mil\nocho.\n\n \n\nConsiderando:\n\n \n\n1°-Que de conformidad con la Ley N° 7384, Ley de Creación del INCOPESCA, y la Ley N° 8436, Ley de\nPesca y Acuicultura, es atribución y competencia del INCOPESCA proteger y conservar los recursos\nhidrobiológicos, en aras de garantizar a las generaciones venideras, los recursos vivos del mar.\n\n2°-Que está considerado técnicamente, que una de las formas de conservación de los recursos\nhidrobiológicos y garantizar una explotación sostenible de los recursos, es el establecimiento de\nperíodos y áreas de vedas, lo cual resulta conveniente definir y aplicar en el presente año.\n\n3°-Que luego de\nanalizar los criterios técnicos y recomendaciones emanadas por\nla Comisión de Veda, así como el criterio de\nla Dirección General\nTécnica del INCOPESCA, se considera acoger los citados criterios y\nrecomendaciones. Por tanto,\n\n \n\nLA JUNTA DIRECTIVA DE INCOPESCA ACUERDA:\n\n \n\nArtículo 1°-Se decreta\nperíodo de veda para el Golfo de Nicoya\ncorrespondiente al año 2008, según los términos que a continuación se detallan:\n\n \n\na)         De\nla pesca por parte de\nla Flota Semi-Industrial\ncamaronera de arrastre:\n\n \n\nSe prohibe\na la Flota Semi-Industrial camaronera de arrastre\nfaenar durante los meses de mayo, junio y octubre de cada año, en el área\ncomprendida entre una línea recta imaginaria que va desde Punta Torres,\nconocida como Peñón (84°43'52\" Longitud Oeste, 09°53'31\" Latitud Norte) hasta\nel Faro de las Islas Negritos Afuera (84°49'35\" Longitud Oeste, 09°49'14\"\nLatitud Norte) y de aquí hasta Punta Cuchillo (84°52'23\" Longitud Oeste,\n09°49'39\" Latitud Norte), de esa línea imaginaria, aguas adentro hasta la\ndesembocadura del Río Tempisque.\n\n \n\nb)         La Flota Semi-Industrial camaronera de arrastre no podrá realizar su actividad en\nninguna época del año en la zona comprendida entre una línea recta imaginaria que va desde el Muelle\nde Cruceros de Puntarenas (84°49'51\" Longitud Oeste, 9°58'26\" Latitud Norte) hasta el Faro de las\nIslas Negritos Afuera (84°49'35\" Longitud Oeste,  09°49' 14\" Latitud Norte) y de aquí hasta Punta\nCuchillo (84°52'23\" Longitud Oeste, 09°49'39\" Latitud Norte), de esta línea imaginaria, aguas\nadentro hasta la desembocadura del río Tempisque.\n\n \n\nc)         De la pesca por parte\nde la Flota Artesanal\nen Pequeña Escala.\n\n \n\nc-1)   \nPesca con redes agalleras\no trasmallos:\n\n \n\nDurante los meses de mayo, junio y octubre de\ncada año, se prohíbe la utilización de redes agalleras\no trasmallos de cualquier luz de malla, en el área comprendida entre una línea\nrecta imaginaria que va desde Muelle Cruceros de Puntarenas (84°49'51\" Longitud\nOeste, 9°58'26\" Latitud Norte) hasta Punta Gigante (84°54'50\" Longitud,\n09°54'15\" Latitud), de esa línea imaginaria, aguas adentro hasta la\ndesembocadura del Río Tempisque.\n\n \n\nc-2)    Pesca con línea taiwanesa:\n\n \n\nDurante el período comprendido entre los\nmeses de mayo, junio y octubre de cada año, se prohíbe la utilización de la línea\ntaiwanesa, en el área comprendida entre una línea\nrecta imaginaria que va desde Punta Torres, conocida como Peñón (84°43'52\"\nLongitud Oeste, 09°53'31\" Latitud Norte) hasta el Faro de las Islas Negritos\nAfuera (84°49'35\" Longitud Oeste, 09°49'14\" Latitud Norte) y de aquí hasta\nPunta Cuchillo (84°52'23\" Longitud Oeste, 09°49'39\" Latitud Norte) de esa línea\nimaginaria, aguas adentro hasta la desembocadura del  Río Tempisque.\n\n \n\nc-3)    Pesca con cuerdas de\nmano:\n\nDurante el período comprendido entre mayo, junio y octubre de cada año, todo aquel permisionario con\nLicencia de Pesca Comercial para la parte interna del Golfo de Nicoya, podrá utilizar a cualquier\nhora del día las cuerdas de mano con anzuelo N° 6, en el área comprendida entre una línea recta\nimaginaria que va desde Punta Torres, conocida como Peñón (84°43' 52\" Longitud Oeste, 09°53 '31\"\nLatitud Norte) hasta el Faro de las Islas Negritos Afuera (84°49'35\" Longitud Oeste, 09°49'14\"\nLatitud Norte) y de aquí hasta Punta Cuchillo (84°52'23\" Longitud Oeste, 09°49'39\" Latitud Norte) de\nesa línea imaginaria, aguas adentro hasta la desembocadura del Río Tempisque y podrán capturar su\npropia carnada utilizando chinchoso de barrer playa y/o red bolichera. Quienes opten por esta\nalternativa deben comunicarlo al Departamento de Protección y Registro.\n\n \n\nc-4) Pesca con línea plañera en la zona aguas adentro del Golfo de Nicoya:\n\n \n\nDurante el período\ncomprendido entre los meses de mayo, junio y octubre de cada año, todo aquel\npermisionario con Licencia de Pesca Comercial para la parte interna del Golfo\nde Nicoya, podrá utilizar a cualquier hora del día\nuna línea plañera por embarcación con un máximo de 500 metros de largo y\ntambién un máximo de 300 anzuelos N° 6, en el área\ncomprendida entre una línea recta imaginaria que va desde Punta Torres,\nconocida como Peñón (84°43'52\" Longitud Oeste, 09°53'31\" Latitud Norte) hasta\nel Faro de las Islas Negritos Afuera (84°49'35\" Longitud Oeste, 09°49'14\"\nLatitud Norte) y de aquí hasta Punta Cuchillo (84°52'23\" Longitud Oeste,\n09°49'39\" Latitud Norte), de esa línea imaginaria, aguas adentro hasta la\ndesembocadura del Río Tempisque. Quienes opten por esta alternativa deben comunicarlo al Departamento de Protección y\nRegistro.\n\n \n\nd) De la pesca de sardina por parte\nde la Flota Semi-lndustrial\nsardinera con red de cerco:\n\n \n\nDurante el periodo\ncomprendido entre los meses de mayo, junio y octubre de cada año, se permitirá\nla pesca de la sardina con red de cerco, durante los días lunes, martes y\nmiércoles de cada semana en la zona interna comprendida, entre una línea recta\nimaginaria que va desde Punta Torres, conocida como Peñón (84°43'52\" Longitud\nOeste, 09°53'31\" Latitud Norte) hasta el Faro de las Islas Negritos Afuera\n(84°49'35\" Longitud Oeste, 09°49'14\" Latitud Norte) y de aquí, en línea recta\nimaginaria que va hasta el Muelle de Cruceros en\nla Ciudad de Puntarenas\n(84°49'51\" Longitud Oeste, 09°58'26\" Latitud Norte).\n\nAquellos permisionarios\nque se dediquen a este tipo de pesca facilitarán sus embarcaciones para que\nfuncionarios del INCOPESCA, puedan permanecer y obtener a bordo de éstas, la\ninformación de sus capturas.\n\nAsimismo estarán\nobligados a informar el lugar, hora y fecha de cada uno de sus desembarques\nante el Departamento de Protección y Registro, para que funcionarios del\nDepartamento de Investigación y Desarrollo o de esa misma Dependencia\nfiscalicen in situ dichos desembarques. Si el permisionario no cumpliera lo\nestipulado en este artículo, se dará por terminada la autorización acordada.\nDurante los 4 días restantes de la semana de esta veda, está flota podrá pescar\naguas afuera de la línea recta imaginaria comprendida desde Punta Torres,\nconocida como Peñón (84°43'52\" Longitud Oeste, 09°53'31\" Latitud Norte) hasta\nel Faro de las Islas Negritos Afuera (84°49'35\" Longitud Oeste, 09°49' 14\" Latitud Norte), y de aquí\nhasta Punta Cuchillo.\n\n \n\n   e) De la pesca de la jaiva con nasas:\n\n \n\nDurante el periodo comprendido\nentre, los meses de mayo, junio y octubre de cada año, se permitirá la pesca\ndel cangrejo jaiva con nasas, únicamente a todo aquel\npermisionario con Licencia de Pesca Comercial vigente para este tipo de pesca y\nen la (s) zona (s) autorizada (s).\n\n \n\nf)  Del otorgamiento del\nsubsidio a los pescadores durante el presente período de veda. Para efecto de\notorgar este beneficio a los permisionarios y sus respectivos peones, el\nINCOPESCA organizará un programa de capacitación que deberá ser cumplido por\nlos pescadores como requisito para optar al subsidio.\n\n \n\n(Así\nreformado el inciso anterior por acuerdo AJDIP/167 del 25 de abril de 2008)\n\n \n\ng) De la presentación del Listado de\npescadores afectos al subsidio.\n\n \n\nLa Dirección General Técnica deberá realizar las acciones\npertinentes a fin de que en un plazo no mayor a 30 días naturales contados a\npartir de la publicación de esta regulación, presente ante las instancias administrativas\ny competentes del IMAS, el listado preliminar de pescadores sujeto a las\nrestricciones y condiciones de veda para el Golfo de Nicoya,\na fin de que se les otorgue el subsidio económico correspondiente, mismo que\notorgará el IMAS según lo disponga este ente.\n\nCon sustento en lo establecido en\nla Ley 8436, únicamente gozarán\nde ese beneficio aquellos pescadores debidamente legalizados que se vean\nafectados en el ejercicio de su trabajo por la veda. Aquellos pescadores que\nrealicen actividades de pesca de acuerdo a las condiciones permitidas y\nautorizadas a través de esta regulación, serán beneficiarías del subsidio\neconómico pertinente por parte del IMAS. INCOPESCA, se limitará a otorgar al\nIMAS, únicamente el listado de los pescadores debidamente inscritos en sus\nregistros y que laboren en el Golfo de Nicoya. El\notorgamiento de estos listados no crea en ningún aspecto ningún tipo de\nobligación por parte del INCOPESCA, así como tampoco genera ningún tipo de\nrelación obrero-patronal, entre INCOPESCA y los pescadores que califiquen para\nrecibir la ayuda económica que brinda el IMAS.\n\nArtículo 2°-De las sanciones: Además de la\naplicación de aquellas sanciones establecidas en\nla Ley de Pesca y Acuicultura,\nLey N° 8436, a\ntodos aquellos permisionarios que durante la presente veda las autoridades\ncompetentes los encuentren infringiendo las disposiciones establecidas en este\nacuerdo, el FNCOPESCA a través de cada una de sus oficinas competentes\nprocederá a suspender como medida precautoria a partir de que se cometa\nla infracción y hasta que se concluya el proceso administrativo sancionatorio,\nel otorgamiento del combustible a precio preferencial y solicitará al Instituto\nMixto de Ayuda Social (IMAS) que tanto los permisionarios como sus ayudantes\nsean excluidos automáticamente de los listados remitidos como potenciales beneficiarios\nde la ayuda económica que esa Institución otorga durante las vedas establecidas\nen el Golfo de Nicoya.\n\nArtículo 3°-Para dar\nfiel cumplimiento a lo dispuesto en este acuerdo, referente a las artes de\npesca permitidas en la pesquería artesanal, se autoriza únicamente mantener\nabordo las cuerdas de mano y la línea plañera autorizada en el permiso de pesca\nvigente.\n\nAsí mismo\nla Flota Artesanal\nsustituirá por 3 ¼ el tamaño de la malla a partir de agosto del 2008; el\nINCOPESCA, realizará una campaña nacional para eliminar las artes de pesca\nilegales y gestionará los fondos requeridos a través de ONGs., para financiar\nla campaña y el cambio de dicha malla en la red agallera utilizada para la\ncaptura del camarón dentro del golfo de Nicoya.\n\nArtículo 4°-Vigencia. Therefore,\n\n \n\nTHE BOARD OF DIRECTORS OF INCOPESCA AGREES:\n\n \n\nArticle 1°-A\nclosed season is hereby established for the Gulf of Nicoya\ncorresponding to the year 2008, according to the terms detailed below:\n\n \n\na) Of\nfishing by\nthe Semi-Industrial Shrimp Trawl Fleet:\n\n \n\nThe Semi-Industrial Shrimp Trawl Fleet is prohibited\nfrom operating during the months of May, June, and October of each year, in the area\nbetween an imaginary straight line running from Punta Torres,\nknown as Peñón (84°43'52\" West Longitude, 09°53'31\" North Latitude) to\nthe Lighthouse of the Negritos Afuera Islands (84°49'35\" West Longitude, 09°49'14\"\nNorth Latitude) and from there to Punta Cuchillo (84°52'23\" West Longitude,\n09°49'39\" North Latitude), from that imaginary line, inward waters to the\nmouth of the Tempisque River.\n\n \n\nb) The Semi-Industrial Shrimp Trawl Fleet may not carry out its activity at\nany time of the year in the zone comprised between an imaginary straight line running from the\nCruise Ship Dock of Puntarenas (84°49'51\" West Longitude, 9°58'26\" North Latitude) to the Lighthouse of the\nNegritos Afuera Islands (84°49'35\" West Longitude, 09°49' 14\" North Latitude) and from there to Punta\nCuchillo (84°52'23\" West Longitude, 09°49'39\" North Latitude), from this imaginary line, inward waters\nto the mouth of the Tempisque River.\n\n \n\nc) Of fishing by\nthe Small-Scale Artisanal Fleet.\n\n \n\nc-1) Fishing with gillnets\nor trammel nets:\n\n \n\nDuring the months of May, June, and October of\neach year, the use of gillnets\nor trammel nets of any mesh size is prohibited in the area comprised between an imaginary straight\nline running from the Cruise Ship Dock of Puntarenas (84°49'51\" West Longitude,\n9°58'26\" North Latitude) to Punta Gigante (84°54'50\" Longitude,\n09°54'15\" Latitude), from that imaginary line, inward waters to the\nmouth of the Tempisque River.\n\n \n\nc-2) Fishing with Taiwanese line:\n\n \n\nDuring the period between the\nmonths of May, June, and October of each year, the use of the Taiwanese\nline is prohibited in the area comprised between an imaginary straight\nline running from Punta Torres, known as Peñón (84°43'52\"\nWest Longitude, 09°53'31\" North Latitude) to the Lighthouse of the Negritos\nAfuera Islands (84°49'35\" West Longitude, 09°49'14\" North Latitude) and from there to\nPunta Cuchillo (84°52'23\" West Longitude, 09°49'39\" North Latitude), from that imaginary\nline, inward waters to the mouth of the Tempisque River.\n\n \n\nc-3) Fishing with handlines:\n\nDuring the period between May, June, and October of each year, any permit holder with\na Commercial Fishing License for the inner part of the Gulf of Nicoya may use, at any\ntime of day, handlines with a No. 6 hook, in the area comprised between an imaginary straight\nline running from Punta Torres, known as Peñón (84°43' 52\" West Longitude, 09°53 '31\"\nNorth Latitude) to the Lighthouse of the Negritos Afuera Islands (84°49'35\" West Longitude, 09°49'14\"\nNorth Latitude) and from there to Punta Cuchillo (84°52'23\" West Longitude, 09°49'39\" North Latitude), from\nthat imaginary line, inward waters to the mouth of the Tempisque River, and may catch their\nown bait using a beach seine (chinchoso de barrer playa) and/or a cast net (red bolichera). Those who opt for this\nalternative must notify the Department of Protection and Registration.\n\n \n\nc-4) Fishing with longline (línea plañera) in the inward waters zone of the Gulf of Nicoya:\n\n \n\nDuring the period\nbetween the months of May, June, and October of each year, any\npermit holder with a Commercial Fishing License for the inner part of the Gulf\nof Nicoya may use, at any time of day,\none longline (línea plañera) per vessel with a maximum length of 500 meters and\nalso a maximum of 300 No. 6 hooks, in the area\ncomprised between an imaginary straight line running from Punta Torres,\nknown as Peñón (84°43'52\" West Longitude, 09°53'31\" North Latitude) to\nthe Lighthouse of the Negritos Afuera Islands (84°49'35\" West Longitude, 09°49'14\"\nNorth Latitude) and from there to Punta Cuchillo (84°52'23\" West Longitude,\n09°49'39\" North Latitude), from that imaginary line, inward waters to the\nmouth of the Tempisque River. Those who opt for this alternative must\nnotify the Department of Protection and Registration.\n\n \n\nc-5) Fishing with longline (línea plañera) in the outward waters zone of the Gulf of Nicoya:\n\n \n\nDuring the period between the months of May, June, and October of each year, any\npermit holder with a Commercial Fishing License for the inner part of the Gulf of Nicoya may\nuse one longline (línea plañera) per vessel with a maximum length of 500 meters and a maximum of 300\nNo. 6 hooks, in the area comprised between an imaginary straight line running from Punta Torres,\nknown as Peñón (84°43'52\" West Longitude, 09°53'31\" North Latitude) to the Lighthouse of the Negritos\nAfuera Islands (84°49'35\" West Longitude, 09°49'14\" North Latitude) and from there to Punta Cuchillo\n(84°52'23\" West Longitude, 09°49'39\" North Latitude), from that line outward waters of the Gulf of\nNicoya. Those who opt for this alternative must notify the Department of Protection and\nRegistration.\n\n \n\nd) Of sardine fishing by\nthe Semi-Industrial Sardine Fleet with purse seine:\n\n \n\nDuring the period\nbetween the months of May, June, and October of each year, sardine fishing\nwith purse seine will be permitted during the days Monday, Tuesday, and\nWednesday of each week in the inner zone comprised between an imaginary straight\nline running from Punta Torres, known as Peñón (84°43'52\" West Longitude,\n09°53'31\" North Latitude) to the Lighthouse of the Negritos Afuera Islands\n(84°49'35\" West Longitude, 09°49'14\" North Latitude) and from there, in an imaginary straight\nline running to the Cruise Ship Dock in\nthe City of Puntarenas\n(84°49'51\" West Longitude, 09°58'26\" North Latitude).\n\nThose permit holders\nwho engage in this type of fishing will provide their vessels so that\nofficials of INCOPESCA can remain on board and obtain from them\ninformation on their catches.\n\nLikewise, they will be\nobligated to report the place, time, and date of each of their landings\nto the Department of Protection and Registration, so that officials of the\nDepartment of Research and Development or of that same Unit\nmay supervise said landings in situ. If the permit holder fails to comply\nwith what is stipulated in this article, the agreed authorization will be terminated.\nDuring the 4 remaining days of the week of this closed season, this fleet may fish\nin the outward waters of the imaginary straight line from Punta Torres,\nknown as Peñón (84°43'52\" West Longitude, 09°53'31\" North Latitude) to\nthe Lighthouse of the Negritos Afuera Islands (84°49'35\" West Longitude, 09°49' 14\" North Latitude), and from there\nto Punta Cuchillo.\n\n \n\n e) Of fishing for swimming crab (jaiva) with traps:\n\n \n\nDuring the period between\nthe months of May, June, and October of each year, fishing for the swimming crab (jaiva) with traps will be permitted, only to any\npermit holder with a current Commercial Fishing License for this type of fishing and\nin the authorized zone(s).\n\n \n\nf) Of the granting of the\nsubsidy to fishers during the present closed season. For the purpose of\ngranting this benefit to permit holders and their respective crew members,\nINCOPESCA will organize a training program that must be completed by\nthe fishers as a requirement to opt for the subsidy.\n\n \n\n(Thus\nreformed the previous sub-paragraph by agreement AJDIP/167 of April 25, 2008)\n\n \n\ng) Of the presentation of the List of\nfishers eligible for the subsidy.\n\n \n\nThe General Technical Directorate must take the pertinent\nactions so that, within a period not exceeding 30 calendar days counted\nfrom the publication of this regulation, it presents to the administrative\nand competent bodies of IMAS the preliminary list of fishers subject to\nthe closed season restrictions and conditions for the Gulf of Nicoya,\nso that they are granted the corresponding economic subsidy, which\nIMAS will grant as determined by that entity.\n\nBased on what is established in\nLaw 8436, only those\nduly legalized fishers whose work is affected by the closed season will\nenjoy that benefit. Those fishers who\ncarry out fishing activities according to the conditions permitted and\nauthorized through this regulation will be beneficiaries of the\npertinent economic subsidy from IMAS. INCOPESCA will limit itself to providing\nIMAS only the list of fishers duly registered in its\nrecords and who work in the Gulf of Nicoya. The\nprovision of these lists does not in any way create any\ntype of obligation on the part of INCOPESCA, nor does it generate any\ntype of employer-employee relationship between INCOPESCA and the fishers who qualify to\nreceive the economic aid provided by IMAS.\n\nArticle 2°-Of sanctions: In addition to the\napplication of those sanctions established in\nthe Fisheries and Aquaculture Law,\nLaw No. 8436, to\nall those permit holders that the competent authorities find\nviolating the provisions established in this\nagreement during the present closed season, INCOPESCA, through each of its competent offices,\nwill proceed to suspend, as a precautionary measure, from the moment the\ninfringement is committed until the administrative sanctioning process is concluded,\nthe granting of fuel at a preferential price and will request the Instituto\nMixto de Ayuda Social (IMAS) that both the permit holders and their assistants\nbe automatically excluded from the lists sent as potential beneficiaries\nof the economic aid that that Institution grants during the closed seasons established\nin the Gulf of Nicoya.\n\nArticle 3°-To ensure\nfaithful compliance with the provisions of this agreement, regarding the fishing gear\npermitted in the artisanal fishery, it is authorized to only keep\non board the handlines and the longline (línea plañera) authorized in the current fishing permit.\n\nLikewise,\nthe Artisanal Fleet\nwill replace the mesh size with 3 ¼ starting August 2008;\nINCOPESCA will carry out a national campaign to eliminate illegal fishing gear\nand will manage the required funds through NGOs to finance\nthe campaign and the change of said mesh in the gillnet used for\ncatching shrimp within the Gulf of Nicoya.\n\nArticle 4°-Effective date.
