Directiva de\nla Solicitud de Delegación de\nla Administración del\nSistema de Acueductos y Alcantarillados.\n\n \n\nResultando:\n\n \n\n1º-Que de conformidad con el artículo 50, 129 de\nla Constitución Política,\nel Estado debe procurar el mayor bienestar de todos los habitantes, mediante un\nambiente sano y ecológicamente equilibrado. \n\n2º-Que de conformidad con los artículos 11, 21, 129 y 169 de\nla Constitución Política,\ncorresponde a las Municipalidades velar por los intereses locales, y\nla Sala Constitucional\nen reiterados pronunciamientos se ha manifestado en el sentido de que se\ngarantiza la inviolabilidad de la vida cuando se suministra agua potable y\nsaneamiento ambiental en los términos del artículo 297 de\nla Ley General de Salud,\npor lo que resulta imperativo que\nla Municipalidad coadyuve en especial en lo relativo\na los reglamentos de zonificación, desarrollo urbanístico, con la organización\nadministradora de los sistemas comunales, como instrumento de desarrollo\nsostenible social, económico, industrial, empresariales, agrario, turístico y\nde asentamientos humanos que proporcionan los sistemas de acueductos y\nalcantarillados.\n\n3º-Que de conformidad con los artículos 1, 2, 3, 4, 5, 11, 18, 19, 21,\n22 y 23 de la Ley\n Constitutiva del AyA, artículo 264 de\nla Ley General de Salud\nPública, artículos 17, 32, 33, 148 y siguientes de\nla Ley de Aguas N° 276 del 24 de\nagosto de 1942, Ley General de Agua Potable y Reglamento de\nla Asociaciones\n Administradoras de los Sistemas de Acueductos y\nAlcantarillados Comunales N° 39529-S-MINAE, publicado en\nLa Gaceta N° 150 del\n5 de agosto del 2005, se establece que AyA es el ente Rector en todo lo\nrelativo a los Sistemas de Acueductos y Alcantarillados en todo el territorio\nNacional, y se encuentra facultado para delegar la administración de tales\nsistemas en organizaciones debidamente constituidas al efecto.\n\n \n\nConsiderando:\n\n \n\n1º-Que la participación de la comunidad o sociedad civil, constituye uno\nde los instrumentos eficaces para lograr la consecución del desarrollo\nsostenible en Costa Rica, por lo que AyA, desde 1976 ha venido delegando en\nlas comunidades la administración de aquellos sistemas en las que las ventajas\ncomparativas de inmediatez, eficacia y eficiencia; costo y beneficio a las\npoblaciones, resulte más adecuado asignar en las comunidades su administración.\n\n2º-Que la comunidad La\n Lucha de San Alberto de Siquirres con aporte de la comunidad,\nde AyA y del Estado, se ha con aporte de la comunidad, de AyA y del Estado, se\nha construido un sistema de acueductos comunales, para el abastecimiento de una\npoblación de habitantes. \n\n3º-Que en Asamblea General de vecinos, dispusieron constituir la\norganización y solicitar al AyA, que delegue la administración de los sistemas\nen dicha organización.\n\n4º-Que por las características del sistema, es procedente delegar la\nadministración en la organización comunal constituida al efecto, denominada\nAsociación Administradora del Acueducto y Alcantarillado Sanitario de\nLa Lucha, cédula jurídica tres-\ncero cero dos - cuatrocientos ochenta y un mil, que se encuentra debidamente\ninscrita en el Registro de Asociaciones del Registro Nacional bajo el tomo\nquinientos sesenta y nueve, asiento número setenta y cuatro mil ochocientos\ncincuenta y tres. \n\n5º-Que para los efectos de lo dispuesto en el Reglamento,\nla Dirección de\nla Región Huetar\nAtlántica, mediante el memorando N° HU-2008-0091, del día 21 de enero del 2008,\nasí como la\n Dirección Jurídica en el memorando Nº DJ-1078-2008 del día 1º\nde abril del 2008, recomiendan a la\n Gerencia proceder a\nla Delegación de\nla Administración del\nsistema en la respectiva organización.\n\n6º-Que mediante el dictamen legal Nº DJ-SC-025-2008 del día primero del\nmes de abril del 2008, la\n Asesoría Legal de Sistemas Comunales de\nla Dirección Jurídica,\nemitió criterio, estableciendo que cumplidos los trámites técnicos, es\njurídicamente procedente delegar la administración de dicho sistema. cost and benefit to\nthe populations, make it more appropriate to assign their administration to the communities.\n\n2º-That the community of La\n Lucha de San Alberto de Siquirres, with contributions from the community,\nfrom AyA, and from the State, has had a communal aqueduct system built for the supply of a\npopulation of inhabitants. \n\n3º-That in a General Assembly of residents, they resolved to constitute the\norganization and request that AyA delegate the administration of the systems\nto said organization.\n\n4º-That due to the characteristics of the system, it is appropriate to delegate the\nadministration to the communal organization constituted for this purpose, named\nAsociación Administradora del Acueducto y Alcantarillado Sanitario de\nLa Lucha, legal identification number three-\nzero zero two - four hundred eighty-one thousand, which is duly\nregistered in the Associations Registry of the National Registry under volume\nfive hundred sixty-nine, entry number seventy-four thousand eight hundred\nfifty-three. \n\n5º-That for the purposes of the provisions of the Regulation,\nthe Directorate of\nthe Huetar\nAtlántica Region, via memorandum No. HU-2008-0091, dated January 21, 2008,\nas well as the\n Legal Directorate in memorandum No. DJ-1078-2008 dated April\n1, 2008, recommend that the\n General Management proceed with\nthe Delegation of the\nAdministration of the\nsystem to the respective organization.\n\n6º-That through legal opinion No. DJ-SC-025-2008 of the first day of\nApril 2008, the\n Legal Advisory Office for Communal Systems of\nthe Legal Directorate\nissued its criterion, establishing that having completed the technical procedures, it is\nlegally appropriate to delegate the administration of said system.
