Asimismo, está obligado a propiciar un desarrollo\neconómico y ambientalmente sostenible, entendido como el desarrollo que\nsatisface las necesidades humanas básicas, sin comprometer las opciones de las\ngeneraciones futuras.\n\n2º-Que\nmediante la Ley Nº\n7317, publicada a La\n Gaceta Nº 235 del 7 de diciembre de 1992, se crea el\nFondo de Vida Silvestre (FVS), administrado por el Sistema Nacional de Áreas de\nConservación, según lo establecido en la\n Ley de Biodiversidad Nº 7788, publicada a\nLa Gaceta Nº 101 del\n27 de mayo de 1998.\n\n3º-Que\nmediante el oficio SINAC-DE-1649 de 30 de setiembre de 2008, el Director del\nSistema Nacional de Áreas de Conservación (SINAC), solicitó ampliar el gasto\npresupuestario máximo autorizado para el 2009, con el fin de incorporar a su\npresupuesto la suma de ¢6.045.000.000,00 (seis mil cuarenta y cinco millones\nexactos).\n\n4º-Que\nel monto anterior se cubrirá con recursos provenientes de una transferencia de\nla Ley Nº 8691, Ley de\nPresupuesto Ordinario y Extraordinario de\nla República para el\nEjercicio Económico para el año 2009, publicada en el Alcance Nº 56 a\nLa Gaceta Nº 253 de\n31 de diciembre de 2008, para solventar las necesidades de adquisición de\njaulas para transportar mamíferos, aves silvestres, productos de decomisos,\ninvestigaciones, enfermedad, etc, las cuales serán distribuidas a cada una de\nlas áreas de conservación que conforman el sistema nacional de áreas.\n\n5º-Que\nmediante el Decreto Ejecutivo Nº 34404-H y su reforma, publicado a\nLa Gaceta Nº 56 de 19\nde marzo de 2008, se emitieron las Directrices Generales de Política\nPresupuestaria para el año 2009, estableciéndose en el artículo 1º del citado\ndecreto, el gasto presupuestario máximo de ese período, para las entidades\ncubiertas por el ámbito de\nla Autoridad Presupuestaria.\n\n6º-Que\ncon el oficio STAP-CIRCULAR-0679-08 de 7 de abril de 2008, se comunicó al Fondo\nde Vida Silvestre, el gasto presupuestario máximo autorizado para el 2009 por\n¢7.530.000.000,00 (siete mil quinientos treinta millones de colones exactos),\nel cual no contempla los gastos adicionales a que hace referencia el\nconsiderando tercero de este decreto.\n\n7º-Que\ncon el oficio DM-1189-2008 del 16 de octubre de 2008, el señor Ministro Rector\ndel Sector Ambiente, Energía y Telecomunicaciones, avaló la solicitud planteada\npor el Fondo de Vida Silvestre (FVS).\n\n8º-Que\npor lo anterior, resulta necesario modificar el gasto presupuestario máximo\nfijado para el Fondo de Vida Silvestre administrado por el Sistema Nacional de\nÁreas de Conservación, incrementándolo en la suma de ¢6.045.000.000,00 (seis\nmil cuarenta y cinco millones exactos). Likewise, it is obligated to promote economically\nand environmentally sustainable development, understood as development that\nsatisfies basic human needs, without compromising the options of\nfuture generations.\n\n2º-That\nthrough Law No.\n7317, published in La\n Gaceta No. 235 of December 7, 1992, the\nWildlife Fund (FWS) was created, administered by the National System of\nConservation Areas, as established in the\n Biodiversity Law No. 7788, published in\nLa Gaceta No. 101 of\nMay 27, 1998.\n\n3º-That\nthrough official communication SINAC-DE-1649 of September 30, 2008, the Director of the\nNational System of Conservation Areas (SINAC), requested to expand the maximum\nauthorized budgetary expenditure for 2009, in order to incorporate into its\nbudget the sum of ¢6,045,000,000.00 (six billion forty-five million\nexact).\n\n4º-That\nthe above amount will be covered with resources from a transfer from\nLaw No. 8691, Law of the\nOrdinary and Extraordinary Budget of the Republic for the\nEconomic Year 2009, published in Supplement No. 56 to\nLa Gaceta No. 253 of\nDecember 31, 2008, to meet the needs for acquisition of\ncages for transporting mammals, wild birds, seizure products,\ninvestigations, disease, etc., which will be distributed to each of the\nconservation areas that make up the national system of areas.\n\n5º-That\nthrough Executive Decree No. 34404-H and its amendment, published in\nLa Gaceta No. 56 of 19\nMarch 2008, the General Budgetary Policy Guidelines\nfor the year 2009 were issued, establishing in article 1 of the aforementioned\ndecree, the maximum budgetary expenditure for that period, for the entities\ncovered by the scope of\nthe Budgetary Authority.\n\n6º-That\nthrough official communication STAP-CIRCULAR-0679-08 of April 7, 2008, the\nWildlife Fund was notified of the maximum authorized budgetary expenditure for 2009 of\n¢7,530,000,000.00 (seven billion five hundred thirty million exact colones),\nwhich does not include the additional expenses referred to in\nthe third considering clause of this decree.\n\n7º-That\nthrough official communication DM-1189-2008 of October 16, 2008, the Minister Rector\nof the Environment, Energy and Telecommunications Sector, endorsed the request made\nby the Wildlife Fund (FVS).\n\n8º-That\ndue to the foregoing, it is necessary to amend the maximum budgetary expenditure\nset for the Wildlife Fund administered by the National System of\nConservation Areas, increasing it by the sum of ¢6,045,000,000.00 (six\nbillion forty-five million exact). Therefore,\n\n \n\nDecree:\n\n \n\nArticle\n1-The maximum 2009 budgetary expenditure for the Wildlife Fund (FVS) administered by the National System\nof Conservation Areas (SINAC) is hereby amended, pursuant to article 1 established in Executive Decree No. 34404-H and its\namendment, published in La\n Gaceta No. 56 of March 19, 2008, leaving the maximum\nbudgetary expenditure in the sum of ¢13,575,000,000.00 (thirteen billion\nfive hundred seventy-five million exact colones), for that period.\n\nArticle\n2-For its execution, it takes effect as of January 1, 2009.\n\nGiven in\nthe Presidency of\nthe Republic, on the\nfourteenth day of the month of January, two thousand nine."
