  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 34551\n\n                        Delimita el canal en el Estero de Puntarenas\n\nTexto Completo acta: BB8BE\nNº 34551\n\n \n\nNº 34551\n\n \n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nY LA MINISTRA DE OBRAS\nPÚBLICAS Y TRANSPORTES\n\n \n\nEn uso de las facultades que les confieren los\nartículos 140 incisos 3) y 18) y 146 de la Constitución Política, el artículo 2º\ninciso c) de la Ley de Creación del Ministerio de Obras Públicas y Transportes\nNº 4786 del 5 de julio de 1971, Ley Orgánica del Ministerio de Seguridad\nPública Nº 5482 del 24 de diciembre de 1973, Ley del Servicio Nacional de\nGuardacostas Nº 8000 del 5 de mayo del 2000 y la Ley General de la\nAdministración Pública Nº 6227 del 2 de mayo de 1978.\n\n \n\nConsiderando:\n\n \n\n1º-Que la Ley Nº 4786, del 5 de julio de 1971\nconfiere al Ministerio de Obras Públicas y Transportes competencia en lo\nrelativo a la regulación y control del transporte marítimo internacional, de\ncabotaje y por vías de navegación interior.\n\n \n\n2º-Que para reducir el riesgo de percances en la\nlibre navegación en el Estero de Puntarenas que pongan en peligro la seguridad\nde la navegación y la vida humana, y con el fin de reducir los conflictos en\nlas áreas marítimas, se hace necesario definir el canal oficial de navegación\nen el Estero para establecer un ordenamiento en la navegación. \n\n \n\n3º-Que el Estero de Puntarenas ha sido y seguirá\nsiendo una vía de transporte importante para la comunidad Puntarenense y para\nlas actividades comerciales que se desarrollan a su vera.\n\n \n\n4º-Que la navegación por el Estero de Puntarenas\nestá afectada por sus especiales características, principalmente relacionadas\ncon su morfología y configuración, las mareas que determinan los periodos de\nnavegación y el Plan Regulador de la Ciudad de Puntarenas, cuestiones que deben\nser tomadas en cuenta para la definición del Canal Principal de Navegación por\nesa franja marítima.\n\n \n\n5º-Que conforme al inciso 10), del artículo 13,\ndel Plan Regulador de la Ciudad de Puntarenas, publicado en La Gaceta Nº 93,\ndel 16 de mayo del 2006, se solicita al MOPT la delimitación del canal de\nnavegación del mencionado estero. Por tanto,\n\n \n\nDECRETAN:\n\n \n\n \n\nArtículo 1º-Definiciones. A los efectos de la\naplicación del presente Decreto Ejecutivo se aceptan las siguientes\ndefiniciones y términos:\n\n \n\n \n\n1.1.      MOPT: Ministerio de Obras\nPúblicas y Transportes.\n\n1.2.      IGN: Instituto Geográfico\nNacional.\n\n1.3.      Estero: Estero de Puntarenas.\n\n1.4.      Canal: Franja marítima en el Estero de\nPuntarenas, que incluye el canal de navegación y las zonas de seguridad, en la\nque no se permite la permanencia de embarcaciones ni la construcción de\ninfraestructura.\n\n1.5.      Canal natural: Parte más\nprofunda y limpia a lo largo del Estero.\n\n1.6.      Canal de Navegación: Vía de navegación\nmarítima recomendada para el internamiento y salida de embarcaciones en el\nEstero, definida para la navegación en ambos sentidos y subdividida por una\nlínea central imaginaria.\n\n1.7.      Zonas de Seguridad: Franjas externas\nparalelas a ambos lados del Canal de Navegación para la protección de\nembarcaciones que navegan en el Canal.\n\n1.8.      Baliza: Instrumento, aparato o cuerpo que\nse instala en el estero, para advertir un peligro o emitir indicaciones\nprecisas a los navegantes.\n\nArtículo 2º-Objeto. El objeto del presente decreto es la delimitación del\nCanal en el Estero de Puntarenas con el fin de mejorar la seguridad de\nnavegantes y embarcaciones que utilizan esa área marítima, resguardar el\nprincipio de libre circulación que por norma constitucional se establece para\ntoda zona pública y para que sirva como instrumento coadyuvante de la\nMunicipalidad de Puntarenas en la delimitación física, ordenamiento y otorgamiento\na particulares de concesiones de zonas de agua fuera de esa franja marítima, de\nconformidad con el artículo 77, de la Ley Sobre Zona Marítimo Terrestre Nº\n6043.\n\nArtículo 3º-Morfodinámica del Estero. El trazado del Canal que se\nestablece en el presente Decreto corresponde a una configuración cercana a la\ncondición del Canal natural del Estero. La hidrodinámica, transporte de sedimentos\ny procesos de erosión y sedimentación en el Estero tienen gran actividad y no\nestán en equilibrio, por lo que a futuro podría ser necesario modificar los\nlímites del Canal; esto sucederá cuando el MOPT, respaldado en estudios\ntécnicos, lo considere pertinente.\n\nArtículo 4º-Coordenadas de la Línea de Centro del\nCanal. Channel (Canal): Maritime strip in the Estero de Puntarenas, which includes the navigation channel (canal de navegación) and the safety zones (zonas de seguridad), in which the permanence of vessels and the construction of infrastructure are not permitted.\n\n1.5.      Natural channel (Canal natural): The deepest and cleanest part along the Estuary.\n\n1.6.      Navigation Channel (Canal de Navegación): Recommended maritime navigation route for the entry and exit of vessels in the Estuary, defined for navigation in both directions and subdivided by an imaginary center line.\n\n1.7.      Safety Zones (Zonas de Seguridad): External strips parallel to both sides of the Navigation Channel for the protection of vessels navigating in the Channel.\n\n1.8.      Beacon (Baliza): Instrument, apparatus, or body installed in the estuary to warn of a danger or to issue precise indications to navigators.\n\nArticle 2—Purpose. The purpose of this decree is the delimitation of the Channel in the Estero de Puntarenas in order to improve the safety of navigators and vessels using that maritime area, to protect the principle of free movement established by constitutional regulation for all public zones, and to serve as an auxiliary instrument for the Municipality of Puntarenas in the physical delimitation, ordering, and granting to private parties of concessions for water zones outside that maritime strip, in accordance with article 77 of the Law on the Maritime-Terrestrial Zone No. 6043.\n\nArticle 3—Morphodynamics of the Estuary. The layout of the Channel established in this Decree corresponds to a configuration close to the condition of the natural channel (canal natural) of the Estuary. The hydrodynamics, sediment transport, and erosion and sedimentation processes in the Estuary have great activity and are not in equilibrium, so in the future it may be necessary to modify the limits of the Channel; this will occur when the MOPT, supported by technical studies, deems it pertinent.\n\nArticle 4—Coordinates of the Channel Center Line. Navigators are recommended to adopt the following basic rules for safe navigation through the Channel:\n\nTake into account, among others, the following circumstances: the characteristics of the Channel; the characteristics of the vessel; the depth conditions of the Estuary; the tides; the meteorological conditions; and the final destination.\n\nNavigation to starboard (to the right), according to the forward direction of travel.\n\nComply with the rules stipulated in the \"International Regulations for Preventing Collisions at Sea\", in order to reduce the risk of accidents between vessels.\n\nDo not exceed a navigation speed of 22.2 km/hr (12 knots) through the Channel.\n\nArticle 7—Navigational aids. In accordance with the Law Declaring the Urban Zone of the City of Puntarenas No. 4071 and its amendments of January 22, 1968, the Municipality of Puntarenas is responsible for the administration of the Estuary and its adjacent land areas; therefore, said Municipality must carry out the maintenance and dredging work of the Estuary, in addition to taking charge of the maritime signaling of the Channel.\n\nArticle 8—To carry out the dredging tasks of the Estuary and Navigational Aids in the Channel, the Municipality must have prior authorization from the Maritime-Port Division of the MOPT, which, in turn, is empowered by this act to provide the technical assistance needed by the Municipality of Puntarenas for the fulfillment of these objectives.\n\nArticle 9—Updating of the Nautical Chart of the Estuary. It is the responsibility of the IGN to update the Nautical Chart of the Estuary before the end of the current year.\n\nArticle 10.—Effective from its publication.\n\n \n\nGiven at the Presidency of the Republic, on the thirtieth day of April of two thousand eight."
