  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 34973\n\n                        Se incluye el cantón de Turrialba dentro de la declaratoria de emergencia\ncontemplado en el DE-34906 del 26 de noviembre de 2008\n\nTexto Completo acta: E51A9\nNº 34973-MP\n\nNº 34973-MP\n\n    (Este\n      decreto fue derogado por el artículo 1° del decreto ejecutivo N°\n      37140 del 13 de febrero del 2012)\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE\nLA PRESIDENCIA\n\nEn ejercicio de las facultades que les confieren los\nartículos 140, incisos 3) y 18), 146 y 180 de\nla Constitución\n Política, artículos 25 inciso 1), 27 inciso 1), 28 incisos b)\ny j), de la Ley Nº\n6227 del 2 de mayo de 1978 que es Ley General de\nla Administración\n Pública, y artículo 29 de\nla Ley Nº 8488 del 11 de enero del 2006, que es\nla Ley Nacional de\nEmergencias y Prevención del Riesgo.\n\nConsiderando:\n\n1º-Que un frente frío que afectó al país desde el día 20\nde noviembre de 2008, así como, la suma de un sistema de baja presión, ubicado\nen Panamá y el Caribe costarricense, además, de un sistema de alta presión\nubicado al norte de Centroamérica, fenómenos que interactuaron generando y\nmanteniendo condiciones de vientos de intensidad variable y un patrón lluvioso\nen el Caribe, Zona Norte y Valle Central, provocando un acumulado importante de\nprecipitación e inundaciones. Condiciones qué prevalecieron desde el 20 de\nnoviembre y hasta el día 04 de diciembre, todo lo cual consta en los informes\nemitidos por la\n Comisión Nacional de Prevención de Riesgos y Atención de\nEmergencias.\n\n2º-Estos fenómenos ocasionaron\ninundaciones en la cuenca del río Chirripó Atlántico, Sixaola, Reventazón, con\ndesbordamientos extensivos en las cuencas de los ríos Matina, Barbilla,\nReventazón, Palacios, Hone Creek, Rojo, Sarapiquí y sectores aledaños a la\ncosta.\n\n3º-Lo anterior provocó daños a\nlos bienes y a las personas, afectaciones de la infraestructura vial, las\ncomunicaciones, la agricultura, los servicios públicos y las viviendas, por lo\nque la\n Comisión Nacional de Prevención del Riegos y Atención de\nEmergencias, declaró alertas verde, amarilla y roja para las regiones y\ncantones más afectados del país.\n\n4º-Que como consecuencia de\nestos fenómenos se debió evacuar a las personas damnificadas y ubicarlas en\ndiferentes albergues instalados por\nla Comisión Nacional\nde Prevención de Riesgos y Atención de Emergencias.\n\n5º-Que para el día 26 de\nnoviembre de 2008, el Poder Ejecutivo firmó el Decreto de Emergencia Nacional,\nnúmero 34906-MP, que incluyó, todos los cantones de la provincia de Limón, el\ncantón de Sarapiquí de la provincia de Heredia, los cantones de Moravia y\nCoronado de la provincia de San José. Lo anterior de acuerdo con el informe de\ndaños producidos, que existía a la fecha de la firma del decreto.\n\n6º-Que los efectos del evento\nque generó la emergencia, se prolongaron hasta el 4 de diciembre de 2008,\nsiendo que para el día 5,\nla Comisión Nacional de Prevención de Riesgo y\natención de emergencias, levantó las alertas existentes.\n\n7º-Que el día 27 de noviembre\nde 2008, el comité municipal de emergencias del Cantón de Turrialba, emite un\nreporte sobre daños importantes en ese cantón de la provincia de Cartago, en el\nque se da cuenta de afectaciones de relevancia en el lugar.\n\n8º-Que la vida de la población\nes un bien de interés público tutelado por el Estado, quien debe velar por su\nprotección y por la seguridad de los habitantes y en general por la\nconservación del orden social.\n\n9º-Que\nla Ley Nacional de\nEmergencias y Prevención del Riesgo dispone que, en caso de calamidad pública,\nocasionada por hechos de la naturaleza o del hombre, que son imprevisibles o\nprevisibles pero inevitables y no puedan ser controlados, manejados ni\ndominados con las potestades ordinarias de que dispone el Gobierno, el Poder\nEjecutivo podrá declarar emergencia nacional, a fm de, integrar y definir las\nresponsabilidades y funciones de todos los organismos, entidades públicas y\nprivadas y poder brindar una solución acorde a la magnitud del desastre.\n\n10.-Que en razón de lo\nexpuesto, se hace necesaria la promulgación de un marco jurídico para tomar las\nmedidas de excepción, que señala\nla Constitución\n Política y la\n Ley Nacional de Emergencias y Prevención del Riesgo, para\nhacerle frente a los efectos ocasionados por este fenómeno hidrometeorológico y\nmitigar las consecuencias que ocasionó su impacto en las diferentes zonas del\npaís.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Regulation 34973\n\n                        The canton of Turrialba is included within the emergency declaration\ncontemplated in DE-34906 of November 26, 2008\n\nFull Text of record: E51A9\nNº 34973-MP\n\nNº 34973-MP\n\n    (This\n      decree was repealed by article 1 of Executive Decree N°\n      37140 of February 13, 2012)\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF\nTHE PRESIDENCY\n\nIn exercise of the powers conferred upon them by\narticles 140, subsections 3) and 18), 146, and 180 of\nthe Political Constitution, articles 25 subsection 1), 27 subsection 1), 28 subsections b)\nand j), of Law Nº\n6227 of May 2, 1978, which is the General Law of\nPublic Administration, and article 29 of\nLaw Nº 8488 of January 11, 2006, which is\nthe National Law of\nEmergencies and Risk Prevention.\n\nConsidering:\n\n1º-That a cold front that affected the country from the 20th\nof November, 2008, as well as the combination of a low-pressure system located\nin Panama and the Costa Rican Caribbean, in addition to a high-pressure system\nlocated north of Central America, phenomena which interacted generating and\nmaintaining conditions of winds of variable intensity and a rainy pattern\nin the Caribbean, Northern Zone and Central Valley, causing a significant accumulation of\nprecipitation and flooding. Conditions that prevailed from the 20th of\nNovember until the 4th of December, all of which is recorded in the reports\nissued by the\n National Commission for Risk Prevention and Emergency\nAttention.\n\n2º-These phenomena caused\nflooding in the Chirripó Atlántico, Sixaola, and Reventazón river basins, with\nextensive overflows in the basins of the Matina, Barbilla,\nReventazón, Palacios, Hone Creek, Rojo, Sarapiquí rivers and sectors adjacent to the\ncoast.\n\n3º-The above caused damage to\nproperty and persons, impacts on road infrastructure, communications,\nagriculture, public services, and housing, for which the\n National Commission for Risk Prevention and Emergency\nAttention declared green, yellow, and red alerts for the most affected regions and\ncantons of the country.\n\n4º-That as a consequence of\nthese phenomena, it was necessary to evacuate the affected persons and place them in\ndifferent shelters set up by\nthe National Commission\nfor Risk Prevention and Emergency Attention.\n\n5º-That on November 26,\n2008, the Executive Branch signed National Emergency Decree\nnumber 34906-MP, which included all the cantons of the province of Limón, the\ncanton of Sarapiquí of the province of Heredia, the cantons of Moravia and\nCoronado of the province of San José. The above in accordance with the\ndamage report produced that existed on the date of signing the decree.\n\n6º-That the effects of the event\nthat generated the emergency continued until December 4, 2008,\nsuch that on the 5th,\nthe National Commission for Risk Prevention and Emergency\nAttention lifted the existing alerts.\n\n7º-That on November 27,\n2008, the municipal emergency committee of the Canton of Turrialba issued a\nreport on significant damages in that canton of the province of Cartago, in\nwhich relevant impacts in the place are reported.\n\n8º-That the life of the population\nis a public-interest asset protected by the State, which must ensure its\nprotection and the security of the inhabitants and, in general, the\npreservation of social order.\n\n9º-That\nthe National Law of\nEmergencies and Risk Prevention provides that, in the event of a public calamity,\ncaused by acts of nature or of man, which are unforeseeable or\nforeseeable but inevitable and cannot be controlled, managed, or\novercome with the ordinary powers available to the Government, the Executive\nBranch may declare a national emergency in order to integrate and define the\nresponsibilities and functions of all agencies, public and private entities,\nand to be able to provide a solution commensurate with the magnitude of the disaster.\n\n10.-That by reason of the\nforegoing, the enactment of a legal framework is necessary to take the\nexceptional measures indicated by\nthe Political Constitution and\nthe National Law of Emergencies and Risk Prevention, to\naddress the effects caused by this hydrometeorological phenomenon and\nmitigate the consequences its impact caused in the different zones of the\ncountry. Therefore,\n\nDecree:\n\nArticle 1º-Given the situation caused by the phenomenon\ndescribed in considering clauses one and two of this decree, and given the report\non the magnitude of the damages suffered in the canton of Turrialba, this\ncanton is included within the emergency declaration of Executive Decree 34906-MP,\npublished in the Official Gazette La\n Gaceta Nº 238 of December 9, 2008.\n\nArticle 2º-It takes effect as of\nthis date.\n\n \n\nGiven at the\n Presidency of\nthe Republic.-San José, on the twelfth day of the month of\nDecember, two thousand eight."
