Por\ntanto,\n\nACUERDAN:\n\nArtículo 1º-Modifíquense los artículos\n1, 2, 4, 5, 8, 10 y 12 del Acuerdo Ejecutivo AJDIP/476-2008, publicado en\nLa Gaceta Nº 8, del\n13 de enero del 2009, los cuales se leerán de la siguiente manera:\n\n\"Artículo 1º-Se prohíbe la pesca dirigida al pez vela, utilizando\npalangre de superficie adaptada para ese fin y con carnada viva como arte de\npesca, en todas las aguas marinas jurisdiccionales costarricenses, a la flota\ncomercial no turística-deportiva. Las faenas de pesca de la flota pesquera\nnacional, utilizando palangre, en lo especial en cuanto a zonas y fechas,\nquedarán sometidas a las regulaciones del presente acuerdo.\"\n\n\"Artículo 2º-El presente acuerdo establece disposiciones o\nregulaciones de naturaleza técnica, de acatamiento obligatorio. Las\ninfracciones o inobservancias a este acuerdo se sancionarán de conformidad con\nlo establecido en la Ley\nde Pesca y Acuicultura\".\n\n\"Artículo 4º-Establézcase una zona de prohibición para la pesca y\nalmacenamiento de carnada viva en viveros, a la flota comercial no\nturística-deportiva, según la siguiente demarcación y características:\n\na.   En el Golfo Dulce a partir de una línea imaginaria\ncomprendida entre Cabo Matapalo y Punta Banco, y de esta línea aguas adentro\nhasta el final del Golfo Dulce (hacia Rincón de Osa), a embarcaciones que no\ncuenten con los respectivos permisos de pesca vigentes para tal fin.\n\nb.  En el Golfo de Nicoya a partir de una línea imaginaria\ncomprendida entre Punta Peñón e Isla Negritos, y de esta línea aguas adentro\nhasta la desembocadura del Río Tempisque, a aquellas embarcaciones que no\ncuenten con los respectivos permisos de pesca vigentes para tal fin. En el\nGolfo de Papagayo a partir de una línea imaginaria comprendida entre Cabo Velas\na Punta Blanca, y de esta línea aguas adentro, a aquellas embarcaciones que no\ncuenten con los respectivos permisos de pesca vigentes para tal fin\".\n\n\"Artículo 5º-A partir de\nla Costa Pacífica Costarricense y las líneas\nimaginarias establecidas en los incisos a, b, y c, del artículo 4; hasta las 30 millas aguas afuera,\nse establece una línea imaginaria perpendicular a la costa que delimita una\nzona de prohibición permanente para el ejercicio de la pesca comercial no\nturística utilizando palangre (long line) de superficie con carnada viva como\narte de pesca ya que será considerado como pesca dirigida a la captura de pez\nvela.\n\nAdicionalmente y bajo la misma prohibición, se establece una línea recta imaginaria que va desde\nPunta Burica (08° 02' Latitud Norte y 82° 54' Longitud Oeste) treinta millas náuticas sobre la línea\ndemarcatoria de la frontera marina entre Costa Rica y Panamá hasta la posición 07° 28' Latitud Norte\ny 83° 10' Longitud Oeste y otra línea recta imaginaria que va desde Punta Quepos (09° 24' Latitud\nNorte y 84° 11' Longitud Oeste) treinta millas náuticas hasta la posición 09° 00' Latitud Norte y\n84° 28' Longitud Oeste. \n\nEntre estas dos líneas imaginarias indicadas anteriormente, se\nestablece un área de treinta millas náuticas perpendiculares a la costa, en la\ncual, durante los meses de enero a mayo de cada año, en las primeras doce\nmillas se permite la pesca con palangre de superficie sin carnada viva a la\nflota nacional pequeña escala, de las doce millas y hasta las treinta millas,\nse permite la pesca con palangre sin carnada viva a la flota nacional mediana\nescala y después de las treinta millas se permite la pesca con palangre sin\ncarnada viva a la flota nacional avanzada\".\n\n\"Artículo 8º-En caso de producirse pesca incidental de pez vela en la\nactividad de pesca comercial no turística, sin que hubiere sido posible la\ndevolución al mar del ejemplar aún vivo; se permitirá la comercialización del\nproducto en estado fresco o congelado para consumo humano exclusivamente en el\nmercado nacional. Para efectos de lo anterior, la pesca incidental no podrá\nexceder el 15% (peso eviscerado) de la captura total de la embarcación por cada\nviaje de pesca comercial no turística realizado.\n\nEl Incopesca no emitirá recomendaciones para la exportación de Pez\nVela, en concordancia con lo señalado en el párrafo anterior de este artículo\nocho, medida que será revisada anualmente, después de que entre en vigencia\nesta disposición, para valorar el impacto de los resultados producidos y\ndeterminar si se vuelve a recomendar la exportación.\n\nLa Junta Directiva conformará una comisión que trimestralmente dará seguimiento a la\ninformación que obligatoriamente brindará\nla Dirección General\nTécnica sobre el impacto de esta medida en el mercado nacional. Therefore,\n\nTHEY AGREE:\n\nArticle 1º-Amend articles\n1, 2, 4, 5, 8, 10 and 12 of Executive Agreement AJDIP/476-2008, published in\nLa Gaceta Nº 8, of\nJanuary 13, 2009, which shall read as follows:\n\n\"Article 1º-Directed fishing for sailfish (pez vela), using\nsurface longline (palangre de superficie) adapted for that purpose and with live bait (carnada viva) as fishing gear (arte de pesca), is prohibited in all Costa Rican jurisdictional marine waters, for the\nnon-tourist-sport commercial fleet. The fishing operations of the national fishing\nfleet, using longline, especially regarding zones and dates,\nare hereby subjected to the regulations of this agreement.\"\n\n\"Article 2º-This agreement establishes provisions or\nregulations of a technical nature, of mandatory compliance. In the\nGolfo de Papagayo from an imaginary line between Cabo Velas\nto Punta Blanca, and from this line inward, for those vessels that do not\nhave the respective valid fishing permits for such purpose.\"\n\n\"Article 5º-From\nthe Costa Rican Pacific Coast and the imaginary\nlines established in subsections a, b, and c, of article 4; up to 30 miles offshore,\nan imaginary line perpendicular to the coast is established that delimits a\npermanent prohibition zone for non-tourist\ncommercial fishing using surface longline (palangre de superficie, long line) with live bait (carnada viva) as\nfishing gear (arte de pesca) since it will be considered as directed fishing for sailfish (pez vela).\n\nAdditionally and under the same prohibition, an imaginary straight line is established that runs from\nPunta Burica (08° 02' North Latitude and 82° 54' West Longitude) thirty nautical miles along the line\ndemarcating the marine border between Costa Rica and Panama to position 07° 28' North Latitude\nand 83° 10' West Longitude and another imaginary straight line that runs from Punta Quepos (09° 24' North\nLatitude and 84° 11' West Longitude) thirty nautical miles to position 09° 00' North Latitude and\n84° 28' West Longitude. \n\nBetween these two imaginary lines indicated above, an\narea of thirty nautical miles perpendicular to the coast is\nestablished, in which, during the months of January to May of each year, in the first twelve\nmiles, fishing with surface longline without live bait is permitted for the\nsmall-scale national fleet; from twelve miles to thirty miles,\nfishing with longline without live bait is permitted for the medium-scale national\nfleet; and beyond thirty miles, fishing with longline without\nlive bait is permitted for the advanced national fleet.\"\n\n\"Article 8º-In the event of bycatch (pesca incidental) of sailfish (pez vela) in non-tourist\ncommercial fishing activity, where it was not possible to\nreturn the still-living specimen to the sea, the commercialization of the\nproduct in a fresh or frozen state for exclusive human consumption in the\ndomestic market shall be permitted. For the purposes of the foregoing, the bycatch (pesca incidental) may not\nexceed 15% (gutted weight) of the vessel's total catch per each\nnon-tourist commercial fishing trip carried out.\n\nIncopesca shall not issue recommendations for the export of Sailfish (Pez Vela),\nin accordance with the provisions of the preceding paragraph of this article\neight, a measure that shall be reviewed annually, after this\nprovision enters into force, to assess the impact of the results produced and\ndetermine whether to recommend export again.\n\nThe Board of Directors (Junta Directiva) shall form a commission that shall quarterly monitor the\ninformation that the Dirección General\nTécnica shall mandatorily provide on the impact of this measure on the domestic market. Composed of\nthree members of the Board of Directors from the coastal provinces, two members\nof the Tourist-Sport Fishing Organizations and two members of the non-tourist\ncommercial fishing sector, submitted through the respective shortlists.\"\n\n\"Article 10.-For the unloading of bycatch (capturas incidentales) of Sailfish (Pez Vela),\nvessels shall be obligated to previously request the respective\nin-port inspection, following for this purpose the procedures established by\nIncopesca.\n\nWhen sailfish (pez vela) is detected in the unloading of the product that exceeds or\nsurpasses the 15% of the total catch permitted as bycatch (pesca incidental), without\nthe same constituting, due to the quantities close to the percentage, directed fishing for\nsailfish (pez vela), the Incopesca official in charge of the inspection\nshall not authorize the commercialization of that excess, and the\ninterested party must proceed to authorize its donation to charitable institutions or,\notherwise, to dispose of it in accordance with the applicable\nlegal provisions.\"\n\n\"Article 12.-(Repealed by agreement\nA.J.D.I.P.081-2014 of March 26, 2014).\n\nArticle 2º-Shall be effective as of its\npublication in the Official Gazette La\n Gaceta.\n\nFinal agreement.\n\nLic.
