Estos programas implicarán necesariamente\nservicios de trabajo comunal por parte de los beneficiarios, conforme al\nreglamento correspondiente o para la realización de estudios sobre la materia.\n\n6º-Que\nla Ley de Creación del Instituto Mixto de Ayuda Social, Nº 4760 del 4 de\nmayo de 1971, establece en su artículo 2º la finalidad de resolver el problema\nde la pobreza extrema en el país y en su artículo 4º dentro de sus fines de\ncreación, se señala \"atender las necesidades de los grupos sociales o de las\npersonas que deban ser provistas de medios de subsistencia cuando carezcan de\nellos\".\n\n7º-Que el\nartículo 4º del Reglamento para la Prestación de Servicios\ny el Otorgamiento de Beneficios del Instituto Mixto de Ayuda Social, publicado\nen La Gaceta Nº 102 del 29 de mayo del 2000, define el concepto de pobreza como:\n\"Fenómeno o situación compleja de índole coyuntural o estructural multifacético\ny heterogéneo, que afecta a las personas y que se caracteriza por sus precarias\ncondiciones de vivienda y sanitarias, bajos niveles educacionales, inserción\ninestable en el sistema productivo, condiciones de riesgo social, con poca o ninguna\nincorporación en mecanismos de participación social, recursos insuficientes\npara satisfacer necesidades básicas nutricionales, salud, educación y vivienda)\ny en algunos casos ausencia o insuficiencia de destrezas, aptitudes,\nherramientas y oportunidades para generar y acumular ingresos\".\n\n8º-Que en el\nartículo 21 inciso h) del citado Reglamento, se señala en cuanto a los sujetos\nde los servicios institucionales, lo siguiente: \"En casos de excepción\ndebidamente documentados y con el correspondiente informe técnico social\nautorizados por quien ejerza\nla Gerencia Regional respectiva, se podrá otorgar beneficios a personas o familias que\npresenten una situación de pobreza coyuntural no necesariamente registrada como\ntal en el SIPO, o que mediante algún decreto o ley específica, se considere\nbeneficiarios de la acción institucional\".\n\n9º-Que no se\ncuenta con un fondo compensatorio para brindar un subsidio económico a los\npescadores afectados por la veda.\n\n10.-Que el\nperíodo de veda, provoca una situación de pobreza coyuntural en los pescadores\npor la carencia de ingresos por este concepto. Por tanto,\n\n \n\nDecretan:\n\n \n\nArtículo\n1º-Declárese en situación de pobreza coyuntural la condición de los pescadores\nsujetos a las restricciones y condiciones de veda para el Golfo de Nicoya,\nsegún el acuerdo A.J.D.I.P./137-2008, publicado en el Diario Oficial\nLa Gaceta Nº 79 del jueves 24 de abril del 2008 de\nla Junta Directiva de INCOPESCA; y que carezcan de otras fuentes de ingresos.\n\nArtículo\n2º-Autorízase al Instituto Mixto de Ayuda Social a otorgar beneficios\neconómicos en calidad de subsidio a las personas indicadas en el artículo\nanterior, en apego a las condiciones que se establecen en el presente decreto.\n\nArtículo\n3º-Serán beneficiarias de los recursos del IMAS, únicamente aquellas personas\nque se encuentren expresamente comprendidas dentro de la lista de pescadores\nque le será remitida por INCOPESCA en un plazo no mayor a 30 días naturales\ncontados a partir de la fecha de publicación del Acuerdo Nº A.J.D.I.P./137-2008\nde INCOPESCA.\n\nDicha lista\ncontendrá los siguientes requisitos mínimos:\n\n \n\na)  Nombre\ncompleto del beneficiario.\n\n \n\nb)  Número\nde cédula de identidad.\n\n \n\nc) \nDomicilio exacto de los beneficiarios.\n\nArtículo 4º-El\nIMAS, procederá a la atención de estas personas con base en la resolución\ndebidamente fundamentada y aprobada por\nla Gerente Regional que determine el cumplimiento de los requisitos establecidos en\neste decreto, de conformidad con el listado depurado y reemitido al IMAS por\nINCOPESCA y con los siguientes requisitos:\n\n \n\na) \nFotocopia de la licencia de pesca vigente, extendida por INCOPESCA.\n\n \n\nb) \nDeclaración jurada de cada beneficiario indicando que no cuenta con más fuentes\nde ingresos en su núcleo familiar que la actividad de pesca, antes y durante la\nveda.\n\nArtículo 5º-El\nIMAS otorgará un subsidio a los beneficiarios que cumplan con las condiciones\nestipuladas en el artículo anterior. No obstante, si de la información contenida en dicho sistema\no de otros medios se desprende que los potenciales beneficiarios o sus familias\ncuentan con otros ingresos, proveniente de salarios, actividades remuneradas,\nrenta u otros el IMAS podrá denegar el otorgamiento del beneficio.\n\nArtículo 7º-Para\nhacer efectiva la entrega del monto económico correspondientes al primer y\nsegundo tracto, INCOPESCA deberá verificar y actualizar la información\nsuministrada con base en este decreto. These programs will necessarily involve\ncommunity work services (servicios de trabajo comunal) by the beneficiaries, in accordance with the\ncorresponding regulation or for conducting studies on the matter.\n\n6º-That\nthe Law Creating the Joint Institute for Social Aid, No. 4760 of May 4,\n1971, establishes in its article 2 the purpose of solving the problem\nof extreme poverty in the country and in its article 4, within its founding\npurposes, it states \"to meet the needs of social groups or of\npersons who must be provided with means of subsistence when they lack\nthem.\"\n\n7º-That\narticle 4 of the Regulation for the Provision of Services\nand the Granting of Benefits of the Joint Institute for Social Aid, published\nin La Gaceta No. 102 of May 29, 2000, defines the concept of poverty as:\n\"A complex phenomenon or situation of a temporary or structural nature (índole coyuntural o estructural), multifaceted\nand heterogeneous, that affects persons and is characterized by their precarious\nhousing and sanitary conditions, low educational levels, unstable\ninsertion in the productive system, conditions of social risk, with little or no\nincorporation into mechanisms of social participation, insufficient resources\nto satisfy basic nutritional, health, education and housing needs\nand in some cases absence or insufficiency of skills, aptitudes,\ntools and opportunities to generate and accumulate income.\"\n\n8º-That in\narticle 21, subsection h) of the cited Regulation, it is stated regarding the subjects\nof institutional services, the following: \"In duly documented exceptional\ncases and with the corresponding authorized social technical report\nby the respective Regional Manager (Gerencia Regional), benefits may be granted to persons or families that\npresent a situation of temporary poverty (pobreza coyuntural) not necessarily registered as\nsuch in the SIPO, or who through a specific decree or law, are considered\nbeneficiaries of institutional action.\"\n\n9º-That a\ncompensatory fund is not available to provide an economic subsidy to\nfishermen affected by the closed season (veda).\n\n10.-That the\nclosed season period (período de veda) causes a situation of temporary poverty (pobreza coyuntural) among fishermen\ndue to the lack of income from this source. Said subsidy shall be issued in two events\nor installments (tractos), as follows:\n\na) The\nfirst installment (tracto) shall be delivered no later than June 15, 2008 and shall\ncorrespond to the months of May and June of 2008 for a total amount\nto be subsidized of exactly one hundred ten thousand colones (¢110,000.00) per beneficiary.\n\nb) The\nsecond installment (tracto) shall correspond to the month of June and shall be for the sum of exactly fifty-five thousand colones (¢55,000.00).\n\nArticle 6º-The\nsubsidies shall be processed by the Regional Managements (Gerencias Regionales) of IMAS in the\nPuntarenas and Guanacaste zones. IMAS professionals shall be empowered\nto request from potential beneficiaries the requirements established in\narticle 4 of this decree and shall not require that they be\nregistered in the Target Population Information System (Sistema de Información de la Población Objetivo) (SIPO). However, if from the information contained in said system\nor from other means it is evident that the potential beneficiaries or their families\nhave other income, from salaries, remunerated activities,\nrent or others, IMAS may deny the granting of the benefit.\n\nArticle 7º-To\nmake effective the delivery of the economic amount corresponding to the first and\nsecond installments (tractos), INCOPESCA must verify and update the information\nprovided based on this decree. Said information shall be sent to IMAS,\nwithin the first five business days of the month of June and October\nrespectively of 2008.\n\nArticle\n8º-It is the responsibility of INCOPESCA to supervise and control the community work (trabajo comunal) that\nfishermen will perform during the closed season period (período de veda), in accordance with the\nrespective regulation that governs said activity. INCOPESCA shall communicate to\nthe respective Regional Management (Gerencia Regional) of IMAS, within a period not exceeding three business days, the\nname of those persons who fail to comply with this condition, as well as those who\ncarry out actions that contravene the closed season declaration (declaratoria de veda) or who have supplementary\nincome. In these cases, the authorized benefit shall be revoked, after compliance with due process (debido proceso).\n\nArticle 9º-It shall\ntake effect upon its publication.\n\nGiven at\nthe Presidency of the Republic.-San José, on the\nsecond day of the month of May of two thousand eight." }
