Por cuanto:\n\n \n\nEn la ciudad de San José, Costa Rica, el día tres de\noctubre del dos mil ocho, se suscribió la Carta de Intenciones en materia\nAgropecuaria y Rural entre el Ministerio Agropecuario y Forestal de Nicaragua y\nel Gobierno de Costa Rica, a través del Ministerio de Agricultura y Ganadería,\nfirmando por la República de Costa Rica el señor Edgar Ugalde\nÁlvarez, Viceministro de Relaciones Exteriores y Culto.\n\n \n\nConsiderando:\n\n \n\n1º-Que la presente Carta de Intenciones, se\nfundamenta en el artículo 8, inciso g) del Tratado de Integración Social\nCentroamericana, aprobado por la Asamblea Legislativa mediante Ley 7631 del 26\nde setiembre de 1996, que establece que los Estados Partes se comprometen a\nestablecer mecanismos de cooperación e intercambio de metodologías, recursos y\ntecnologías entre los países miembros.\n\n2º-Que la mencionada Carta de Intenciones tiene como objeto establecer\nun mecanismo de cooperación orientado al desarrollo de las capacidades\ninstitucionales del sector agropecuario y medio rural como: la investigación,\ndifusión, capacitación y operación de un amplio programa dirigido a atender y\nprocurar el desarrollo del sector agropecuario y medio rural. Por tanto,\n\nEn uso de las facultades conferidas por el artículo\n140, incisos 10) y 12) de la Constitución Política.\n\n \n\nDECRETAN:\n\n \n\nArtículo 1º-Promulgar teniendo como vigente para los\nefectos internos y externos, la Carta de Intenciones en materia Agropecuaria y\nRural entre el Ministerio Agropecuario y Forestal de Nicaragua y el Gobierno de\nCosta Rica, a través del Ministerio de Agricultura y Ganadería, suscrita en la\nciudad de San José, Costa Rica, el día tres de octubre de dos mil ocho, cuyo\ntexto literal es el siguiente:\n\n \n\nCARTA DE\nINTENCIONES EN MATERIA AGROPECUARIA Y RURAL\n\nENTRE EL MINISTERIO AGROPECUARIO Y FORESTAL DE\n\nNICARAGUA Y EL GOBIERNO DE COSTA RICA, A TRAVÉS DEL\n\nMINISTERIO DE AGRICULTURA Y GANADERÍA\n\n \n\nEl Ministerio Agropecuario y Forestal de Nicaragua y el Gobierno de\nCosta Rica, a través del Ministerio de Agricultura y Ganadería de Costa Rica,\nen adelante \"las Partes\",\n\n \n\nCONSIDERANDO\n\n \n\n1.  Que ambos Ministerios entienden la\nimportancia de la cooperación en materia agropecuaria y rural, como un valioso\ninstrumento que se constituye en un aporte al desarrollo económico y social de\nsus respectivos países;\n\n2.  Que el intercambio de experiencias,\nformación y capacitación, en materia agropecuaria y rural en el ámbito público y\nprivado contribuirá al mejoramiento de las condiciones socioeconómicas en ambos\npaíses;\n\n3.  Que la suscripción de la presente Carta de\nIntenciones entre ambas Partes refleja el interés especial por ampliar y\nprofundizar el conocimiento mutuo en el ámbito del sector agropecuario;\n\n4.  Que estos esfuerzos representan un aporte\nsignificativo orientado a fomentar una mayor interacción entre los sectores\npúblicos de ambos países, en aras de contribuir al mejoramiento de sus\ncapacidades competitivas, a la mejoría de los servicios y servidores públicos\ndel sector, así como para facilitar la inserción del sector agropecuario y\nactividades conexas en los mercados internacionales.\n\n5.  El deseo de ambas instituciones de\nestablecer a futuro un amplio Programa de Cooperación en materia agropecuaria y\nrural, y\n\n6.  Que el presente instrumento jurídico se\nfundamenta en los propósitos y principios del Protocolo de Tegucigalpa y en el\nartículo 8 inciso g) del Tratado de la Integración Social Centroamericana, que\npromueve la cooperación entre los Estados miembros del Sistema de la\nIntegración Centroamericana.\n\n \n\nMANIFIESTAN SU FIRME INTENCIÓN DE:\n\n \n\nArtículo 1. Objeto.\n\n \n\nEstablecer un mecanismo de cooperación orientado al\ndesarrollo de las capacidades institucionales del sector agropecuario y medio\nrural como: la investigación, difusión, capacitación y operación de un amplio\nprograma dirigido a atender y procurar el desarrollo del sector agropecuario y\nmedio rural.\n\nArtículo 2. Desarrollo y Seguimiento.\n\n \n\nDesignar como puntos focales para desarrollar y darle seguimiento a los\nalcances de esta Carta de Intenciones, a los Responsables de la Cooperación\nInternacional de ambas partes, con el objetivo de coordinar, así como definir\nun marco estable de colaboración para el desarrollo de programas y proyectos\nconjuntos, que redunden en el beneficio mutuo y en la consolidación de los vínculos\nentre el sector agropecuario de ambos países.\n\nEn este sentido, las Partes tendrán las siguientes responsabilidades:\n\n1.  Desarrollar un programa de trabajo para promover la\nimplementación de la Carta de Intenciones.\n\n2.  Establecer los mecanismos de\nseguimiento oportunos para lograr los objetivos de esta Carta de Intenciones e\nintercambiar información sobre el progreso de los programas, proyectos y\nactividades de cooperación;\n\n3.  Evaluar los programas y\nresultados obtenidos por medio de esta Carta;\n\n4.  Preparar nuevos programas dentro\ndel objeto original que, eventualmente, podrán cubrir otras áreas de interés\nmutuo, que no se encuentren contemplados en esta Carta de Intenciones, y que se\nformalizarían mediante Anexos que formarán parte integrante del presente\ninstrumento;\n\n5.  Emprender cualesquiera otras\nactividades que las Partes acuerden.\n\nArtículo 5. Programa de Trabajo y Áreas Prioritarias de Cooperación.\n\n \n\n1.  Acordar un programa de trabajo que refleje las prioridades\nnacionales para las actividades de cooperación. El programa de trabajo puede\nincluir actividades de largo, mediano y corto plazo, relacionadas con:\n\na.   El fortalecimiento de los sistemas de gestión en\nmateria agropecuaria y de desarrollo rural de cada una de las Partes, incluidos\nel fortalecimiento de los marcos institucionales y legales, y la capacidad para\ndesarrollar, aplicar, administrar y hacer cumplir la legislación en estas\nmaterias.\n\nb.  El desarrollo y promoción de\nincentivos y otros mecanismos voluntarios y flexibles, a efectos de fomentar el\ndesarrollo de la agricultura y el medio rural, incluyendo el desarrollo de\niniciativas de mercado para el sector.\n\nc.   El fomento de asociaciones\ny alianzas estratégicas empresariales para abordar temas actuales y futuros.\n\n2.  El Programa de Trabajo inicial de manera prioritaria entre\notras acciones contemplará:\n\na.   Intercambio sobre el desarrollo de las actividades\nagropecuarias que se desarrollan en ambos países;\n\nb.  Intercambio de información\nrelevante para toma de decisiones de productores y productoras del sector\nagropecuario,\n\nc.   Intercambio de información\ny experiencias en materia de aplicación de normas sanitarias y fitosanitarias y\ndel desarrollo rural territorial;\n\nd.  Facilitación en el desarrollo y\nla transferencia de tecnología, y la capacitación para promover el desarrollo\nde la agricultura sostenible\n\ne.   Organización de\nencuentros que faciliten la vinculación de negocios entre los pequeños y\nmedianos productores del sector;\n\nf.   Intercambio de información\nen materia de legislación y reglamentación sanitario nacional que rige en cada\npaís, para la administración del recurso pesquero, acuícola y agropecuario.\n\ng.  Estimular y facilitar según sea\napropiado, contactos directos y cooperación entre las entidades\ngubernamentales, organizaciones multilaterales, fundaciones, universidades,\ncentros de investigación, organizaciones no gubernamentales, instituciones del\nEstado, empresas y otras entidades, para emprender actividades de cooperación\nque contribuyan al desarrollo integral del sector agropecuario y medio rural en\nsus respectivos países.\n\nLas formas de financiación de las actividades a desarrollar a partir\nde la presente Carta serán decididas por las Partes en cada caso concreto.\n\nArtículo 6. Recursos.\n\n \n\n1.  Desarrollar todas las actividades de cooperación en el marco\nde esta Carta de Intenciones, de conformidad con la disponibilidad de fondos,\nrecursos humanos, y de otra índole, así como a las leyes y regulaciones\naplicables en sus respectivos Estados.\n\n2.  Considerar, para la elaboración\nde los planes de trabajo conjuntos, los mecanismos a través de los cuales se\npuedan financiar las actividades de cooperación, así como la asignación\nadecuada de recursos humanos, tecnológicos, materiales y organizativos que sean\nnecesarios para la efectiva ejecución de actividades de cooperación, de\nconformidad con las capacidades de las Partes. Los siguientes mecanismos de\nfinanciamiento pueden ser considerados para la cooperación en materia\nagropecuaria y de desarrollo rural:\n\na.   Actividades de cooperación financiadas de manera\ncoordinada, según lo acuerden las Partes;\n\nb.  Actividades de cooperación en\nlas que cada institución, asuma los costos de su propia participación; y\n\nc.   Actividades de cooperación\nfinanciadas, según sea apropiado, por instituciones privadas, fundaciones, u\norganizaciones no gubernamentales, organizaciones públicas internacionales,\ninclusive por medio de programas en curso; o\n\nd.  Mediante una combinación de las\nanteriores.\n\nArtículo 7. Entrada en Vigor, Retiro, Enmiendas.\n\n \n\n1.  La presente Carta de Intenciones tendrá un plazo inicial de\ncuatro años pudiendo renovarse previo acuerdo entre las partes, por períodos\niguales y entrará en vigor en la fecha en que las Partes comuniquen, por la vía\ndiplomática, el cumplimiento de sus requisitos internos.\n\n2.  Esta Carta de intenciones podrá\nser denunciada por cualquiera de las Partes, por la vía diplomática, en\ncualquier momento. Whereas:\n\nIn the city of San José, Costa Rica, on the third day of\nOctober of two thousand eight, the Letter of Intent on Agricultural\nand Rural Matters was signed between the Ministry of Agriculture and Forestry of Nicaragua and\nthe Government of Costa Rica, through the Ministry of Agriculture and Livestock,\nsigned on behalf of the Republic of Costa Rica by Mr. Edgar Ugalde\nÁlvarez, Vice Minister of Foreign Affairs and Worship.\n\nConsidering:\n\n1º-That this Letter of Intent is\nbased on Article 8, subsection g) of the Central American Social Integration Treaty,\napproved by the Legislative Assembly through Law 7631 of September 26,\n1996, which establishes that the States Parties undertake to\nestablish mechanisms for cooperation and exchange of methodologies, resources, and\ntechnologies among member countries.\n\n2º-That the purpose of the aforementioned Letter of Intent is to establish\na cooperation mechanism aimed at developing the institutional\ncapacities of the agricultural and rural sector, such as: research,\ndissemination, training, and operation of a broad program aimed at addressing and\npromoting the development of the agricultural and rural sector. Therefore,\n\nIn exercise of the powers conferred by Article\n140, subsections 10) and 12) of the Political Constitution.\n\nHEREBY DECREE:\n\nArticle 1º-To promulgate, having as valid for\ninternal and external purposes, the Letter of Intent on Agricultural and\nRural Matters between the Ministry of Agriculture and Forestry of Nicaragua and the Government of\nCosta Rica, through the Ministry of Agriculture and Livestock, signed in the\ncity of San José, Costa Rica, on the third day of October of two thousand eight, whose\nverbatim text is as follows:\n\nLETTER OF\nINTENT ON AGRICULTURAL AND RURAL MATTERS\n\nBETWEEN THE MINISTRY OF AGRICULTURE AND FORESTRY OF\n\nNICARAGUA AND THE GOVERNMENT OF COSTA RICA, THROUGH THE\n\nMINISTRY OF AGRICULTURE AND LIVESTOCK\n\nThe Ministry of Agriculture and Forestry of Nicaragua and the Government of\nCosta Rica, through the Ministry of Agriculture and Livestock of Costa Rica,\nhereinafter \"the Parties\",\n\nCONSIDERING\n\n1. That both Ministries understand the\nimportance of cooperation on agricultural and rural matters, as a valuable\ninstrument that constitutes a contribution to the economic and social development of\ntheir respective countries;\n\n2. That the exchange of experiences,\neducation, and training in agricultural and rural matters in the public and\nprivate sphere will contribute to the improvement of socioeconomic conditions in both\ncountries;\n\n3. That the signing of this Letter of\nIntent between both Parties reflects the special interest in broadening and\ndeepening mutual knowledge in the field of the agricultural sector;\n\n4. That these efforts represent a significant\ncontribution aimed at fostering greater interaction between the\npublic sectors of both countries, in order to contribute to the improvement of\ntheir competitive capacities, to the improvement of the services and public servants\nof the sector, as well as to facilitate the integration of the agricultural sector and\nrelated activities into international markets.\n\n5. The desire of both institutions to\nestablish in the future a broad Cooperation Program on agricultural and\nrural matters, and\n\n6. That this legal instrument is\nbased on the purposes and principles of the Tegucigalpa Protocol and on\nArticle 8, subsection g) of the Central American Social Integration Treaty,\nwhich promotes cooperation among the member States of the Central American\nIntegration System.\n\nHEREBY EXPRESS THEIR FIRM INTENTION TO:\n\nArticle 1. Purpose.\n\nEstablish a cooperation mechanism aimed at the\ndevelopment of the institutional capacities of the agricultural and rural\nsector, such as: research, dissemination, training, and operation of a broad\nprogram directed at addressing and promoting the development of the agricultural and\nrural sector.\n\nArticle 2. Content.\n\nEstablish a Work Program between the parties, which allows them, in a\ncoordinated manner, to promote and support the development, growth, stability, and\nglobal competitiveness of the agricultural and rural sector, being able to count\non the collaboration of the private sector, public and private bodies and\ninstitutions for its execution, in order to achieve the objective set forth\nin Article 1.\n\nArticle 3. Modalities and Forms of Cooperation.\n\nImplement, through institutional activities, the cooperation to\nbe developed under this Letter of Intent, taking into consideration the\nprovisions of cooperation on agricultural and rural development matters,\nbased on joint technical assistance programs that may include:\n\na. The joint organization of study visits, consultancies,\nconferences, seminars, workshops, meetings, exchange of experiences between\nprofessionals, technicians, and specialists from the private, academic, and\ngovernment sectors, to strengthen the development, implementation, and analysis of policies\nand standards on agricultural and rural matters;\n\nb. The facilitation to promote\nthe development and/or exchange of best practices, information, and data, on\nagricultural and rural matters, likely to be of interest to both Parties;\n\nc. The compilation,\npublication, and exchange of information on policies, laws, standards,\nregulations, and development indicators for the agricultural and rural sector, as well\nas on the mechanisms for compliance with legal standards;\n\nd. Any other modality agreed upon\nby the Parties.\n\nArticle 4. Development and Follow-up.\n\nDesignate as focal points to develop and follow up on\nthe scope of this Letter of Intent, the Heads of International\nCooperation of both parties, with the objective of coordinating, as well as defining\na stable framework of collaboration for the development of joint programs and projects,\nwhich result in mutual benefit and the consolidation of ties\nbetween the agricultural sector of both countries.\n\nIn this sense, the Parties shall have the following responsibilities:\n\n1. Develop a work program to promote the\nimplementation of the Letter of Intent.\n\n2. Establish the appropriate follow-up\nmechanisms to achieve the objectives of this Letter of Intent and\nexchange information on the progress of cooperation programs, projects, and\nactivities;\n\n3. Evaluate the programs and\nresults obtained through this Letter;\n\n4. Prepare new programs within\nthe original purpose that, eventually, may cover other areas of mutual\ninterest not contemplated in this Letter of Intent, and which would\nbe formalized through Annexes that will form an integral part of this\ninstrument;\n\n5. Undertake any other\nactivities agreed upon by the Parties.\n\nArticle 5. Work Program and Priority Cooperation Areas.\n\n1. Agree on a work program that reflects the national\npriorities for cooperation activities. The work program may\ninclude long, medium, and short-term activities related to:\n\na. The strengthening of management systems for\nagricultural and rural development matters in each of the Parties, including\nthe strengthening of institutional and legal frameworks, and the capacity\nto develop, apply, administer, and enforce legislation in these\nmatters.\n\nb. The development and promotion of\nincentives and other voluntary and flexible mechanisms, in order to foster the\ndevelopment of agriculture and the rural environment, including the development of\nmarket initiatives for the sector.\n\nc. The promotion of business\nassociations and strategic alliances to address current and future issues.\n\n2. The initial Work Program, on a priority basis, among\nother actions, will contemplate:\n\na. Exchange on the development of agricultural\nactivities carried out in both countries;\n\nb. Exchange of relevant\ninformation for decision-making by producers in the agricultural\nsector;\n\nc. Exchange of information\nand experiences regarding the application of sanitary and phytosanitary standards\nand territorial rural development;\n\nd. Facilitation in the development and\ntransfer of technology, and training to promote the development\nof sustainable agriculture;\n\ne. Organization of\nmeetings that facilitate business linkages between small and\nmedium-sized producers in the sector;\n\nf. Exchange of information\non national sanitary legislation and regulations that govern in each\ncountry, for the management of fishery, aquaculture, and agricultural resources.\n\ng. Stimulate and facilitate, as\nappropriate, direct contacts and cooperation between governmental\nentities, multilateral organizations, foundations, universities,\nresearch centers, non-governmental organizations, State\ninstitutions, companies, and other entities, to undertake cooperation activities\nthat contribute to the comprehensive development of the agricultural and rural sector in\ntheir respective countries.\n\nThe forms of financing the activities to be developed from\nthis Letter shall be decided by the Parties in each specific case.\n\nArticle 6. Resources.\n\n1. Develop all cooperation activities within the framework\nof this Letter of Intent, in accordance with the availability of funds,\nhuman, and other resources, as well as with the applicable laws and regulations\nin their respective States.\n\n2. Consider, for the elaboration\nof joint work plans, the mechanisms through which\ncooperation activities may be financed, as well as the adequate\nallocation of human, technological, material, and organizational resources\nnecessary for the effective execution of cooperation activities, in\naccordance with the capacities of the Parties. The following financing\nmechanisms may be considered for cooperation on agricultural\nand rural development matters:\n\na. Cooperation activities financed in a\ncoordinated manner, as agreed by the Parties;\n\nb. Cooperation activities in\nwhich each institution assumes the costs of its own participation; and\n\nc. Cooperation activities\nfinanced, as appropriate, by private institutions, foundations, or\nnon-governmental organizations, international public organizations,\nincluding through ongoing programs; or\n\nd. Through a combination of the\nabove.\n\nArticle 7. Entry into Force, Withdrawal, Amendments.\n\n1. This Letter of Intent shall have an initial term of\nfour years and may be renewed by prior agreement between the parties, for\nequal periods, and shall enter into force on the date the Parties communicate, through\ndiplomatic channels, the fulfillment of their internal requirements.\n\n2. This Letter of Intent may\nbe denounced by either Party, through diplomatic channels, at\nany time. The denunciation shall take effect six months after\nthe date of its communication to the other Party.\n\nThe denunciation shall not affect the completion of the activities\nstarted during its validity and that are in progress.\n\n3. This Letter of Intent may\nbe amended by mutual consent and shall enter into force, in accordance\nwith the first paragraph of this article.\n\nWe sign, in the city of San José, Costa Rica, at sixteen hundred hours\non the third day of October of the year two thousand eight, in two copies of equal legal value.\n\nFor the Government of Costa Rica For\nthe Government of Nicaragua\n\nEdgar Ugalde Álvarez Valdrack\nJaentschke\n\nVice Minister of Foreign Vice Minister\n\nAffairs and Worship Secretary\nof External Cooperation\n\nArticle 2º-It shall be effective as of its publication.\n\nGiven at the Presidency of the Republic on the twenty-fourth day of the\nmonth of October of two thousand eight."
