7384, publicada a\nLa Gaceta Nº 62 de 29\nde marzo de 1994 y sus reformas se faculta al Instituto Costarricense de Pesca\ny Acuicultura (INCOPESCA), a extender, suspender y cancelar los permisos de\npesca marina y construcciones de embarcaciones, así como las licencias y\nconcesiones para la producción en el campo de la acuicultura, a las personas\nfísicas o jurídicas que los soliciten.\n\nII.-Que\nla Ley Nº 8436, publicada a\nLa Gaceta Nº 78 del\n25 de abril del 2005, señala que el Instituto, ejercerá el control de la\nactividad pesquera y acuícola que se realice en aguas marinas e interiores y\nbrindará asistencia técnica a la actividad acuícola en aguas continentales y\nmarinas.\n\nIII.-Que mediante oficios\nPEP-0584-09-2008 de 22 de setiembre y PESJ-847-10-2008 de 08 de octubre, ambos\nde 2008, el Instituto solicita incrementar el gasto presupuestario máximo del\n2009, por un monto total de ¢1.000.000,00 (mil millones de colones exactos),\nque financiará con recursos provenientes del superávit específico, recursos\npropios y transferencias corrientes del Gobierno Central, para el pago de\nremuneraciones, transporte y viáticos dentro del país, combustible,\nmantenimiento y repuestos para vehículos, alimentos concentrados para tilapias\ny truchas, bienes para la producción de estanques, construcciones, adiciones y\nmejoras, edificios, mobiliario y equipo de oficina, subsidio al sector\npesquero, así como cuotas a organismos internacionales.\n\nIV.-Que el Instituto\nmediante superávit específico, cubrirá gastos relacionados con inversiones en\nbienes duraderos por ¢118.620.000,00 (ciento dieciocho millones seiscientos\nveinte mil colones exactos), subsidio al sector pesquero nacional por\n¢400.000.000,00 (cuatrocientos millones de colones exactos), aporte convenio\nJAPDEVA-INCOPESCA por ¢3.000.000,00 (tres millones de colones exactos), para un\ntotal de ¢521.620.000,00 (quinientos veintiún millones seiscientos veinte mil\ncolones exactos).\n\nV.-Que el Instituto mediante\ntransferencia incluida en la Ley\n Nº 8691 de Presupuesto Ordinario y Extraordinario de\nla República para el\nEjercicio Económico para el año 2009, publicada en el alcance Nº 56 a\nLa Gaceta Nº 253 de\n31 de diciembre de 2008, cubrirá gastos tales como: pago del percentil 35 y 40\ny aumento de costo de vida por ¢365.500.000,00 (trescientos sesenta y cinco\nmillones quinientos mil colones exactos), así como el plan reactivación de\nalimentos por ¢47.880.000,00 (cuarenta y siete millones ochocientos ochenta y\nocho mil colones exactos), para un total de ¢413.380.000,00 (cuatrocientos\ntrece millones trescientos ochenta mil colones exactos).\n\nVI.-Que el Instituto\nfinanciará la cuota de Costa Rica a\nla Comisión\n Interamericana del Atún Tropical (CIAT), con recursos propios\nprovenientes de derechos administrativos a los servicios de transporte\nportuario por ¢65.000.000,00 (sesenta y cinco millones de colones exactos).\n\nVII.-Que mediante el Decreto\nEjecutivo Nº 32452-H y su reformas, publicado a\nLa Gaceta Nº 130 de 6\nde julio de 2005, se emite el \"Lineamiento para la aplicación del artículo 6 de\nla Ley Nº 8131\nde la\n Administración Financiera de\nla República y\nPresupuestos Públicos y la regulación de la clase de ingresos del Sector\nPúblico denominada Financiamiento\".\n\nVIII.-Que el artículo 9º\nseñala que el superávit específico podrá utilizarse para financiar los gastos\ndefinidos en los fines establecidos en las disposiciones especiales o legales\naplicables a esos recursos.\n\nIX.-Que mediante el Decreto\nEjecutivo Nº 34404-H y su reforma, publicado en\nLa Gaceta Nº 56 de 19\nde marzo de 2008, se emitieron las Directrices Generales de Política\nPresupuestaria and Executive Decree\nNº 34404-H of March 5, 2008, and its amendment.\n\n \n\nConsidering:\n\n \n\nI.-That by means of\nLaw Nº 7384, published in\nLa Gaceta Nº 62 of March\n29, 1994, and its amendments, the Costa Rican Institute of Fisheries\nand Aquaculture (INCOPESCA) is empowered to issue, suspend, and cancel marine fishing permits and vessel constructions, as well as licenses and\nconcessions for production in the field of aquaculture, to any natural\nor legal persons who apply for them.\n\nII.-That\nLaw Nº 8436, published in\nLa Gaceta Nº 78 of\nApril 25, 2005, states that the Institute shall exercise control over the\nfishing and aquaculture activity carried out in marine and inland waters and\nshall provide technical assistance for aquaculture activity in continental\nand marine waters.\n\nIII.-That by means of official letters\nPEP-0584-09-2008 of September 22 and PESJ-847-10-2008 of October 8, both\nfrom 2008, the Institute requests to increase the maximum budgetary expenditure for\n2009, by a total amount of ¢1,000,000.00 (one billion exact colones),\nto be financed with resources from the specific surplus (superávit específico), own\nresources, and current transfers from the Central Government, for the payment of\nremunerations, domestic transportation and travel expenses (viáticos), fuel,\nmaintenance and spare parts for vehicles, concentrated feed for tilapia\nand trout, goods for pond production, constructions, additions and\nimprovements, buildings, office furniture and equipment, subsidy to the fishing\nsector, as well as contributions to international organizations.\n\nIV.-That the Institute,\nthrough the specific surplus (superávit específico), will cover expenses related to investments in\ndurable goods for ¢118,620,000.00 (one hundred eighteen million six hundred\ntwenty thousand exact colones), subsidy to the national fishing sector for\n¢400,000,000.00 (four hundred million exact colones), the JAPDEVA-INCOPESCA agreement contribution for ¢3,000,000.00 (three million exact colones), for a\ntotal of ¢521,620,000.00 (five hundred twenty-one million six hundred twenty\nthousand exact colones).\n\nV.-That the Institute, through a\ntransfer included in\nLaw Nº 8691, the Law of the Ordinary and Extraordinary Budget of\nthe Republic for the\nEconomic Year 2009, published in supplement Nº 56 to\nLa Gaceta Nº 253 of\nDecember 31, 2008, will cover expenses such as: payment of the 35th and 40th\npercentile and cost-of-living increase for ¢365,500,000.00 (three hundred sixty-five\nmillion five hundred thousand exact colones), as well as the food reactivation\nplan for ¢47,880,000.00 (forty-seven million eight hundred eighty\nthousand exact colones), for a total of ¢413,380,000.00 (four hundred\nthirteen million three hundred eighty thousand exact colones).\n\nVI.-That the Institute\nwill finance Costa Rica's contribution to\nthe Inter-American Tropical Tuna Commission (CIAT), with its own resources\nfrom administrative fees for port transportation\nservices for ¢65,000,000.00 (sixty-five million exact colones).\n\nVII.-That by means of Executive\nDecree Nº 32452-H and its amendments, published in\nLa Gaceta Nº 130 of July\n6, 2005, the \"Guideline for the application of Article 6 of\nLaw Nº 8131\nof the\nFinancial Administration of\nthe Republic and\nPublic Budgets and the regulation of the Public Sector revenue class\ncalled Financing (Financiamiento)\" is issued.\n\nVIII.-That Article 9\nprovides that the specific surplus (superávit específico) may be used to finance the expenses\ndefined for the purposes established in the special or legal provisions\napplicable to those resources.\n\nIX.-That by means of Executive\nDecree Nº 34404-H and its amendment, published in\nLa Gaceta Nº 56 of March\n19, 2008, the General Budgetary Policy Guidelines for the year 2009 were issued, establishing in Article 1 of the cited\ndecree the maximum budgetary expenditure for the year 2009 for entities\ncovered by the scope of\nthe Budgetary Authority (Autoridad Presupuestaria).\n\nX.-That by official letter STAP\nCIRCULAR 0675-08 of April 7, 2008, the Institute was notified of the\nmaximum budgetary expenditure set for the year 2009, in the sum of ¢1,712,500,000.00\n(one billion seven hundred twelve million five hundred thousand exact colones).\n\nXI.-That the Rector Minister\nof the Productive Sector, through official letter PEP-0584-09-2008 of September 22,\n2008, endorses the request made by the Institute.\n\nXII.-That due to the foregoing,\nit is necessary to modify the maximum budgetary expenditure set for the\nInstitute, for 2009, increasing it by the sum of ¢1,000,000.00 (one\nbillion exact colones).
