  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 171\n\n                        Suspender la implementación y vigencia del Acuerdo A.J.D.I.P/139-2008 sobre\nRegulación sobre el adecuado aprovechamiento y protección del recurso Tiburón\n\nTexto Completo acta: C258A\nINSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA\n\n(Así\nderogado mediante acuerdo AJDIP /343-2008 de 14 de agosto del 2008 y\nposteriormente vuelto a derogar mediante acuerdo AJDIP/470 del 12 de diciembre\nde 2008)\n\n \n\n \n\nINSTITUTO\nCOSTARRICENSE DE PESCA Y ACUICULTURA\n\n \n\nAJDIP/171-2008.-Puntarenas,\na los dos días del mes de mayo del 2008.\n\n \n\nConsiderando:\n\n \n\n1º-Que mediante\nAcuerdo A.J.D.I.P/139-2008, del 4 de abril del 2008,\nla Junta\n Directiva\nemitió las disposiciones correspondientes relacionadas con el cumplimiento de\ninstrucciones giradas por\nla\n Contraloría General de la República, sobre el aprovechamiento y manejo del\nrecurso Tiburón.\n\n \n\n2º-Que las\ndisposiciones indicadas respecto del planteamiento realizado por el Ente Contralor,\ndefinen en apego a la interpretación efectuada del artículo 40 de\nla Ley número 8436, el aprovechamiento del recurso\ncon la adherencia natural de las aletas, no permitiéndose ningún tipo de cortes\nparciales;\n\n \n\n3º-Que a pesar de la\nemisión de las disposiciones indicadas, se dejó de considerar los efectos de\nregulaciones técnicas emitidas por instancias competentes dentro del Sistema,\nque establecen y recomiendan por razones sanitarias de inocuidad y calidad en\nel aprovechamiento del recurso, la necesaria aplicación de la técnica de cortes\nlongitudinales parciales en la zona muscular adyacente a la aleta del tiburón,\ncon el objetivo de facilitar el desangrado necesario para garantía de inocuidad\ndel producto.\n\n \n\n4º-Que aunado a lo\nanterior, los dictámenes emitidos sobre este tema por\nla Procuraduría General de la República, no han llevado incorporado, al no haberse\nconsultado, si dicha técnica del corte parcial de las aletas, es acorde al\ncontenido legal y finalidad perseguida por el legislador, dispuesto en el\nartículo 40 de la Ley número 8436;\n\n \n\n5º-Que la\nimplementación de las medidas establecidas en el Acuerdo A.J.D.I.P/139-2008,\npodrían tener efectos negativos respecto de posibles acciones legales contra el\nInstituto, incumplimiento de disposiciones a nivel de Organismos\nInternacionales y medidas técnicas de carácter sanitario, establecidas por\nautoridades competentes nacionales.
