  "body_en_text": "throughout the entire text\n\n                    -\n\n                        Complete Text of Regulation 34623\n\n                        Modifies for the National Commission for Biodiversity Management, the\nmaximum budgetary expenditure for 2008\n\nComplete Text of record: BD229\nNº 34623-H\n\nNº 34623-H\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF FINANCE\n\nBased on the powers conferred upon them by articles 140 subsections 3) and 18) and 146 of the Political Constitution; articles 25 subsection l), 27 subsection l), and 28 subsection 2) subparagraph b) of Law Nº 6227, General Law of Public Administration of May 2, 1978 and its amendments; Law Nº 8131, Law of the Financial Administration of the Republic and Public Budgets of September 18, 2001 and its amendments; its Regulation, Executive Decree Nº 32988-H-MP-PLAN of January 31, 2006 and its amendments; Law Nº 7788, Biodiversity Law of April 30, 1998 and its amendment; Executive Decree Nº 32452-H of June 29, 2005 and its amendments, and Executive Decree Nº 33646-H of March 9, 2007 and its amendments.\n\nConsidering:\n\n1º-That Law Nº 7788, published in La Gaceta Nº 101 of May 27, 1998 and its amendment, creates the National Commission for Biodiversity Management (Comisión Nacional para la Gestión de la Biodiversidad), as a deconcentrated body of the Ministry of Environment and Energy, which among its powers has that of issuing policies regarding the conservation, ecologically sustainable use, and restoration of biodiversity, as well as serving as a consultative body for the Executive Branch and autonomous institutions in biodiversity matters.\n\n2º-That through official communication OT-118-08 of April 3, 2008, the Executive Director of the National Commission for Biodiversity Management requests an increase in the maximum budgetary expenditure authorized to that body for the year 2008 by ₡30,000,000.00 (thirty million colones without cents), in order to cover various operating expenses and finance a consultative process with indigenous communities regarding the granting of access permits to the genetic and biochemical elements and resources of biodiversity.\n\n3º-That to cover the expenses indicated in the preceding considerando, the Commission will incorporate resources from the accumulated specific surplus (superávit específico).\n\n4º-That through Executive Decree Nº 32452-H and its amendments, published in La Gaceta Nº 130 of July 6, 2005, the \"Guideline for the application of article 6 of Law N° 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing (Financiamiento)\" is issued.\n\n5º-That in relation to the specific surplus, numeral 9° of the referred Executive Decree Nº 32452-H enables its use for the payment of expenses defined within the purposes established in the special or legal provisions applicable to such resources.\n\n6º-That through Executive Decree Nº 33646-H, published in La Gaceta Nº 58 of March 22, 2007 and its amendments, the General Budgetary Policy Guidelines for 2008 were issued, establishing in article 1° of the cited Decree the budgetary expenditure for the year 2008 for the institutions covered by the scope of the Budgetary Authority (Autoridad Presupuestaria).\n\n7º-That with official communication STAP-0703-07 of April 23, 2007, the Commission was notified of the maximum budgetary expenditure set for the year 2008 in the amount of ₡141,930,000.00 (one hundred forty-one million nine hundred thirty thousand colones without cents).\n\n8º-That due to the foregoing, it is necessary to modify the maximum budgetary expenditure set for the National Commission for Biodiversity Management for the year 2008. Therefore;\n\nDecree:\n\nArticle 1º-The maximum budgetary expenditure for the year 2008 for the National Commission for Biodiversity Management is modified, as established in Executive Decree Nº 33646-H, published in La Gaceta Nº 58 of March 22, 2007 and its amendments, with the budgetary expenditure limit being the amount of ₡171,930,000.00 (one hundred seventy-one million nine hundred thirty thousand colones without cents) for that period.\n\nArticle 2°-It is the responsibility of the active administration of the National Commission for Biodiversity Management to comply with the provisions of article 6 of Law Nº 8131, Law of the Financial Administration of the Republic and Public Budgets, published in La Gaceta Nº 198 of October 16, 2001 and its amendments, as well as in Executive Decree Nº 32452-H, published in La Gaceta Nº 130 of July 6, 2005 and its amendments.\n\nArticle 3º-It shall be effective as of its publication.\n\nGiven at the Presidency of the Republic, on the twenty-eighth day of the month of May of two thousand eight."
