1961.\n\nConsiderando\n\n \n\n1º-Que Guanacaste es\nuna de las zonas de menor riqueza hídrica del país. Su precipitación promedio\nanual es cercana a 1.729 mm,\nen contraste con el resto del país, donde la precipitación promedio es de 3.272 mm. Por otra parte,\npese a que todo su territorio está regado por ríos, el caudal de su red\nhidrográfica, dominada por el Río Tempisque y sus afluentes, como el Bebedero,\ndisminuye notablemente durante la estación seca, que se prolonga, en general\npor cinco o seis meses.\n\n2º-Que en razón de las limitaciones\nhídricas naturales que posee dicha provincia, aunado a la necesidad de\nsatisfacer la demanda de dicho recurso para uso doméstico de las comunidades\nexistentes, el creciente desarrollo habitacional, el auge turístico y las\nnecesidades que deben ser satisfechas como consecuencia del mismo, los\nfenómenos naturales que propician cambios climáticos, que modifican el patrón\nde las lluvias y alteran por consiguiente la recarga de los mantos acuíferos,\nse ha visualizado la necesidad de obtener el máximo aprovechamiento posible de\nlas aguas que provienen del Embalse Arenal y del Distrito de Riego\nArenal-Tempisque, que administra SENARA, con el objeto de suplir la necesidad\ndescrita y propiciar un auge en el desarrollo agropecuario y la satisfacción de\nlas necesidades comunitarias.\n\n3º-Que las tres fuentes de agua\nmás importantes en la región, son en su orden:\nLa Cuenca del Río Tempisque,\nlas aguas subterráneas y desde 1979 el Embalse Arenal. El trasvase de las\nabundantes aguas superficiales de la cuenca del Río Arenal y la subcuenca del\nRío Cote, ambas de la vertiente del Caribe, cuya precipitación promedio anual\nes de 3.820 y 4.711 mm\nrespectivamente a la cuenca del Río Tempisque en\nla Vertiente Pacífico,\nde características hídricas menos favorables (1.545 mm de precipitación\npromedio anual), da como resultado un aprovechamiento comprensivo de ese\nrecurso en el Complejo Arenal - Dengo - Sandillal (ARDESA) y en el Distrito de\nRiego Arenal - Tempisque (DRAT).\n\n4º-Que el Proyecto de\nabastecimiento de agua potable para la margen occidental del Río Tempisque a\npartir del Sistema Arenal, en su fase previa, pretende tomar hasta 1.0 m3/s\n(31.5 millones de m3 anuales) de las aguas turbinadas del Sistema\nARDESA, derivadas por SENARA.\n\n5º-Que como mecanismo de\nintercambio, mientras se tiene capacidad de almacenamiento, se propone\nrehabilitar la obra de toma en el Río Piedras, punto en el cual SENARA tiene\nuna concesión, Expediente 3312A, de 1.5 m3/s y vigente hasta febrero\ndel 2016. El proyecto propone utilizar el Canal Oeste CO-Tramo II desde\nla Estación 1+250,\naguas abajo del Cruce del Río Piedras, hasta el sitio de derivación para el\nabastecimiento de agua de comunidades y desarrollos turísticos de la zona\ncostera de Guanacaste. La longitud de conducción por el Canal Oeste, hasta el\nsitio de la estructura de derivación, unos 300 m. después del Río\nCabuyo, es de aproximadamente 20\n Km.\n\n6º-Que el proyecto incluye una\nserie de obras complementarias como son: Construir un sistema de captación, una\nestación de bombeo, una línea de impulsión y una planta de tratamiento. Además,\nes compatible con el sistema DRAT (Distrito de Riego Arenal Tempisque), porque\npermite sustituir el caudal derivado para los requerimientos, señalados.\nAsimismo, permitiría atender alguna contingencia entre Presa Derivadora-Miguel\nPablo Dengo y el Cruce del Río Piedras. De igual forma, articula perfectamente\ncon la propuesta de SENARA de construir\nla Presa-Embalse DRAT\n(Distrito de Riego Arenal Tempisque), lo cual le permite a los usuarios aguas\nabajo del Cruce del Río Piedras, incrementar la confiabilidad del suministro de\nagua ante la eventualidad de fallas en el sistema hidráulico.\n\n7º-Que este Proyecto de\nabastecimiento de agua potable para la margen occidental del Río Tempisque a\npartir del Sistema Arenal, fue estudiado por SENARA en el año 2004 mediante dos\ninformes técnicos denominados \"Proyecto de Conducción de Agua para el\nAbastecimiento del Sector Nimboyores, Guanacaste\" y \"Proyecto de Conducción de\nAgua para el Abastecimiento del Sector Papagayo, Guanacaste\", así como en el\nEstudio Técnico a Nivel de Prefactibilidad \"Incremento de\nla Disponibilidad de\nRecurso Hídrico en la Cuenca\ndel Río Tempisque y Zona Costera de Guanacaste\", realizado en el Marco de\nCooperación Interinstitucional AYA-SENARA, en el 2006.\n\n8º-Que el proyecto que se\npretende desarrollar tiene a la época de verano como la de mayor actividad\nhidráulica, dado que es en los meses de la estación seca cuando las plantas de\ngeneración del ICE, a saber, Arenal, Corobicí y Sandillal, tienen su máxima\nproducción. Siendo que esta época es de baja precipitación sobre la margen\nderecha del Río Tempisque, podría este proyecto considerar la recarga\nartificial en los acuíferos durante dichos períodos.\n\n9º-Que dicho proyecto involucra\nla participación de instituciones públicas que utilizan el recurso hídrico para\nla satisfacción de los fines públicos que las leyes de creación les asignan, y\nlograr puntos de consenso sobre la distribución y el uso sostenible del agua,\nque permitan y faciliten la consolidación de acciones que promuevan el\ndesarrollo armónico de la zona.\n\n10º-Que la propuesta de\nconstrucción del Proyecto de Abastecimiento de agua potable para la margen\noccidental del Río Tempisque a partir del Sistema Arenal, es coherente con el\nPlan Nacional de Desarrollo (PND 2006-2010) en su Acción Estratégica para el\nSector Productivo que plantea \"Plan de estímulo a la competitividad\nsostenible y la generación de valor agregado en el sector productivo, como\nsector clave de la economía nacional\" y cuyo objetivo es \"Propiciar las\ncondiciones que permitan mejorar la competitividad de las empresas, con visión\nde cadena productiva, mediante la articulación de esfuerzos\ninterinstitucionales e intersectoriales\". Asimismo, la propuesta guarda relación\ncon los lineamientos estratégicos del Subsector Hídrico contenidos en\nla Estrategia Nacional\nAmbiental, por cuanto considera, entre otros: \"El agua y las fuerzas que se\nderivan de ésta son bienes estratégicos del país, que contribuyen al desarrollo\nnacional y a mejorar la calidad de vida de sus habitantes\", \"Para\npromover el uso eficiente del agua, se requiere la utilización de las mejores\ninfraestructuras y tecnologías disponibles adecuadas a la realidad del país\" y\n\"La selección de proyectos de desarrollo con relevancia del recurso hídrico, se\nbasa en un análisis integral de los costos y beneficios económicos, sociales y\nambientales.\"\n\n11º-Que en la fase de\npre-ejecución y diseño de las obras del proyecto así como en la fase\nconstructiva, se requiere extraer y reubicar fauna y especies vegetales menores\ntales como orquídeas, herbáceas, bromelias, helechos arborescentes, bambúes\nsilvestres, para fines de investigación científica, así como la eventual corta\nfocalizada de especies, arbóreas.\n\n12º-Que los artículos 19 inciso\nb) y 34 de la Ley\n Forestal, prohíben el cambio de uso de los suelos excepto en\naquellos proyectos estatales o privados que el Poder Ejecutivo declare de\nconveniencia nacional, sean aquellos proyectos cuyos beneficios sociales sean\nmayores a los costos socio ambientales.\n\n13º-Que en razón de lo anterior,\nse requiere declarar la conveniencia pública e importancia nacional del citado\nproyecto, habida cuenta que el país requiere incrementar todos los esfuerzos\nnecesarios para el aprovechamiento óptimo y sostenible de los recursos\nhídricos, de tal forma que pueda satisfacer adecuadamente las necesidades\nbásicas de los ciudadanos, las cuales muestran una tendencia creciente,\nproducto del aumento de población, impacto turístico, cambio climático,\ncompetitividad agroproductiva, demanda alimentaria, entre otras razones.\n\n14º-Que el Gobierno de\nla República en\nConsejo de Gobierno del día 25 de julio de 2006 y a través de varias\ninstituciones, promocionó la firma del Convenio para la formalización del\nProyecto de Abastecimiento de Agua Potable para la margen occidental del Río\nTempisque a partir del Sistema Arenal. Por tanto,\n\nDecretan\n\n \n\nDeclaratoria\nde interés público y conveniencia nacional del proyecto\n\nde abastecimiento de agua potable\npara la margen occidental\n\ndel Río Tempisque a partir del\nSistema Arenal\n\n \n\nArtículo 1º-Se\ndeclara de Conveniencia Nacional e Interés Público el Proyecto de\nabastecimiento de agua potable para la margen occidental del Río Tempisque a\npartir del Sistema Arenal, cuyo organismo ejecutor será el Instituto\nCostarricense de Acueductos y Alcantarillados.\n\nArtículo 2º-\nLa Administración Pública Central y Descentralizada,\ndentro del marco de cooperación interinstitucional contribuirán, de acuerdo a\nlas potestades que la legislación vigente les atribuye, en forma prioritaria y\nefectiva con inversión en infraestructura, capacitación,\nrecuperación-conservación ambiental, cuando el Instituto Costarricense de\nAcueductos y Alcantarillados formalice alianzas a fin de contribuir al\ndesarrollo del Proyecto.\n\nArtículo 3º-Los procesos de\nfinanciamiento necesarios para los estudios de factibilidad así como para la\nconstrucción del Proyecto por parte del Instituto Costarricense de Acueductos y\nAlcantarillados, recibirán un trámite expedito y efectivo para asegurar las\nautorizaciones necesarias de parte del Ministerio de Hacienda, MIDEPLAN, Banco\nCentral de Costa Rica, Autoridad Presupuestaria y Tesorería Nacional. On the other hand, despite all its territory being watered by rivers, the flow of its hydrographic network, dominated by the Tempisque River and its tributaries, such as the Bebedero, decreases notably during the dry season, which generally lasts for five or six months.\n\n2º-That by reason of the natural water limitations that this province possesses, coupled with the need to satisfy the demand for this resource for domestic use of the existing communities, the growing residential development, the tourism boom and the needs that must be satisfied as a consequence thereof, and the natural phenomena that foster climate changes, which modify rainfall patterns and consequently alter the recharge of aquifers (mantos acuíferos), the need has been envisioned to obtain the maximum possible use of the waters coming from the Arenal Reservoir and the Arenal-Tempisque Irrigation District, which is administered by SENARA, with the object of meeting the described need and fostering a boom in agricultural development and the satisfaction of community needs.\n\n3º-That the three most important water sources in the region are, in their order:\nThe Tempisque River Basin,\nthe groundwater (aguas subterráneas), and since 1979 the Arenal Reservoir. The transfer of the abundant surface waters from the Arenal River Basin and the Cote River Sub-basin, both from the Caribbean watershed, whose average annual precipitation is 3,820 and 4,711 mm respectively, to the Tempisque River Basin on the Pacific Watershed, which has less favorable water characteristics (1,545 mm of average annual precipitation), results in a comprehensive use of this resource in the Arenal - Dengo - Sandillal Complex (ARDESA) and in the Arenal - Tempisque Irrigation District (DRAT).\n\n4º-That the Potable Water Supply Project for the western bank of the Tempisque River from the Arenal System, in its preliminary phase, intends to take up to 1.0 m3/s (31.5 million m3 per year) of the turbined waters of the ARDESA System, diverted by SENARA.\n\n5º-That as an exchange mechanism, while storage capacity is available, it is proposed to rehabilitate the intake works on the Piedras River, a point at which SENARA holds a concession, File 3312A, for 1.5 m3/s, valid until February 2016. The project proposes to use the West Canal CO-Section II from Station 1+250, downstream of the Piedras River Crossing, to the diversion site for the water supply of communities and tourism developments in the coastal zone of Guanacaste. The conveyance length along the West Canal to the diversion structure site, approximately 300 m after the Cabuyo River, is approximately 20 Km.\n\n6º-That the project includes a series of complementary works such as: Building a catchment system, a pumping station, a force main, and a treatment plant. Furthermore, it is compatible with the DRAT system (Arenal Tempisque Irrigation District), because it allows the flow diverted for the indicated requirements to be replaced. Likewise, it would make it possible to address any contingency between the Miguel Pablo Dengo Diversion Dam and the Piedras River Crossing. Similarly, it articulates perfectly with the SENARA proposal to build the DRAT Dam-Reservoir (Arenal Tempisque Irrigation District), which allows users downstream of the Piedras River Crossing to increase the reliability of the water supply in the event of failures in the hydraulic system.\n\n7º-That this Potable Water Supply Project for the western bank of the Tempisque River from the Arenal System was studied by SENARA in 2004 through two technical reports called \"Water Conveyance Project for the Supply of the Nimboyores Sector, Guanacaste\" and \"Water Conveyance Project for the Supply of the Papagayo Sector, Guanacaste\", as well as in the Prefeasibility-Level Technical Study \"Increase in the Availability of Water Resources in the Tempisque River Basin and the Coastal Zone of Guanacaste\", carried out within the Framework of AYA-SENARA Interinstitutional Cooperation, in 2006.\n\n8º-That the project intended to be developed has the summer season as the period of greatest hydraulic activity, given that it is during the dry season months when ICE's generation plants, namely, Arenal, Corobicí, and Sandillal, have their maximum production. Since this period is one of low precipitation on the right bank of the Tempisque River, this project could consider artificial recharge in the aquifers during such periods.\n\n9º-That this project involves the participation of public institutions that use water resources to satisfy the public purposes assigned to them by their founding laws, and to achieve points of consensus on the distribution and sustainable use of water, which permit and facilitate the consolidation of actions that promote the harmonious development of the area.\n\n10º-That the proposed construction of the Potable Water Supply Project for the western bank of the Tempisque River from the Arenal System is coherent with the National Development Plan (PND 2006-2010) in its Strategic Action for the Productive Sector, which proposes a \"Plan to stimulate sustainable competitiveness and the generation of added value in the productive sector, as a key sector of the national economy\" and whose objective is to \"Foster conditions that allow for improving the competitiveness of companies, with a productive chain vision, through the articulation of inter-institutional and intersectoral efforts.\" Likewise, the proposal relates to the strategic guidelines of the Water Subsector contained in the National Environmental Strategy, inasmuch as it considers, among others: \"Water and the forces derived from it are strategic assets of the country, which contribute to national development and to improving the quality of life of its inhabitants,\" \"To promote the efficient use of water, the use of the best infrastructures and technologies available and suitable to the country's reality is required,\" and \"The selection of development projects with relevance to water resources is based on a comprehensive analysis of the economic, social, and environmental costs and benefits.\"\n\n11º-That in the pre-execution and design phase of the project works, as well as in the construction phase, it is required to extract and relocate fauna and minor plant species such as orchids, herbaceous plants, bromeliads, tree ferns, wild bamboos, for scientific research purposes, as well as the eventual selective cutting of tree species.\n\n12º-That Articles 19 subsection b) and 34 of the Forest Law (Ley Forestal) prohibit the change of land use (cambio de uso de los suelos) except in those state or private projects that the Executive Branch declares of national convenience (conveniencia nacional), namely, those projects whose social benefits are greater than the socio-environmental costs.\n\n13º-That by reason of the foregoing, it is required to declare the public convenience and national importance of the aforementioned project, taking into account that the country must redouble all necessary efforts for the optimal and sustainable use of water resources, in such a way that it can adequately satisfy the basic needs of citizens, which show a growing trend, as a result of population increase, tourism impact, climate change, agro-productive competitiveness, food demand, among other reasons.\n\n14º-That the Government of the Republic, in the Government Council session of July 25, 2006, and through several institutions, promoted the signing of the Agreement for the formalization of the Potable Water Supply Project for the western bank of the Tempisque River from the Arenal System. Therefore,\n\nThey Decree\n\nDeclaration of public interest and national convenience (conveniencia nacional) of the potable water supply project\nfor the western bank\nof the Tempisque River from the Arenal System\n\nArticle 1-The Potable Water Supply Project for the western bank of the Tempisque River from the Arenal System is declared of National Convenience (Conveniencia Nacional) and Public Interest, whose implementing body shall be the Costa Rican Institute of Aqueducts and Sewers.\n\nArticle 2-The Central and Decentralized Public Administration, within the framework of interinstitutional cooperation, shall contribute, in accordance with the powers attributed to them by current legislation, in a prioritized and effective manner with investment in infrastructure, training, environmental recovery-conservation, when the Costa Rican Institute of Aqueducts and Sewers formalizes alliances in order to contribute to the development of the Project.\n\nArticle 3-The financing processes necessary for the feasibility studies as well as for the construction of the Project by the Costa Rican Institute of Aqueducts and Sewers shall receive expeditious and effective processing to secure the necessary authorizations from the Ministry of Finance, MIDEPLAN, the Central Bank of Costa Rica, the Budgetary Authority, and the National Treasury. The same shall apply to the procedures and requests that SENARA must manage for the implementation of the Project and all works associated with it, before the different Public Entities and Bodies.\n\nArticle 4-The National Environmental Technical Secretariat (SETENA) shall provide prioritized and expeditious treatment to the procedures for the determination of environmental viability (viabilidad ambiental), as well as to any requirement necessary for the prompt and adequate execution of the Project.\n\nArticle 5-It shall be effective as of this date.\n\nGiven in the city of Nicoya, Guanacaste, on the twenty-fifth day of July, two thousand eight." }
