(as):\n\nPor este medio transcribo a su persona acuerdo\ntomado por el Concejo Municipal de Osa, en sesión ordinaria Nº 31-2008,\ncelebrada el día 6 de agosto del 2008, el cual dice:\n\nCAPÍTULO\nVII\n\nAcuerdos\ny mociones\n\nAcuerdo 7º-Del Señor Jorge Alberto Cole de León,\nAlcalde Municipal de Osa, acogido por\nla Regidora Propietaria\nJessica Hernández Sanarrusia, el cual dice literalmente así:\n\nConsiderando:\n\nI.-Siendo que la modificación del Plan Regulador de\nPunta Dominical, data de varios años, habiéndose avalado oportunamente en cada\nuna de sus etapas, por las instituciones competentes, ergo Instituto\nCostarricense de Turismo y esta Municipalidad como así consta en los distintos\nacuerdos tomados en sesiones ordinaria 08-05, celebrada el 23 de febrero del\n2005, ratificada el 2 de marzo del 2005 y en virtud de estar pendiente para su\nfinalización, la etapa de publicación de los mapas correspondientes, trámite\núltimo que no ha sido observado por\nla Administración,\nresulta menester que esta Corporación, como administradora de la zona marítima\nterrestre, coadyuve en la finalización de este proceso.\n\nII.-Que\nla Municipalidad como\nparte de la\n Administración Pública, debe estarse al\nPrincipio de Inderogabilidad Singular de los Actos, cuya acepción principal,\nsalvo excepciones taxativamente señaladas en Ley, le veda la posibilidad de\nemitir actos contrarios a los dictados previamente por ella. De incumplir los\nalcances de ese principio, se encuentra facultada por el Principio de\nAutotutela, para revisar los actos dictados en contraposición de lo expuesto y\nrestituir la situación a su estado original\n\nIII.-Que el acuerdo\nNº 5 del Capítulo III, adoptado por este Concejo Municipal, en sesión extraordinaria\nNº 13-2008, celebrada el día 7 de julio del 2008, fue dictado, sin reparar en\nla existencia de actos previos dictados por\nla Propia\n Administración Municipal, que evidencian una voluntad\ndistinta de la referida en dicho acuerdo-, entre otros, oficio DAM-ALCAOSA-141-2008,\nsuscrito por el señor Alcalde Municipal y dirigida al Director de Urbanismo del\nINVU. En este sentido, este acuerdo Nº 5, constituye un impedimento\ninjustificado para alcanzar la finalidad apuntada en el considerando primero,\ntoda vez que lo supedita al cumplimiento de un supuesto futuro e incierto, que\nconcuerda con un requisito que no encuentra soporte jurídico alguno, en cuyo\ncaso, se contrapone a las ordenanzas que le impone a\nla Administración,\nla Ley de Protección al\nCiudadano del Exceso de Requisitos y Trámites Administrativos Nº 8220. Por\ntanto:\n\nVistas las anteriores consideraciones, el Concejo\nMunicipal de Osa, acuerda:\n\n1º-Dejar sin efecto el acuerdo Nº 5, del Capítulo\nIII, adoptado en sesión extraordinaria Nº 13-2008, celebrada el día 7 de julio\ndel 2008.\n\n2º-En aplicación\ndel artículo 21 de la\n Ley Nº 6043, aprobar el contenido de los mapas,\ncorrespondientes al trámite final de Modificación o Cambio de Uso de Suelo del\nPlan Regulador del Sector Costero de Punta Dominical y autorizar su\ncorrespondiente publicación.\n\n3º-Autorizar a\nla Administración\n Municipal, para que ejecute la totalidad de acciones\npertinentes, a efecto de concluir el proceso de modificación del Plan Regulador\ndel Sector Costero de Punta Dominical.\n\n4º-Informar a\nla Dirección de\nUrbanismo del Instituto Nacional de Vivienda y Urbanismo, así como al\nMacroproceso de Planeamiento y Desarrollo del Instituto Costarricense de\nTurismo, del presente acuerdo, a fin de solicitar su coadyuvancia en todo lo\nque el presente trámite implique a fin de finalizar este proceso y así\ngarantizar el dominio municipal sobre esta zona de conformidad con lo\nestablecido por la\n Constitución de\nla República y la\nmisma Ley Nº 6043. Que se dispense de trámite de comisión y se declare\nacuerdo definitivamente aprobado.\n\nUna vez conocido y analizado el presente acuerdo, el\nConcejo Municipal, lo somete a votación y acuerda aprobarlo de manera\ndefinitiva por medio de los votos de los Regidores Propietarios Alba Cerdas\nAguilar; Jessica Hernández Sanarrusia, Sonia Segura Matamoros y Marvin Antonio\nLoría Murillo. No se omite manifestar que tal votación presenta un voto en\ncontra por parte de la\n Regidora Propietaria Daisy Anchía\nAngulo. Isabel Chaves Bonilla, Head of the Maritime-Terrestrial Zone Department.\n\nDear Sirs/Madams:\n\nBy this means, I transcribe to you an agreement\ntaken by the Municipal Council of Osa, in ordinary session No. 31-2008,\nheld on August 6, 2008, which states:\n\nCHAPTER\nVII\n\nAgreements\nand motions\n\nAgreement 7-By Mr. Jorge Alberto Cole de León,\nMunicipal Mayor of Osa, seconded by\nthe Proprietary Councilmember\nJessica Hernández Sanarrusia, which reads literally as follows:\n\nWhereas:\n\nI.-Whereas the modification of the Regulatory Plan of\nPunta Dominical dates back several years, having been duly endorsed at each\nof its stages by the competent institutions, ergo the Costa Rican\nTourism Institute and this Municipality, as recorded in the various\nagreements taken in ordinary session 08-05, held on February 23,\n2005, ratified on March 2, 2005, and by virtue of the publication stage of the corresponding maps still being pending for its\ncompletion, a final procedure that has not been observed by\nthe Administration,\nit is necessary that this Corporation, as administrator of the maritime-terrestrial\nzone, contribute to the completion of this process.\n\nII.-That\nthe Municipality, as\npart of the\n Public Administration, must abide by the\nPrinciple of Singular Non-Derogability of Acts (Principio de Inderogabilidad Singular de los Actos), whose main meaning,\nexcept for exceptions exhaustively stated in Law, prohibits the possibility of\nissuing acts contrary to those previously dictated by it. In the event of non-compliance with\nthe scope of this principle, it is empowered by the Principle of\nSelf-Protection (Principio de Autotutela) to review the acts dictated in contravention of the foregoing and\nto restore the situation to its original state.\n\nIII.-That agreement\nNo. 5 of Chapter III, adopted by this Municipal Council, in extraordinary session\nNo. 13-2008, held on July 7, 2008, was issued without considering\nthe existence of previous acts issued by\nthe Municipal\n Administration itself, which demonstrate an intent\ndifferent from that referenced in said agreement-, among others, official communication DAM-ALCAOSA-141-2008,\nsigned by the Municipal Mayor and addressed to the Director of Urban Planning of\nINVU. In this sense, this agreement No. 5 constitutes an unjustified\nimpediment to achieving the purpose noted in the first whereas clause,\nas it makes it conditional on the fulfillment of a future and uncertain assumption that\nmatches a requirement lacking any legal support whatsoever, in which\ncase it contravenes the mandates imposed on\nthe Administration\nby the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures No. 8220. Therefore:\n\nHaving considered the foregoing considerations, the Municipal\nCouncil of Osa agrees:\n\n1-To render without effect agreement No. 5, of Chapter\nIII, adopted in extraordinary session No. 13-2008, held on July 7,\n2008.\n\n2-In application\nof Article 21 of\n Law No. 6043, to approve the content of the maps\ncorresponding to the final procedure of Modification or Land-Use Change (Cambio de Uso de Suelo) of the\nRegulatory Plan of the Coastal Sector of Punta Dominical and to authorize their\ncorresponding publication.\n\n3-To authorize\nthe Municipal\n Administration to execute all pertinent\nactions to conclude the modification process of the Regulatory Plan\nof the Coastal Sector of Punta Dominical.\n\n4-To inform\nthe Urban Planning\nDirectorate (Dirección de Urbanismo) of the Instituto Nacional de Vivienda y Urbanismo, as well as the\nMacroprocess of Planning and Development (Macroproceso de Planeamiento y Desarrollo) of the Costa Rican\nTourism Institute, of this agreement, in order to request their collaboration in everything\nthat this procedure entails so as to finalize this process and thus\nguarantee the municipal domain over this zone in accordance with what is\nestablished by the\n Constitution of\nthe Republic and the\nsame Law No. 6043. It is not omitted to state that this vote presents one vote\nagainst from the\n Proprietary Councilmember Daisy Anchía\nAngulo. Therefore, the Municipal Council of Osa agrees to render without effect\nagreement No. 5, of Chapter III, adopted in extraordinary session No. 13-2008,\nheld on July 7, 2008.
