Esta\nsituación se presenta de manera grave en las partes altas del cantón donde se\nencuentran las fuentes de agua y zonas de recarga.\n\nPor tanto, este Concejo\nMunicipal por unanimidad, acuerda declarar Pro tempore durante tres (3) meses\nprorrogables, para la siembra y establecimientos de nuevas áreas de\nexplotación, producción y agro industrial de piña, una moratoria en la parte\nsur del cantón por induvio pronatura, acogiéndose al artículo diecisiete (17)\nde la Ley de Biodiversidad\ny el articulo cincuenta (50) de nuestra Constitución Política, hasta tanto no\nse cuente con loa estudios técnicos de las siguientes instituciones:\n\n-    INTA-MAG\n(Estudio de capacidad de uso de suelo y la posible afectación por la\nsedimentación en los cuerpos de agua al lado sur y norte y la erosión del suelo\nen general)\n\n-    MINAE\nen las dependencias de ACTo (en cuanto a la afectación del recursos forestal),\naguas (por la posible afectación de los cuerpos de agua superficiales), SENARA\n(estudio Hidrogeológico y la posible afectación de las aguas subterráneas por\nla vulnerabilidad a la contaminación por infiltración agroquímicos y otros)\n\n-   \nDepartamento Ambiental de Acueductos y Alcantarillados (por la posible\ncontaminación del recurso hídrico para el consumo humano, Museo Nacional\n(Estudio arqueológico)\n\n-    Ministerio\nde Salud (posible afectación en la salud de las personas por el riego de\nlos agroquímicos y por el consumo de agua debido a la cercanía de las empresas\npiñeras a la comunidad.\n\nY que los mismos indiquen que no está en riesgo la\npoblación, el ambiente y el recursos hídrico.\n\nAcuerdo Nº 1. This situation occurs severely in the upper parts of the canton where water sources and recharge zones are located.\n\nTherefore, this Municipal Council unanimously agrees to declare Pro tempore for three (3) months, extendable, for the planting and establishment of new areas of exploitation, production, and agro-industry of pineapple, a moratorium in the southern part of the canton by indiviso pronatura, invoking article seventeen (17) of the Biodiversity Law and article fifty (50) of our Political Constitution, until such time as the technical studies from the following institutions are available:\n\n- INTA-MAG (Study of land-use capacity and the possible impact from sedimentation in the water bodies on the south and north sides and soil erosion in general)\n- MINAE in the dependencies of ACTo (regarding the impact on forest resources), water resources (due to the possible impact on surface water bodies), SENARA (Hydrogeological study and the possible impact on groundwater due to vulnerability to contamination by agrochemical infiltration and others)\n- Environmental Department of Acueductos y Alcantarillados (due to the possible contamination of the water resource for human consumption), Museo Nacional (Archaeological study)\n- Ministerio de Salud (possible impact on people's health from the spraying of agrochemicals and from water consumption due to the proximity of the pineapple companies to the community).\n\nAnd that said studies indicate that the population, the environment, and the water resource are not at risk.\n\nAcuerdo Nº 1.
