protección de los recursos naturales y establecer las\nmedidas preventivas para evitar el deterioro de los mismos.\n\n2º-Que\nde acuerdo con el artículo 22 de la\n Ley de Biodiversidad Nº 7788, del 30 de abril de 1998, y\npublicada el 27 de mayo de 1998, se crea el Sistema Nacional de Áreas de\nConservación (SINAC), órgano de desconcentración máxima del Ministerio del\nAmbiente y Energía, con personería jurídica instrumental, como un sistema de\ngestión y coordinación institucional, desconcentrado y participativo, que\nintegra las competencias en materia forestal, vida silvestre y áreas\nprotegidas, con el fin de dictar políticas, planificar y ejecutar procesos\ndirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de\nCosta Rica.\n\n3º-Que\nlos incendios forestales provocan al país cuantiosas pérdidas e irreparables\ndaños en sus recursos forestales, agrícolas, suelo, aire, agua, belleza\nescénica y en la calidad de vida de sus habitantes.\n\n4º-Que\nel artículo 35 de la Ley\n Forestal Nº 7575, del 13 de febrero de 1996, señala que le\ncorresponde a\nla Administración Forestal del Estado, por medio del\nSistema Nacional de Áreas de Conservación (SINAC), ordenar y encauzar las\nacciones tendientes a prevenir y extinguir los incendios forestales.\n\n5º-Que\nel citado artículo de la\n Ley Forestal declara de interés público todas las acciones\nque se emprendan, siendo éstas medidas vinculantes y de acatamiento obligatorio\npara todas las autoridades del país.\n\n6º-Que\nestas acciones requieren de una estrecha coordinación y apoyo conjunto entre\ndiferentes instituciones, organizaciones públicas y privadas, así como de la\nsociedad civil; mediante una instancia operativa encargada de definir y\norientar los lineamientos nacionales en materia de manejo del fuego.\n\n7º-Que\nse faculta a\nla Administración Forestal del Estado para organizar\nbrigadas contra incendios; para esto podrá exigir la\ncolaboración de particulares y organismos de\nla\n Administración Pública.\n\n8º-Que\ndesde el año de 1988 en el país se han desarrollado procesos de capacitación y formación\nde bomberos forestales institucionales que involucra funcionarios de\nla Administración\n Forestal del Estado, otras instituciones, la sociedad y\nempresas privadas.\n\n9º-Que\ndesde el año 1991 en el país se han conformado brigadas voluntarias contra incendios\nforestales, las cuales han apoyado las labores de prevención y control de\nincendios forestales que se han llevado a cabo a nivel nacional, con un alto\ngrado de compromiso para la protección de la biodiversidad de nuestro país.\n\n10.-Que\ndesde el año 1997 el país cuenta con una Estrategia Nacional de Manejo del\nFuego, la cual establece los lineamientos y políticas que permiten enfrentar la\nproblemática de los incendios forestales y agrícolas en el país.\n\n11.-Que\npor medio del Decreto Ejecutivo N° 33108-MINAE, publicado en\nLa Gaceta Nº 124 del\n28 de junio del 2006, se oficializa\nla Estrategia Nacional\npara el Manejo del Fuego en Costa Rica 2006-2010 y su Plan de Acción, como los\ninstrumentos oficiales de planificación, control, seguimiento y evaluación en\nesta materia, de igual manera se ratifica\nla Comisión Nacional\nsobre Incendios Forestales (CONIFOR).\n\n12.-Que\npor medio del Decreto Ejecutivo N° 32944-MINAE, publicado en\nLa Gaceta Nº 76 del\n20 de abril del 2006, se declara oficialmente el día 4 de mayo de cada año como\nel Día del Bombero (a) Forestal, de igual manera se establece y reconoce la\nfigura del Bombero (a) Forestal como aquella persona que participa y apoya en\nlas labores de prevención, mitigación, control y liquidación de fuego,\ncapacitada y entrenada para trabajar en forma segura y eficiente.\n\n13.-Que\nen el mes de marzo del año 2008 se realizó el Primer Ejercicio Nacional de\nMovilización de Brigadas Forestales, actividad de coordinación\ninterinstitucional que promueve la integración, trabajo en equipo, disciplina,\nintercambio de experiencia y el manejo y uso de herramientas para el control de\nincendios forestales por parte de las brigadas de bomberos forestales a nivel\nnacional. through an operational body responsible for defining and\norienting national guidelines regarding fire management (manejo del fuego).\n\n7º-That\nthe State Forest Administration is empowered to organize\nbrigades against fires; for this purpose it may demand the\ncollaboration of private parties and bodies of\nthe\n Public Administration.\n\n8º-That\nsince 1988, processes of training and formation\nof institutional forest firefighters have been developed in the country, involving officials of\nthe State Forest\n Administration, other institutions, society, and\nprivate companies.\n\n9º-That\nsince 1991, volunteer brigades against forest\nfires have been formed in the country, which have supported the prevention and control efforts for\nforest fires carried out nationally, with a high\ndegree of commitment to the protection of the biodiversity of our country.\n\n10.-That\nsince 1997, the country has had a National Fire Management Strategy (Estrategia Nacional de Manejo del\nFuego), which establishes the guidelines and policies that allow confronting the\nproblem of forest and agricultural fires in the country.\n\n11.-That\nthrough Executive Decree (Decreto Ejecutivo) N° 33108-MINAE, published in\nLa Gaceta Nº 124 of\nJune 28, 2006, the National Strategy\nfor Fire Management in Costa Rica 2006-2010 (Estrategia Nacional\npara el Manejo del Fuego en Costa Rica 2006-2010) and its Action Plan are made official, as the\nofficial instruments for planning, control, follow-up, and evaluation in\nthis matter; likewise, the National Commission\non Forest Fires (CONIFOR) is ratified.\n\n12.-That\nthrough Executive Decree N° 32944-MINAE, published in\nLa Gaceta Nº 76 of\nApril 20, 2006, May 4 of each year is officially declared as\nthe Day of the Forest Firefighter (Bombero (a) Forestal); likewise, the\nfigure of the Forest Firefighter is established and recognized as that person who participates and supports\nthe prevention, mitigation, control, and extinguishment of fire,\ntrained and equipped to work safely and efficiently.\n\n13.-That\nin March 2008, the First National Forest Brigade Mobilization Exercise (Primer Ejercicio Nacional de\nMovilización de Brigadas Forestales) was held, an inter-institutional coordination\nactivity that promotes integration, teamwork, discipline,\nexchange of experience, and the management and use of tools for the control of\nforest fires by the national forest firefighter brigades.
