de Valverde Vega, Alajuela.\n\n \n\n            Conoce esta Junta\nDirectiva de la Solicitud\nde Delegación de la\n Administración del Sistema de Acueductos y Alcantarillados.\n\n \n\nResultando:\n\n \n\n1º-Que de conformidad con el artículo 50, 129 de\nla Constitución Política,\nel Estado debe procurar el mayor bienestar de todos los habitantes, mediante un\nambiente sano y ecológicamente equilibrado. \n\n2º-Que de conformidad con los artículos 11, 21, 129 y 169 de\nla Constitución Política,\ncorresponde a las Municipalidades velar por los intereses locales, y\nla Sala Constitucional\nen reiterados pronunciamientos se ha manifestado en el sentido de que se garantiza\nla inviolabilidad de la vida cuando se suministra agua potable y turístico y\nde asentamientos humanos que proporcionan los sistemas de acueductos y\nalcantarillados.\n\n3º-Que de conformidad con los artículos 1º, 2º, 3º, 4º, 5º, 11, 18, 19,\n21, 22 y 23 de la Ley\n Constitutiva del AyA, artículo 264 de\nla Ley General de Salud\nPública, artículos 17, 32, 33, 148 y siguientes de\nla Ley de Aguas Nº 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de\nla Asociaciones\n Administradoras de los Sistemas de Acueductos y\nAlcantarillados Comunales Nº 39529-S-MINAE, publicado en\nLa Gaceta Nº 150 del\n5 de agosto del 2005, se establece que AyA es el ente Rector en todo lo\nrelativo a los Sistemas de Acueductos y Alcantarillados en todo el territorio\nNacional, y se encuentra facultado para delegar la administración de tales\nsistemas en organizaciones debidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\n1º-Que la participación de la comunidad o sociedad civil, constituye uno\nde los instrumentos eficaces para lograr la consecución del desarrollo\nsostenible en Costa Rica, por lo que AyA, desde 1976 ha venido delegando en\nlas comunidades la administración de aquellos sistemas en las que las ventajas\ncomparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las\npoblaciones, resulte más adecuado asignar en las comunidades su administración.\n\n2º-Que la comunidad de San Pedro de Valverde Vega, con aporte de la\ncomunidad, de AyA y del\nEstado, se ha construido un sistema de acueductos comunales, para el\nabastecimiento de una población de habitantes. \n\n3º-Que en Asamblea General de vecinos, dispusieron constituir la\norganización y solicitar al AyA, que delegue la administración de los sistemas\nen dicha organización.\n\n4º-Que por las características del sistema, es procedente delegar la\nadministración en la organización comunal constituida al efecto, denominada\nAsociación Administradora Acueducto Rural de San Pedro de Valverde Vega, cédula\njurídica tres- cero cero dos - ciento ochenta y cinco mil cincuenta y tres, que\nse encuentra debidamente inscrita en el Registro de Asociaciones del Registro\nNacional bajo el tomo número cuatrocientos veintiocho, asiento número cuatro\nmil ciento cuarenta y seis. \n\n5º-Que para los efectos de lo dispuesto en el Reglamento,\nla Jefatura Regional\nAcueductos Rurales Gran Área Metropolitana, mediante el memorando Nº 2008-0632\ndel día 8 de abril del 2008, así como\nla Dirección Jurídica\nen el memorando Nº DJ-1287-2008 del día 15 de abril del 2008, recomiendan a\nla Gerencia proceder a\nla Delegación de\nla Administración del\nsistema en la respectiva organización.\n\n6º-Que mediante el dictamen legal Nº DJ-SC31-2008 del día quince del mes\nde abril del 2008, la\n Asesoría Legal de Sistemas Comunales de\nla Dirección Jurídica,\nemitió criterio, estableciendo que cumplidos los trámites técnicos, es\njurídicamente procedente delegar la administración de dicho sistema. That in accordance with articles 50 and 129 of the Political Constitution, the State must ensure the greatest well-being of all inhabitants, through a healthy and ecologically balanced environment. \n\n2. That in accordance with articles 11, 21, 129, and 169 of the Political Constitution, it is the responsibility of the Municipalities to safeguard local interests, and the Constitutional Chamber, in repeated pronouncements, has stated that the inviolability of life is guaranteed when potable water and environmental sanitation are supplied in the terms of article 297 of the General Health Law, making it imperative that the Municipality cooperates, especially regarding zoning and urban development regulations, with the administrative organization of the communal systems, as an instrument for sustainable social, economic, industrial, business, agricultural, tourism, and human settlement development that the water supply and sewerage systems provide.\n\n3. That in accordance with articles 1, 2, 3, 4, 5, 11, 18, 19, 21, 22, and 23 of the Constitutive Law of AyA, article 264 of the General Public Health Law, articles 17, 32, 33, 148 and following of the Water Law Nº 276 of August 24, 1942, the General Potable Water Law and the Regulation for the Administrative Associations of Communal Water Supply and Sewerage Systems Nº 39529-S-MINAE, published in La Gaceta Nº 150 of August 5, 2005, it is established that AyA is the Governing Entity in everything related to Water Supply and Sewerage Systems throughout the national territory, and is empowered to delegate the administration of such systems to organizations duly constituted for this purpose.\n\n \n\nConsidering:\n\n \n\n1. That the participation of the community or civil society constitutes one of the effective instruments for achieving sustainable development in Costa Rica, and therefore AyA, since 1976, has been delegating to communities the administration of those systems where the comparative advantages of immediacy, effectiveness, and efficiency; cost and benefit to the populations, make it more appropriate to assign their administration to the communities.\n\n2. That the community of San Pedro de Valverde Vega, with contributions from the community, AyA, and the State, has constructed a communal water supply system to serve a population of inhabitants. \n\n3. That in a General Assembly of residents, they decided to form the organization and request that AyA delegate the administration of the systems to said organization.\n\n4. That due to the characteristics of the system, it is appropriate to delegate the administration to the communal organization constituted for this purpose, named Asociación Administradora Acueducto Rural de San Pedro de Valverde Vega, legal identification number tres- cero cero dos - ciento ochenta y cinco mil cincuenta y tres, which is duly registered in the Registry of Associations of the National Registry under volume number four hundred twenty-eight, entry number four thousand one hundred forty-six. \n\n5. That for the purposes of what is stipulated in the Regulation, the Regional Office for Rural Water Supply Gran Área Metropolitana, via memorandum Nº 2008-0632 of April 8, 2008, as well as the Legal Directorate in memorandum Nº DJ-1287-2008 of April 15, 2008, recommend to the Management to proceed with the Delegation of the Administration of the system to the respective organization.\n\n6. That through legal opinion Nº DJ-SC31-2008 of April 15, 2008, the Legal Advisory Office for Communal Systems of the Legal Directorate issued its criterion, establishing that, the technical procedures having been completed, it is legally appropriate to delegate the administration of said system.
