sistemas en organizaciones debidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\nI.-Que la\nparticipación de la comunidad o sociedad civil, constituye uno de los\ninstrumentos eficaces para lograr la consecución del desarrollo sostenible en\nCosta Rica, por lo que A y A, desde 1976 ha venido delegando en las comunidades\nla administración de aquellos sistemas en las que las ventajas comparativas de\ninmediatez, eficacia y eficiencia; costo y beneficio a las poblaciones, resulte\nmás adecuado asignar en las comunidades su administración.\n\nII.-Que la comunidad de Florida de Siquirres,\ncon aporte de la comunidad, de A y A y del Estado, se ha construido un sistema\nde acueductos comunales, para el abastecimiento de una población de habitantes.\n\nIII.-Que en Asamblea General de vecinos,\ndispusieron constituir la organización y solicitar al A y A, que delegue la\nadministración de los sistemas en dicha organización.\n\nIV.-Que por las características del sistema,\nes procedente delegar la administración en la organización comunal constituida\nal efecto, denominada Asociación Administradora del Acueducto Rural de Florida\nde Siquirres, cédula jurídica tres-cero cero dos-trescientos diecinueve mil\nsetecientos cincuenta, que se encuentra debidamente inscrita en el Registro de\nAsociaciones del Registro Nacional bajo el tomo número cuatrocientos ochenta y\nocho asiento número diecinueve mil ochocientos setenta y ocho.\n\nV.-Que para los efectos de lo dispuesto en el\nReglamento, la Dirección de la Región Huetar Atlántica mediante el memorando\nNº  HU-2008-091 del día 21 de enero de 2008, así como la Dirección\nJurídica en el memorando Nº  DJ-1042-2008 del día 27 de marzo de 2008,\nrecomiendan a la Gerencia proceder a la Delegación de la Administración del\nsistema en la respectiva organización.\n\nVI.-Que mediante el dictamen legal Nº \nDJ-SC-016-2008 del día veintisiete del mes de marzo de 2008, la Asesoría Legal\nde Sistemas Comunales de la Dirección Jurídica, emitió criterio, estableciendo\nque cumplidos los trámites técnicos, es jurídicamente procedente delegar la\nadministración de dicho sistema. cost and benefit to the populations, make it\nmore appropriate to assign their administration to the communities.\n\nII.-That the community of Florida de Siquirres,\nwith contributions from the community, from AyA, and from the State, has built a communal\naqueduct system, for the supply of a population of inhabitants.\n\nIII.-That in a General Assembly of residents,\nthey decided to constitute the organization and request that AyA delegate the\nadministration of the systems to said organization.\n\nIV.-That due to the characteristics of the system,\nit is appropriate to delegate the administration to the communal organization constituted\nfor this purpose, named Asociación Administradora del Acueducto Rural de Florida\nde Siquirres, legal identification number tres-cero cero dos-trescientos diecinueve mil\nsetecientos cincuenta, which is duly registered in the Registry of\nAssociations of the National Registry under volume number cuatrocientos ochenta y\nocho, entry number diecinueve mil ochocientos setenta y ocho.\n\nV.-That for the purposes of the provisions of the\nRegulation, the Directorate of the Huetar Atlántica Region, through memorandum\nNº HU-2008-091 of January 21, 2008, as well as the Legal\nDirectorate in memorandum Nº DJ-1042-2008 of March 27, 2008,\nrecommend that Management proceed with the Delegation of the Administration of the\nsystem to the respective organization.\n\nVI.-That through legal opinion Nº \nDJ-SC-016-2008 of the twenty-seventh day of March 2008, the Legal Advisory Office\nfor Communal Systems of the Legal Directorate issued its opinion, establishing\nthat, the technical procedures having been completed, it is legally appropriate to delegate the\nadministration of said system.
