reformas;\nla Ley Nº 7788, Ley de\nBiodiversidad de 30 de abril de 1998; el Decreto Ejecutivo Nº 32452-H de 29 de\njunio de 2005 y sus reformas, el Decreto Ejecutivo Nº 33646-H de 9 de marzo de\n2007 y sus reformas.\n\nConsiderando:\n\n1º-Que\nla Ley Orgánica del Ambiente Nº 7554, publicada en\nLa Gaceta Nº 215 de\n13 de noviembre de 1995 y sus reformas, establece que el Estado debe velar por\nla utilización racional de los elementos ambientales, con el fin de proteger y\nmejorar la calidad de vida de los habitantes del territorio nacional. Asimismo,\nestá obligado a propiciar un desarrollo económico y ambientalmente sostenible,\nentendido como el desarrollo que satisface las necesidades humanas básicas, sin\ncomprometer las opciones de las generaciones futuras.\n\n2º-Que el Fondo de Parques Nacionales creado mediante Ley Nº 6084, Ley\ndel Servicio de Parques Nacionales, publicada en\nLa Gaceta Nº 169 de 7\nde setiembre de 1977 y sus reformas, está administrado por el Sistema Nacional\nde Áreas de Conservación, según lo establecido en\nla Ley Nº 7788, Ley de\nBiodiversidad, publicada en La\n Gaceta Nº 101 de 27 de mayo de 1998.\n\n3º-Que el Fondo de Parques Nacionales requiere incorporar recursos\nadicionales para atender gastos operativos en las siguientes partidas: pago de\nservicios, materiales y suministros y transferencias corrientes, por lo que\nsolicita incrementar el gasto presupuestario máximo aprobado para el 2008, en\n¢577.580.000,00 (quinientos setenta y siete millones quinientos ochenta mil\ncolones exactos).\n\n4º-Que del monto citado en el considerando anterior, ¢397.580.000,00\n(trescientos noventa y siete millones quinientos ochenta mil colones exactos)\ncorresponden a recursos propios provenientes del aumento en las tarifas de\nentrada a las Áreas Silvestres Protegidas, autorizadas mediante el Decreto\nEjecutivo Nº 34164-MINAE, publicado en\nLa Gaceta Nº 7 de 10 de enero de 2008, con\nlos cuales financiarán gastos en las partidas de servicios, materiales y\nsuministros y transferencias corrientes y ¢180.000.000,00 (ciento ochenta\nmillones de colones exactos) provenientes de Superávit Libre, que se destinarán\na gastos en equipo de transporte.\n\n5º-Que mediante el Decreto Ejecutivo Nº 32452-H, publicado en\nLa Gaceta Nº 130 de 6\nde julio de 2005 y sus reformas, se emite el Lineamiento para la aplicación del\nartículo 6º de la Ley Nº\n8131 de la\n Administración Financiera de\nla República y\nPresupuestos Públicos y la regulación de la clase de ingresos del Sector\nPúblico denominada Financiamiento.\n\n6º-Que el artículo 7º del Decreto supra citado, dispone que los\nrecursos provenientes del superávit libre forman parte del patrimonio de los\nórganos y las entidades y pueden utilizarlos en períodos subsiguientes para\nfinanciar gastos que se refieran a su actividad ordinaria, con los cuales se\natienda el interés de la colectividad, el servicio público y los fines\ninstitucionales, que como los aquí incluidos, no tienen carácter permanente ni\ngeneran una obligación que requiera financiarse a través del tiempo.\n\n7º-Que mediante el Decreto Ejecutivo Nº 33646-H, publicado en\nLa Gaceta Nº 58 de 22\nde marzo de 2007 y sus reformas, se emitieron las Directrices Generales de\nPolítica Presupuestaria para el año 2008, estableciéndose en el artículo 1º del\ncitado Decreto, el gasto presupuestario máximo del año 2008 para las\ninstituciones cubiertas por el ámbito de\nla Autoridad Presupuestaria.\n\n8º-Que mediante el Decreto Ejecutivo Nº 34178-H, publicado en\nLa Gaceta Nº 34 de 18\nde febrero de 2008, se modificó el gasto presupuestario máximo autorizado al\nFondo de Parques Nacionales para el año 2008, fijándolo en la suma de\n¢3.642.360.000,00 (tres mil seiscientos cuarenta y dos millones trescientos\nsesenta mil colones exactos).\n\n9º-Que el señor Ministro Rector del Sector Ambiente, Energía y\nTelecomunicaciones, mediante el oficio DM-477-2008 de 8 de mayo de 2008, avala\nla solicitud planteada por el Fondo de Parques Nacionales.\n\n10.-Que por lo anterior, resulta necesario modificar el gasto\npresupuestario máximo fijado para el Fondo de Parques Nacionales para el año\n2008, incrementándolo en la suma de ¢577.580.000,00 (quinientos setenta y siete\nmillones quinientos ochenta mil colones exactos). Likewise,\nit is obliged to promote an economically and environmentally sustainable development,\nunderstood as development that satisfies basic human needs, without\ncompromising the options of future generations.\n\n2º-That the National Parks Fund created through Law Nº 6084, the Law\nof the National Parks Service, published in\nLa Gaceta Nº 169 of 7\nSeptember 1977 and its amendments, is administered by the National System\nof Conservation Areas, as established in\nLaw Nº 7788, the Biodiversity\nLaw, published in La\nGaceta Nº 101 of 27 May 1998.\n\n3º-That the National Parks Fund requires incorporating additional\nresources to meet operating expenses in the following line items: payment of\nservices, materials and supplies, and current transfers, and therefore\nrequests an increase in the maximum budgetary expenditure approved for 2008, in\nthe amount of ¢577,580,000.00 (exactly five hundred seventy-seven million five hundred eighty thousand\ncolones).\n\n4º-That of the amount cited in the preceding considerando, ¢397,580,000.00\n(exactly three hundred ninety-seven million five hundred eighty thousand colones)\ncorrespond to own resources coming from the increase in entrance\nfees to Protected Wild Areas, authorized through Executive\nDecree Nº 34164-MINAE, published in\nLa Gaceta Nº 7 of 10 January 2008, with\nwhich they will finance expenses in the line items of services, materials and\nsupplies, and current transfers, and ¢180,000,000.00 (exactly one hundred eighty\nmillion colones) coming from Free Surplus, which will be allocated\nto expenses in transportation equipment.\n\n5º-That through Executive Decree Nº 32452-H, published in\nLa Gaceta Nº 130 of 6\nJuly 2005 and its amendments, the Guideline for the application of\narticle 6 of Law Nº\n8131 of the\nFinancial Administration of\nthe Republic and\nPublic Budgets and the regulation of the class of revenues of the Public\nSector called Financing is issued.\n\n6º-That article 7 of the above-cited Decree provides that the\nresources coming from the free surplus form part of the equity of the\norgans and entities and can be used in subsequent periods to\nfinance expenses referring to their ordinary activity, with which\nthe interest of the community, the public service, and the institutional\npurposes are served, which, like those included herein, do not have a permanent character nor\ngenerate an obligation that requires financing over time.\n\n7º-That through Executive Decree Nº 33646-H, published in\nLa Gaceta Nº 58 of 22\nMarch 2007 and its amendments, the General Budgetary Policy\nDirectives for the year 2008 were issued, establishing in article 1 of\nthe cited Decree, the maximum budgetary expenditure for the year 2008 for\nthe institutions covered by the scope of\nthe Budgetary Authority.\n\n8º-That through Executive Decree Nº 34178-H, published in\nLa Gaceta Nº 34 of 18\nFebruary 2008, the maximum budgetary expenditure authorized for\nthe National Parks Fund for the year 2008 was modified, setting it at the sum of\n¢3,642,360,000.00 (exactly three billion six hundred forty-two million three hundred\nsixty thousand colones).\n\n9º-That the Rector Minister of the Environment, Energy and\nTelecommunications Sector, through official communication DM-477-2008 of 8 May 2008, endorses\nthe request made by the National Parks Fund.\n\n10.-That due to the foregoing, it is necessary to modify the maximum budgetary\nexpenditure set for the National Parks Fund for the year\n2008, increasing it by the sum of ¢577,580,000.00 (exactly five hundred seventy-seven\nmillion five hundred eighty thousand colones).
