  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Regulation 34647\n\n                        Approval and Declaration of Public and National Interest of the Solid Waste Plan-Costa Rica (Plan de Residuos Sólidos-Costa Rica, PRESOL)\n\nComplete Text of record: BD3A3\nNº 34647-S-MINAE\n\nNº 34647-S-MINAE\n\n \n\nTHE PRESIDENT OF THE REPUBLIC,\n\nAND THE MINISTER OF HEALTH\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\n \n\nExercising the powers conferred upon them by Articles 46, 50, 140 sections 3) and 18), and 146 of the Political Constitution; 1, 2, 4, 263, 278, 279, 280, 281, 282, 283, and 284 of Law No. 5395 of October 30, 1973, \"Ley General de Salud\"; 1, 2, 68, and 69 of Law No. 7554 of October 4, 1995, \"Ley Orgánica del Ambiente.\"\n\n \n\nConsidering:\n\n \n\n1º-That all persons have the right to a healthy and ecologically balanced environment, and it is the duty of the State to guarantee this right.\n\n2º-That it is the responsibility of the State, in coordination with the social sector and the productive sector, to implement an adequate integrated solid waste management (Gestión Integral de Residuos Sólidos), considering the associated economic, social, and environmental benefit.\n\n3º-That in accordance with Executive Decree No. 33477-S-MP of November 23, 2006, initiatives aimed at providing an integral solution to the problem of solid waste were declared of public and national interest.\n\n4º-That the inadequate management of solid waste represents one of the main problems we face as a Nation, causing significant impacts on health and the environment.\n\n5º-That the Solid Waste Plan-Costa Rica (PRESOL) is a national effort that aims to guide governmental and private actions on the subject through a consensus-based strategy to implement adequate integrated solid waste management in the country.\n\n6º-That this plan contains a set of strategic actions and the respective parties responsible for their execution.\n\n7º-That this effort was supported by the Competitiveness and Environment Program (Programa Competitividad y Medio Ambiente, CYMA), which is an inter-institutional platform formed by the Ministry of Health, the Ministry of Environment and Energy, the Ministry of National Planning and Economic Policy, the Chamber of Industries of Costa Rica, and the Institute for Municipal Promotion and Advisory Services (Instituto de Fomento y Asesoría Municipal), within the framework of the Bilateral Cooperation Agreement between Costa Rica and Germany, through the support of the German Agency for Technical Cooperation (GTZ).\n\n8º-That in accordance with Directive No. 024-S of December 17, 2007, the Ministry of Health is the governing body in matters of solid waste.\n\n9º-That the approval, implementation, and monitoring of said plan are necessary in order to achieve a definitive solution to the problem of waste through integrated solid waste management (gestión integral de residuos sólidos, GIRS).
