Ambos deberán\ncontar con formación de auditores de calidad, debiendo tener cursos o módulos\nde auditor calidad documentados por al menos 50 horas.\n\n     Adicionalmente\ndeberán:\n\n.     Estar\nincorporados al Colegio Federado de Ingenieros y Arquitectos, debiendo estar al\ndía con sus obligaciones.\n\n.    \nTener una experiencia mínima de 3 años desde su incorporación al Colegio\nFederado de Ingenieros y Arquitectos.\n\n.     Se\ntomará como experiencia su participación en auditorías de calidad de cualquier\ntipo y/o contratación, ejecución, fiscalización de proyectos de vialidad (uno o\nvarios siempre que se hayan dado labores mayoritariamente continuas), tanto de\nmantenimiento, rehabilitación, mejoramiento, reconstrucción o construcción\nnueva, así como en investigación aplicada en Ingeniería de Pavimentos.\n\nb)  Contar con un experto técnico\nque deberá ser un licenciado en Ingeniería Civil o en Ingeniería en\nConstrucción con experiencia mínima de 3 años en ejecución de proyectos viales.\nSe tomará como experiencia su participación en la contratación, ejecución,\nfiscalización de proyectos de vialidad, tanto de mantenimiento, rehabilitación,\nmejoramiento, reconstrucción o construcción nueva, así como en investigación\naplicada a la construcción de proyectos viales.\"\n\n \"Artículo\n24.-Causas de exclusión. Son causas que facultan a\nla Institución\npara la exclusión del registro a las organizaciones, las siguientes:\n\na)  Muerte o extinción de la\npersona física o jurídica.\n\nb)  La manifestación\nexpresa del proveedor inscrito.\n\nc)  La inhabilitación\nde conformidad con el artículo 100 de la\n Ley de Contratación Administrativa.\n\nd)  Por decisión de\nla Administración\nde no continuar contratando las auditorías técnicas para los proyectos siempre\nque medien motivos de interés público, caso fortuito o fuerza mayor.\n\ne)  Por la no atención\nde la organización, en el plazo conferido, a los requerimientos legales,\ntécnicos y financieros, solicitados por\nla Administración.\n\nf)   La presentación\nde información falsa, sobre aspectos técnicos o legales relevantes para su\ninscripción.\n\ng)  Cuando se determine\nque la organización ha incurrido en prácticas de competencia desleal.\n\nh)  Cuando en la\nejecución del contrato, la organización haya violado alguna normativa interna o\nrelacionada con el pago de impuestos.\n\ni)   Cuando la\norganización haya alcanzado el monto límite por multas, procediendo la\nresolución del contrato.\n\nj)   Cuando por la\nevaluación del desempeño sea no aceptable.\n\nk)  Cuando se compruebe\nque se ha llevado a cabo alguna actividad que haya puesto en peligro la\nconfianza en la independencia de juicio e integridad de la organización, en\nrelación con las actividades de auditoría que realiza.\n\nl)   Por el\nvencimiento o expiración del plazo de inscripción -seis meses- y no haya\ninterés por parte del proveedor de renovar su oferta en el registro de\nelegibles.\n\nm)  Cuando al cabo de\nlos 12 meses de vigencia no se haya suministrado evidencia de capacitación\nadicional de los auditores en gestión de calidad y/o auditorías técnicas por un\ntotal de 50 horas. Both must have quality auditor training, and must have documented quality auditor courses or modules for at least 50 hours.\n\nAdditionally, they must:\n\n. Be incorporated into the Federated College of Engineers and Architects (Colegio Federado de Ingenieros y Arquitectos), and must be up to date with their obligations.\n\n. Have a minimum of 3 years of experience since their incorporation into the Federated College of Engineers and Architects.\n\n. Their participation in quality audits of any type and/or contracting, execution, supervision (fiscalización) of road projects (one or several as long as the work was mostly continuous), whether maintenance, rehabilitation, improvement, reconstruction, or new construction, as well as in applied research in Pavement Engineering, will be considered as experience.\n\nb) Have a technical expert who must hold a bachelor's degree (licenciado) in Civil Engineering or Construction Engineering with a minimum of 3 years of experience in the execution of road projects. Their participation in the contracting, execution, supervision (fiscalización) of road projects, whether maintenance, rehabilitation, improvement, reconstruction, or new construction, as well as in applied research in the construction of road projects, will be considered as experience.\"\n\n\"Article 24.-Causes for Exclusion. The following are causes that empower the Institution\nto exclude organizations from the registry:\n\na) Death or dissolution of the natural or legal person.\n\nb) The express manifestation of the registered supplier.\n\nc) Disqualification (inhabilitación)\nin accordance with Article 100 of the\nAdministrative Contracting Law (Ley de Contratación Administrativa).\n\nd) By decision of the Administration\nnot to continue contracting technical audits for the projects, provided there are reasons of public interest, fortuitous event, or force majeure.\n\ne) Due to the organization's failure to address, within the granted period, the legal,\ntechnical, and financial requirements requested by\nthe Administration.\n\nf) The presentation\nof false information regarding technical or legal aspects relevant to its\nregistration.\n\ng) When it is determined\nthat the organization has engaged in unfair competition practices.\n\nh) When, in the\nexecution of the contract, the organization has violated any internal regulation or one\nrelated to the payment of taxes.\n\ni) When the\norganization has reached the limit amount for fines, leading to the\nresolution of the contract.\n\nj) When the\nperformance evaluation is unacceptable.\n\nk) When it is proven\nthat any activity has been carried out that has endangered\ntrust in the independence of judgment and integrity of the organization, in\nrelation to the audit activities it performs.\n\nl) Due to the\nexpiration or end of the registration term -six months- and the supplier has no\ninterest in renewing its offer in the eligible registry (registro de\nelegibles).\n\nm) When, after the\n12-month validity period, no evidence has been provided of additional training of the auditors in quality management and/or technical audits for a\ntotal of 50 hours. Except for technical auditors (auditores técnicos) with training of 300\nhours or more, either because this is recorded in the eligible registry at the time of\nregistration, or because through additional training during execution, the hours were\ncompleted and the supporting documentation is provided.\"\n\n\"Article 44.-On the Execution Period.\nThe Office of the Comptroller General of the Republic,\nthrough official communication Nº 08299 (DCA-2439) of August 13, 2008, established the\nvalidity of this special contracting system as 24 months, counted\nfrom the notification of that official communication; thus, the execution period of\nthe contracts generated under this Regulation shall be one year,\nwhich may be extended at the discretion of\nthe Administration.\"\n\nThe other articles and\nprovisions established in the Special Regulation for this contracting that\nare not modified by this publication shall remain unchanged and\nvalid for their application in accordance with the content provided for each\nof them." }
