que\nla Municipalidad coadyuve en especial en lo relativo\na los reglamentos de zonificación, desarrollo urbanístico, con la organización\nadministradora de los sistemas comunales, como instrumento de desarrollo\nsostenible social, económico, industrial, empresariales, agrario, turístico y de\nasentamientos humanos que proporcionan los sistemas de acueductos y\nalcantarillados.\n\n3º-Que de conformidad con los artículos 1º, 2º, 3º, 4º, 5º, 11, 18, 19,\n21, 22 y 23 de la Ley\n Constitutiva del AyA, artículo 264 de\nla Ley General de Salud\nPública, artículos 17, 32, 33, 148 y siguientes de\nla Ley de Aguas Nº 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de\nla Asociaciones\n Administradoras de los Sistemas de Acueductos y\nAlcantarillados Comunales Nº 39529-S-MINAE, publicado en\nLa Gaceta Nº 150 del\n5 de agosto del 2005, se establece que AyA es el ente Rector en todo lo\nrelativo a los Sistemas de Acueductos y Alcantarillados en todo el territorio\nNacional, y se encuentra facultado para delegar la administración de tales\nsistemas en organizaciones debidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\n1º-Que la participación de la comunidad o sociedad civil, constituye uno\nde los instrumentos eficaces para lograr la consecución del desarrollo\nsostenible en Costa Rica, por lo que AyA, desde 1976 ha venido delegando en\nlas comunidades la administración de aquellos sistemas en las que las ventajas\ncomparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las\npoblaciones, resulte más adecuado asignar en las comunidades su administración.\n\n2º-Que la comunidad del Sector Norte de\nPedregoso de Pérez Zeledón, con aporte de la comunidad, de AyA y del Estado, se ha\nconstruido un sistema de acueductos comunales, para el abastecimiento de una\npoblación de habitantes.\n\n3º-Que en Asamblea General de vecinos, dispusieron constituir la\norganización y solicitar al AyA, que delegue la administración de los sistemas\nen dicha organización.\n\n4º-Que por las características del sistema, es procedente delegar la\nadministración en la organización comunal constituida al efecto, denominada\nAsociación Pro Construcción y Mantenimiento de Cañería del Sector Norte de\nPedregoso de Pérez Zeledón, cédula jurídica tres- cero cero dos - ciento\nsesenta y cinco mil ochocientos cincuenta y siete, que se encuentra debidamente\ninscrita en el Registro de Asociaciones del Registro Nacional bajo el tomo\nnúmero cuatrocientos once, asiento número mil trescientos sesenta y cinco.\n\n5º-Que para los efectos de lo dispuesto en el Reglamento,\nla Dirección de\nla Región Brunca,\nmediante el memorando Nº RB-DOM-2008-042del día 06 de febrero del 2008, así\ncomo la Dirección\n Jurídica en el memorando Nº DJ-1078-2008 del día 1º de abril\ndel 2008, recomiendan a la\n Gerencia proceder a\nla Delegación de\nla Administración del\nsistema en la respectiva organización.\n\n6º-Que mediante el dictamen legal Nº DJ-SC-023-2008 del día primero del\nmes de abril del 2008, la\n Asesoría Legal de Sistemas Comunales de\nla Dirección Jurídica,\nemitió criterio, estableciendo que cumplidos los trámites técnicos, es\njurídicamente procedente delegar la administración de dicho sistema. cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\n2º-That the community of the Northern Sector of Pedregoso de Pérez Zeledón, with contributions from the community, AyA, and the State, has built a communal water supply (acueductos comunales) system, to supply a population of inhabitants.\n\n3º-That in a General Assembly of residents, they resolved to constitute the organization and request AyA to delegate the administration of the systems to said organization.\n\n4º-That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named Asociación Pro Construcción y Mantenimiento de Cañería del Sector Norte de Pedregoso de Pérez Zeledón, legal identification number three - zero zero two - one hundred sixty-five thousand eight hundred fifty-seven, which is duly registered in the Registry of Associations of the Registro Nacional under volume number four hundred eleven, entry number one thousand three hundred sixty-five.\n\n5º-That for the purposes of the provisions of the Reglamento, the Directorate of the Brunca Region, through memorandum Nº RB-DOM-2008-042 of February 6, 2008, as well as the Dirección Jurídica in memorandum Nº DJ-1078-2008 of April 1, 2008, recommend that the Management proceed with the Delegation of the System Administration to the respective organization.\n\n6º-That through legal opinion Nº DJ-SC-023-2008 of April 1, 2008, the Legal Advisory Office for Communal Systems of the Dirección Jurídica issued a criterion, establishing that, the technical procedures having been completed, it is legally appropriate to delegate the administration of said system.
