desarrollo sostenible social,\neconómico, industrial, empresariales, agrario, turístico y de asentamientos\nhumanos que proporcionan los sistemas de acueductos y alcantarillados.\n\n3º-Que de conformidad con los artículos 1º, 2º, 3º, 4º, 5º, 11, 18,\n19, 21, 22 y 23 de la Ley Constitutiva del A y A, artículo 264 de la Ley\nGeneral de Salud Pública, artículos 17, 32, 33, 148 y siguientes de la Ley de\nAguas N° 276 del 24 de agosto de 1942, Ley General de Agua Potable y Reglamento\nde la Asociaciones Administradoras de los Sistemas de Acueductos y\nAlcantarillados Comunales N° 39529-S-MINAE, publicado en La Gaceta N°\n150 del 5 de agosto de 2005, se establece que A y A es el ente Rector en todo\nlo relativo a los Sistemas de Acueductos y Alcantarillados en todo el\nterritorio Nacional, y se encuentra facultado en delegar la administración de\ntales sistemas en organizaciones debidamente constituidas al efecto.\n\n \n\n \n\nConsiderando:\n\n \n\n \n\nI.-Que la participación de la comunidad o sociedad\ncivil, constituye uno de los instrumentos eficaces para lograr la consecución\ndel desarrollo sostenible en Costa Rica, por lo que A y A, desde 1976 ha venido\ndelegando en las comunidades la administración de aquellos sistemas en las que\nlas ventajas comparativas de inmediatez, eficacia y eficiencia; costo y\nbeneficio a las poblaciones, resulte más adecuado asignar en las comunidades su\nadministración.\n\nII.-Que la comunidad de Cedral de Cajón de Pérez Zeledón, con aporte\nde la comunidad, de A y A y del Estado, se ha construido un sistema de\nacueductos comunales, para el abastecimiento de una población de habitantes.\n\nIII.-Que en Asamblea general de vecinos celebrada el día cuatro de\nabril del dos mil uno, al ser las quince horas y treinta minutos, dispusieron\nconstituir la organización y solicitar al A y A, que delegue la administración\nde los sistemas en dicha organización.\n\nIV.-Que por las características del sistema, es procedente delegar la\nadministración en la organización comunal constituida al efecto, denominada\nAsociación Administradora del Acueducto Rural de Cajón de Pérez Zeledón, cédula\njurídica tres- cero cero dos-trescientos siete mil cuatrocientos treinta y uno,\nque se encuentra debidamente inscrita en el Registro de Asociaciones del\nRegistro Nacional bajo el tomo número cuatrocientos noventa y tres, asiento\nnúmero catorce mil setecientos veintinueve.\n\nV.-Que para los efectos de lo dispuesto en el Reglamento, la Dirección\nde la Región Brunca mediante el memorando N° DIRB-2008-0055, del día dieciséis\nde enero de 2008, así como la Dirección Jurídica en el memorando N° DJ-\n2008-008 del día veintiocho de febrero de 2008, recomiendan a la Gerencia\nproceder a la Delegación de la Administración del sistema en la respectiva\norganización.\n\nVI.-Que mediante el dictamen legal N° DJ-SC-008-2008 del día\nveintiocho del mes de febrero de 2008, la Asesoría Legal de Sistemas Comunales\nde la Dirección Jurídica, emitió criterio, estableciendo que cumplidos los\ntrámites técnicos, es jurídicamente procedente delegar la administración de\ndicho sistema. Comuníquese y\npublíquese.\n\n \n\nAcuerdo firme.\n\n \n\nAcuerdo Nº 2008-127, adoptado por la junta directiva\ndel Instituto Costarricense de Acueductos y Alcantarillados en el inciso f),\ndel artículo 6º, de la sesión ordinaria N° 2008-016, celebrada el 11/03/2008.", "body_en_text": "throughout the entire text\n\n-\n\nFull Text of Regulation 127\n\nDelegation Agreement of the Administrative Association of the Aqueduct and Sanitary Sewer System of Cedral de Cajón de Pérez Zeledón\n\nFull Text of Act: B8F70\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS\n\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS\n\nBOARD OF DIRECTORS\n\nNo. 2008-127\n\nSUBJECT: Delegation Agreement of the Administrative Association of the Aqueduct and Sanitary Sewer System of Cedral de Cajón de Pérez Zeledón.\n\nThis Board of Directors is aware of the request for delegation of the administration of the Aqueduct and Sewer System.\n\nWhereas:\n\n1.- That in accordance with Articles 50 and 129 of the Political Constitution, the State must seek the greatest well-being for its citizens, planning production towards an ecologically balanced and healthy environment.\n\n2.- That in accordance with Articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to look after local interests, and the Constitutional Chamber, in reiterated pronouncements, has stated that the inviolability of life is guaranteed when potable water and environmental sanitation are supplied in the terms of Article 297 of the General Health Law; therefore, it is imperative that the Municipality cooperate, especially regarding zoning regulations and urban development, with the administrative organization of the communal systems, as an instrument of sustainable social, economic, industrial, business, agricultural, touristic, and human settlement development that the aqueduct and sewer systems provide.\n\n3.- That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 24, 1942, the General Potable Water Law, and the Regulation of the Administrative Associations of Communal Aqueduct and Sewer Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Body in everything related to Aqueduct and Sewer Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for this purpose.\n\nConsidering:\n\nI.- That the participation of the community or civil society constitutes one of the effective instruments to achieve sustainable development in Costa Rica, for which reason AyA, since 1976, has been delegating to communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\nII.- That the community of Cedral de Cajón de Pérez Zeledón, with contributions from the community, AyA, and the State, has built a communal aqueduct system for the supply of a population of inhabitants.\n\nIII.- That at a General Assembly of neighbors held on the fourth day of April, two thousand one, at fifteen thirty hours, they decided to constitute the organization and request AyA to delegate the administration of the systems to said organization.\n\nIV.- That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named Asociación Administradora del Acueducto Rural de Cajón de Pérez Zeledón, legal identification number three-zero zero two-three hundred seven thousand four hundred thirty-one, which is duly registered in the Associations Registry of the National Registry under volume number four hundred ninety-three, entry number fourteen thousand seven hundred twenty-nine.\n\nV.- That for the purposes of the provisions of the Regulation, the Directorate of the Brunca Region, through memorandum No. DIRB-2008-0055, dated January sixteenth, two thousand eight, as well as the Legal Directorate in memorandum No. DJ-2008-008 dated February twenty-eighth, two thousand eight, recommend that Management proceed with the Delegation of the Administration of the system to the respective organization.\n\nVI.- That through legal opinion No. DJ-SC-008-2008 dated the twenty-eighth day of February, two thousand eight, the Legal Advisory Office for Communal Systems of the Legal Directorate issued its criterion, establishing that, the technical procedures having been completed, it is legally appropriate to delegate the administration of said system.
