  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 199\n\n                        Convenio de Delegación de Acueducto y Alcantarillado de Matapalo, Puerto\nJiménez, Golfito, Puntarenas\n\nTexto Completo acta: BA640\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nY ALCANTARILLADOS\n\n \n\nNº 2008-199\n\n \n\nASUNTO:         Convenio de Delegación de Acueducto y\nAlcantarillado de Matapalo, Puerto Jiménez, Golfito, Puntarenas.\n\n \n\n            Conoce esta Junta\nDirectiva de la Solicitud\nde Delegación de la\n Administración del Sistema de Acueductos y Alcantarillados.\n\n \n\nResultando:\n\n \n\n1º-Que de conformidad con el artículo 50, 129 de\nla Constitución Política,\nel Estado debe procurar el mayor bienestar de todos los habitantes, mediante un\nambiente sano y ecológicamente equilibrado.\n\n2º-Que de\nconformidad con los artículos 11, 21, 129 y 169 de\nla Constitución Política,\ncorresponde a las Municipalidades velar por los intereses locales, y\nla Sala Constitucional\nen reiterados pronunciamientos se ha manifestado en el sentido de que se\ngarantiza la inviolabilidad de la\nvida cuando se suministra agua potable y saneamiento ambiental en los términos\ndel artículo 297 de la Ley\n General de Salud, por lo que resulta imperativo que\nla Municipalidad\ncoadyuve en especial en lo relativo a los reglamentos de zonificación,\ndesarrollo urbanístico, con la organización administradora de los sistemas\ncomunales, como instrumento de desarrollo sostenible social, económico,\nindustrial, empresariales, agrario, turístico y de asentamientos humanos que\nproporcionan los sistemas de acueductos y alcantarillados.\n\n3º-Que de conformidad con los artículos 1º, 2º, 3º, 4º, 5º, 11, 18, 19,\n21, 22 y 23 de la Ley\n Constitutiva del AyA, artículo 264 de\nla Ley General de Salud\nPública, artículos 17, 32, 33, 148 y siguientes de\nla Ley de Aguas N° 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de\nla Asociaciones\n Administradoras de los Sistemas de Acueductos y\nAlcantarillados Comunales N° 39529-S-MINAE, publicado en\nLa Gaceta N° 150 del\n5 de agosto del 2005, se establece que AyA es el ente Rector en todo lo\nrelativo a los Sistemas de Acueductos y Alcantarillados en todo el territorio\nNacional, y se encuentra facultado para delegar la administración de tales\nsistemas en organizaciones debidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\n1º-Que la participación de la comunidad o sociedad civil, constituye uno\nde los instrumentos eficaces para lograr la consecución del desarrollo\nsostenible en Costa Rica, por lo que AyA, desde 1976 ha venido delegando en\nlas comunidades la administración de aquellos sistemas en las que las ventajas\ncomparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las\npoblaciones, resulte más adecuado asignar en las comunidades su administración.\n\n2º-Que la comunidad Matapalo de Puerto Jiménez Golfito, con aporte de la\ncomunidad, de AyA y del\nEstado, se ha construido un sistema de acueductos comunales, para el\nabastecimiento de una población de habitantes.\n\n3º-Que en Asamblea General de vecinos, dispusieron constituir la\norganización y solicitar al AyA, que delegue la administración de los sistemas\nen dicha organización.\n\n4º-Que por las características del sistema, es procedente delegar la\nadministración en la organización comunal constituida al efecto, denominada Asociación\nPro Acueducto de Matapalo de Puerto Jiménez Golfito, cédula jurídica tres -\ncero cero dos - cuatrocientos sesenta mil seiscientos noventa y uno, que se\nencuentra debidamente inscrita en el Registro de Asociaciones del Registro\nNacional bajo el tomo número quinientos sesenta y siete, asiento número setenta\ny cinco mil trescientos ochenta y seis. \n\n5º-Que para los efectos de lo dispuesto en el Reglamento,\nla Dirección de\nla Región Brunca,\nmediante el memorando N° RB-DOM-2008-019 del día 15 de enero del 2008, así como\nla Dirección\n Jurídica en el memorando N° DJ-1078-2008 del día 1º de abril\ndel 2008, recomiendan a la\n Gerencia proceder a\nla Delegación de\nla Administración del\nsistema en la respectiva organización.\n\n6º-Que mediante el dictamen legal N° DJ-SC-024-2008 del día primero del\nmes de abril del 2008, la\n Asesoría Legal de Sistemas Comunales de\nla Dirección Jurídica,\nemitió criterio, estableciendo que cumplidos los trámites técnicos, es\njurídicamente procedente delegar la administración de dicho sistema. Por\ntanto:\n\n \n\nDe la Ley\nde Caminos Públicos N° 5060 del 22 de agosto de 1972, Reglamento del\nLaboratorio Nacional de Aguas de AyA Decreto N° 26066-S, publicado en\nLa Gaceta N° 109 del\n09 de junio de 1997; Reglamento para\nla Calidad de Agua Decreto Ejecutivo N° 32327 del 10\nde febrero del 2005; Reglamento de Uso y Vertido del\nla Aguas Residuales\nDecreto Ejecutivo N° 26042-S-MINAE del 19 de junio de 1997, Reglamento de\nAprobación y Operación de Sistemas de Tratamiento de Aguas Residuales Decreto\nEjecutivo N° 31545 del 9 de octubre del 2003 y Reglamento de Lodos de Tanques\nSépticos Decreto Ejecutivo N° 21279-S del 15 de mayo de 1992. Reglamento\nSectorial para la\n Regulación de los Servicios de Acueducto y Alcantarillado\nSanitario N° 30413-MP-MINAE-S-MEIC del 25 de\nmarzo del\n2002.   "body_en_text": "throughout the entire text\n\n                    -\n\n                        Full Text of Rule 199\n\n                        Delegation Agreement for the Aqueduct and Sewer System of Matapalo, Puerto\nJiménez, Golfito, Puntarenas\n\nFull Text of record: BA640\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nINSTITUTO COSTARRICENSE DE ACUEDUCTOS\n\nY ALCANTARILLADOS\n\n \n\nNo. 2008-199\n\n \n\nSUBJECT:         Delegation Agreement for the Aqueduct and Sewer System of Matapalo, Puerto Jiménez, Golfito, Puntarenas.\n\n \n\n            This Board of Directors is reviewing the Request for Delegation of the Administration of the Aqueduct and Sewer System.\n\n \n\nWhereas:\n\n \n\n1º-That in accordance with articles 50 and 129 of the Political Constitution, the State must ensure the greatest well-being of all inhabitants, through a healthy and ecologically balanced environment.\n\n2º-That in accordance with articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to look after local interests, and the Constitutional Chamber has repeatedly ruled that the inviolability of life is guaranteed when potable water and environmental sanitation are supplied, in accordance with the terms of article 297 of the General Health Law, making it imperative that the Municipality cooperate, especially regarding zoning and urban development regulations, with the administrative organization of the community systems, as an instrument for the sustainable social, economic, industrial, business, agricultural, tourism, and human settlement development that the aqueduct and sewer systems provide.\n\n3º-That in accordance with articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, article 264 of the General Public Health Law, articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 24, 1942, the General Law of Potable Water, and the Regulation of the Administrative Associations of Community Aqueduct and Sewer Systems No. 39529-S-MINAE, published in La Gaceta No. 150 of August 5, 2005, it is established that AyA is the Governing Body for everything related to Aqueduct and Sewer Systems throughout the National territory, and is empowered to delegate the administration of such systems to organizations duly constituted for this purpose.\n\n \n\nConsidering:\n\n \n\n1º-That community or civil society participation constitutes one of the effective instruments for achieving sustainable development in Costa Rica, which is why AyA, since 1976, has been delegating to communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\n2º-That the community of Matapalo de Puerto Jiménez Golfito, with contributions from the community, AyA, and the State, has built a community aqueduct system to supply a population of inhabitants.\n\n3º-That in a General Assembly of neighbors, they decided to form the organization and request that AyA delegate the administration of the systems to said organization.\n\n4º-That due to the characteristics of the system, it is appropriate to delegate the administration to the community organization formed for this purpose, named Asociación Pro Acueducto de Matapalo de Puerto Jiménez Golfito, legal identification number three - zero zero two - four hundred sixty thousand six hundred ninety-one, which is duly registered in the Registry of Associations of the National Registry under volume number five hundred sixty-seven, entry number seventy-five thousand three hundred eighty-six.\n\n5º-That for the purposes of the provisions of the Regulation, the Directorate of the Brunca Region, through memorandum No. RB-DOM-2008-019 of January 15, 2008, as well as the Legal Directorate in memorandum No. DJ-1078-2008 of April 1, 2008, recommend that the Management proceed with the Delegation of the Administration of the system to the respective organization.\n\n6º-That through legal opinion No. DJ-SC-024-2008 of April first, 2008, the Legal Advisory Office for Community Systems of the Legal Directorate issued its criterion, establishing that the technical procedures having been completed, it is legally appropriate to delegate the administration of said system. Therefore:\n\n \n\nBased on the Public Roads Law No. 5060 of August 22, 1972, the Regulation of the National Water Laboratory of AyA Decree No. 26066-S, published in La Gaceta No. 109 of June 9, 1997; the Regulation for Water Quality Executive Decree No. 32327 of February 10, 2005; the Regulation for the Use and Discharge of Wastewater Executive Decree No. 26042-S-MINAE of June 19, 1997, the Regulation for the Approval and Operation of Wastewater Treatment Systems Executive Decree No. 31545 of October 9, 2003, and the Regulation for Sludge from Septic Tanks Executive Decree No. 21279-S of May 15, 1992. The Sectoral Regulation for the Regulation of Aqueduct and Sanitary Sewer Services No. 30413-MP-MINAE-S-MEIC of March 25, 2002. The Regulation of Administrative Associations of Community Aqueduct and Sewer Systems No. 32529-SMINAE, published in La Gaceta 150 of August 5, 2005, and the Regulation for Service Provision to Clients, published in the Official Gazette La Gaceta No. 159 of August 20, 1997.\n\n \n\nHEREBY AGREES:\n\n \n\n1º-To grant the delegation of the administration of the community's aqueduct and sanitary sewer systems to the Asociación Pro Acueducto de Matapalo de Puerto Jiménez Golfito, legal identification number three - zero zero two - four hundred sixty thousand six hundred ninety-one; let it be registered in our internal records.\n\n2º-To authorize the Administration to sign the Delegation Agreement with the representative of the Association, in which, in addition to compliance with current legislation, specific obligations and reciprocal considerations assumed by the parties will be specified and it will repeal previously signed agreements.\n\n3º-To direct that the Directorate of Community Systems and the corresponding Regional Directorate according to the geographic location of the systems, carry out all advisory, control, and technical, environmental training activities. Based on the provisions of articles 11, 21, 18, 50, 129, 169, and 188 of the Political Constitution; articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, article 264 of the General Public Health Law No. 5395 of October 30, 1973, articles 17, 32, 33, 148 and following of the Water Law No. 276 of August 27, 1942, the General Law of Potable Water No. 1634 of September 18, 1953, articles 1, 4, 11, 16, 113.12, 114 of the General Law of Public Administration, the Environment Law No. 7554 of October 4, 1995, articles 4 and 33 of the Forest Law No. 7575 of February 13, 1996, and its amendments, the Wildlife Conservation Law No. 7317 of October 30, 1992, article 7, regarding financial, legal, organizational, and community matters as established by laws and Regulations.\n\n4º-Once the Agreement is approved, Notify all users of the system and neighbors of the respective community, through publication in the Official Gazette La Gaceta, so that they may exercise all their rights, duties, and obligations regarding the system in accordance with laws and Regulations.\nLet it be communicated and published.\n\n \n\nFinal agreement.\n\nAgreement number 2008-199, adopted by the Board of Directors of the Instituto Costarricense de Acueductos y Alcantarillados in subsection g), of article 6, of the ordinary session No. 2008-024, held on 22/04/2008."
