  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 35023\n\n                        Modifica para el Servicio Nacional de Aguas, el gasto presupuestario máximo\nfijado para el año 2009\n\nTexto Completo acta: C37EF\n\nNº\n35023-H\n\nEL PRESIDENTE DE\nLA REPÚBLICA\n\nY EL MINISTRO DE HACIENDA\n\n \n\nCon fundamento en las\natribuciones que les confieren los artículos 140, incisos 3) y 18) y 146 de\nla Constitución Política;\nlos artículos 25 inciso 1), 27 inciso 1) y 28 inciso 2), acápite b) de\nla Ley Nº 6227, Ley General de\nla Administración Pública\nde 2 de mayo de 1978 y sus reformas;\nla Ley Nº 8131, Ley de\nla Administración Financiera\nde la República\ny Presupuestos Públicos de 18 de setiembre del 2001 y sus reformas; su\nReglamento, el Decreto Ejecutivo Nº 32988-H-MP-PLAN de 31 de enero del 2006 y\nsus reformas; la Ley Nº\n6877 de 18 de julio de 1983, Creación del Servicio Nacional de Aguas\nSubterráneas, Riego y Avenamiento (SENARA); Ley Nº 8691, Ley de Presupuesto\nOrdinario y Extraordinario de la\n República para el Ejercicio Económico para el año 2009 de 10\nde diciembre del 2008 y el Decreto Ejecutivo Nº 34404-H de 5 de marzo del 2008\ny su reforma.\n\nConsiderando:\n\n \n\n1º-Que mediante\nla Ley Nº 6877, publicada a\nLa Gaceta Nº 143 de\n29 de julio de 1983, se crea el Servicio Nacional de Aguas Subterráneas, Riego\ny Avenamiento (SENARA), cuyos objetivos, entre otros, son fomentar el\ndesarrollo agropecuario del país, mediante el establecimiento y funcionamiento\nde sistemas de riego, avenamiento y protección contra inundaciones, contribuir\na desarrollar preferentemente aquellos proyectos de desarrollo agropecuario que\nse sustenten en una justa distribución de la tierra y procurar que en el\nterritorio beneficiado por la creación de distritos de riego y avenamiento, se\nefectúe una modificación racional y democrática en la propiedad de la tierra.\n\n \n\n2º-Que mediante oficio Nº GE-627-08 de 2 de octubre del 2008, el\nGerente General del Servicio, solicita ampliar el gasto presupuestario máximo\npara 2009, por la suma de ¢1.845.000.000,00 (mil ochocientos cuarenta y cinco millones\nde colones exactos), de los cuales, ¢1.442.200.000,00 (mil cuatrocientos\ncuarenta y dos millones doscientos mil colones exactos), se utilizarán para el\nPlan Nacional de Granos Básicos y ¢402.800.000,00 (cuatrocientos dos millones\nochocientos mil colones exactos), para gastos operativos de la institución de\nlas partidas de servicios y de materiales y suministros.\n\n \n\n3º-Que los recursos provienen de una transferencia de\nla Ley Nº 8691, Ley de\nPresupuesto Ordinario y Extraordinario de\nla República para el\nEjercicio Económico para el año 2009, publicada en el Alcance Nº 56 a\nLa Gaceta Nº 253 de\n31 de diciembre del 2008, por ¢3.170.262.007,00 (tres mil ciento setenta\nmillones doscientos sesenta y dos mil siete colones exactos), para cubrir el\nPlan Nacional de Granos Básicos y los gastos operativos institucionales.\n\n \n\n4º-Que mediante el Decreto Ejecutivo Nº 34404-H y su reforma,\npublicado a La Gaceta\n Nº 56 de 19 de marzo del 2008, se emitieron las Directrices\nGenerales de Política Presupuestaria para el año 2009, estableciéndose en el\nartículo 1 del citado decreto, el gasto presupuestario máximo del año 2009,\npara las entidades cubiertas por el ámbito de\nla Autoridad Presupuestaria.\n\n \n\n5º-Que con oficio Nº STAP CIRCULAR 0670-08 de 8 de abril del 2008,\nse comunicó al SENARA, el gasto presupuestario máximo fijado para el año 2008,\npor la suma de ¢2.049.500.000,00 (dos mil cuarenta y nueve millones quinientos\nmil colones exactos), la cual no contempla los recursos adicionales señalados\nen el considerando segundo de este decreto.\n\n \n\n6º-Que con el oficio Nº DM-1281-88 de 20 de noviembre del 2008, el señor Ministro rector del Sector\nProductivo avala la solicitud planteada por el SENARA.\n\n \n\n7º-Que por lo anterior, resulta necesario modificar el gasto\npresupuestario máximo fijado para el Servicio para el 2009, incrementándolo en\nla suma de ¢1.845.000.000,00 (mil ochocientos cuarenta y cinco millones de\ncolones exactos).
