costo y beneficio a las poblaciones, resulte\nmás adecuado asignar en las comunidades su administración.\n\nII.-Que la comunidad de Matapalo Distrito\nJuntas Cantón Abangares Provincia Guanacaste, con aporte de la comunidad, de A\ny A y del Estado, se ha construido un sistema de acueductos comunales, para el\nabastecimiento de una población de habitantes.\n\nIII.-Que en Asamblea General de vecinos,\ndispusieron constituir la organización y solicitar al A y A, que delegue la\nadministración de los sistemas en dicha organización.\n\nIV.-Que por las características del sistema,\nes procedente delegar la administración en la organización comunal constituida\nal efecto, denominada Asociación Administradora del Acueducto y Alcantarillado\nSanitario de Matapalo distrito Juntas cantón Abangares Provincia Guanacaste,\ncédula jurídica tres-cero cero dos-trescientos noventa y dos mil setecientos\nsetenta y uno que se encuentra debidamente inscrita en el Registro de\nAsociaciones del Registro Nacional bajo el tomo número quinientos cuarenta y\ntres, asiento número catorce mil quinientos cincuenta y tres.\n\nV.-Que para los efectos de lo dispuesto en el\nReglamento, la Dirección de la Región Chorotega mediante el memorando Nº\nRCH-149-2008 del día 7 de marzo de 2008, así como la Dirección Jurídica en el\nmemorando Nº DJ-1042-2008 del día 27 de marzo de 2008, recomiendan a la Gerencia\nproceder a la Delegación de la Administración del sistema en la respectiva\norganización.\n\nVI.-Que mediante el dictamen legal Nº\nDJ-SC-018-2008 del día veintisiete del mes de marzo de 2008, la Asesoría Legal\nde Sistemas Comunales de la Dirección Jurídica, emitió criterio, estableciendo\nque cumplidos los trámites técnicos, es jurídicamente procedente delegar la\nadministración de dicho sistema. cost and benefit to the populations, make it\nmore appropriate to assign their administration to the communities.\n\nII.-That the community of Matapalo, District of\nJuntas, Canton of Abangares, Province of Guanacaste, with contributions from the community, from AyA, and from the State, has built a communal aqueduct system for\nsupplying a population of inhabitants.\n\nIII.-That in a General Assembly of residents,\nthey decided to constitute the organization and request AyA to delegate the\nadministration of the systems to said organization.\n\nIV.-That due to the characteristics of the system,\nit is appropriate to delegate the administration to the communal organization constituted\nfor that purpose, named the Administrative Association of the Aqueduct and Sanitary\nSewer of Matapalo, district of Juntas, canton of Abangares, Province of Guanacaste,\nlegal identification number three-zero zero two-three hundred ninety-two thousand seven hundred\nseventy-one, which is duly registered in the Registry\nof Associations of the National Registry under volume number five hundred forty-three, entry number fourteen thousand five hundred fifty-three.\n\nV.-That for the purposes of the provisions of the\nRegulation, the Directorate of the Chorotega Region, via memorandum No.\nRCH-149-2008 of March 7, 2008, as well as the Legal Directorate, in\nmemorandum No. DJ-1042-2008 of March 27, 2008, recommend to the General Management\nto proceed with the Delegation of the Administration of the system to the respective\norganization.\n\nVI.-That through legal opinion No.\nDJ-SC-018-2008 of the twenty-seventh day of the month of March 2008, the Legal Advisory Office\nfor Communal Systems of the Legal Directorate issued a criterion, establishing\nthat, the technical procedures having been completed, it is legally appropriate to delegate\nthe administration of said system. Regulation of Administrative Associations of\nCommunal Aqueduct and Sewer Systems No. 32529-S-MINAE, published\nin La Gaceta\n150 of August 5, 2005, and Regulation on the Provision of Services to\nClients, published in the Official Gazette\nLa Gaceta No. 159 of August 20, 1997.\n\n \n\nAGREES:\n\n \n\n1º-To grant the\ndelegation of the administration of the community's aqueduct and sanitary sewer\nsystems to the Administrative Association of the Aqueduct and\nSanitary Sewer of Matapalo, district of Juntas, canton of Abangares, province\nof Guanacaste, legal identification number three-zero zero two-three hundred ninety-two thousand\nseven hundred seventy-one, register it in our internal records.\n\n2º-To authorize the Administration to\nsign the Delegation Agreement with the legal representative of the Association, in\nwhich, in addition to compliance with current legislation, the specific\nobligations and considerations assumed by the parties will be specified and it will repeal\nany agreements signed previously.\n\n3º-To order that the Directorate of Communal\nSystems and the Regional Directorate corresponding to the geographic\nlocation of the systems carry out all advisory, control,\nand training activities in technical, environmental, financial, legal, organizational, and communal matters\nas established by the Laws and Regulations.\n\n4º-Once the Agreement is approved, Notify all\nusers of the system and residents of the respective community, by means of\npublication in the Official Gazette La Gaceta, so that they may exercise all their rights,\nduties, and obligations of the system in accordance with the Laws and Regulations.\nCommunicate and publish.\n\n \n\nFirm agreement.\n\n \n\nAgreement number\n2008-173, adopted by the Board of Directors of the Instituto Costarricense de\nAcueductos y Alcantarillados in subsection f), of Article 6, of ordinary\nsession No. 2008-020, held on 08/04/2008." }
