y el 146 de Constitución Política, el artículo 6 de\nla Ley Orgánica del Ambiente Nº 7554, publicada en\nLa\n Gaceta Nº 215 del 13 de noviembre de\n1995, los artículos 23 y 101 de La Ley de Biodiversidad, Ley Nº 7788,\npublicada en La Gaceta Nº 101, del 27 de mayo de 1998,\ny el artículo 17 de la Ley de Conservación de\nla Vida Silvestre, Nº 7317 y sus reformas,\npublicada en La Gaceta Nº 235 de 7 de diciembre de\n1992, la Convención Interamericana para\nla Protección y Conservación de las Tortugas Marinas, Ley Nº 7906,\npublicada en La Gaceta Nº 186 del 24 de setiembre de\n1999, y la Ley de Protección, Conservación y Recuperación de las\nPoblaciones de Tortugas Marinas, Ley Nº 8325, publicada en\nLa\n Gaceta Nº 230 de 28 de noviembre de\n2002, y\n\nConsiderando:\n\n1º-Que con fundamento en\nla Ley de Conservación de\nla Vida Silvestre, se creó el Refugio Nacional\nde Vida Silvestre Ostional, en los doscientos metros de\nla Zona Marítimo Terrestre, desde Punta India hasta la margen derecha de\nla desembocadura del río Nosara, ampliado mediante Decreto Ejecutivo Nº\n16531-MAG de 18 de julio de 1985, publicado en\nLa\n Gaceta Nº 183 del 26 de setiembre de\n1985, desde la desembocadura del río Nosara hasta el sector de Punta Guiones.\n\n2º-Que posteriormente el Transitorio Primero de\nla Ley de Conservación de\nla Vida Silvestre, ratificó la creación del\nRefugio Nacional de Vida Silvestre Ostional en los doscientos metros de la zona\nmarítimo terrestre que se extiende desde Punta India, cantón de Santa Cruz\nhasta Punta Guiones, cantón de Nicoya de la provincia de Guanacaste.\n\n3º-Que el Decreto Ejecutivo Nº 22551-MIRENEM del 14 de\nsetiembre de 1993, publicado en La Gaceta Nº 193 del 8 de octubre de 1993,\nincorporó dentro de los límites de protección del Refugio Nacional de Vida\nSilvestre Ostional, el sector de las aguas costeras en una franja de tres\nmillas marítimas.\n\n4º-Que dentro del Refugio Nacional de Vida Silvestre\nOstional, en el territorio de 200 metros que se extiende desde Punta\nIndia hasta Punta Guiones, se ha comprobado mediante diversos censos efectuados\npor el Área de Conservación Tempisque y\nla\n Universidad de Costa Rica, que existen propietarios de terrenos privados.\n\n5º-Que dentro de los límites del Refugio Nacional de Vida\nSilvestre de Ostional, existen recursos biológicos y paisajísticos únicos que\nnecesitan una protección y un aprovechamiento sostenible.\n\n6º-Que el artículo 6 de\nla Ley Orgánica del Ambiente, establece el deber del Estado de fomentar\nla participación activa y organizada de los habitantes de\nla República, en la toma de decisiones y acciones tendientes a\nproteger y mejorar el ambiente, a través de instancias regionales y locales con\namplia intervención de la sociedad civil, en coordinación con las instituciones\npúblicas y privadas, a fin de que fomenten un manejo racional de los recursos\nnaturales.\n\n7º-Que el artículo 101 de\nla Ley de Biodiversidad, estableció\nel deber de incentivar la participación de las comunidades en la conservación y\nel uso sostenible de la diversidad biológica, mediante la asistencia técnica y\nlos incentivos legales correspondientes, especialmente en áreas donde haya\nidentificado especies en peligro de extinción, endémicas o raras.\n\n8º-Que se hace necesario establecer los mecanismos para\nasegurar la coordinación interinstitucional en el Refugio Nacional de Vida\nSilvestre Ostional, promoviendo un proceso de coordinación en la toma de\ndecisiones para el manejo del mismo, en procura de incentivar la participación\nde la población civil, de modo que las acciones propuestas resulten efectivas,\nsin perjuicio de las competencias asignadas, a las diferentes entidades y\ngrupos involucrados en la ejecución de las acciones propuestas. Por tanto,\n\nDecretan:\n\nCREACIÓN DEL CONSEJO\nINTERINSTITUCIONAL ASESOR\n\nDEL REFUGIO NACIONAL DE VIDA\nSILVESTRE\n\nOSTIONAL (CIMACO)\n\nArtículo 1º-Créase el Consejo Interinstitucional asesor\ndel Refugio Nacional de Vida Silvestre Ostional, en adelante denominado CIMACO,\nque estará constituido por los siguientes representantes fundadores:\n\n1.  Un representante de\nla Asociación de Desarrollo Integral de Ostional (ADIO) designado por\nsu Junta Directiva.\n\n2.  Un representante de la comunidad de Ostional,\nelegido en una asamblea del pueblo.\n\n3.  Un representante de los Guías locales\nacreditados de Ostional, elegido en asamblea de los guías acreditados.\n\n4.  Un representante de\nla Asociación de Desarrollo de Nosara, designado por su Junta\nDirectiva.\n\n5.  Un representante del Consejo Local de Nosara -\nPelada - Guiones, designado por su Junta Directiva.\n\n6.  Un representante de\nla Asociación Cívica de Nosara, designado por su\nJunta Directiva.\n\n7.  Un representante de\nla Asociación de vecinos del sector de Guiones Sur, designado por su\nJunta Directiva.\n\n8.  Un representante de\nla Asociación de Vecinos de Playa Pelada, designado por su Junta\nDirectiva.\n\n9.  Un representante de\nla\n Municipalidad de Nicoya, designado por el Concejo Municipal.\n\n10.   Un representante de\nla\n Municipalidad de Santa Cruz, designado por el Concejo Municipal.\n\n11.   Un representante de los pescadores de\nPeladas y Guiones, elegido en una asamblea de pescadores de ambas comunidades.\n\n12.   Un representante de los pescadores de San\nJuanillo, designado por su Junta Directiva.\n\n13.   Un representante del INCOPESCA, designado\npor la Dirección correspondiente.\n\n14.   Un representante de\nla\n Escuela de Biología de la Universidad de Costa Rica, designado por\nla Dirección de la Escuela.\n\n15.   Dos representantes del Área de\nConservación Tempisque, designados por el Director del Área.\n\nLos representantes propietarios y suplentes del Consejo\nasumirán su cargo en la primera reunión del mismo y permanecerán en él durante\nel tiempo en que cada entidad que representa, así lo disponga.\n\nArtículo 2º-Para ser representante de CIMACO se requerirá\nser nombrado por acuerdo de cada institución o asociación.\n\nEl CIMACO podrá modificar el número de sus\nrepresentantes, cuando sea aprobado mediante las dos terceras partes de sus\nrepresentantes, previo cumplimiento del reglamento que para tal efecto se\nestablecerá en un plazo no mayor de seis meses después de su creación.\n\nArtículo 3º-El objetivo principal de CIMACO será\nconsolidar e incentivar la participación de las comunidades en la conservación,\nuso y manejo sostenible y responsable de los recursos naturales del Refugio\nNacional de Vida Silvestre Ostional y su área de influencia, según lo\nestablezca el plan de manejo. Las actividades que se realicen dentro del\nRefugio Nacional de Vida Silvestre Ostional podrán ser analizadas desde este\nConsejo, el cual deberá recomendar decisiones congruentes con el objetivo\nplanteado; excepto las relacionadas con servicios no esenciales según el\nartículo 39 de la Ley de Biodiversidad.\n\nArtículo 4º-Las sesiones de CIMACO se celebrarán en el\nRefugio Nacional de Vida Silvestre Ostional, donde tendrán su asiento. Sin\nembargo, podrán realizarse en otros lugares del país, cuando el presidente las\nconvoque con tres días de antelación, cuando lo exijan razones especiales.\n\nEl quórum de cada sesión estará constituido por la mitad\nmás uno de los representantes vigentes, quienes tomarán los acuerdos por\nmayoría simple. Cuando por la urgencia de un tema así se requiera, se podrán\ntomar acuerdos por ad referendum, es decir por consulta.\n\nEl CIMACO elaborará un reglamento interno donde se\nestablezcan las normas de su operación. Este deberá ser aprobado por el Consejo\nRegional del Área de Conservación Tempisque, creado mediante el artículo 7 de\nla Ley Orgánica del Ambiente Nº 7554, publicada en\nLa\n Gaceta Nº 215 de 13 de noviembre de\n1995. Este deberá presentarse en un plazo de tres meses contados a partir de la\npublicación del presente decreto.\n\nArtículo 5º-El CIMACO tendrá las siguientes funciones:\n\na.   Brindar apoyo al\ncumplimiento de las disposiciones técnicas, científicas y las recomendaciones o\nnormas para la conservación, uso y manejo sostenible y responsable de los\nrecursos naturales y la biodiversidad en el Refugio Nacional de Vida Silvestre\nOstional y su área de influencia.\n\nb.  Participar activamente en el diseño, gestión y\nseguimiento de las actividades y políticas para el manejo del Refugio Nacional\nde Vida Silvestre Ostional.\n\nc.   Recomendar al Área de Conservación\nTempisque, la aprobación de los diferentes planes de acción que se requieran\npara los fines de investigación, educación, protección, control y el\naprovechamiento sostenible de los recursos naturales.\n\nd.  Velar por el adecuado funcionamiento y calidad\nde los servicios que se presten en el Refugio Nacional de Vida Silvestre\nOstional.\n\ne.   Colaborar con la aplicación de las normas\nbásicas de conservación, uso y manejo sostenible y responsable de los recursos\nnaturales, así como aspectos que\nla Administración del Refugio Nacional de Vida\nSilvestre Ostional requiera.\n\nf.   Proponer y fomentar al Área de\nConservación Tempisque y a la Administración del Refugio Nacional de Vida\nSilvestre Ostional, políticas para la conservación, uso y manejo responsable de\nlos recursos naturales.\n\ng.   Promover la generación de recursos y\nfondos para los fines que procura el Refugio Nacional de Vida Silvestre\nOstional, a través de proyectos, donaciones, convenios y alianzas, entre otros,\na través de las organizaciones aquí representadas. Los recursos generados\nestarán sometidos a la fiscalización de\nla Contraloría General de\nla República, los cuales serán administrados y depositados en el\nFondo de Vida Silvestre.\n\nArtículo 6º-Los puestos de CIMACO que se asignarán serán:\n\na)  Presidente(a). Puesto\nque ejercerá el representante del Área de Conservación Tempisque.\n\nb)  Vicepresidente(a).\n\nc)  Secretario(a).\n\nd)  Tesorero(a).\n\ne)  Tres vocales.\n\nf)   Un Fiscal.\n\nLo puestos serán ocupados por dos años, con la\nposibilidad de ser reelecto. El mecanismo de elección será establecido en el\nreglamento.\n\nArtículo 7º-CIMACO contará además con:\n\nUna Secretaría Ejecutiva que corresponderá al\nAdministrador del Refugio Nacional de Vida Silvestre Ostional, la cual contará\ncon el apoyo del secretario(a) de CIMACO y será el órgano ejecutor de los\nacuerdos tomados.\n\nArtículo 8º-Los representantes de CIMACO tendrán las\nsiguientes funciones:\n\na)  Reunirse mensualmente\nde forma ordinaria, según el calendario que se establezca anualmente. De manera\nextraordinaria, se podrán convocar sesiones cuando el Presidente o el Fiscal\nasí lo soliciten, o por solicitud escrita de la mayoría de los representantes,\nsiempre con al menos ocho días naturales de anticipación.\n\nb)  Mantener una adecuada coordinación con\nla Administración del Refugio Nacional de Vida\nSilvestre Ostional y los funcionarios del Área de Conservación Tempisque y el\nCIMACO.\n\nc)  Nombrar un representante para la asamblea anual\ndel Consejo Regional del Área de Conservación Tempisque.\n\nd)  Ejercer la representación de CIMACO ante los\ndemás entes públicos o privados, cuando el CIMACO así lo requiera.\n\nArtículo 9º-El Presidente tendrá las siguientes\nfunciones:\n\na)  Presidir las sesiones\nde CIMACO.\n\nb)  Representar a CIMACO ante cualquier ente público\no privado, cuando el Consejo así lo solicite.\n\nc)  Elaborar la agenda de trabajo.\n\nd)  Moderar con apertura y bajo los principios\ndemocráticos las sesiones del Consejo.\n\ne)  Fomentar la participación de todos sus\nrepresentantes.\n\nf)   Participar en reuniones con las\ncomunidades en los diferentes sectores del Refugio Nacional de Vida Silvestre\nOstional, cuando así se le requiera.\n\ng)  Firmar las actas una vez aprobadas conjuntamente\ncon el secretario(a).\n\nh)  Presentar ante CIMACO un informe anual de\nlabores, sin detrimento de aquellos que le requieran este Consejo.\n\ni)   Promover el cumplimiento de las funciones\nestablecidas en el artículo 5.\n\nArtículo 10.-El Vicepresidente tendrá como función suplir\nal presidente en su ausencia, para lo cual tendrá todas las facultades y\ncompetencias del mismo.\n\nArtículo 11.-Son funciones del Secretario(a) de CIMACO\nlas siguientes:\n\na)  Levantar las actas de\nlas sesiones y hacerlas llegar a sus representantes a través de los medios\nidóneos, con al menos 15 días naturales de anticipación a la siguiente sesión\nordinaria.\n\nb)  Manejar la correspondencia de CIMACO.\n\nc)  Llevar un archivo con toda la documentación de\nCIMACO.\n\nd)  Firmar en forma conjunta con el presidente las\nactas aprobadas.\n\ne)  Coordinar con el Secretario Ejecutivo todo lo\nrelacionado con actas y correspondencia.\n\nArtículo 12.-Son funciones del Tesorero las siguientes:\n\na)  Promover la gestión de\nrecursos económicos para la implementación de acciones contempladas dentro del\nPlan de Manejo del Refugio Nacional de Vida Silvestre Ostional, a través de las\ninstancias que correspondan.\n\nb)  Rendir los informes de trabajo que se le\nrequieran.\n\nc)  Coordinar con las instancias que correspondan,\nla ejecución de los recursos puestos a disposición de CIMACO.\n\nd)  Implementar los mecanismos necesarios para el\nadecuado cumplimiento de sus funciones.\n\nArtículo 13.-Es función de los vocales, sustituir a\ncualquiera de los representantes con funciones administrativas dentro del\nConsejo.\n\nArtículo 14.-\nLa Fiscalía tendrá las siguientes funciones:\n\na)  Velar por el buen\nfuncionamiento de CIMACO y el cumplimiento de este decreto.\n\nb)  Fiscalizar el buen funcionamiento de\nla Secretaría Ejecutiva.\n\nc)  Presentar informes semestrales sobre\nactividades.\n\nd)  Estar presente en las sesiones de CIMACO.\n\nArtículo 15.-Los suplentes tendrán como funciones:\n\na)  Sustituir a los\nrespectivos propietarios, cuando así se requiera.\n\nb)  Asistir a las reuniones siempre que les sea\nposible.\n\nc)  Formar parte de CIMACO y participar en las\ncomisiones de trabajo que se les asigne.\n\nArtículo 16.-\nLa Secretaría Recovery of\nSea Turtle Populations, Law No. 8325, published in\nLa Gaceta No. 230 of November 28,\n2002, and\n\nWhereas:\n\n1º-That based on\nthe Wildlife Conservation Law, the Ostional National Wildlife\nRefuge was created, within the two hundred meters of\nthe Maritime Terrestrial Zone, from Punta India to the right bank of\nthe mouth of the Nosara River, expanded by Executive Decree No.\n16531-MAG of July 18, 1985, published in\nLa Gaceta No. 183 of September 26,\n1985, from the mouth of the Nosara River to the Punta Guiones sector.\n\n2º-That subsequently the First Temporary Provision of\nthe Wildlife Conservation Law, ratified the creation of the\nOstional National Wildlife Refuge within the two hundred meters of the maritime\nterrestrial zone extending from Punta India, canton of Santa Cruz\nto Punta Guiones, canton of Nicoya of the province of Guanacaste.\n\n3º-That Executive Decree No. 22551-MIRENEM of September 14,\n1993, published in La Gaceta No. 193 of October 8, 1993,\nincorporated within the protection boundaries of the Ostional National Wildlife\nRefuge, the coastal waters sector in a strip of three\nmaritime miles.\n\n4º-That within the Ostional National Wildlife Refuge,\nin the 200-meter territory extending from Punta\nIndia to Punta Guiones, it has been verified through various censuses conducted\nby the Tempisque Conservation Area (Área de Conservación Tempisque) and\nthe University of Costa Rica, that there are private landowners.\n\n5º-That within the boundaries of the Ostional National Wildlife\nRefuge, there are unique biological and scenic resources that\nneed protection and sustainable use.\n\n6º-That Article 6 of\nthe Organic Law of the Environment establishes the State's duty to promote\nthe active and organized participation of the inhabitants of\nthe Republic in decision-making and actions aimed at\nprotecting and improving the environment, through regional and local bodies with\nbroad involvement of civil society, in coordination with public\nand private institutions, in order to promote rational management of natural\nresources.\n\n7º-That Article 101 of\nthe Biodiversity Law established\nthe duty to encourage the participation of communities in the conservation and\nsustainable use of biological diversity, through technical assistance and\nthe corresponding legal incentives, especially in areas where\nendangered, endemic, or rare species have been identified.\n\n8º-That it is necessary to establish mechanisms to\nensure interinstitutional coordination in the Ostional National Wildlife\nRefuge, promoting a decision-making coordination process for its management,\nseeking to encourage the participation of the civilian population, so that the proposed actions\nare effective, without prejudice to the competencies assigned to the different entities and\ngroups involved in the execution of the proposed actions. Therefore,\n\nThey Decree:\n\nCREATION OF THE INTERINSTITUTIONAL ADVISORY\nCOUNCIL\n\nOF THE OSTIONAL NATIONAL WILDLIFE\nREFUGE\n\n(CIMACO)\n\nArticle 1-The Interinstitutional Advisory Council\nof the Ostional National Wildlife Refuge, hereinafter referred to as CIMACO,\nis created, which shall be constituted by the following founding representatives:\n\n1.  A representative of\nthe Ostional Integral Development Association (Asociación de Desarrollo Integral de Ostional, ADIO) appointed by\nits Board of Directors.\n\n2.  A representative of the community of Ostional,\nelected in a town assembly.\n\n3.  A representative of the accredited Local Guides\nof Ostional, elected in an assembly of accredited guides.\n\n4.  A representative of\nthe Nosara Development Association, appointed by its Board of\nDirectors.\n\n5.  A representative of the Local Council of Nosara -\nPelada - Guiones, appointed by its Board of Directors.\n\n6.  A representative of\nthe Nosara Civic Association, appointed by its\nBoard of Directors.\n\n7.  A representative of\nthe Neighbors Association of the Guiones Sur sector, appointed by its\nBoard of Directors.\n\n8.  A representative of\nthe Playa Pelada Neighbors Association, appointed by its Board of\nDirectors.\n\n9.  A representative of\nthe Municipality of Nicoya, appointed by the Municipal Council (Concejo Municipal).\n\n10.   A representative of\nthe Municipality of Santa Cruz, appointed by the Municipal Council (Concejo Municipal).\n\n11.   A representative of the fishermen of\nPeladas and Guiones, elected in an assembly of fishermen from both communities.\n\n12.   A representative of the fishermen of San\nJuanillo, appointed by their Board of Directors.\n\n13.   A representative of INCOPESCA, appointed\nby the corresponding Directorate.\n\n14.   A representative of\nthe School of Biology of the University of Costa Rica, appointed by\nthe School's Directorate.\n\n15.   Two representatives of the Tempisque\nConservation Area, appointed by the Area Director.\n\nThe full representatives and alternate representatives of the Council\nshall assume their positions at the Council's first meeting and shall remain in them during\nthe time that each entity they represent so determines.\n\nArticle 2-To be a representative of CIMACO, it shall be required\nto be named by agreement of each institution or association.\n\nCIMACO may modify the number of its\nrepresentatives, when approved by two-thirds of\nits representatives, upon compliance with the regulation that for such purpose\nshall be established within a period of no more than six months after its creation.\n\nArticle 3-The primary objective of CIMACO shall be to\nconsolidate and encourage the participation of communities in the conservation,\nuse, and sustainable and responsible management of the natural resources of the Ostional National\nWildlife Refuge and its area of influence, as established by the management plan (plan de manejo). The activities carried out within the\nOstional National Wildlife Refuge may be analyzed by this\nCouncil, which must recommend decisions consistent with the stated objective;\nexcept those related to non-essential services according to\nArticle 39 of the Biodiversity Law.\n\nArticle 4-The meetings of CIMACO shall be held in the\nOstional National Wildlife Refuge, where they shall have their seat. However,\nthey may be held in other places in the country, when the president\nconvenes them with three days' notice, when special reasons so require.\n\nThe quorum for each meeting shall be constituted by half\nplus one of the current representatives, who shall adopt agreements by\nsimple majority. When the urgency of a matter so requires, agreements may be adopted\nby ad referendum, that is, by consultation.\n\nCIMACO shall draft an internal regulation establishing\nthe rules for its operation. This must be approved by the Regional\nCouncil of the Tempisque Conservation Area, created by Article 7 of\nthe Organic Law of the Environment No. 7554, published in\nLa Gaceta No. 215 of November 13,\n1995. This must be submitted within a period of three months counted from the\npublication of this decree.\n\nArticle 5-CIMACO shall have the following functions:\n\na.   Provide support for the\nfulfillment of technical and scientific provisions and recommendations or\nstandards for the conservation, use, and sustainable and responsible management of\nnatural resources and biodiversity in the Ostional National Wildlife\nRefuge and its area of influence.\n\nb.  Actively participate in the design, management, and\nmonitoring of activities and policies for the management of the Ostional National\nWildlife Refuge.\n\nc.   Recommend to the Tempisque Conservation\nArea the approval of the different action plans required\nfor research, education, protection, control, and the\nsustainable use of natural resources.\n\nd.  Ensure the proper functioning and quality\nof the services provided in the Ostional National Wildlife\nRefuge.\n\ne.   Collaborate with the application of basic\nstandards for the conservation, use, and sustainable and responsible management of natural\nresources, as well as aspects that\nthe Administration of the Ostional National Wildlife Refuge requires.\n\nf.   Propose and promote to the Tempisque\nConservation Area and the Administration of the Ostional National Wildlife Refuge policies for the conservation, use, and responsible management of\nnatural resources.\n\ng.   Promote the generation of resources and\nfunds for the purposes pursued by the Ostional National Wildlife\nRefuge, through projects, donations, agreements, and alliances, among\nothers, through the organizations represented herein. The resources generated\nshall be subject to the oversight of\nthe Comptroller General of\nthe Republic (Contraloría General de la República), and shall be managed and deposited in the\nWildlife Fund (Fondo de Vida Silvestre).\n\nArticle 6-The positions of CIMACO to be assigned shall be:\n\na)  President(a). Position\nto be exercised by the representative of the Tempisque Conservation Area.\n\nb)  Vice President(a).\n\nc)  Secretary.\n\nd)  Treasurer.\n\ne)  Three members at large (vocales).\n\nf)   One Inspector (Fiscal).\n\nThe positions shall be held for two years, with the\npossibility of being re-elected. The election mechanism shall be established in the\nregulation.\n\nArticle 7-CIMACO shall also have:\n\nAn Executive Secretariat, which shall correspond to the\nAdministrator of the Ostional National Wildlife Refuge, which shall have\nthe support of the secretary of CIMACO and shall be the executing body of the\nagreements adopted.\n\nArticle 8-The representatives of CIMACO shall have the\nfollowing functions:\n\na)  Meet monthly on\nan ordinary basis, according to the schedule established annually. Extraordinary\nmeetings may be convened when the President or the Inspector (Fiscal)\nso requests, or by written request of the majority of the representatives,\nalways with at least eight calendar days' notice.\n\nb)  Maintain adequate coordination with\nthe Administration of the Ostional National Wildlife Refuge and the officials of the Tempisque Conservation Area and\nCIMACO.\n\nc)  Appoint a representative for the annual assembly\nof the Regional Council of the Tempisque Conservation Area.\n\nd)  Represent CIMACO before\nother public or private entities, when CIMACO so requires.\n\nArticle 9-The President shall have the following\nfunctions:\n\na)  Preside over the meetings\nof CIMACO.\n\nb)  Represent CIMACO before any public\nor private entity, when the Council so requests.\n\nc)  Prepare the work agenda.\n\nd)  Moderate the Council meetings with openness and under\ndemocratic principles.\n\ne)  Promote the participation of all its\nrepresentatives.\n\nf)   Participate in meetings with the\ncommunities in the different sectors of the Ostional National Wildlife\nRefuge, when so requested.\n\ng)  Sign the minutes once approved jointly\nwith the secretary.\n\nh)  Present an annual report of\nactivities to CIMACO, without prejudice to those requested by this Council.\n\ni)   Promote the fulfillment of the functions\nestablished in Article 5.\n\nArticle 10-The Vice President shall have the function of substituting for\nthe president in his/her absence, for which he/she shall have all the powers and\ncompetencies thereof.\n\nArticle 11-The functions of the Secretary of CIMACO are\nthe following:\n\na)  Draw up the minutes of\nthe meetings and deliver them to its representatives through suitable\nmeans, at least 15 calendar days in advance of the next ordinary meeting.\n\nb)  Manage the correspondence of CIMACO.\n\nc)  Maintain a file with all the documentation of\nCIMACO.\n\nd)  Sign jointly with the president the\napproved minutes.\n\ne)  Coordinate with the Executive Secretary everything\nrelated to minutes and correspondence.\n\nArticle 12-The functions of the Treasurer are the following:\n\na)  Promote the management of\neconomic resources for the implementation of actions contemplated within the\nManagement Plan of the Ostional National Wildlife Refuge, through the\ncorresponding bodies.\n\nb)  Submit the work reports required.\n\nc)  Coordinate with the corresponding bodies\nthe execution of the resources made available to CIMACO.\n\nd)  Implement the mechanisms necessary for the\nadequate fulfillment of his/her functions.\n\nArticle 13-The function of the members at large (vocales) is to substitute for\nany of the representatives with administrative functions within the\nCouncil.\n\nArticle 14-\nThe Inspector's Office (Fiscalía) shall have the following functions:\n\na)  Ensure the proper\nfunctioning of CIMACO and compliance with this decree.\n\nb)  Inspect the proper functioning of\nthe Executive Secretariat.\n\nc)  Present semiannual activity reports.\n\nd)  Be present at the meetings of CIMACO.\n\nArticle 15-The alternates shall have the following functions:\n\na)  Substitute for the\nrespective full representatives, when so required.\n\nb)  Attend meetings whenever possible.\n\nc)  Be part of CIMACO and participate in the\nworking commissions assigned to them.\n\nArticle 16-\nThe Executive Secretariat shall have the following\nfunctions:\n\na)  Incorporate into the\nAdministration's management the agreements adopted by\nCIMACO.\n\nb)  Coordinate the calls for ordinary\nand extraordinary meetings of CIMACO.\n\nc)  Collaborate with the dissemination and distribution of\nCIMACO materials and reports.\n\nd)  Maintain control of agreements and their execution.\n\ne)  Facilitate communication among the different\nrepresentatives of CIMACO.\n\nf)   Present reports at each meeting on the\nachievements and activities carried out.\n\ng)  Maintain a file with the generated documentation.\n\nh)  May participate in CIMACO debates, but\nshall not have a vote.\n\nArticle 17-The duties of the representatives of CIMACO\nare:\n\na)  Attend the ordinary\nand extraordinary meetings to which they are convened.\n\nb)  Justify their absence and ask the alternate for\ntheir participation when for justified reasons they cannot attend.\n\nc)  Present oral or written reports when\nrequested.\n\nd)  Communicate to their institution or sector they\nrepresent the agreements, decisions, policies, work plans, and everything\nagreed upon in CIMACO.\n\ne)  Transmit to CIMACO the concerns, proposals,\ninitiatives, and problems of their organization or sector.\n\nf)   Execute the agreements and commitments\nundertaken in CIMACO.\n\ng)  Participate in the working commissions and subcommittees\nestablished.\n\nh)  The treasurer must subscribe to a fidelity\ninsurance policy and keep it current.\n\nArticle 18-The representatives of CIMACO shall have the\nfollowing rights:\n\na)  Elect and be elected\nto any position within CIMACO.\n\nb)  Have voice and vote in the meetings.\n\nc)  Request reports on agreements adopted by the\nCouncil.\n\nd)  Pronounce themselves on any matter submitted\nfor consideration.\n\ne)  Provide their opinion and that of their represented entity so\nthat it is taken into account in CIMACO's decision-making.\n\nf)   Collaborate with the officials of the Ostional\nNational Wildlife Refuge in the operational planning for the Wild\nArea.\n\nArticle 19-Everything related to the operation of\nCIMACO shall be governed by the rules established in Title Two, Chapter\nThree of the General Law of\nthe Administration.\n\nArticle 20-It shall take effect upon its publication in the
