Su precipitación promedio anual es\ncercana a 1.729 mm,\nen contraste con el resto del país, donde la precipitación promedio es de 3.272 mm. Por otra parte,\npese a que todo su territorio está regado por ríos, el caudal de su red\nhidrográfica, dominada por el Río Tempisque y sus afluentes, como El Bebedero,\ndisminuye notablemente durante la estación seca, que se prolonga, en general,\npor cinco o seis meses. Las tres fuentes de agua más importantes en la región\nson en su orden: la Cuenca\ndel Río Tempisque; las aguas subterráneas y desde 1979 el Embalse Arenal.\n\n3º-Que en razón de las\nlimitaciones hídricas naturales que posee dicha provincia aunado, a la\nnecesidad de satisfacer la demanda de dicho recurso para uso doméstico de las\ncomunidades existentes, el creciente desarrollo habitacional, el auge turístico\ny las necesidades que deben ser satisfechas como consecuencia del mismo, los\nfenómenos naturales que propician cambios climáticos, que modifican el patrón\nde las lluvias y alteran por consiguiente la recarga de los mantos acuíferos,\nse ha visualizado la necesidad de obtener el máximo aprovechamiento posible de\nlas aguas que provienen del Río Tempisque, con el objeto de suplir la necesidad\ndescrita y propiciar un auge en el desarrollo agropecuario, al asegurar el\nalmacenamiento de caudales de la estación lluviosa a fin de utilizarlos para\ndiversos usos durante la época seca.\n\n4º-Que resulta altamente de\nconveniencia nacional e interés público la construcción de la obra denominada\nEmbalse La Cueva,\nel cual se localizaría sobre el cauce del Río Tempisque, aguas abajo de la\nconfluencia de los ríos Ahogados y Tempisquito, cantón de Canillo, en las\ncoordenadas 367 240 LE y 295 625 LN, que adicionalmente a constituir un\nreservorio de agua para ser utilizada en la época seca supliría las necesidades\ny demanda del sector costero comprendido desde Papagayo hasta Playa Junquillal\ny un sector de Zapandí Norte, contribuyendo en forma adicional a amortiguar las\ninundaciones de la cuenca baja del Tempisque.\n\n5º-Que dicho proyecto consiste en\nla construcción de un embalse en el Sitio denominado\nLa Cueva a partir de una presa\nde cuarenta y tres metros de altura, cuya capacidad efectiva de almacenaje\nsería en el orden de 90 millones de metros cúbicos. Esta obra permitiría regar\nunas 7000 Ha\n(siete mil hectáreas) con un caudal adicional aportado en la época seca de 6m\n3/s. La población beneficiada se estima en aproximadamente mil familias de\npequeños y medianos productores.\n\n6º-Que las principales\ncaracterísticas del Proyecto Presa-Embalse\nla Cueva son: Área de drenaje hasta el sitio de la\npresa: 633\n Kilómetros cuadrados; Elevación de\nla Presa: 76.0 msnm; Elevación\ndel embalse: 73.6msnm; Área del Embalse: 1200 Ha; Volumen útil del\nembalse: 90 x l0.6 m3\n\n7º-Que en la fase de\npre-ejecución y diseño de las obras así como en la fase constructiva, se requiere\nextraer y reubicar fauna y especies vegetales menores tales como orquídeas,\nherbáceas, bromelias, helechos arborescentes, bambúes silvestres, para fines de\ninvestigación científica, así como la eventual corta focalizada de especies\narbóreas.\n\n8º-Que los artículos 19 inciso b)\ny 34 de la Ley Forestal,\nprohiben el cambio de uso de los suelos excepto en aquellos proyectos estatales\no privados que el Poder Ejecutivo declare de conveniencia nacional, sean\naquellos proyectos cuyos beneficios sociales sean mayores a los costos socio\nambientales.\n\n9º-Que en razón de lo anterior,\nse requiere declarar la conveniencia pública e importancia nacional del citado\nproyecto, habida cuenta que el país requiere incrementar todos los esfuerzos\nnecesarios para el aprovechamiento óptimo y sostenible de los recursos\nhídricos, de tal forma que pueda satisfacer adecuadamente las necesidades\nbásicas de los ciudadanos, las cuales muestran una tendencia creciente producto\ndel aumento de población, impacto turístico, cambio climático, competitividad\nagroproductiva y demanda alimentaría, entre otras razones.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 34677\n\n                        Declaration of public interest and national convenience of the La Cueva\ndam-reservoir project\n\nFull Text record: BDD60\nNo. 34677-MP-MAG-MINAE\n\nNo. 34677-MP-MAG-MINAE\n\nTHE\nPRESIDENT OF THE\n REPUBLIC,\n\nTHE MINISTER OF\nTHE PRESIDENCY,\n\nTHE MINISTER OF ENVIRONMENT AND\nENERGY\n\nAND THE MINISTER OF AGRICULTURE AND\nLIVESTOCK\n\nIn the exercise of\nthe powers conferred by Article 140, subsections 3) and 18), and 146 of\nthe Political\n Constitution; Article 28, paragraph 2, subsection b) of\nthe General Law of\nPublic\n Administration, Law No. 6227 of May 2, 1978; Article 2,\nsubsection c) of the\n Organic Environmental Law, Law No. 7554 of October 4,\n1995; the Law Creating the National Groundwater, Irrigation and Drainage Service,\nLaw No. 6877 of July 18, 1983; Articles 2, 3 subsections a), c),\nd), m), 19 subsection b), and 34 of the\n Forestry Law, Law No. 7575 of February 13, 1996; and\nExecutive Decree No. 15321-MAG of March 16, 1984, Creating Irrigation,\nDrainage and Flood Control Districts.\n\nConsidering\n\n1º—That among the\ngoals of the National Development Plan 2006-2010, Jorge Manuel Dengo Obregón, a\nstrategic action for the Productive Sector is proposed: the \"Plan to\nstimulate sustainable competitiveness and the generation of added value in the\nproductive sector, as a key sector of the national economy,\" whose objective is\n\"To foster the conditions that allow improving the competitiveness of\ncompanies, with a productive chain vision, through the articulation of\ninter-institutional and inter-sectoral efforts.\"\n\n2º—That Guanacaste is one of the\nareas with the lowest water wealth in the country. Its average annual precipitation is\nclose to 1,729 mm,\nin contrast to the rest of the country, where the average precipitation is 3,272 mm. On the other hand,\nalthough its entire territory is irrigated by rivers, the flow of its hydrographic\nnetwork, dominated by the Tempisque River and its tributaries, such as the Bebedero,\ndecreases notably during the dry season, which generally lasts\nfor five or six months. The three most important water sources in the region\nare, in order: the Tempisque\nRiver Basin; groundwater; and, since 1979, the Arenal Reservoir.\n\n3º—That due to the\nnatural water limitations that said province possesses, coupled with\nthe need to satisfy the demand for said resource for domestic use by\nthe existing communities, the growing housing development, the tourism boom,\nand the needs that must be satisfied as a consequence thereof, and the\nnatural phenomena that cause climate changes, which modify the rainfall\npattern and consequently alter the recharge of the aquifer (mantos acuíferos) layers,\nthe need has been envisioned to obtain the maximum possible utilization of\nthe waters coming from the Tempisque River, with the purpose of supplying the\ndescribed need and fostering a boom in agricultural development, by ensuring the\nstorage of rainy season flows in order to use them for\nvarious uses during the dry season.\n\n4º—That the construction of the work called\nLa Cueva Reservoir is highly of\nnational convenience and public interest,\nwhich would be located on the channel of the Tempisque River, downstream of the\nconfluence of the Ahogados and Tempisquito rivers, Canillo canton, at\ncoordinates 367,240 LE and 295,625 LN, which, in addition to constituting a\nwater reservoir to be used in the dry season, would supply the needs\nand demand of the coastal sector comprised from Papagayo to Playa Junquillal\nand a sector of Zapandí Norte, additionally contributing to mitigating the\nfloods of the lower Tempisque basin.\n\n5º—That said project consists of\nthe construction of a reservoir (embalse) at the site called\nLa Cueva, starting from a dam (presa)\nforty-three meters high, whose effective storage capacity\nwould be in the order of 90 million cubic meters. This work would allow irrigating\nsome 7,000 Ha\n(seven thousand hectares) with an additional flow provided in the dry season of 6\nm3/s. The beneficiary population is estimated at approximately one thousand families of\nsmall and medium producers.\n\n6º—That the main\ncharacteristics of the La Cueva Dam-Reservoir\nProject are: Drainage area up to the dam (presa)\nsite: 633\n square kilometers; Dam Elevation: 76.0 masl; Reservoir\nElevation: 73.6 masl; Reservoir Area: 1,200 Ha; Useful reservoir volume:\n90 x 10.6 m3.\n\n7º—That in the pre-execution\nand design phase of the works, as well as in the construction phase, it is required\nto extract and relocate fauna and minor plant species such as orchids,\nherbaceous plants, bromeliads, tree ferns, and wild bamboos, for scientific research\npurposes, as well as the eventual focused felling of tree\nspecies.\n\n8º—That Articles 19, subsection b),\nand 34 of the Forestry Law\nprohibit land-use change (cambio de uso del suelo) except in those state or\nprivate projects that the Executive Branch declares of national convenience, being\nthose projects whose social benefits are greater than the socio-environmental\ncosts.\n\n9º—That due to the foregoing,\nit is required to declare the public convenience and national importance of the cited\nproject, given that the country needs to increase all the necessary\nefforts for the optimal and sustainable utilization of water\nresources, in such a way that it can adequately satisfy the basic\nneeds of citizens, which show a growing trend as a result\nof population increase, tourism impact, climate change, agricultural-productive\ncompetitiveness, and food demand, among other reasons. Therefore,\n\nThey Decree\n\n\"Declaration\nof public interest and national convenience\n\nof the La Cueva dam-reservoir project.\"\n\nArticle 1—The\nfeasibility studies and the works of the La Cueva dam-reservoir\nProject, which will be constructed\nby the National Groundwater, Irrigation and Drainage Service (SENARA), are hereby declared of Public Interest and National Convenience.\n\nArticle 2—\nThe Central and Decentralized Public Administration,\nwithin the framework of inter-institutional cooperation, shall contribute, in accordance with\nthe powers that current legislation attributes to them, in a priority and\neffective manner with investment in infrastructure, training, and\nenvironmental recovery-conservation, when SENARA formalizes alliances in order\nto contribute to the development of the project.\n\nArticle 3—The\nfinancing processes necessary for the pre-feasibility and feasibility studies,\nas well as for the construction of the Project by SENARA, shall receive\nexpeditious and effective processing to ensure the necessary authorizations\nfrom the Ministry of Finance, the Ministry of National Planning and\nEconomic Policy, the Central Bank of Costa Rica, the Budgetary Authority, and the\nNational Treasury. Likewise, the procedures and requests that SENARA must\nmanage for the implementation of the project and all associated works\nshall receive priority and expeditious treatment from Public\nEntities and bodies.\n\nArticle 4—\nThe National Environmental Technical Secretariat (SETENA)\nshall provide priority and expeditious treatment to the procedures for\ndetermining environmental feasibility (viabilidad ambiental), as well as to any requirement\nnecessary for the prompt and adequate execution.\n\nArticle 5—It shall be effective as of this\ndate.\n\nGiven in Nicoya, Guanacaste,\non the twenty-fifth day of July, two thousand eight."
