Además, conforme lo establece la\nLey de la República Nº 1721 de diciembre de 1953, reformada por Ley Nº 4964 de\nmarzo de 1972 y ley Nº 8461 en la cual aclara que es competencia del Instituto\nCostarricense de Puertos del Pacífico (INCOP) las funciones de Autoridad\nPortuaria del Litoral Pacífico de Costa Rica.\n\nArtículo 2º-Para lo que atañe a este conjunto de normas se definen los\nsiguientes conceptos:\n\n \n\nI.N.C.O.P.: Instituto Costarricense de Puertos del\nPacífico.\n\nInstalaciones: Toda obra de infraestructura del puerto\ndestinada a brindar cualquier atención y facilidad a los buques y a la carga.\n\nBuque: Cualquier embarcación destinada a la\nnavegación marítima que se utiliza para el transporte de carga y/o pasajeros,\nde cabotaje o turismo.\n\nT.R.B.: Tonelada de Registro Bruto del buque, es la\ncapacidad total del barco expresada en toneladas de 100 pies cúbicos.\n\nMuelle: Parte de la infraestructura del Puerto,\ndestinada para la estadía del buque a efecto de facilitar sus operaciones de\ncarga y descarga.\n\nCliente: Toda persona natural o jurídica que\nsolicita y pague por un servicio y acatando las normas establecidas por el\nInstituto.\n\nInsumos: Cada uno de los factores que intervienen en\nla producción de bienes o servicios.\n\nCódigo PBIP: Código para la protección de buques e\ninstalaciones Portuarias.\n\nOPIP: Oficial de Protección de las Instalaciones\nPortuarias\n\n \n\nArtículo 3º-Este Reglamento funcionará como Apéndice del Reglamento\nGeneral de Servicios Portuarios de INCOP, según su Artículo 2.\n\nLa Administración del Muelle de Quepos tomará las previsiones necesarias\npara contar con los requerimientos de seguridad en el muelle, que le permitan\nimplantar el Código PBIP, las condiciones que se determinen en este formarán\nparte integral de este Reglamento.\n\n \n\nArtículo 4º-El horario de funcionamiento de los servicios prestados en\nel muelle será definido por la Administración según la conveniencia y\nnecesidades, siempre y cuando se respeten las normas internas que el INCOP ha\nestablecido. Sin embargo, después de las 18 horas (6.00 p.m.) no podrá ingresar\nvehículo alguno al recinto portuario, a excepción de una emergencia calificada\no con la debida autorización de la Administración del Muelle.\n\n \n\nArtículo 5º-La Administración del Muelle de Puerto Quepos podrá\nreservarse el derecho de no prestar o suspender los servicios a aquellos\nclientes que no se encuentren a derecho en sus obligaciones o que incumplan las\ndisposiciones de este Reglamento, o cuando las condiciones internas o externas\ndeterminen algún probable peligro para la salud humana.\n\n \n\nArtículo 6º-Todo daño a las instalaciones y equipos propiedad de INCOP\no bajo su administración, causados por terceros, será indemnizado por el\nresponsable en el costo real del daño.\n\n \n\nArtículo 7º-No se permitirá a los clientes o particulares dejar basuras\no desperdicios dentro de las instalaciones del muelle. Estos deben ser\nretirados una vez concluida la operación por cuenta del cliente.\n\n \n\nArtículo 8º-Todo reclamo que se relacione con la prestación de\nservicios o su cobro, debe dirigirse a la Contraloría de Servicios o a la\nGerencia Operaciones Portuarias.\n\n \n\nArtículo 9º-A los trabajadores del INCOP les será prohibida la compra\nde productos en las naves. El incumplimiento acarreará la sanción disciplinaria\ny legal correspondiente.\n\n \n\nArtículo 10.-Los Oficiales (servicio de\nvigilancia) destacados en el muelle, seguirán las normas y directrices\nestablecidas por la Administración del Muelle de Puerto Quepos o en su efecto\nel encargado de la Seguridad Portuaria (Oficial Protección de las Instalaciones\nPortuarias).\n\n \n\nArtículo 11.-No podrá ninguna nave utilizar la\npantalla de atraque sin la debida autorización de la Administración del muelle.\n\n \n\nArtículo 12.-La Administración del Muelle de\nQuepos se reserva el derecho de designar el orden de atraque de las naves o\nlimitar su permanencia en el muelle, cuando esto se requiera por razón de orden\noperativo.\n\n \n\nArtículo 13.-Ninguna nave será atracada,\ndesatracada o cambiada de atracadero sin la autorización de la Administración\ndel Muelle de Puerto Quepos.\n\n \n\nArtículo 14.-Las naves serán atendidas\nsiguiendo el orden de arribo, siempre y cuando no se expongan las instalaciones\ndel muelle o a los usuarios y funcionarios destacados en él.\n\n \n\nArtículo 15.-Perderá el derecho de atraque\ntoda nave que no vaya a trabajar inmediatamente después de su arribo al muelle,\nasí como las que estando fondeadas y les corresponda el atraque, no lo\nefectúen.\n\n \n\nArtículo 16.-Toda nave que ponga en peligro o\ndañe las instalaciones del muelle no será atracada.\n\n \n\nArtículo 17.-El capitán o el responsable de cada\nnave cuidará que su embarcación se encuentre lista para desatracar o cambiar de\nsitio, cuando a juicio de la Administración del muelle sea necesario hacerlo.\n\n \n\nArtículo 18.-Terminadas las operaciones, toda\nnave deberá abandonar el puesto de atraque de inmediato.\n\n \n\nArtículo 19.-En caso de naves que no reúnan\nlas condiciones que exige la Administración del muelle para la seguridad de las\ninstalaciones del mismo o su personal, podrán suspenderse las operaciones o no\ndar inicio a las mismas hasta que las anomalías sean corregidas o se pronuncie\nal respecto el encargado del Muelle o el Oficial de Seguridad de las\nInstalaciones Portuarias (OPIP).\n\n \n\nArtículo 20.-En caso de incendio o algún otro\naccidente de peligro inminente abordo, la nave debe ser desatracada inmediatamente.\n\n \n\nArtículo 21.-La Administración del muelle\npuede ordenar la suspensión de labores y el desatraque de una nave cuando\nconsidere que la forma y condiciones de trabajo perjudican las labores en el\nMuelle de Puerto Quepos, la atención de otras naves o dañen de alguna manera\nlas instalaciones del muelle.\n\n \n\nArtículo 22.-El embarque o desembarque de\npasajeros de embarcaciones de placer y turísticas, se hará por cuenta y riesgo\nde los encargados de dicha actividad.\n\n \n\nCAPÍTULO II\n\n \n\nDe la descripción de los\nservicios\n\n \n\n \n\nArtículo 23.-Todo servicio que se brinde en\nlas instalaciones del Muelle de Puerto Quepos estará sujeto a las regulaciones\ny las disposiciones tarifarias.\n\n \n\nArtículo\n24.-La estructura tarifaria comprenderá los siguientes servicios:\n\n MARGIN-LEFT: 24pt\" class=\"Pa61\">a)\nEstadía: Corresponde a la ocupación que hace la nave del muelle\nmientras se encuentra atracada. \n\nUnidad\nde tarificación: Metro eslora-hora o fracción.\n\nDescripción\nde servicios:\n\n1)\nEmbarcaciones de pesca deportiva o recreativa.\n\n2)\nEmbarcaciones de pesca artesanal.\n\n3)\nYates y embarcaciones de placer.\n\n4)\nEmbarcaciones comerciales.\n\n5)\nCruceros.\n\nb)\nMuellaje: Consiste en la utilización que hace la carga de las\ninstalaciones del muelle en tránsito de o hacia la nave. \n\nUnidad\nde tarificación: Tonelada métrica o fracción.\n\nc)\nSuministro de insumos: Este servicio consiste en el aprovisionamiento de\ninsumos a los usuarios del muelle.\n\n1)\nCombustible.\n\nUnidad\nde tarificación: Tonelada métrica (TM).\n\n2)\nCarga General (cualquier carga incluyendo agua).\n\nUnidad\nde tarificación: Tonelada métrica (TM).\n\n   \nd) Ingreso de vehículos a las instalaciones del muelle: Todo vehículo\nque ingrese a las instalaciones del muelle deberá pagar su peaje, además\ncumplir con la normativa vigente y lo indicado en el artículo 27, 28 y 29 de\neste reglamento.\n\nUnidad\nde tarificación: Vehículo.\n\n   \ne) Embarque y desembarque de pasajeros: Los pasajeros que desembarquen o\naborden cruceros deberán pagar por el uso de las instalaciones.\n\nUnidad\nde tarificación: Por persona\n\n   \nf) Pasajeros en tránsito: Los pasajeros que aborden o desembarquen\nembarcaciones de placer, turísticas y cruceros deberán pagar por el uso de las\ninstalaciones.\n\nUnidad\nde tarificación: Por persona.\n\n   \ng) Fondeo de embarcaciones en la rada: Posicionamiento de un buque en\naguas establecidas para el anclaje.\n\nUnidad\nde tarificación: El T.R.B. según la estructura tarifaria.\n\nh)\nLimpieza de muelle: Consiste en la limpieza del muelle ocupado por las\nnaves y las instalaciones afectadas por la operación de dicha nave. Este\nservicio será prestado por el prestatario del servicio de carga en todos los\npuestos de atraque con el personal contratado para el aseo. Su tarifa es por\ntonelada métrica embarcada y/o desembarcada.\n\ni)\nCualquier otro servicio ofrecido principalmente a embarcaciones mayores, se\nregirá por el Reglamento General de Servicios Portuarios de INCOP y sus\ndisposiciones tarifarias.\n\n(Así reformado el artículo\n24) anterior mediante sesión N° 3835 del 9 de mayo del 2013)\n\nCAPÍTULO III\n\n \n\nDel ingreso y permanencia de\npersonas y vehículosa las instalaciones del muelle de\npuerto Quepos\n\n \n\n \n\nArtículo 25.-El control de ingresos, salida y\npermanencia de personas y vehículos dentro de las instalaciones del muelle se\nregirá por lo que indique este articulado y en caso de circunstancias no\ncubiertas regirán además las disposiciones legales y reglamentarias que el\nINCOP tiene establecidas.\n\n \n\nArtículo\n26.-Únicamente se permitirá el ingreso y permanencia dentro de las\ninstalaciones del muelle a las siguientes personas:\n\n MARGIN-LEFT: 24pt\" class=\"Pa61\">a)\nFuncionarios o empleados del INCOP debidamente identificados.\n\nb)\nEmpleados de las naves o personas que por razón de trabajo deban permanecer\ndentro de las instalaciones siempre y cuando estén debidamente identificados\ncon su pase.\n\nc)\nLos turistas que deban abordar una nave de algún tour operador que brinde los\nservicios desde el muelle.\n\nd)\nLas que autorice el Administrador del Muelle. \n\n (Así reformado el artículo 26) anterior\n mediante sesión N° 3835 del 9 de mayo del 2013)\n\nArtículo 27.-Los conductores de vehículos dentro de las instalaciones\ndel muelle deben:\n\n \n\na)  Transitar por las vías señaladas para tal fin.\n\nb)  Respetar el límite de velocidad que se indique.\n\nc)  Estacionarse en los lugares indicados para tal efecto.\n\nd)  Detener el motor mientras se realiza la carga o descarga.\n\ne)  No efectuar reparaciones y en caso de averías deberán ser\nretirados de las instalaciones del muelle de inmediato.\n\nf)   No permanecer más de 15 minutos en las instalaciones del\nMuelle siempre y cuando se esté realizando alguna labor de carga y descarga\n\n \n\nArtículo 28.-Todo conductor, cliente y\ncualquier otra persona debe abstenerse de actos imprudentes o peligrosos dentro\nde las instalaciones del Muelle que puedan originar accidentes o exponer la\nsalud de las personas.\n\n \n\nArtículo 29.-En el acceso vehicular se revisara visualmente y físico\ncuando lo amerite, todos los vehículos que ingresan y egresan; en caso de\nvehículos con cajuela y camiones de carga, observar para verificar si viene a\nretirar o traer producto o provisiones, si se observa consumiendo licor dentro\ndel vehículo, informarles que tienen que desecharlo antes del ingreso, si se\nobserva al conductor del vehículo en aparente estado de ebriedad, denegarle el\nacceso e informar al OPIP o a la Administración inmediatamente.\n\n \n\nArtículo 30.-Es prohibido el ingreso de\nvehículos salvo los siguientes casos:\n\n \n\na)  Todos los vehículos propiedad del INCOP o bajo su\nadministración.\n\nb)  Vehículos particulares autorizados por la Presidencia\nEjecutiva, Gerencia General del INCOP o la Administración del Muelle y el\nOficial de Protección de las instalaciones Portuarias.\n\nc)  Todo vehículo que haya pagado su peaje y que su quehacer sea\nen el muelle. (En el caso de los operadores del transporte acuático, agencias\nnavieras, pagarán por una sola vez el tiquete de peaje siempre y cuando\ningresen en labores de apoyo administrativo al servicio que se les brinda y no\nasí cuando transporten turistas. La aplicación será solo para un vehículo por\noperador).\n\n \n\nArtículo\n31.-Queda terminantemente prohibido ingerir bebidas alcohólicas dentro de las\ninstalaciones portuarias. Así mismo, no podrá ingresar persona alguna que se\nencuentre en aparente estado de ebriedad.\n\n(Así reformado el artículo\n31) anterior mediante sesión N° 3835 del 9 de mayo del 2013)\n\nArtículo 32.-El ingreso de las personas al\nrecinto portuario se efectuará por la entrada principal donde está la casetilla\ny se realizara la inspección visual y física cuando lo amerite de todos los\nbultos de mano o espalda (salveques, bolsos, neveras\nmaletas, entre otros); en este lugar se identificarán con la unidad de\nvigilancia.\n\n \n\nArtículo\n33.-Todas las personas que ingresen, con excepción de los funcionarios o\nempleados de la Institución destacados en el Muelle de Quepos, deberán indicar\nal oficial los motivos de sus visitas al muelle.\n\n (Así reformado el artículo 33) anterior\n mediante sesión N° 3835 del 9 de mayo del 2013)\n\nArtículo\n34.-Toda persona vinculada al quehacer dentro del muelle deberá preverse de\nun pase para poder ingresar a las instalaciones del mismo.\n\nExisten\ntres pases:\n\n MARGIN-LEFT: 24pt\" class=\"Pa61\">a)\nTripulantes.\n\nb)\nDueños o administradores de naves.\n\nc)\nTemporales.\n\n (Así reformado el artículo 34) anterior\n mediante sesión N° 3835 del 9 de mayo del 2013)\n\nArtículo\n35.-Los pases temporales serán otorgados a trabajadores ocasionales de los\nusuarios que deban realizar constantemente labores dentro de las instalaciones\ndel muelle, mismos que se entregarán con base en nota firmada por el o los dueños\nde las embarcaciones a quien le trabaja.\n\n(Así reformado el artículo\n35) anterior mediante sesión N° 3835 del 9 de mayo del 2013)\n\nArtículo\n36.-Los pases a tripulantes serán otorgados de acuerdo a lo estipulado en el\ncertificado de navegabilidad de la nave y deberán contener el nombre de la\nembarcación.\n\n (Así reformado el artículo 36) anterior\n mediante sesión N° 3835 del 9 de mayo del 2013)\n\nArtículo\n37.-Todos los pases deberán llevar una fotografía reciente del propietario,\nun número de registro, además deberán indicar la fecha de vencimiento.\n\n(Así reformado el artículo\n37) anterior mediante sesión N° 3835 del 9 de mayo del 2013)\n\nArtículo 38.-Toda persona al ingresar a las\ninstalaciones del muelle deberá entregar el pase en el puesto de entrada\n(tarjeta o carné) al oficial de seguridad, la cual le será devuelta a la\nsalida, además deberán acatar las disposiciones dadas en este capítulo.\n\n \n\nArtículo 39.-Cuando una persona haya perdido su tarjeta, deberá\ninformarlo a la Administración del muelle, la cual le dará trámite para que se\nle extienda una nueva tarjeta previo a la presentación de la fotocopia de la\ncédula de identidad, y la respectiva foto tamaño pasaporte.\n\n \n\nArtículo 40.-La Administración del Muelle de\nPuerto Quepos llevará el control y registro de los pases otorgados, en conjunto\ncon el encargado de seguridad portuaria (OPIP).\n\n \n\nArtículo 41.-El pase otorgado a una persona,\nno autoriza el ingreso de su vehículo particular, el cual estará bajo otra\nregulación.\n\n \n\nArtículo 42.-La Administración del Muelle y el\nEncargado de Seguridad Portuaria de Puerto Quepos podrán negar el permiso de\ningreso a las personas que no cumplan las disposiciones de este capítulo.\n\n \n\nCAPÍTULO IV\n\n \n\nDel suministro de insumos\n\n \n\n \n\nArtículo 43.-Todos aquellos servicios de\nsuministros de insumos que se brinden a las embarcaciones que utilicen las instalaciones\ndel Muelle de Quepos, deberán ser amparadas al reglamento para las personas\nfísicas y jurídicas que brindan servicios o suministros a buques que arriban a\nlos puertos administrados por el INCOP y consecuentemente objeto de la\naplicación del Canon que requiere el artículo 5 del citado Reglamento.\n\n \n\nArtículo 44.-El expendio tanto de combustible,\nagua potable, energía eléctrica y otros insumos en dicho muelle, será ejecutado\nsólo por el personal designado por la empresa proveedora para tal fin.\n\n \n\nArtículo 45.-La Administración del Muelle de Puerto Quepos definirá los\nhorarios y modo de operar en la venta de insumos, siempre y cuando no\ninterfiera con las normas de este Reglamento o las de la Institución.\n\n \n\nArtículo\n46.-Los vehículos que deberán brindar el suministro de combustible,\nprovisiones (hielo, alimentos u otros), deberán cancelar el respectivo tiquete\nde peaje y su permanencia dentro del muelle se encontrará ajustado al tiempo\nnecesario para el desarrollo de la actividad que generó su ingreso por lo que\ninmediatamente finalizada su gestión, deberá abandonar el área restringida\n(muelle).\n\n (Así reformado el artículo 46) anterior\n mediante sesión N° 3835 del 9 de mayo del 2013)\n\nArtículo 47.-No se permitirá el ingreso al muelle (área restringida),\nde aquellos vehículos cuyos propietarios resulten empleados de la Terminal\nMuelle de Quepos o aquellos que pertenezcan a los miembros de las tripulaciones\nde las embarcaciones que lleven a cabo actividades en el muelle, los cuales\ndeberán permanecer fuera del área restringida, la violación de esta condición,\nse hará una notificación formal sobre las medidas correctivas que se aplicarían\ny en caso de ser reincidente, se denegará el ingreso al recinto portuario del\nvehículo infractor.\n\n \n\nArtículo 48.-Bajo ninguna circunstancia se\npermitirá el ingreso al recinto portuario de más de tres vehículos (automóviles,\nbusetas, microbuses o taxis), acorde al arribo de la embarcación que efectuará\nel servicio, para tal efecto, los representantes de las embarcaciones deberán\ncoordinar lo pertinente con el funcionario de INCOP que se ubica en el portón\nde acceso del muelle, procurando un ordenamiento adecuado y seguro para las\npersonas, vehículos e infraestructura del muelle.\n\n \n\n \n\nCAPÍTULO V\n\n \n\nDel uso y manejo de las\nmáquinas\n\n \n\n \n\nArtículo 49.-Toda maquinaria que se utilice en\nlas instalaciones del muelle estará bajo la estricta supervisión de la\nAdministración y contará con los respectivos seguros por responsabilidad civil.\n\n \n\nArtículo 50.-Es prohibido para cualquier trabajador manejar u operar\nequipos sin autorización de la Administración del muelle, así como abrir o\ncerrar válvulas, interruptores de electricidad, gas, vapor, aire, etc., y si\nestá autorizado para ello, deberá cerciorarse que su acción no ponga en peligro\na otras personas.\n\n \n\nArtículo 51.-Es prohibido para cualquier trabajador el uso de camisetas\nabiertas y otros objetos como cadenas, pulseras o cualquier tipo de prendas\npersonales y ropa que puedan ser arrolladas por máquinas en movimiento (grúas,\nmontacargas, etc.) o enganchadas por los aparatos de manipulación de cargas.\n\n \n\nArtículo 52.-El servicio de cualquier máquina\npara la manipulación de carga estará regulada por una estructura tarifaria en\nla cual se establece el rubro a cobrar.\n\n \n\nCAPÍTULO VI\n\n \n\nDe la facturación y el cobro de\nlos servicios\n\n \n\n \n\nArtículo 53.-Todo cliente, cualquiera que sea su\nclase, que necesite los servicios que se brindan en el muelle o en alguna forma\nutiliza las instalaciones o facilidades que se dan, tendrá que solicitarlos por\nescrito y con una antelación de 48 horas como mínimo.\n\nDicha solicitud deberá indicar claramente la identificación del\nservicio que solicita, bajo un formato de presentación el cual contendrá entre\notras cosas nombre del que lo solicita, cédula de identidad, descripción de los\nservicios a solicitar y datos de la embarcación.\n\nLa solicitud será firmada por el cliente o su representante,\npreviamente acreditado como tal ante la Administración del Muelle de Quepos,\npara lo cual ésta llevará un registro de firmas de las personas facultadas por\nel usuario para contraer las responsabilidades que implica la prestación del\nservicio\n\n \n\nArtículo 54.-El interesado, al presentar la\nsolicitud de servicios, lo hará ante la Administración del muelle, la cual\ntendrá que autorizar, canalizar y agilizar los trámites correspondientes.\n\n \n\nArtículo 55.-Además de la solicitud del servicio, el usuario tendrá que\ndepositar el valor estimado de los servicios que se requiere, o bien realizar\nun depósito previo, cuyo monto será establecido por la Administración del\nMuelle, en concordancia con la cantidad promedio de servicios y pasajeros que\nrealizan las naves en un período de dos semanas, sin embargo cuando el saldo\ndel depósito alcance al menos para dos servicios, deberá nuevamente cancelar la\ndiferencia con el fin de renovar el depósito correspondiente.\n\n \n\nArtículo 56.-El funcionario designado para el cobro de los servicios\ntendrá que entregar a la persona designada por la Administración, la suma\nrecaudada diariamente con su debida justificación (documentos, comprobantes),\nésta hará un depósito diario en los Bancos del Sistema Bancario Nacional en la\ncuenta de INCOP.\n\nEl encargado de efectuar el depósito del banco reportará todos los días\nhábiles al Área de Contabilidad de la Institución el informe de ingresos.\n\n \n\nArtículo 57.-El valor del depósito se le\ncomunicará a la Sección de Facturación del Área de Contabilidad al momento de\nrecibir la solicitud.\n\nEl importe del depósito debe ser pagado en dinero efectivo o cheques\ncertificados siempre y cuando la Gerencia General del INCOP autorice a la\nAdministración del muelle a la recepción de cheques contra Bancos del Sistema\nNacional.\n\n \n\nArtículo 58.-Una vez prestado el servicio, los\ncargos respectivos se presentarán en una factura al efecto. Se efectuará una\nliquidación sobre la base del depósito previamente efectuada.\n\n \n\nArtículo 59.-En caso que el cobro de los\nservicios prestados sobrepase el depósito, el usuario debe cancelar\ninmediatamente la diferencia que corresponda; de no hacerlo la Administración\ndel muelle podrá suspender o cancelar los servicios en el futuro.\n\nEn caso de que el saldo de la liquidación sea acreedor, su importe le\nserá acreditado para aplicarse a próximos servicios.\n\n \n\n \n\nCAPÍTULO VII\n\n \n\nDisposiciones finales\n\n \n\n \n\nArtículo 60.-En caso de duda sobre la\ninterpretación de este Reglamento, corresponderá a la Junta Directiva del INCOP\ninterpretar correctamente las disposiciones contenidas.\n\n \n\nArtículo 61.-Para cualquier nave que no cumpla\nlas disposiciones estipuladas en este Reglamento, la Administración del muelle\nnegará el permiso para atracar en dicho muelle.\n\n \n\nArtículo 62.-Las disposiciones contempladas\ndeben ser estrictamente acatadas por todos los trabajadores del INCOP y los\nparticulares que hagan uso de las instalaciones del muelle o que por razones de\nvisita o trabajo transiten o permanezcan dentro de ellas.\n\n \n\nArtículo 63.-Los trabajadores del INCOP que no\nacaten las normas de este articulado, se les sancionará como lo dispone el\nReglamento Autónomo de Servicios de la Institución y la respectiva legislación.\n\nEn lo que corresponde a los clientes de las instalaciones del muelle\nque incumplan las disposiciones aquí establecidas recibirán las siguientes\nsanciones:\n\na)  Con una advertencia escrita, si no es reincidente, ésta en\ncasos menores.\n\nb)  Con la suspensión de la prestación del servicio o del pase de\ningreso a las instalaciones del muelle por 15 días la primera vez.\n\nc)  Con la anulación total de la prestación de los servicios o del\npase o permiso de entrada a las instalaciones del muelle\n\n \n\nArtículo 64.-Cualquier servicio o normativa\nque escape a este Articulado será cubierto por el Reglamento General de\nServicios Portuarios de INCOP.\n\n \n\nArtículo 65.-Toda la Reglamentación aprobada\npor la Junta Directiva del INCOP será aplicable al Muelle de Puerto Quepos.\n\n TEXT-INDENT: 12pt; mso-margin-bottom-alt: auto\">Artículo\n66.-Este Reglamento deroga al anterior(*).\n\n(*)\n(Nota de Sinalevi: Mediante sesión\nN° 3835 del 9 de mayo de 2013, se indicó derogar este artículo. Furthermore, as established by the\nLaw of the Republic No. 1721 of December 1953, amended by Law No. 4964 of\nMarch 1972, and Law No. 8461, which clarifies that it is the competence of the\nCosta Rican Institute of Pacific Ports (INCOP) to exercise the functions of Port\nAuthority of the Pacific Coast of Costa Rica.\n\nArticle 2º-For the purposes of this set of rules, the following\nconcepts are defined:\n\n \n\nI.N.C.O.P.: Costa Rican Institute of Pacific\nPorts.\n\nFacilities (Instalaciones): All port infrastructure works\nintended to provide any care and facility to vessels and cargo.\n\nVessel (Buque): Any watercraft intended for\nmaritime navigation that is used for the transport of cargo and/or passengers,\ncabotage, or tourism.\n\nG.R.T.: Gross Registered Tonnage of the vessel, is the\ntotal capacity of the ship expressed in tons of 100 cubic feet.\n\nPier (Muelle): Part of the Port's infrastructure,\nintended for the vessel's stay for the purpose of facilitating its\nloading and unloading operations.\n\nClient (Cliente): Any natural or legal person who\nrequests and pays for a service and complies with the rules established by the\nInstitute.\n\nSupplies (Insumos): Each of the factors involved in\nthe production of goods or services.\n\nISPS Code (Código PBIP): International Ship and Port Facility\nSecurity Code.\n\nPFSO (OPIP): Port Facility Security\nOfficer\n\n \n\nArticle 3º-This Regulation shall function as an Appendix to the General\nRegulations of Port Services of INCOP, according to its Article 2.\n\nThe Administration of the Quepos Pier shall take the necessary precautions\nto have the security requirements at the pier that allow it to\nimplement the ISPS Code (Código PBIP); the conditions determined herein shall form\nan integral part of this Regulation.\n\n \n\nArticle 4º-The operating hours of the services provided at\nthe pier shall be defined by the Administration according to convenience and\nneeds, provided that the internal rules that INCOP has\nestablished are respected. However, after 18:00 hours (6:00 p.m.), no\nvehicle may enter the port enclosure, except in the case of a qualified emergency\nor with the due authorization of the Pier Administration.\n\n \n\nArticle 5º-The Administration of the Puerto Quepos Pier may\nreserve the right not to provide or to suspend services to those\nclients who are not up to date with their obligations or who fail to comply with\nthe provisions of this Regulation, or when internal or external conditions\ndetermine any probable danger to human health.\n\n \n\nArticle 6º-Any damage to the facilities (instalaciones) and equipment owned by INCOP\nor under its administration, caused by third parties, shall be compensated by the\nresponsible party at the real cost of the damage.\n\n \n\nArticle 7º-Clients or private individuals shall not be permitted to leave trash\nor waste inside the pier facilities. These must be\nremoved once the operation is concluded, at the client's expense.\n\n \n\nArticle 8º-Any claim related to the provision of\nservices or their billing must be directed to the Services Comptroller's Office or to the\nPort Operations Management.\n\n \n\nArticle 9º-INCOP workers shall be prohibited from purchasing\nproducts on the vessels. Non-compliance shall result in the corresponding disciplinary\nand legal sanction.\n\n \n\nArticle 10.-The Officers (security\nservice) stationed at the pier shall follow the rules and guidelines\nestablished by the Administration of the Puerto Quepos Pier or, in effect,\nthe person in charge of Port Security (Port Facility\nSecurity Officer, PFSO (Oficial Protección de las Instalaciones Portuarias)).\n\n \n\nArticle 11.-No vessel may use the\nberthing fender without the due authorization of the Pier Administration.\n\n \n\nArticle 12.-The Administration of the Quepos\nPier reserves the right to designate the berthing order of the vessels or\nlimit their stay at the pier, when this is required for operational\nreasons.\n\n \n\nArticle 13.-No vessel shall be berthed,\nunberthed, or moved from its berth without the authorization of the Administration\nof the Puerto Quepos Pier.\n\n \n\nArticle 14.-Vessels shall be attended\nfollowing the order of arrival, provided that the pier facilities\nor the users and officials stationed at it are not exposed to danger.\n\n \n\nArticle 15.-Any vessel that is not going to work\nimmediately after its arrival at the pier shall lose its berthing right,\nas well as those that, being anchored and whose turn for berthing corresponds, do not\ndo so.\n\n \n\nArticle 16.-Any vessel that endangers or\ndamages the pier facilities shall not be berthed.\n\n \n\nArticle 17.-The captain or the person in charge of each\nvessel shall ensure that their watercraft is ready to unberth or change\nlocation, when in the judgment of the Pier Administration it is necessary to do so.\n\n \n\nArticle 18.-Once operations are completed, every\nvessel must vacate the berth immediately.\n\n \n\nArticle 19.-In the case of vessels that do not meet\nthe conditions required by the Pier Administration for the safety of its\nfacilities or personnel, operations may be suspended or not initiated\nuntil the anomalies are corrected or until the person in charge of the Pier or the Port Facility Security\nOfficer (PFSO, OPIP) rules on the matter.\n\n \n\nArticle 20.-In the event of fire or any other\naccident of imminent danger on board, the vessel must be unberthed immediately.\n\n \n\nArticle 21.-The Pier Administration\nmay order the suspension of work and the unberthing of a vessel when\nit considers that the manner and conditions of work harm the operations at the\nPuerto Quepos Pier, the service to other vessels, or damage in any way\nthe pier facilities.\n\n \n\nArticle 22.-The embarkation or disembarkation of\npassengers from pleasure and tourist boats shall be at the own risk of\nthose in charge of said activity.\n\n \n\nCHAPTER II\n\n \n\nDescription of\nServices\n\n \n\n \n\nArticle 23.-Every service provided at\nthe facilities of the Puerto Quepos Pier shall be subject to the regulations\nand tariff provisions.\n\n \n\nArticle\n24.-The tariff structure shall comprise the following services:\n\n MARGIN-LEFT: 24pt\" class=\"Pa61\">a)\nStay (Estadía): Corresponds to the occupation that the vessel makes of the pier\nwhile berthed. \n\nTariff\nunit: Meter of length-hour or fraction.\n\nDescription\nof services:\n\n1)\nSport or recreational fishing vessels.\n\n2)\nArtisanal fishing vessels.\n\n3)\nYachts and pleasure boats.\n\n4)\nCommercial vessels.\n\n5)\nCruise ships.\n\nb)\nWharfage (Muellaje): Consists of the use that the cargo makes of the\npier facilities in transit from or to the vessel. \n\nTariff\nunit: Metric ton or fraction.\n\nc)\nSupply of supplies (insumos): This service consists of provisioning\nsupplies to pier users.\n\n1)\nFuel.\n\nTariff\nunit: Metric ton (MT).\n\n2)\nGeneral Cargo (any cargo including water).\n\nTariff\nunit: Metric ton (MT).\n\n \nd) Vehicle entry to the pier facilities: Every vehicle\nentering the pier facilities must pay its toll, and also\ncomply with the current regulations and what is indicated in Articles 27, 28, and 29 of\nthis regulation.\n\nTariff\nunit: Vehicle.\n\n \ne) Passenger embarkation and disembarkation: Passengers disembarking or\nboarding cruise ships must pay for the use of the facilities.\n\nTariff\nunit: Per person\n\n \nf) Passengers in transit: Passengers boarding or disembarking\npleasure boats, tourist boats, and cruise ships must pay for the use of the\nfacilities.\n\nTariff\nunit: Per person.\n\n \ng) Anchoring of vessels in the roadstead (rada): Positioning of a vessel in\nwaters established for anchoring.\n\nTariff\nunit: The G.R.T. according to the tariff structure.\n\nh)\nPier cleaning: Consists of cleaning the pier occupied by\nvessels and the facilities affected by the operation of said vessel. This\nservice shall be provided by the provider of the cargo service at all\nberths with personnel contracted for cleaning. Its tariff is per\nmetric ton embarked and/or disembarked.\n\ni)\nAny other service offered mainly to large vessels shall be governed by the General Regulations of Port Services of INCOP and its\ntariff provisions.\n\n(Thus amended the preceding Article\n24) through session No. 3835 of May 9, 2013)\n\nCHAPTER III\n\n \n\nOn the Entry and Stay of\nPersons and Vehicles at the Facilities of the Puerto Quepos\nPier\n\n \n\n \n\nArticle 25.-The control of entry, exit, and\nstay of persons and vehicles within the pier facilities shall be\ngoverned by what this article indicates, and in the case of circumstances not\ncovered, the legal and regulatory provisions that\nINCOP has established shall also govern.\n\n \n\nArticle\n26.-Entry and stay within the\npier facilities shall only be permitted for the following persons:\n\n MARGIN-LEFT: 24pt\" class=\"Pa61\">a)\nOfficials or employees of INCOP, duly identified.\n\nb)\nVessel employees or persons who, by reason of work, must remain\nwithin the facilities, provided they are duly identified\nwith their pass.\n\nc)\nTourists who must board a vessel of a tour operator that provides\nservices from the pier.\n\nd)\nThose authorized by the Pier Administrator. \n\n (Thus amended the preceding Article 26)\n through session No. 3835 of May 9, 2013)\n\nArticle 27.-Drivers of vehicles within the facilities\nof the pier must:\n\n \n\na) Travel on the lanes indicated for that purpose.\n\nb) Respect the indicated speed limit.\n\nc) Park in the places indicated for that purpose.\n\nd) Turn off the engine while loading or unloading takes place.\n\ne) Not carry out repairs, and in case of breakdowns, they must be\nremoved from the pier facilities immediately.\n\nf) Not stay more than 15 minutes at the Pier\nfacilities, provided that some loading or unloading task is being carried out.\n\n \n\nArticle 28.-Every driver, client, and\nany other person must refrain from reckless or dangerous acts within\nthe Pier facilities that may cause accidents or expose the\nhealth of persons.\n\n \n\nArticle 29.-At the vehicular access, all vehicles entering and leaving shall be inspected visually and physically when warranted; in the case of\nvehicles with trunks and cargo trucks, observe to verify if they are coming to\npick up or bring products or provisions; if alcohol consumption is observed inside\nthe vehicle, inform them that they must dispose of it before entry; if\nthe vehicle driver is observed in an apparent state of intoxication, deny them\naccess and inform the PFSO (OPIP) or the Administration immediately.\n\n \n\nArticle 30.-Vehicle entry is\nprohibited, except in the following cases:\n\n \n\na) All vehicles owned by INCOP or under its\nadministration.\n\nb) Private vehicles authorized by the Executive Presidency,\nGeneral Management of INCOP, or the Pier Administration and the\nPort Facility Security Officer (Protección de las instalaciones Portuarias).\n\nc) Any vehicle that has paid its toll and whose business is\nat the pier. (In the case of water transport operators, shipping\nagencies, they shall pay the toll ticket only once provided\nthey are entering for administrative support tasks related to the service provided to them, and not\nwhen transporting tourists. The application shall be for only one vehicle per\noperator).\n\n \n\nArticle\n31.-The consumption of alcoholic beverages within\nthe port facilities is strictly prohibited. Likewise, no person who\nis in an apparent state of intoxication may enter.\n\n(Thus amended the preceding Article\n31) through session No. 3835 of May 9, 2013)\n\nArticle 32.-The entry of persons to the\nport enclosure shall be made through the main entrance where the guard booth is,\nand a visual and physical inspection, when warranted, of all\nhand-carried or back-carried packages (backpacks, bags, coolers,\nsuitcases, among others) shall be carried out; in this location, they shall identify themselves to the\nsecurity unit.\n\n \n\nArticle\n33.-All persons entering, with the exception of Institution officials or\nemployees stationed at the Quepos Pier, must indicate\nto the officer the reasons for their visits to the pier.\n\n (Thus amended the preceding Article 33)\n through session No. 3835 of May 9, 2013)\n\nArticle\n34.-Every person linked to the activity within the pier must obtain\na pass to be able to enter its facilities.\n\nThere are\nthree types of passes:\n\n MARGIN-LEFT: 24pt\" class=\"Pa61\">a)\nCrew members (Tripulantes).\n\nb)\nOwners or administrators of vessels.\n\nc)\nTemporary (Temporales).\n\n (Thus amended the preceding Article 34)\n through session No. 3835 of May 9, 2013)\n\nArticle\n35.-Temporary passes shall be granted to occasional workers of the\nusers who must constantly perform tasks within the\npier facilities, which shall be issued based on a note signed by the owner(s) of the vessels for whom they work.\n\n(Thus amended the preceding Article\n35) through session No. 3835 of May 9, 2013)\n\nArticle\n36.-Passes for crew members shall be granted according to what is stipulated in the\nnavigability certificate of the vessel and must contain the name of the\nvessel.\n\n (Thus amended the preceding Article 36)\n through session No. 3835 of May 9, 2013)\n\nArticle\n37.-All passes must bear a recent photograph of the owner,\na registration number, and must also indicate the expiration date.\n\n(Thus amended the preceding Article\n37) through session No. 3835 of May 9, 2013)\n\nArticle 38.-Upon entering the\npier facilities, every person must hand over their pass at the entry post\n(card or badge) to the security officer, which shall be returned to them upon\nexit; they must also comply with the provisions given in this chapter.\n\n \n\nArticle 39.-When a person has lost their card, they must\nreport it to the Pier Administration, which shall process the issuance\nof a new card, prior to the presentation of a photocopy of the\nidentity card and the respective passport-size photograph.\n\n \n\nArticle 40.-The Administration of the Puerto Quepos\nPier shall keep the control and record of the passes granted, together\nwith the port security officer (PFSO, OPIP).\n\n \n\nArticle 41.-A pass granted to a person\ndoes not authorize the entry of their private vehicle, which shall be under another\nregulation.\n\n \n\nArticle 42.-The Pier Administration and the\nPort Security Officer of Puerto Quepos may deny the entry\npermit to persons who do not comply with the provisions of this chapter.\n\n \n\nCHAPTER IV\n\n \n\nOn the Supply of Supplies (insumos)\n\n \n\n \n\nArticle 43.-All those supply services\nfor supplies (insumos) provided to vessels that use the facilities\nof the Quepos Pier must be covered by the regulations for natural\nand legal persons providing services or supplies to vessels arriving at\nports administered by INCOP, and consequently subject to the\napplication of the Fee (Canon) required by Article 5 of the cited Regulations.\n\n \n\nArticle 44.-The sale of fuel,\ndrinking water, electrical power, and other supplies at said pier shall be carried out\nsolely by the personnel designated by the supplying company for that purpose.\n\n \n\nArticle 45.-The Administration of the Puerto Quepos Pier shall define the\nhours and mode of operation for the sale of supplies, provided it does not\ninterfere with the rules of this Regulation or those of the Institution.\n\n \n\nArticle\n46.-Vehicles that are to provide the supply of fuel,\nprovisions (ice, food, or others) must pay the respective\ntoll ticket, and their stay within the pier shall be adjusted to the time\nnecessary for the development of the activity that generated their entry; therefore,\nimmediately upon finishing their task, they must leave the restricted area\n(pier).\n\n (Thus amended the preceding Article 46)\n through session No. 3835 of May 9, 2013)\n\nArticle 47.-Entry to the pier (restricted area)\nshall not be permitted for those vehicles whose owners are employees of the\nQuepos Pier Terminal or those belonging to crew members\nof vessels carrying out activities at the pier, which\nmust remain outside the restricted area. Upon violation of this condition,\na formal notification shall be made regarding the corrective measures that would be applied,\nand in the case of a repeat offender, entry to the port enclosure of the\ninfringing vehicle shall be denied.\n\n \n\nArticle 48.-Under no circumstances shall\nentry to the port enclosure be permitted for more than three vehicles (cars,\nminibuses, microbuses, or taxis), according to the arrival of the vessel that will carry out\nthe service. For this purpose, the vessels' representatives must\ncoordinate the pertinent arrangements with the INCOP official stationed at the\npier access gate, ensuring adequate and safe order for\npersons, vehicles, and pier infrastructure.\n\n \n\n \n\nCHAPTER V\n\n \n\nOn the Use and Handling of\nMachines\n\n \n\n \n\nArticle 49.-All machinery used at\nthe pier facilities shall be under the strict supervision of the\nAdministration and shall have the respective civil liability insurance.\n\n \n\nArticle 50.-It is prohibited for any worker to operate or use\nequipment without authorization from the Pier Administration, as well as to open or\nclose valves, electricity switches, gas, steam, air, etc., and if\nthey are authorized to do so, they must ensure that their action does not endanger\nother persons.\n\n \n\nArticle 51.-It is prohibited for any worker to wear\nopen shirts and other objects such as chains, bracelets, or any type of\npersonal accessories and clothing that could be caught by moving machinery (cranes,\nforklifts, etc.) or snagged by cargo handling devices.\n\n \n\nArticle 52.-The service of any machine\nfor cargo handling shall be regulated by a tariff structure in\nwhich the charge to be levied is established.\n\n \n\nCHAPTER VI\n\n \n\nOn Invoicing and Collection of\nServices\n\n \n\n \n\nArticle 53.-Every client, regardless of their\nclass, who needs the services provided at the pier or in any way\nuses the facilities or amenities provided, must request them in\nwriting and at least 48 hours in advance.\n\nSaid request must clearly indicate the identification of the\nservice requested, under a presentation format which shall contain, among\nother things, the name of the requester, identity card number, description of the\nservices requested, and vessel data.\n\nThe request shall be signed by the client or their representative,\npreviously accredited as such before the Administration of the Quepos Pier,\nfor which purpose the latter shall keep a registry of the signatures of persons empowered by\nthe user to assume the responsibilities implied by the provision of the service.\n\n \n\nArticle 54.-The interested party, upon submitting the\nservice request, shall do so before the Pier Administration, which\nmust authorize, channel, and expedite the corresponding procedures.\n\n \n\nArticle 55.-In addition to the service request, the user must\ndeposit the estimated value of the required services, or make\na prior deposit, the amount of which shall be established by the Pier\nAdministration, in accordance with the average quantity of services and passengers that\nthe vessels handle in a period of two weeks. However, when the deposit\nbalance reaches an amount sufficient for at least two services, they must again pay the\ndifference in order to renew the corresponding deposit.\n\n \n\nArticle 56.-The official designated for the collection of services\nmust deliver to the person designated by the Administration the\ndaily collected amount with its due justification (documents, vouchers);\nthe latter shall make a daily deposit in the banks of the National Banking System to the\naccount of INCOP.\n\nThe person in charge of making the bank deposit shall report every\nbusiness day to the Institution's Accounting Area the income report.\n\n \n\nArticle 57.-The value of the deposit shall be\ncommunicated to the Invoicing Section of the Accounting Area upon\nreceiving the request.\n\nThe amount of the deposit must be paid in cash or certified\nchecks, provided that the General Management of INCOP authorizes the\nPier Administration to receive checks drawn on banks of the National\nSystem.\n\n \n\nArticle 58.-Once the service has been provided, the\nrespective charges shall be presented in an invoice for that purpose. A\nsettlement shall be carried out based on the previously made deposit.\n\n \n\nArticle 59.-If the charge for the\nservices provided exceeds the deposit, the user must immediately pay\nthe corresponding difference; failure to do so allows the Pier\nAdministration to suspend or cancel services in the future.\n\nIf the settlement balance results in a credit for the user, the amount shall\nbe credited for application to future services.\n\n \n\n \n\nCHAPTER VII\n\n \n\nFinal Provisions\n\n \n\n \n\nArticle 60.-In case of doubt regarding the\ninterpretation of this Regulation, it shall correspond to the Board of Directors of INCOP\nto correctly interpret the contained provisions.\n\n \n\nArticle 61.-For any vessel that does not comply with\nthe provisions stipulated in this Regulation, the Pier Administration shall\ndeny the permit to berth at said pier.\n\n \n\nArticle 62.-The provisions contemplated\nmust be strictly observed by all INCOP workers and\nprivate individuals who make use of the pier facilities or who, for reasons of\nvisit or work, transit or remain within them.\n\n \n\nArticle 63.-INCOP workers who do not\ncomply with the rules of this article shall be sanctioned as provided by the\nAutonomous Service Regulations of the Institution and the respective legislation.\n\nAs for the clients of the pier facilities\nwho fail to comply with the provisions established herein, they shall receive the following\nsanctions:\n\na) A written warning, if they are not a repeat offender; this applies\nin minor cases.\n\nb) Suspension of the service provision or the entry pass\nto the pier facilities for 15 days the first time.\n\nc) Complete cancellation of the service provision or\nthe pass or entry permit to the pier facilities.\n\n \n\nArticle 64.-Any service or regulation\nnot covered by this Article shall be covered by the General Regulations of\nPort Services of INCOP.\n\n \n\nArticle 65.-All regulations approved\nby the Board of Directors of INCOP shall be applicable to the Puerto Quepos Pier.\n\n TEXT-INDENT: 12pt; mso-margin-bottom-alt: auto\">Article\n66.-This Regulation repeals the previous one(*).\n\n(*)\n(Note by Sinalevi: Through session\nNo. 3835 of May 9, 2013, it was indicated to repeal this article.
