Ley Nº\n7664 del 8 de abril de 1997, Ley de Protección Fitosanitaria.\n\nConsiderando:\n\n1º-Que con ocasión\ndel sismo acaecido a las trece horas veintidós minutos del día ocho de enero\ndel presente año y con epicentro en la\n Zona de\nla Cordillera Volcánica Central, se declaró estado\nde emergencia en los cantones de Alajuela, Grecia, Poás,\nAlfaro Ruiz, y Valverde Vega de la provincia de Alajuela y los cantones de\nHeredia, Barva, Santa Bárbara y Sarapiquí\nde la provincia de Heredia.\n\n2º-Que dicha\ndeclaratoria de emergencia comprende todas las acciones necesarias para la atención,\nrespuesta, rehabilitación, reconstrucción y reposición de la infraestructura,\nlas viviendas, la agricultura y en general de todos los servicios públicos\ndañados.\n\n3º-Que como\nproducto del terremoto, los daños en el Sector Agropecuario han sido cuantiosos\ny es necesario tomar medidas urgentes para atender las unidades productivas\nafectadas, sus animales y sus sistemas de producción.\n\n4º-Que igualmente\ncon ocasión del terremoto han quedado vulnerables animales domésticos y\nsilvestres que es necesario atender y con ello evitar que\nla Salud Pública\nse vea expuesta a riesgos de enfermedades por su desatención.\n\n5º-Que tanto el\nServicio Nacional de Salud Animal como el Servicio Fitosanitario del Estado,\nambos órganos desconcentrados del Ministerio de Agricultura y Ganadería, en sus\ncorrespondientes leyes constitutivas contienen instrumentos para ser aplicados\nen momentos de emergencia y están llamados por ello a realizar acciones de\nrespuesta inmediata, rehabilitación y reconstrucción de actividades ligadas al\nSector Agropecuario, sus procesos, sus animales y plantas productivas y\nrespecto del manejo de animales domésticos y silvestres que han quedado en\nriesgo y que potencialmente podrían afectar\nla Salud Pública.\n\n6º-Que la magnitud\nde la catástrofe requiere para su debida atención, especialmente en las etapas\nde rehabilitación y reconstrucción reforzar la infraestructura y servicios\nnecesarios existentes en los cantones declarados en estado de emergencia a los\nefectos de poder atender adecuadamente las demandas que los diferentes actores\nestablezcan sobre la misma y sea el Estado capaz de dar repuestas efectivas a\ndichas demandas de apoyo y servicios. Articles 25, 27.1, 28.2.b) of Law No. 6227 of May 2, 1978, General Law of Public Administration; Law No. 8495 of April 6, 2006, Law of the National Animal Health Service; Law No. 7664 of April 8, 1997, Phytosanitary Protection Law.\n\nConsidering:\n\n1st—That on the occasion of the earthquake that occurred at thirteen hours twenty-two minutes on the eighth of January of this year, with its epicenter in the Central Volcanic Mountain Range Zone, a state of emergency was declared in the cantons of Alajuela, Grecia, Poás, Alfaro Ruiz, and Valverde Vega in the province of Alajuela and the cantons of Heredia, Barva, Santa Bárbara, and Sarapiquí in the province of Heredia.\n\n2nd—That said emergency declaration encompasses all actions necessary for the attention, response, rehabilitation, reconstruction, and replacement of infrastructure, housing, agriculture, and in general all damaged public services.\n\n3rd—That as a result of the earthquake, the damage in the Agricultural Sector has been substantial, and it is necessary to take urgent measures to assist the affected production units, their animals, and their production systems.\n\n4th—That likewise, on the occasion of the earthquake, domestic and wild animals have been left vulnerable, requiring attention in order to prevent Public Health from being exposed to disease risks due to their neglect.\n\n5th—That both the National Animal Health Service and the State Phytosanitary Service, both deconcentrated bodies of the Ministry of Agriculture and Livestock, in their corresponding constitutive laws contain instruments to be applied in times of emergency and are therefore called upon to carry out actions of immediate response, rehabilitation, and reconstruction of activities related to the Agricultural Sector, its processes, its productive animals and plants, and regarding the management of domestic and wild animals that have been left at risk and could potentially affect Public Health.\n\n6th—That the magnitude of the catastrophe requires, for its proper attention, especially during the rehabilitation and reconstruction stages, reinforcing the necessary existing infrastructure and services in the cantons declared in a state of emergency in order to adequately meet the demands that different stakeholders place upon it and for the State to be capable of providing effective responses to said demands for support and services. Therefore,\n\nThey Decree:\n\nThe following:\n\nDeclaration of Regional Health Emergency\n\nArticle 1—Under the protection of the national emergency occurring on the occasion of the earthquake of thirteen hours twenty-two minutes on the eighth of January of this year, an animal and phytosanitary health emergency is declared in the cantons of Alajuela, Grecia, Poás, Alfaro Ruiz, and Valverde Vega in the province of Alajuela and the cantons of Heredia, Barva, Santa Bárbara, and Sarapiquí in the province of Heredia, and therefore the National Animal Health Service (SENASA) and the State Phytosanitary Service (SFE) are authorized to use the emergency mechanisms that their corresponding constitutive laws authorize them, for the purpose of attending to the needs and requirements that arise during the immediate response, rehabilitation, and reconstruction stages on behalf of the Agricultural Sector in relation to its production processes, animals, and plants. Likewise, to attend to and develop actions and activities relating to the management of domestic and wild animals that have been left vulnerable and at risk and thereby capable of causing harm to Public Health.\n\nArticle 2—The National Animal Health Service (SENASA) and the State Phytosanitary Service (SFE) are authorized to each use up to 500,000,000.00 colones (five hundred million colones) of their accumulated surplus as of December 2008, to execute actions related to providing immediate response, rehabilitation, and reconstruction of Agricultural Sector activities in the disaster zone, as well as likewise for the development of actions relating to the management of domestic and wild animals at risk and capable of causing harm to Public Health.
