  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 34683\n\n                        Declara de utilidad pública para los intereses del Estado la Asociación de\nAcueductos y Alcantarillados de Playa Tamarindo de Santa Cruz Guanacaste\n\nTexto Completo acta: 146F0B\nNº 34683-J\n\nNº\n34683-J\n\n(Este decreto ejecutivo fue derogado por el artículo\n1° del decreto ejecutivo N° 43112 del 2 de junio del 2021)\n\nEL PRESIDENTE DE\nLA REPÚBLICA\n\nY LA MINISTRA DE\nJUSTICIA\n\n \n\nCon fundamento en lo dispuesto en los artículos 140,\ninciso 18) y 146 de\nla Constitución Política, en el artículo 32 de\nla Ley de Asociaciones y en los\nartículos 27 y siguientes de su Reglamento.\n\n \n\nConsiderando\n\n \n\nI.-Que el artículo 32 de\nla Ley de Asociaciones número 218\nde 08-08-39 y sus reformas, confiere al Poder Ejecutivo la potestad de declarar\nde Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo\ndesarrollo y actividades sean particularmente útiles para los intereses del\nEstado, y que por ello contribuyan a solventar una necesidad social.\n\nII.-Que la Asociación\nde Acueductos y Alcantarillados de Playa Tamarindo de Santa Cruz Guanacaste,\ncédula de persona jurídica número 3-002-248845, se inscribió en el Registro de\nAsociaciones del Registro Público desde el día 14 de abril de 1999, bajo el\nexpediente Nº 11378.\n\nIII.-Que los fines que persigue\nla Asociación,\nsegún el artículo tercero de sus estatutos, son: \"(...) artículo tercero:\n(...) a) Construir un sistema de alcantarillado y tratamiento de aguas en Santa\nRosa de Santa Cruz, b) Administrar, operar y conservar en buenas condiciones el\nacueducto de acuerdo a las disposiciones y reglamentos de acueductos y\nalcantarillados, c) Obtener la participación efectiva de la comunidad en la\nconstrucción y mantenimiento del acueducto, ch) Cooperar con las campañas de\níndole .educativa que se emprendan, d) Ayudar a explicar y divulgar en la\ncomunidad las reglamentaciones de Acueductos y Alcantarillados, e) Cooperar con\nlos planes, proyectos y otras obras que emprenda Acueductos y Alcantarillados\nen Playa Tamarindo de Santa Cruz Guanacaste, f) Participar en la vigilancia y\nprotección de las fuentes de abastecimiento del acueducto, evitar las\ncontaminaciones de las mismas y ayudar a la protección de las cuencas\nhidrográficas de la región (...)\".\n\nIV.-Que tales fines solventan una necesidad social de primer orden,\npor lo cual merecen el apoyo del Estado Costarricense. Por tanto,\n\n \n\nDecretan\n\n \n\nArtículo 1º-Declárese de Utilidad Pública para los\nintereses del estado la\n Asociación de Acueductos y Alcantarillados de Playa Tamarindo\nde Santa Cruz Guanacaste, cédula de persona jurídica número 3-002-248845.\n\nArtículo 2º-Es deber de\nla Asociación rendir anualmente un informe ante el\nMinisterio de Justicia, de conformidad con lo indicado en el artículo 32 del\nReglamento a la Ley\nde Asociaciones.\n\nArtículo 3º-Una vez publicado este decreto los interesados deberán\nprotocolizar y presentar el respectivo testimonio, ante el Registro de\nAsociaciones de Registro Nacional, para su respectiva inscripción.\n\nArtículo 4º-Rige a partir de su publicación.\n\n \n\nDado en\nla Presidencia de\nla República.-San\nJosé, a los seis días del mes de junio del dos mil ocho.",
  "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 34683\n\n                        Declares of public utility for the interests of the State the Association of\nAqueducts and Sewers of Playa Tamarindo of Santa Cruz Guanacaste\n\nFull Text record: 146F0B\nNo. 34683-J\n\nNo.\n34683-J\n\n(This executive decree was repealed by article\n1 of executive decree No. 43112 of June 2, 2021)\n\nTHE PRESIDENT OF\nTHE REPUBLIC\n\nAND THE MINISTER OF\nJUSTICE\n\n \n\nBased on the provisions of articles 140,\nsubsection 18) and 146 of\nthe Political Constitution, article 32 of\nthe Law of Associations and\narticles 27 and following of its Regulation.\n\n \n\nConsidering\n\n \n\nI.-That article 32 of\nthe Law of Associations number 218\nof 08-08-39 and its amendments, grants the Executive Branch the power to declare\nof Public Utility simple, federated, or confederated Associations, whose\ndevelopment and activities are particularly useful for the interests of the\nState, and therefore contribute to solving a social need.\n\nII.-That the Association\nof Aqueducts and Sewers of Playa Tamarindo of Santa Cruz Guanacaste,\nlegal entity identification number 3-002-248845, was registered in the Registry of\nAssociations of the Public Registry as of April 14, 1999, under\nfile No. 11378.\n\nIII.-That the purposes pursued by\nthe Association,\naccording to article three of its bylaws, are: \"(...) article three:\n(...) a) Build a sewer system and water treatment in Santa\nRosa of Santa Cruz, b) Administer, operate, and maintain in good condition the\naqueduct in accordance with the provisions and regulations of aqueducts and\nsewers, c) Obtain the effective participation of the community in the\nconstruction and maintenance of the aqueduct, ch) Cooperate with the\neducational campaigns that are undertaken, d) Help explain and disseminate in the\ncommunity the regulations of Aqueducts and Sewers, e) Cooperate with\nthe plans, projects, and other works undertaken by Aqueducts and Sewers\nin Playa Tamarindo of Santa Cruz Guanacaste, f) Participate in the monitoring and\nprotection of the aqueduct's supply sources (fuentes de abastecimiento), prevent their\ncontamination, and help protect the hydrographic basins of the region (...)\".\n\nIV.-That such purposes solve a social need of the first order,\nand therefore merit the support of the Costa Rican State. Therefore,\n\n \n\nDecree\n\n \n\nArticle 1-Declare of Public Utility for the\ninterests of the state the\n Association of Aqueducts and Sewers of Playa Tamarindo\nof Santa Cruz Guanacaste, legal entity identification number 3-002-248845.\n\nArticle 2-It is the duty of\nthe Association to annually submit a report to the\nMinistry of Justice, in accordance with what is indicated in article 32 of the\nRegulation to the Law\nof Associations.\n\nArticle 3-Once this decree is published, the interested parties must\nnotarize and present the respective certified copy, before the Registry of\nAssociations of the National Registry, for its respective registration.\n\nArticle 4-It shall be effective as of its publication.\n\n \n\nGiven at\nthe Presidency of\nthe Republic.-San\nJosé, on the sixth day of June of two thousand eight."
