El acuerdo se sustenta además en un informe de la Contraloría General de la República (DFOE-SD-3-2007), la anulación previa del mismo plan por parte del Instituto Costarricense de Turismo (ICT), la anulación realizada por la Municipalidad de Aguirre en 2004 y publicada en La Gaceta en 2009, y el criterio C-046-2009 de la Procuraduría General de la República.
