArtículo\n5º-El horario de atención a los visitantes será de las ocho horas a las\ndieciséis horas, incluyendo sábados, domingos y feriados. Queda facultada la\nAdministración para establecer el horario diario y a destinar un día por semana\na actividades exclusivas de mantenimiento y protección por lo que permanecerá\ncerrado al público.\n\nCAPÍTULO II\n\nSectorización\n\n \n\nArtículo 6º-Para los efectos del presente\nreglamento, se establece la siguiente sectorización tomando como referencia las\nhojas cartográficas: Dominical y Coronado, escala 1:50.000 del Instituto\nGeográfico Nacional.\n\n \n\na. Sector A (Piñuela): se inicia en las coordenadas 497308 y\n338696, en el lugar denominado como Punta Piñuela y finaliza en las coordenadas\n496759 y 339995.\n\n \n\nb. Sector B (Ballena): inicia en las\ncoordenadas 496759 y 339995 y finaliza en las coordenadas 494615 y 342123, en\nel lugar conocido como Punta Chimenea.\n\n \n\nc. Sector C (Playa de Arco): se inicia en las\ncoordenadas 494615 y 342123 en el lugar denominado Punta Chimenea y finaliza en\nlas coordenadas 493489 y 343292, en la desembocadura de Quebrada Grande.\n\n \n\nd. Sector D (Colonia): se inicia en las\ncoordenadas 493489 y 343292 en la desembocadura de Quebrada Grande y finaliza\nen las coordenadas 490594 y 344977, en la desembocadura de Quebrada Villegas.\n\n \n\ne. Sector E (Uvita - Playa Hermosa): se\ninicia en las coordenadas 490594 y 344977 en la desembocadura de Quebrada\nVillegas y finaliza en las coordenadas 489539 y 346584, en la desembocadura del\nRío Uvita. Este sector incluye el tómbolo de Uvita y el ecosistema de manglar\ndel Estero Negro.\n\n \n\nf. Sector F (área marina): incluye toda el\nárea marina descrita en el Decreto de establecimiento del Parque (Decreto\nEjecutivo Nº 21294-MIRENEM).\n\nArtículo 7º-Anclaje: Se permite esta\nactividad únicamente en los sitios denominados Piñuelas, Playa Uvita y Roca\nBallena, solamente para fines de buceo e investigación.\n\nCon\nbase en lo establecido en el artículo 9º de la Ley de Pesca y Acuicultura, Nº\n8436. En caso fortuito o fuerza mayor, la Administración del Parque se\nreservará el derecho de limitar el anclaje en los sitios y definirá el número y\ntamaño de las embarcaciones.\n\nLos\nanclajes se permitirán estrictamente en fondos arenosos, cualquier anclaje en\náreas con colonias de coral será totalmente prohibido.\n\nArtículo\n8º-Embarque y desembarque: Esta actividad se restringe únicamente a los\nsitios Playa Uvita y Piñuelas y para uso de las embarcaciones de los operadores\nde turismo y pescadores residentes de las comunidades indicadas en el artículo\n4º de este reglamento. La Administración del Parque definirá el número y tamaño\nde las embarcaciones mediante resolución fundamentada.\n\nArtículo\n9º-Investigación, grabación, filmación y fotografía: Toda investigación\no filmación dentro del Parque estará regulada por los correspondientes\nreglamentos del Ministerio del Ambiente y Energía. Para la fotografía o\nfilmación comercial submarina o de tortugas marinas en la playa durante la\nnoche, se deberá obtener un permiso emitido por la Dirección del Área de\nConservación Osa (ACOSA) del Sistema Nacional de Áreas de Conservación del\nMinisterio del Ambiente y Energía, y acatar las disposiciones que la\nadministración del Parque considere pertinentes. Cuando la investigación,\nfilmación y fotografía sea marina, la embarcación deberá portar una bandera\nanaranjada en lugar visible.\n\nArtículo\n10.-Pesca de subsistencia: Esta actividad queda restringida a los sitios\ndenominados Colonia, Ballena y Playa Uvita (exceptuando el Tómbolo y el manglar\ndebido al deterioro y fragilidad de sus ecosistemas y especies). Estará\npermitida solamente a aquellos grupos familiares que demuestren una condición\nsocioeconómica que amerite esta práctica.\n\nEl\ndesarrollo de esta actividad se permitirá únicamente mediante el uso de cuerda,\nla obtención de carnadas se autoriza solo con este mismo método. El interesado\nen practicar dicha actividad, deberá informar de previo a la Administración del\nParque.\n\nArtículo\n11.-Bañistas y natación: Se permitirá en todos los sectores y en los\nsitios donde las playas sean arenosas y no catalogadas como riesgosas, de conformidad\ncon la rotulación dispuesta por la Administración del Parque.\n\nArtículo\n12.-Buceo de \"scuba diving\" o buceo con tanques y \"snorkeling\" o esnorquel:\nLas actividades de buceo con equipo SCUBA y el snorkeling serán permitidas\najustándose a las siguientes disposiciones:\n\n \n\na) Los visitantes que realicen buceo deberán ir acompañados de un guía\ncertificado, quien a su vez será responsable directo del grupo y su manejo.\nPara tal efecto deberá reportarse con los funcionarios del Parque, para lo\ncual, mostrará su licencia de buceo con equipo scuba e informará su ubicación.\n\n \n\nb) Los sitios permitidos para bucear serán\ndemarcados por la Administración del Parque. Quedará a discreción de ésta, la\nrestricción del buceo en caso de que las condiciones oceanográficas,\nclimáticas, u otras pongan en peligro la vida de personas o provoquen daño a\nlas colonias coralinas u otra vida silvestre.\n\n \n\nc) Los buzos deberán desplazarse alrededor de los\ncorales evitando pasarles por encima. En ningún caso se podrá descansar, apoyar,\ntocar, arrastrar o pararse en el arrecife, así como extraer cualquier\norganismo. El guía del grupo será el responsable del cumplimiento de esta\ndisposición.\n\n \n\nd) Todo bote deberá mantenerse a cien metros de las\nbanderas de buceo y/o de los bañistas y kayaquistas.\n\n \n\ne) Queda prohibido el uso de patas de rana en el\nsector de Punta Uvita.\n\n \n\nf) Se autoriza un máximo de quince personas\nrealizando esta actividad, para lo cual deberá establecerse con los operadores\nde turismo los tiempos de permanencia en cada sitio.\n\n \n\ng) Queda totalmente prohibida la colecta o\nextracción de organismos marinos, así como tocar, cambiar de lugar o someter a\nalguna forma de estrés o muerte a los organismos marinos. Cualquier tipo de\nregulación adicional a la actividad se fundamentará en las regulaciones\nestablecidas por las organizaciones competentes para tal fin.\n\nArtículo 13.-Kayak: Se permitirá en los\nsectores Piñuela, Ballena y Uvita - Playa Hermosa, con excepción de aquellas\nzonas donde haya presencia de buzos o bañistas. Además deberán seguir las\ndisposiciones que para tal efecto establezca la Administración.\n\nArtículo\n14.-Observación de cetáceos: Se aplicará lo estipulado en el Decreto\nEjecutivo Nº 32495-MINAE-MOPT-MSP-MAG, Reglamento para la\nOperación de Actividades relacionadas con cetáceos en Costa Rica, publicado en La\nGaceta Nº 145 del 28 de julio del 2005.\n\nArtículo\n15.-Surf: Cualquier persona que practique el \"surf\" en las playas del\nParque deberá obedecer las disposiciones que para tal efecto desarrolle la\nAdministración. Además, estará obligado a mantener en todo momento atado el\n\"leash\". Los torneos de \"surf\" serán permitidos únicamente si se establece con\nla Administración del Parque, una anticipada y programada coordinación de\nactividades preparatorias, de ejecución y de control, para estos eventos en el\nárea seleccionada se prohibirá la presencia de bañistas.\n\nArtículo\n16.-Caminatas y senderos: Las caminatas se podrán realizar en las áreas\nseñaladas para tal fin, siguiendo las indicaciones que en los mismos se\nestablezcan.\n\nArtículo\n17.-Áreas de Acampar: Solamente se podrá acampar en las áreas\ndebidamente demarcadas para tal fin en los sectores Colonia, Uvita-Playa\nHermosa Ballena y Piñuela hasta tanto no estén debidamente concecionadas de\nparte de la Municipalidad de Osa las zonas de acampar en la zona restringida de\nla zona marítima terrestre.\n\nArtículo\n18.-Recorridos nocturnos: Los recorridos por los esteros y manglares del\nParque, serán autorizados por la Administración, únicamente si los visitantes\nvan en compañía de un guía local debidamente identificado y autorizado para\nejercer esta actividad.\n\nArtículo\n19.-Los riesgos personales derivados de las actividades que realicen los\nvisitantes al Parque Nacional, serán su responsabilidad y de quienes les vendan\nlos servicios.\n\nCAPÍTULO IV\n\nProhibiciones\n\n \n\nArtículo 20.-Con el propósito de ordenar las\nactividades propuestas y minimizar los impactos negativos que estas puedan\nprovocar se establecen las siguientes prohibiciones:\n\n \n\na) Lanzar o dejar cualquier tipo de basura, desecho, sustancia o\nmaterial dentro de los límites del Parque.\n\n \n\nb) El consumo de licor y otras drogas de acuerdo a\nla Ley sobre estupefacientes, sustancias psicotrópicas y drogas de uso no\nautorizado, Ley Nº 8204, publicada en La Gaceta Nº 8 del 11 de enero de\n2002.\n\n \n\nc) El uso de motocicletas, cuadraciclos, bicicletas\no cualquier otro tipo de vehículo y semovientes en las playas; a excepción de\nlos requeridos para fines de atención de emergencias, de la Administración o\nremolque de lanchas en los sectores mencionados en el artículo 8 del presente\nreglamento.\n\n \n\nd) El uso de motos acuáticas en el parque, con la\núnica excepción de que se utilicen en labores de socorrismo y rescate con\nprevia autorización de la administración del Parque Nacional.\n\n \n\ne) El ingreso o tránsito de vehículos y semovientes\nen los lugares que no sean los senderos y caminos debidamente demarcados para\ntal efecto.\n\n \n\nf) Las actividades de comercialización de bienes y\nservicios (venta de productos, alquiler de vehículos y semovientes, prestación\nde servicios y otros) dentro de los límites del Parque Nacional. Tales\nactividades deberán realizarse fuera del límite del Parque.\n\n \n\ng) El ingreso o tránsito de cualquier tipo de\nmascotas o animal domésticos exceptuando perros de compañía que porten su\ncorrea.\n\n \n\nh) La pesca comercial, industrial, deportiva o\nartesanal en las aguas marinas protegidas.\n\n \n\ni) El uso en las aguas marinas protegidas del Parque\nde redes de arrastre, agalleras, chinchorros, trasmallos, atarrayas, palangre,\nlíneas, explosivos y cualquier otro tipo de arte de pesca no permitido por este\nreglamento, la Ley de Pesca y Acuicultura, Nº 8436, y la normativa jurídica\nvigente.\n\n \n\nj) Hacer fogatas o quemas dentro del Parque.\n\n \n\nk) La excavación y recolección de huevos, neonatos y\ncualquier producto de tortuga marina, así como la extracción de conchas,\ncaracoles, piedras y cualquier otro producto animal, vegetal o mineral del\nParque.\n\n \n\nl) Realizar cualquier actividad que genere ruidos\nexcesivos o perturbe la tranquilidad de las especies silvestres y los\nvisitantes.\n\n \n\nm) Uso de equipos de audio y vídeo o cualquier otro\nartefacto a alto volumen.\n\n \n\nn) No se permite alimentar, capturar o someter a\nninguna forma de estrés o muerte a la vida silvestre.\n\nCAPÍTULO V\n\nGlosario\n\n \n\nArtículo 21.-Con el objetivo de facilitar el\nentendimiento de las disposiciones en el presente reglamento, a continuación se\ndefinen los principales términos:\n\n \n\na) Colecta: extracción temporal o permanente de productos o\nsubproductos de la flora o fauna.\n\n \n\nb) Organismos marinos: Conjunto de flora y\nfauna que vive en condiciones naturales, temporales o permanentes en el mar.\n\n \n\nc) Residentes permanentes: Son aquellos\ncostarricenses (por nacimiento o naturalización) o no que poseen cédula de\nresidencia permanente, que vivan en forma habitual en las comunidades vecinas.\n\n \n\nd) Comunidades vecinas: Comunidades ubicadas\nen los alrededores inmediatos al Parque Nacional.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 34163\n\n                        Public Use Regulation for Marino Ballena National Park\n\nFull Text record: B7DC8\nNo. 34163\n\nNo. 34163\n\n \n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\n \n\nIn exercise of the powers conferred upon us by\nsubsections 3) and 18) of articles 140 and 146 of the Political Constitution, the National\nParks Service Law, No. 6084 of August 24, 1977, the Organic\nEnvironment Law, No. 7554 of October 4, 1995, published in La\nGaceta No. 215 of November 13, 1995, the Wildlife\nConservation Law, No. 7317 of October 30, 1992, published in La Gaceta\nNo. 235 of December 7, 1992, and its regulation, Executive Decree No.\n32633-MINAE, published in La Gaceta No. 180 of September 20, 2005,\nthe Biodiversity Law, No. 7788 of April 30, 1998, published in La\nGaceta No. 101 of May 27, 1998, the Fisheries and Aquaculture Law, No.\n8436 of March 1, 2005, published in La Gaceta No. 78 of April 25,\n2005, and article 27 of the General Public Administration Law,\nNo. 6227, of May 2, 1978, and pursuant to the final agreement of Ordinary Session No.\n10 of May 15 and 16, 2007, of the National Council of Conservation Areas (CONAC).\n\n \n\nConsidering:\n\n \n\nI.—That it is the State's obligation to protect\nthe marine ecosystems of our country's Pacific coast, which exhibit\ngreat biological diversity along their entire coastline, especially in\nareas such as the Tómbolo of Uvita, Isla Ballena, Tres Hermanas rocks, and the coral\nformations found in their vicinity.\n\nII.—\nMarino Ballena National Park, within the Osa Conservation Area, was created by\nExecutive Decree No. 21294-MIRENEM, published in La Gaceta No. 136 of\nJuly 17, 1992, with the primary objective of its creation being to protect\nthe marine-coastal ecosystems such as mangroves, estuaries, sandy beaches,\ncliffs, and islets, which constitute sites of great scenic beauty and natural\nvalue, as well as a temporary refuge for cetaceans such as the humpback\nwhale and the bottlenose dolphin, among others.\n\nIII.—\nThat Marino Ballena National Park, due to its special characteristics and great\nbiological, geological, and hydrographic richness, is a place of great tourist\nand scientific attraction.\n\nIV.—\nThat this protected wild area currently lacks planning\ninstruments that establish the different use zones of the Park, and in\nwhich studies of impact or of tourist carrying capacity have been conducted.\n\nV.—\nThat due to the potential negative environmental impacts generated by tourist\nactivity in wild areas, it is necessary to regulate the use of the Park\nby the public, in order to ensure its conservation and minimal\ndeterioration of the marine-coastal ecosystems that the National Park protects.\n\nVI.—\nThat this protected area has historically maintained special social relevance\nin economic, recreational, and cultural practice terms. Therefore,\n\n \n\nDecree:\n\n \n\nThe Public Use Regulation for\n\nMarino Ballena National Park\n\n \n\nCHAPTER I\n\nGeneral Aspects\n\n \n\nArticle 1.—The objective of this regulation is to\nestablish the rules governing public use activities, which\nconsequently allows for supporting the protected area's management objectives,\nuntil the management plan (plan de manejo) can be duly formalized.\n\nAll\nactivities carried out within the Park must conform to\nthe provisions of the management plan (plan de manejo), this public use regulation, the\nestablished zoning (sectorización), the technical and administrative guidelines and instructions\nissued by the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), and in\ngeneral, the national and international legal framework in force\non environmental matters.\n\nArticle\n2.—This regulation shall be mandatory for all visitors,\nguides, tour operators, researchers, residents, public officials,\nvolunteers, and other persons entering the Park. Cooperation\nwith and observance of the following regulations will aid in the protection of\nnatural ecosystems and in the management of resources by Park\nofficials.\n\nFailure\nto comply with instructions, provisions, or safety\nregulations, whether written or verbal, shall empower Park\nofficials to expel the violator and, where appropriate, to file a complaint with\nthe relevant judicial or administrative authority, in accordance with the\ncurrent legal framework.\n\nArticle\n3.—Every visitor is required to report their entry at the official admission\nbooths located in the sectors of Playa Colonia, Playa Uvita,\nPlaya Piñuela, and Playa Ballena, and to pay the daily admission fee and\nother charges for the enjoyment of other services within the Park.\n\nThe\nvisitor must always keep the admission ticket during their\nstay in the area, as proof of payment in case it is required by\nany Park official.\n\nArticle\n4.—In order to promote knowledge about the biodiversity within\nthe Park and engagement with neighboring communities, the following shall be exempted from the\nPark entrance fee: national and resident foreign residents\nwho permanently reside in the communities of Ojochal, Piñuelas, Ballena, Bahía,\nUvita centro, Playa Hermosa, La Unión, San Josecito, duly identified\nand verified according to the mechanism established by the Park Administration.\n\nArticle\n5.—The visitor service schedule shall be from eight hours to\nsixteen hours, including Saturdays, Sundays, and holidays. The\nAdministration is empowered to establish the daily schedule and to allocate one day per week\nexclusively to maintenance and protection activities, during which it will remain\nclosed to the public.\n\nCHAPTER II\n\nZoning (Sectorización)\n\n \n\nArticle 6.—For the purposes of this\nregulation, the following zoning (sectorización) is established, with reference to\nthe cartographic sheets: Dominical and Coronado, scale 1:50,000 of the National\nGeographic Institute (IGN).\n\n \n\na. Sector A (Piñuela): begins at coordinates 497308 and\n338696, at the place called Punta Piñuela, and ends at coordinates\n496759 and 339995.\n\n \n\nb. Sector B (Ballena): begins at\ncoordinates 496759 and 339995 and ends at coordinates 494615 and 342123, at\nthe place known as Punta Chimenea.\n\n \n\nc. Sector C (Playa de Arco): begins at\ncoordinates 494615 and 342123 at the place called Punta Chimenea and ends at\ncoordinates 493489 and 343292, at the mouth of Quebrada Grande.\n\n \n\nd. Sector D (Colonia): begins at\ncoordinates 493489 and 343292 at the mouth of Quebrada Grande and ends at\ncoordinates 490594 and 344977, at the mouth of Quebrada Villegas.\n\n \n\ne. Sector E (Uvita - Playa Hermosa):\nbegins at coordinates 490594 and 344977 at the mouth of Quebrada\nVillegas and ends at coordinates 489539 and 346584, at the mouth of\nRío Uvita. This sector includes the tómbolo of Uvita and the mangrove ecosystem\nof Estero Negro.\n\n \n\nf. Sector F (marine area): includes the entire\nmarine area described in the Decree establishing the Park (Executive\nDecree No. 21294-MIRENEM).\n\nArticle 7.—Anchoring: This\nactivity is permitted only at the sites called Piñuelas, Playa Uvita, and Roca\nBallena, solely for diving and research purposes.\n\nBased\non the provisions of article 9 of the Fisheries and Aquaculture Law, No.\n8436, in the event of unforeseen circumstances or force majeure, the Park Administration\nreserves the right to limit anchoring at these sites and shall define the number and\nsize of the vessels.\n\nAnchoring\nshall be permitted strictly on sandy bottoms; any anchoring in\nareas with coral colonies shall be totally prohibited.\n\nArticle\n8.—Embarkation and disembarkation: This activity is restricted solely to\nthe sites Playa Uvita and Piñuelas and for the use of vessels belonging to tour\noperators and resident fishers from the communities indicated in article\n4 of this regulation. The Park Administration shall define the number and size\nof the vessels through a substantiated resolution.\n\nArticle\n9.—Research, audio recording, filming, and photography: All research\nor filming within the Park shall be regulated by the corresponding\nregulations of the Ministry of Environment and Energy (MINAE). For commercial underwater\nphotography or filming, or that of sea turtles on the beach at\nnight, a permit issued by the Directorate of the Osa\nConservation Area (ACOSA) of the National System of Conservation Areas (SINAC) of the\nMinistry of Environment and Energy (MINAE) must be obtained, and the provisions that the\nPark administration deems pertinent must be observed. When the research,\nfilming, and photography is marine, the vessel shall carry an orange\nflag in a visible location.\n\nArticle\n10.—Subsistence fishing: This activity is restricted to the sites\ncalled Colonia, Ballena, and Playa Uvita (except for the Tómbolo and the mangrove\ndue to the deterioration and fragility of their ecosystems and species). It shall be\npermitted only for those family groups that demonstrate a socioeconomic\ncondition that warrants this practice.\n\nThe\npractice of this activity is permitted only by using a handline (cuerda);\nthe obtaining of bait is authorized only by this same method. The person interested\nin practicing said activity must inform the Park Administration in advance (de previo).\n\nArticle\n11.—Bathers and swimming: Permitted in all sectors and\nat sites where beaches are sandy and not classified as hazardous, in accordance\nwith the signage established by the Park Administration.\n\nArticle\n12.—Scuba diving (buceo con tanques) and snorkeling (esnorquel):\nScuba diving (buceo con equipo SCUBA) and snorkeling activities shall be permitted,\ncomplying with the following provisions:\n\n \n\na) Visitors who go scuba diving must be accompanied by a certified\nguide, who shall in turn be directly responsible for the group and its management.\nFor this purpose, the guide must report to Park officials, presenting\ntheir scuba diving license (licencia de buceo con equipo scuba) and informing them of their location.\n\n \n\nb) The sites permitted for diving shall be\ndemarcated by the Park Administration. Restricting scuba diving shall be at its discretion\nin the event that oceanographic, climatic, or other conditions endanger\npeople's lives or cause damage to coral colonies or other wildlife.\n\n \n\nc) Divers (buzos) must move around the\ncorals, avoiding passing over them. Under no circumstances may one rest on, support oneself on,\ntouch, drag across, or stand on the reef, nor extract any\norganism. The group guide shall be responsible for compliance with this\nprovision.\n\n \n\nd) Every boat must stay at least one hundred meters from\ndive flags and/or from bathers and kayakers (kayaquistas).\n\n \n\ne) The use of fins (patas de rana) is prohibited in the\nsector of Punta Uvita.\n\n \n\nf) A maximum of fifteen people is authorized\nperforming this activity, for which purpose the length of stay (tiempos de permanencia) at each site must be\nestablished with the tour operators.\n\n \n\ng) The collection (colecta) or extraction of marine organisms is totally\nprohibited, as is touching, moving from place to place, or subjecting marine organisms to\nany form of stress or death. Any type of additional\nregulation of the activity shall be based on the regulations\nestablished by the organizations competent for that purpose.\n\nArticle 13.—Kayak: Permitted in the\nsectors Piñuela, Ballena, and Uvita - Playa Hermosa, with the exception of those\nareas where there is the presence of divers (buzos) or bathers. Additionally, the\nprovisions established by the Administration for this purpose must be followed.\n\nArticle\n14.—Cetacean watching: The provisions of Executive\nDecree No. 32495-MINAE-MOPT-MSP-MAG, Regulation for the\nOperation of Activities Related to Cetaceans in Costa Rica, published in La\nGaceta No. 145 of July 28, 2005, shall apply.\n\nArticle\n15.—Surfing (Surf): Any person practicing \"surf\" on the Park's\nbeaches must obey the provisions developed by the\nAdministration for this purpose. Additionally, they are required to keep the\n\"leash\" attached at all times. Surfing tournaments shall be permitted only if established\nwith the Park Administration, through advance and planned coordination of\npreparatory, execution, and control activities; for these events, the presence of bathers shall be prohibited in\nthe selected area.\n\nArticle\n16.—Hikes and trails: Hikes (caminatas) may be undertaken in the areas\ndesignated for this purpose, following the indications established therein.\n\nArticle\n17.—Camping Areas: Camping shall only be permitted in the areas\nduly demarcated for this purpose in the Colonia, Uvita-Playa Hermosa,\nBallena, and Piñuela sectors, until such time as the camping zones in the restricted zone of the\nmarine-terrestrial zone (zona marítima terrestre) are duly granted in concession (concecionadas) by\nthe Municipality of Osa.\n\nArticle\n18.—Nocturnal tours: Tours through the Park's estuaries and mangroves\nshall be authorized by the Administration only if visitors\nare accompanied by a local guide duly identified and authorized to\ncarry out this activity.\n\nArticle\n19.—The personal risks arising from the activities undertaken by\nvisitors to the National Park shall be their responsibility and that of those who sell them\nthe services.\n\nCHAPTER IV\n\nProhibitions\n\n \n\nArticle 20.—For the purpose of regulating the\nproposed activities and minimizing the negative impacts they may\ncause, the following prohibitions are established:\n\n \n\na) Throwing or leaving any type of garbage, waste, substance, or\nmaterial within the limits of the Park.\n\n \n\nb) The consumption of liquor and other drugs, in accordance with\nthe Law on Narcotics, Psychotropic Substances, and Drugs of Unauthorized\nUse, Law No. 8204, published in La Gaceta No. 8 of January 11,\n2002.\n\n \n\nc) The use of motorcycles, ATVs (cuadraciclos), bicycles,\nor any other type of vehicle and livestock (semovientes) on the beaches; except for\nthose required for emergency response purposes, by the Administration, or for\ntowing boats in the sectors mentioned in article 8 of this\nregulation.\n\n \n\nd) The use of personal watercraft (motos acuáticas) in the park, with the\nsole exception of their use in rescue and lifesaving operations with\nprior authorization from the National Park administration.\n\n \n\ne) The entry or transit of vehicles and livestock (semovientes)\nin places other than the trails and roads duly demarcated for\nthis purpose.\n\n \n\nf) Commercialization activities of goods and\nservices (sale of products, rental of vehicles and livestock (semovientes), provision\nof services, and others) within the limits of the National Park. Such\nactivities must take place outside the Park's boundary.\n\n \n\ng) The entry or transit of any type of\npet or domestic animal, with the exception of companion dogs (perros de compañía) wearing their\nleash (correa).\n\n \n\nh) Commercial, industrial, sport, or\nartisanal fishing in the protected marine waters.\n\n \n\ni) The use in the Park's protected marine waters\nof trawl nets, gill nets, beach seines (chinchorros), trammel nets (trasmallos), cast nets (atarrayas), longlines (palangre),\nhandlines (líneas), explosives, and any other type of fishing gear (arte de pesca) not permitted by this\nregulation, the Fisheries and Aquaculture Law, No. 8436, and the current legal\nframework.\n\n \n\nj) Building campfires (fogatas) or conducting burns within the Park.\n\n \n\nk) The excavation and collection of eggs, hatchlings, and\nany product of sea turtles, as well as the extraction of shells,\nsnails, stones, and any other animal, plant, or mineral product from the\nPark.\n\n \n\nl) Performing any activity that generates excessive\nnoise or disturbs the tranquility of wild species and\nvisitors.\n\n \n\nm) Use of audio and video equipment or any other\nartifact at high volume.\n\n \n\nn) Feeding, capturing, or subjecting\nwildlife to any form of stress or death is not permitted.\n\nCHAPTER V\n\nGlossary\n\n \n\nArticle 21.—With the aim of facilitating the\nunderstanding of the provisions in this regulation, the\nfollowing key terms are defined:\n\n \n\na) Collection (Colecta): temporary or permanent extraction of products or\nbyproducts of flora or fauna.\n\n \n\nb) Marine organisms: The assemblage of flora and\nfauna that lives in natural, temporary, or permanent conditions in the sea.\n\n \n\nc) Permanent residents: Those\nCosta Ricans (by birth or naturalization) or non-Costa Ricans who hold a\npermanent residency card (cédula de residencia permanente) and who customarily reside in the neighboring communities.\n\n \n\nd) Neighboring communities: Communities located\nin the immediate surroundings of the National Park. The following are considered\nneighboring communities: Ojochal, Piñuelas, Ballena, Bahía, Uvita centro, Playa\nHermosa, La Unión, and San Josecito.\n\n \n\ne) Tour operators: Natural or legal\npersons responsible for organizing, promoting, and marketing the various\ntourist attractions of the area.\n\n \n\nf) ASP Administration: Central management unit\nof the protected area, closely linked with MINAE -\nACOSA, whose representation in the zone falls upon the administrator of\nMarino Ballena National Park.\n\n \n\ng) Kayak: Water sport performed in\ncanoes propelled by paddles (remos).\n\n \n\nh) Guide: That person, duly\naccredited by the Costa Rican Tourism Institute (ICT), who provides services of\norientation, information, and assistance to tourists.\n\n \n\ni) Scuba diving (Scuba diving o buceo con tanques):\ndives (inmersiones) with underwater breathing equipment.\n\n \n\nj) Snorkeling (Snorkeling o esnorquel): dives (inmersiones)\nsolely with eye and respiratory protection equipment. Does not have underwater\nbreathing equipment; \"breath-hold diving\" (buceo a pulmón).\n\nk) Subsistence fishing: That which is\ncarried out to meet the food needs of persons with scarce\neconomic resources, duly verified.\n\nArticle 22.—Effective upon its publication.\n\nTransition Provision I.—With the aim of not hindering the\nservices provided by the Park, the existing facilities and other infrastructure\nshall be maintained until otherwise provided by the Management Plan (Plan de Manejo)\nof the protected wild area and until there is budgeted funding to make the\nproposed changes.\n\n \n\nIssued at the Presidency of the Republic, in San José,\nat thirteen hours fifty minutes on the tenth day of August of the year two thousand\nseven."
