Su precipitación promedio anual es\ncercana a 1.729 mm,\nen contraste con el resto del país, donde la precipitación promedio es de 3.272 mm. Por otra parte,\npese a que todo su territorio está regado por ríos, el caudal de su red\nhidrográfica, dominada por el río Tempisque y sus afluentes, como El Bebedero,\ndisminuye notablemente durante la estación seca, que se prolonga, en general,\npor cinco o seis meses. Las tres fuentes de agua más importantes en la región\nson en su orden: la Cuenca\ndel Río Tempisque; las aguas subterráneas y desde 1979 el Embalse Arenal.\n\n3º-Que en razón de las\nlimitaciones hídricas naturales que posee dicha provincia, aunado a la\nnecesidad de satisfacer la demanda de dicho recurso para uso doméstico de las\ncomunidades existentes, el creciente desarrollo habitacional, el auge turístico\ny las necesidades que deben ser satisfechas como consecuencia del mismo, los\nfenómenos naturales que propician cambios climáticos, que modifican el patrón de\nlas lluvias y alteran por consiguiente la recarga de los mantos acuíferos, se\nha visualizado la necesidad de obtener el máximo aprovechamiento posible de las\naguas que provienen del Embalse Arenal y del Distrito de Riego Arenal-Tempisque\nque administra SENARA, con el objeto de suplir la necesidad descrita y\npropiciar un auge en el desarrollo agropecuario, al permitir cubrir nuevas\náreas de riego, tanto en la parte occidental del proyecto como en la margen\nderecha del Río Tempisque.\n\n4º-Que el Embalse Arenal es la\nprincipal reserva hídrica del país, que por tal naturaleza opera según la\ndemanda de consumo eléctrico del país, lo que hace que la generación eléctrica\nno sea constante, generando picos de generación y por tanto de disposición\nhídrica que no es aprovechada aguas abajo, por la falta de embalse o reservorio\ncon capacidad suficiente para hacer un máximo aprovechamiento de ese recurso.\n\n5º-Que resulta altamente de\nconveniencia nacional e interés público la construcción de la obra denominada\nEmbalse Regulatorio del Canal del Oeste del Distrito de Riego Arenal Tempisque,\ndenominado también Embalse Río Piedras, el cual se ubica en Bagaces,\nGuanacaste, propiamente en el cruce del Canal del Oeste con el Río Piedras.\n\n6º-Que dicho proyecto consiste en\nla construcción de una represa de aproximadamente 717 m de longitud y 40 m de altura, y que va a\npermitir un área de inundación cercana a las 800 hectáreas,\ncon una capacidad de almacenamiento hídrico estimada de 85 millones de metros\ncúbicos. Its average annual rainfall is close to 1,729 mm, in contrast to the rest of the country, where the average rainfall is 3,272 mm. On the other hand, although its entire territory is irrigated by rivers, the flow of its hydrographic network, dominated by the Tempisque River and its tributaries, such as El Bebedero, decreases notably during the dry season, which generally lasts for five or six months. The three most important water sources in the region are, in order: the Tempisque River Basin; groundwater and, since 1979, Arenal Reservoir.\n\n3º-That by reason of the natural water limitations that said province possesses, coupled with the need to satisfy the demand for said resource for domestic use of the existing communities, the growing housing development, the tourism boom and the needs that must be satisfied as a consequence thereof, the natural phenomena that promote climate changes, modifying the pattern of rains and consequently altering the recharge of aquifers, the need has been visualized to obtain the maximum possible utilization of the waters coming from Arenal Reservoir and the Arenal-Tempisque Irrigation District administered by SENARA, with the object of supplying the described need and promoting a boom in agricultural development, by allowing coverage of new irrigation areas, both in the western part of the project and on the right bank of the Tempisque River.\n\n4º-That Arenal Reservoir is the country's main water reserve, which by such nature operates according to the country's electrical consumption demand, which means that electrical generation is not constant, generating generation peaks and therefore water availability that is not utilized downstream, due to the lack of a reservoir or storage body with sufficient capacity to make maximum use of that resource.\n\n5º-That the construction of the work called Regulatory Reservoir of the West Canal of the Arenal Tempisque Irrigation District, also called Río Piedras Reservoir, which is located in Bagaces, Guanacaste, precisely at the crossing of the West Canal with the Río Piedras, is highly of national convenience and public interest.\n\n6º-That said project consists of the construction of a dam approximately 717 m in length and 40 m in height, and which will allow a flood area close to 800 hectares, with an estimated water storage capacity of 85 million cubic meters. Therefore:\n\nDecree\n\n\"Declaration of public interest and national convenience for the project\n\nregulatory dam-reservoir of the west canal of the irrigation district\n\narenal-tempisque, also called piedras reservoir\"\n\nArticle 1º-The execution of the works called Regulatory Dam-Reservoir of the West Canal of the Arenal - Tempisque Irrigation District, also called Río Piedras Reservoir, is declared of public interest and national convenience, whose executing body shall be the National Groundwater, Irrigation and Drainage Service (SENARA).\n\nArticle 2º-The Central and Decentralized Public Administration, within the framework of inter-institutional cooperation, shall contribute, according to the powers that current legislation attributes to them, in a priority and effective manner with investment in infrastructure, training, environmental recovery-conservation, when SENARA formalizes alliances in order to contribute to the development of the project.\n\nArticle 3º-The financing processes necessary for the feasibility studies as well as for the construction of the Project by SENARA, shall receive expeditious and effective processing to ensure the necessary authorizations from the Ministry of Finance, MIDEPLAN, Central Bank of Costa Rica, Budgetary Authority and National Treasury. Likewise, the procedures and requests that SENARA must manage for the implementation of the project and all works associated with it, shall receive from public entities and bodies priority and expeditious treatment.\n\nArticle 4º-The National Environmental Technical Secretariat (SETENA), shall provide priority and expeditious treatment to the procedures for determining environmental viability (viabilidad ambiental), as well as to any requirement necessary for the prompt and adequate execution.\n\nArticle 5º-It shall be effective as of this date.\n\nGiven in the City of Nicoya, Guanacaste, on the twenty-fifth day of the month of July of the year two thousand eight." }
