desarrollo\nurbanístico, con la organización administradora de los sistemas comunales, como\ninstrumento de desarrollo sostenible social, económico, industrial,\nempresariales, agrario, turístico y de asentamientos humanos que proporcionan\nlos sistemas de acueductos y alcantarillados.\n\n3º-Que\nde conformidad con los artículos 1, 2, 3, 4, 5, 11, 18, 19, 21, 22 y 23 de la\nLey Constitutiva del A y A, artículo 264 de la Ley General de Salud Pública,\nartículos 17, 32, 33, 148 y siguientes de la Ley de Aguas N° 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de la Asociaciones\nAdministradoras de los Sistemas de Acueductos y Alcantarillados Comunales N°\n39529-S-MINAE, publicado en La Gaceta N° 150 del 5 de agosto de 2005, se\nestablece que A y A es el ente Rector en todo lo relativo a los Sistemas de\nAcueductos y Alcantarillados en todo el territorio Nacional, y se encuentra\nfacultado para delegar la administración de tales sistemas en organizaciones\ndebidamente constituidas al efecto.\n\nConsiderando:\n\nI.-Que la participación de la comunidad o sociedad civil, constituye uno\nde los instrumentos eficaces para lograr la consecución del desarrollo\nsostenible en Costa Rica, por lo que A y A, desde 1976 ha venido delegando en\nlas comunidades la administración de aquellos sistemas en las que las ventajas\ncomparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las\npoblaciones, resulte más adecuado asignar en las comunidades su administración.\n\nII-Que\nla comunidad Nueva Esperanza de Río Chiquito de Bagaces, con aporte de la\ncomunidad, de A y A y del Estado, se ha construido un sistema de acueductos\ncomunales, para el abastecimiento de una población de habitantes.\n\nIII-Que\nen Asamblea General de vecinos, dispusieron constituir la organización y\nsolicitar al A y A, que delegue la administración de los sistemas en dicha\norganización.\n\nIV-Que\npor las características del sistema, es procedente delegar la administración en\nla organización comunal constituida al efecto, denominada Asociación\nAdministradora del Acueducto y Alcantarillado de Río Chiquito de Bagaces,\ncédula jurídica tres-cero cero dos-trescientos quince mil seiscientos setenta y\ncuatro, que se encuentra debidamente inscrita en el Registro de Asociaciones\ndel Registro Nacional bajo el tomo número cuatrocientos noventa y cuatro,\nasiento número once mil noventa y ocho.\n\nV.-Que\npara los efectos de lo dispuesto en el Reglamento, la Dirección de la Región\nChorotega mediante el memorando N° RCH-091-2008 del día 19 de febrero de 2008,\nasí como la Dirección Jurídica en el memorando N° DJ-914-2008 del día 12 de\nmarzo de 2008, recomiendan a la Gerencia proceder a la Delegación de la\nAdministración del sistema en la respectiva organización.\n\nVI.-Que\nmediante el dictamen legal N° DJ-SC-014-2008 del día doce del mes de marzo de\n2008, la Asesoría Legal de Sistemas Comunales de la Dirección Jurídica, emitió\ncriterio, estableciendo que cumplidos los trámites técnicos, es jurídicamente\nprocedente delegar la administración de dicho sistema. Comuníquese y publíquese.\n\nAcuerdo firme.\n\nAcuerdo número 2008-158, adoptado por la Junta Directiva del Instituto\nCostarricense de Acueductos y Alcantarillados en el inciso e), del artículo 6,\nde la sesión ordinaria N° 2008-019, celebrada el 01/04/2008.", "body_en_text": "in the entirety of the text\n\n -\n\n Full Text of Standard 158\n\n Delegation Agreement of the Administrative Association of the Aqueduct and\nSewer System of Río Chiquito de Bagaces, Guanacaste\n\nFull Text of record: B950C\nCOSTA RICAN INSTITUTE OF AQUEDUCTS\n\nCOSTA RICAN INSTITUTE OF AQUEDUCTS\n\nAND\nSEWERS\n\nN° 2008-158\n\nSUBJECT: Delegation Agreement of the Administrative Association of the Aqueduct and Sewer System of Río Chiquito de Bagaces, Guanacaste.\n\nBOARD OF DIRECTORS\n\nThis Board of Directors hears the Request for Delegation of the Administration of the Aqueduct and Sewer System.\n\nWhereas:\n\n1º-That in accordance with Articles 50 and 129 of the Political Constitution, the State must ensure the greatest well-being of all inhabitants, through a healthy and ecologically balanced environment.\n\n2º-That in accordance with Articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to look after local interests, and the Constitutional Chamber in repeated pronouncements has stated that the inviolability of life is guaranteed when potable water and environmental sanitation are supplied in the terms of Article 297 of the General Health Law, for which reason it is imperative that the Municipality cooperate, especially regarding zoning regulations and urban development, with the administrative organization of the communal systems, as an instrument of sustainable social, economic, industrial, business, agricultural, tourism, and human settlement development that the aqueduct and sewer systems provide.\n\n3º-That in accordance with Articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, Article 264 of the General Public Health Law, Articles 17, 32, 33, 148 and following of the Water Law N° 276 of August 24, 1942, the General Potable Water Law, and the Regulation of the Administrative Associations of Communal Aqueduct and Sewer Systems N° 39529-S-MINAE, published in La Gaceta N° 150 of August 5, 2005, it is established that AyA is the Governing entity in all matters relating to Aqueduct and Sewer Systems throughout the National territory, and is empowered to delegate the administration of such systems to organizations duly constituted for this purpose.\n\nConsidering:\n\nI.-That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica, for which reason AyA, since 1976, has been delegating to the communities the administration of those systems in which the comparative advantages of proximity, effectiveness, and efficiency; cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\nII-That the community of Nueva Esperanza de Río Chiquito de Bagaces, with contributions from the community, from AyA, and from the State, has built a communal aqueduct system to supply a population of inhabitants.\n\nIII-That in a General Assembly of neighbors, they decided to constitute the organization and request that AyA delegate the administration of the systems to said organization.\n\nIV-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, called the Administrative Association of the Aqueduct and Sewer System of Río Chiquito de Bagaces, legal identification number three-zero zero two-three hundred fifteen thousand six hundred seventy-four, which is duly registered in the Associations Registry of the National Registry under volume number four hundred ninety-four, entry number eleven thousand ninety-eight.\n\nV.-That for the purposes of the provisions of the Regulation, the Directorate of the Chorotega Region, through memorandum N° RCH-091-2008 of February 19, 2008, as well as the Legal Directorate in memorandum N° DJ-914-2008 of March 12, 2008, recommend to the Management to proceed with the Delegation of the Administration of the system to the respective organization.\n\nVI.-That through legal opinion N° DJ-SC-014-2008 of March twelfth, 2008, the Legal Advisory for Communal Systems of the Legal Directorate issued its criterion, establishing that having completed the technical procedures, it is legally appropriate to delegate the administration of said system.
