  "body_es_text": "Recuerde que Control F es una opción que le permite buscar en la totalidad del texto\n\n\nIr al final del documento\n\n- Usted está en la última versión de la norma -\n\nLey de Creación de la Junta Administrativa de la Imprenta Nacional\n\n\nN° 5394\n\n\n\n\n\nLA ASAMBLEA LEGISLATIVA DE LA REPÚBLICA DE COSTA RICA,\n\n\n\n\n\nDECRETA:\n\n\n\n\n\nArtículo 1º.- Créase la Junta Administrativa de la Imprenta Nacional, como órgano de\ndesconcentración máxima del Ministerio de Gobernación y Policía con personalidad jurídica\ninstrumental para contratar y adquirir bienes y servicios para el cumplimiento de sus fines.\n\n\n\n\n\n(Así reformado por el artículo 1° de la ley N° 8305 del 19 de setiembre de 2002)\n\n\nFicha articulo\n\n\n\n\n\nArtículo 2º.- Sus fines fundamentales serán:\n\n\n\n\n\na) Proteger y conservar los bienes de la Imprenta Nacional y velar por su mejoramiento;\n\n\n\n\n\nb) Administrar los fondos específicos a que esta ley se refiere; y\n\n\n\n\n\nc) Formular los programas de inversión de acuerdo con las necesidades y previa fijación de\nprioridades y hacer las respectivas licitaciones.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 3º.- La Junta se integrará en la siguiente forma: el Ministro de Gobernación y Justicia o\nsu representante, quien la presidirá; un representante del Ministro de Cultura y un delegado de la\nEditorial de Costa Rica.\n\n\n\n\n\nPara la elección de estos dos últimos miembros deberán enviarse ternas al Ministerio de Gobernación\npara que éste haga la escogencia.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 4º.- Para el cumplimiento de sus fines, el Ministro de Gobernación pondrá a disposición de\nla Junta el personal necesario dentro de sus posibilidades presupuestarias. El Director de la\nImprenta tendrá la representación judicial y extrajudicial de la Junta; y será su personero\nejecutivo.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 5º.- A partir del 1º de enero de 1974, los ingresos que produzcan al Estado la Imprenta\nNacional y lo que dicha Imprenta recaude por cualquier otro concepto, se ingresará en una cuenta\nespecial en un Banco del Estado a nombre de la Junta que aquí se crea.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 6º.- El producto íntegro que reciba el Banco Central por concepto de los pagos\nespecificados en los decretos citados en el artículo anterior, será apartado por el Banco en una\ncuenta especial a nombre de la Junta, deduciendo únicamente el tanto por ciento correspondiente por\nconcepto de gastos de Administración. El resto lo girará a la orden de la Junta en cuotas mensuales\nsegún corresponda en la forma y condición en que determine por Reglamento el Poder Ejecutivo.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 7º.- Con los ingresos que produzca la Imprenta se creará un fondo especial, dedicado\nexclusivamente a la adquisición de maquinaria, equipo, materiales, servicios, repuestos y otros\nbienes necesarios para su modernización y buen funcionamiento.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 8- La Contraloría General de la República fiscalizará el manejo económico de la Junta y la\ninversión de sus fondos.\n\n\n\n\n\n(Así reformado el párrafo anterior por el artículo 2° aparte c) de la Ley Fortalecimiento del\ncontrol presupuestario de los órganos desconcentrados del Gobierno Central, N° 9524 del 7 de marzo\nde 2018)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 9º.- Se autoriza a la Junta Administrativa para que gestione con alguna institución de\ncrédito nacional o del exterior un empréstito para cumplir a la mayor brevedad los fines de la\npresente ley. Asimismo se autoriza a las Instituciones Autónomas y Semiautónomas del Estado para que\nse le concedan préstamos a dicha Junta a través del Ministerio de Gobernación, con destino a la\nadquisición de bienes, equipo, servicios, mobiliario y materiales necesarios para la Imprenta\nNacional. Dichos préstamos serán garantizados con los fondos especiales aquí señalados y cualquiera\notros que dicha institución crea necesarios.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 10.- Se autoriza a las Instituciones Autónomas y Semiautónomas del Estado para que otorguen\ndonaciones a favor de la Junta y para que ésta los reciba de ellas, así como de otras personas o\ninstituciones privadas, nacionales o extranjeras, por cualquier suma.\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 11- La Junta Administrativa de la Imprenta Nacional queda facultada para señalar e imponer\nlas tarifas que considere convenientes y adecuarlas a los precios de costo de los materiales de\nimpresión y edición de las publicaciones que efectúe.\n\n\n\n\n\nTodas las publicaciones que la Asamblea Legislativa deba realizar en el diario oficial La Gaceta, en\nvirtud del proceso de formación de las leyes o los acuerdos legislativos, serán gratuitas.\n\n\n\n\n\nLas publicaciones de las leyes que se deban realizar en el diario oficial La Gaceta serán gratuitas\ny los costos asociados a esta disposición no podrán trasladarse al usuario.\n\n\n\n\n\n(Así reformado por el artículo único de la Ley de austeridad financiera en la publicación de leyes,\nN° 10098 del 6 de enero de 2022)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 12.-Los miembros de la Junta Administrativa y su personero ejecutivo, devengará dietas por\nlas sesiones a las que asistan, a razón de ochocientos colones (¢ 800,00) por sesión. The Director of the Printing Office shall have the judicial and extrajudicial representation of the Board and shall be its executive agent.\n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 5.- As of January 1, 1974, the income produced for the State by the National Printing Office and what said Printing Office collects for any other concept shall be deposited in a special account in a State Bank in the name of the Board hereby created.\n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 6.- The full proceeds received by the Central Bank for the payments specified in the decrees cited in the previous article shall be set aside by the Bank in a special account in the name of the Board, deducting only the corresponding percentage for administration expenses. The remainder shall be remitted to the order of the Board in monthly installments as applicable, in the manner and condition determined by Regulation of the Executive Branch.\n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 7.- With the income produced by the Printing Office, a special fund shall be created, dedicated exclusively to the acquisition of machinery, equipment, materials, services, spare parts, and other goods necessary for its modernization and proper functioning.\n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 8.- The Comptroller General of the Republic (Contraloría General de la República) shall oversee the economic management of the Board and the investment of its funds.\n\n\n\n\n\n(Thus amended the previous paragraph by Article 2, subparagraph c) of the Law for the Strengthening of Budgetary Control of Deconcentrated Bodies of the Central Government, No. 9524 of March 7, 2018)\n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 9.- The Administrative Board is authorized to negotiate a loan with a domestic or foreign credit institution to fulfill the purposes of this law as soon as possible. Likewise, the Autonomous and Semi-Autonomous Institutions of the State are authorized to grant loans to said Board through the Ministry of Governance, destined for the acquisition of goods, equipment, services, furniture, and materials necessary for the National Printing Office. Said loans shall be guaranteed with the special funds indicated herein and any others that said institution deems necessary.\n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 10.- The Autonomous and Semi-Autonomous Institutions of the State are authorized to grant donations in favor of the Board, and the Board is authorized to receive them from them, as well as from other persons or private institutions, national or foreign, for any amount.\n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 11.- The Administrative Board of the National Printing Office is empowered to set and impose the rates it deems convenient and to adjust them to the cost prices of the printing and publishing materials of the publications it carries out.\n\n\n\n\n\nAll publications that the Legislative Assembly must carry out in the official gazette La Gaceta, by virtue of the law-making process or legislative agreements, shall be free of charge.\n\n\n\n\n\nThe publications of laws that must be carried out in the official gazette La Gaceta shall be free of charge, and the costs associated with this provision may not be passed on to the user.\n\n\n\n\n\n(As amended by the sole article of the Law on Financial Austerity in the Publication of Laws, No. 10098 of January 6, 2022)\n\n\n\n\n\nArticle file\n\n\n\n\n\nArticle 12.- The members of the Administrative Board and its executive agent shall earn per diem allowances for the sessions they attend, at a rate of eight hundred colones (¢800.00) per session.
