costo y\nbeneficio a las poblaciones, resulte más adecuado asignar en las comunidades su\nadministración.\n\nII.-Que la comunidad de Dos Brazos de Río Tigre de Puerto Jiménez,\nGolfito, Puntarenas, con aporte de la comunidad, de A y A y del Estado, se ha\nconstruido un sistema de acueductos comunales, para el abastecimiento de una\npoblación de habitantes.\n\nIII.-Que en Asamblea general de vecinos celebrada el día veinticinco\nde noviembre del año dos mil seis, al ser las quince horas, dispusieron\nconstituir la organización y solicitar al A y A, que delegue la administración\nde los sistemas en dicha organización.\n\nIV.-Que por las características del sistema, es procedente delegar la\nadministración en la organización comunal constituida al efecto, denominada\nAsociación Administradora del Acueducto Rural de Dos Brazos de Río Tigre de\nPuerto Jiménez, Golfito, Puntarenas cédula jurídica tres- cero cero\ndos-cuatrocientos ochenta y ocho mil seiscientos cincuenta y nueve, que se\nencuentra debidamente inscrita en el Registro de Asociaciones del Registro\nNacional bajo el tomo número, quinientos setenta, asiento número, setenta y\ncinco mil setecientos treinta y uno.\n\nV.-Que para los efectos de lo dispuesto en el Reglamento, la Dirección\nde la Región Huetar Norte mediante el memorando N° DIR-2008-0055, del día\ndieciséis de enero de 2008, así como la Dirección Jurídica en el memorando N°\nDJ- 2006-008 del día veintiocho de febrero de 2008, recomiendan a la Gerencia\nproceder a la Delegación de la Administración del sistema en la respectiva\norganización.\n\nVI.-Que mediante el dictamen legal N° DJ-SC-006-2008 del día\nveintiocho del mes de  febrero de 2008, la  Asesoría Legal de\nSistemas Comunales de la Dirección Jurídica, emitió criterio, estableciendo que\ncumplidos los trámites técnicos, es jurídicamente procedente delegar la administración\nde dicho sistema. Therefore, it is imperative that the Municipality cooperate, especially regarding zoning and urban development regulations, with the administrative organization of the community systems, as an instrument for the sustainable social, economic, industrial, business, agricultural, tourism, and human settlement development that Aqueduct and Sewerage systems provide.\n\n3º-That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 24, 1942, the General Potable Water Law, and the Regulation of the Administrative Associations of Community Aqueduct and Sewerage Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Entity in everything related to Aqueduct and Sewerage Systems in all the National territory and is empowered to delegate the administration of such systems to organizations duly constituted for that purpose.\n\n \n\nConsidering:\n\n \n\nI.-That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica. Therefore, AyA, since 1976, has been delegating to the communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency, and the cost-benefit to the populations, make it more suitable to assign their administration to the communities.\n\nII.-That the community of Dos Brazos de Río Tigre, Puerto Jiménez, Golfito, Puntarenas, with contributions from the community, AyA, and the State, has built a community aqueduct system to supply a population of inhabitants.\n\nIII.-That in a general Assembly of residents held on the twenty-fifth day of November of the year two thousand six, at fifteen hours, they decided to constitute the organization and request that AyA delegate the administration of the systems to said organization.\n\nIV.-That due to the characteristics of the system, it is appropriate to delegate the administration to the community organization constituted for this purpose, named Asociación Administradora del Acueducto Rural de Dos Brazos de Río Tigre de Puerto Jiménez, Golfito, Puntarenas, legal ID number three-zero zero two-four hundred eighty-eight thousand six hundred fifty-nine, which is duly registered in the Registry of Associations of the National Registry under volume number five hundred seventy, entry number seventy-five thousand seven hundred thirty-one.\n\nV.-That for the purposes of the provisions of the Regulation, the Directorate of the Huetar Norte Region, through memorandum No. DIR-2008-0055 of the sixteenth day of January 2008, as well as the Legal Directorate in memorandum No. DJ-2008-008 of the twenty-eighth day of February 2008, recommend that the Management proceed with the Delegation of the Administration of the system to the respective organization.\n\nVI.-That through legal opinion No. DJ-SC-006-2008 of the twenty-eighth day of the month of February 2008, the Legal Advisory Office for Community Systems of the Legal Directorate issued its criterion, establishing that, the technical procedures having been completed, it is legally appropriate to delegate the administration of said system.
