  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 200\n\n                        Establece prohibiciones a las Flotas Pesqueras Comerciales a faenar con\ncualquier tipo de arte de pesca en áreas comprendidas, a la Flota Semi-Industrial camaronera de\narrastre realizar su actividad en ninguna epoca del año en la zona comprendida\n\nTexto Completo acta: C73B9\nINSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA\n\nINSTITUTO COSTARRICENSE DE\nPESCA Y ACUICULTURA\n\n \n\n \n\n(Nota de Sinalevi: El Instituto Costarricense de Pesca y Acuicultura mediante acuerdo N° 227 del 10\nde julio de 2009, publicado en La Gaceta N° 147 del 30 de julio de 2009, acordó incluir en todos los\nalcances establecidos en este acuerdo a aquellos peones o ayudantes de pescadores propietarios de\nembarcaciones pertenecientes a la Flota Artesanal en Pequeña Escala, que se vean afectados con la\ndeclaratoria de veda acordada por la Junta Directiva en el Golfo de Nicoya, durante el período\ncomprendido entre el 01 de octubre al 15 de noviembre del 2009)\n\n \n\n \n\n \n\nSECRETARÍA\nDE JUNTA DIRECTIVA\n\n \n\nAJDIP/200-2009.-Puntarenas, a los doce días del\nmes de junio del 2009.\n\n \n\nConsiderando:\n\n \n\n1º-Que de conformidad con la Ley Nº 7384, Ley de Creación del INCOPESCA y la Ley Nº 8436, Ley de\nPesca y Acuicultura, es atribución y competencia del INCOPESCA establecer conforme a criterios\ntécnicos, científicos, económicos y sociales, las zonas o épocas de veda, sea por áreas o por\nespecies determinadas, a fin de proteger y aprovechar los recursos hidrobiológicos de manera\nsostenible.\n\n2º-Que\nestá demostrado técnicamente que una de las formas de conservación de los\nrecursos hidrobiológicos y de garantizar un aprovechamiento sostenible, es\nestableciendo periodos y áreas de veda, lo cual resulta conveniente definir\npara su aplicación.\n\n3º-Que\nel Golfo de Nicoya es un refugio natural para gran variedad de especies y\nconsiderado una de las zonas pesqueras más importantes del país.\n\n4º-Que\nde acuerdo con los resultados de las investigaciones que en los últimos años\nhan venido realizando, investigadores del Departamento de Investigación y\nDesarrollo del INCOPESCA, la Escuela de Ciencias Biológicas de la Universidad\nNacional, y del Centro de Investigaciones Marinas de la Universidad de Costa\nRica, es urgente y necesario la implementación de medidas de manejo de las\nprincipales especies de valor comercial que tienen cómo habitat\nel Golfo de Nicoya.\n\n5º-Que\nde conformidad con el artículo 36 de la Ley Nº 8436,\nLey de Pesca y Acuicultura, el Poder Ejecutivo podrá autorizar el destino de\nfondos del Presupuesto Nacional a favor del Instituto Mixto de Ayuda Social\n(IMAS), con el propósito de desarrollar programas de asistencia socioeconómica\ndiseñados especialmente con tal propósito, a favor de los pescadores que se\nvean afectados en los períodos de veda, siempre que se compruebe que no tienen\notras fuentes de ingresos y se encuentran en condición de pobreza. Estos\nprogramas implicarán necesariamente servicios de trabajo comunal por parte de\nlos beneficiarios.\n\n6º-Que\nde conformidad con el artículo 133 de la Ley Nº 8436,\nLey de Pesca y Acuicultura, corresponde a las autoridades del Servicio Nacional\nde Guardacostas realizar los operativos tendientes a arrestar y decomisar\nbienes, equipo, artes de pesca o productos pesqueros utilizados para cometer\ndelitos e infracciones contra la legislación pesquera u obtenidos como producto\nde tales hechos. El Servicio Nacional de Guardacostas actuará de oficio o a\ninstancia de los inspectores acreditados de INCOPESCA o de terceros. Para d\nmejor cumplimiento de los fines de esta Ley, el INCOPESCA establecerá los\nconvenios o los mecanismos necesarios de coordinación con el Servicio Nacional\nde Guardacostas. Por tanto:\n\n \n\nACUERDA:\n\n \n\nArtículo 1º-Se\nprohíbe de manera total a todas las Flotas Pesqueras Comerciales a faenar con\ncualquier tipo de arte de pesca del 01 de octubre al 15 de noviembre del 2009,\nen el área comprendida entre una línea recta imaginaria que va desde Punta\nTorres, conocida como Peñón (84º43'52\" Longitud Oeste, 09º53'31\" Latitud Norte)\nhasta el Faro de las Islas por el JNCOPESCA, podrán realizar sus faenas de\npesca entre el 01 de octubre y el 15 de noviembre del 2009, en el área\ncomprendida entre una línea recta imaginaria que va desde Punta Torres,\nconocida como Peñón (84º43'52\" Longitud Oeste, 09º53'31\" Latitud Norte) hasta\nel Faro de las Islas Negritos (84º49'35\" Longitud Oeste, 09°49'14\" Latitud\nNorte) y de esa línea, aguas afuera.\n\nArtículo\n5º-Aquellos propietarios de embarcaciones pertenecientes a la Flota Artesanal\nen Pequeña Escala del Golfo de Nicoya, que deseen acogerse a lo establecido en\nel artículo anterior, deberán manifestarlo por escrito ante el INCOPESCA antes\ndel 15 de agosto del 2009,\n a los efectos de que se les autorice por la\nvía de la excepción el combustible a precio preferencial y en consecuencia, no\nserán sujetos de la ayuda por parte del IMAS ni a realizar trabajo comunal.\n\nArtículo\n6º-El INCOPESCA coordinará oportuna y debidamente con el Instituto Mixto de\nAyuda Social (IMAS), para que se declare como situación de pobreza coyuntural,\nla condición de los pescadores propietarios de las embarcaciones pertenecientes\na la Flota Artesanal en Pequeña Escala, afectados con la declaratoria de veda en\nel Golfo de Nicoya, que tengan Licencia de Pesca Comercial vigente al 31 de\nagosto del 2009.\n\nArtículo\n7º-El INCOPESCA deberá acreditar ante el IMAS a aquellos pescadores\npropietarios de embarcaciones pesqueras comerciales de la Flota Artesanal en\nPequeña Escala, que se vean afectados por la veda establecida para el Golfo de\nNicoya y que se determine que carecen de otros ingresos complementarios, a\nefecto de que dicha Institución otorgue un beneficio económico por desempleo\nacorde con la situación real de dicho sector y en apego a los requisitos y\ncondiciones que se establezcan para estos efectos.\n\nArtículo\n8º-Para recibir el beneficio económico otorgado por el IMAS, los pescadores\npropietarios de embarcaciones pesqueras comerciales de la Flota Artesanal en Pequeña\nEscala, deberán someterse al Programa de Servicio de Trabajo Comunal que para\neste efecto deberá elaborar el INCOPESCA en coordinación con otras\ninstituciones gubernamentales o no gubernamentales.\n\nArtículo\n9º-De conformidad con el artículo 133 de la Ley de Pesca y Acuicultura, Ley Nº\n8436, el INCOPESCA para el mejor cumplimiento de los fines de este acuerdo,\nestablecerá oportuna y debidamente los convenios o mecanismos necesarios de\ncoordinación con el Ministerio de Seguridad Pública, Fuerza Pública y Servicio\nNacional de Guardacostas.\n\nArtículo\n10.-Publíquese.\n\nTransitorio Primero: El\nDepartamento de Extensión y Capacitación del INCOPESCA, a más tardar un mes\ncalendario a partir de la publicación de este acuerdo en el Diario Oficial La\nGaceta, deberá elaborar y presentar ante la Junta Directiva del INCOPESCA\npara su aprobación, una propuesta para reglamentar el trabajo por Servicio de\nTrabajo Comunal durante las Vedas, así establecido en el artículo 36 de la Ley\nNº 8436, Ley de Pesca y Acuicultura, como requisito indispensable para que los\nfondos de asistencia socioeconómica del Instituto Mixto de Ayuda Social (IMAS),\npuedan ser girados a favor de los pescadores afectados en los períodos de veda.\n\nTransitorio\nSegundo: El Departamento de Extensión y Capacitación del\nINCOPESCA, a los efectos de acreditar ante el IMAS el Servicio de Trabajo\nComunal realizado por los pescadores que se vean afectados en los períodos de\nveda, deberá coordinar únicamente con aquellas organizaciones pesqueras,\npreviamente registradas ante ese Departamento y en el tanto se encuentren\nactivas y tengan personería jurídica vigente.",
  "body_en_text": "across the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 200\n\n                        Establishes prohibitions for Commercial Fishing Fleets from fishing with any type of fishing gear in designated areas, and for the Semi-Industrial shrimp trawler fleet from carrying out its activity at any time of year in the designated zone\n\nComplete Text of the act: C73B9\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nCOSTA RICAN INSTITUTE OF\nFISHERIES AND AQUACULTURE\n\n \n\n \n\n(Sinalevi Note: The Costa Rican Institute of Fisheries and Aquaculture, through Agreement No. 227 of July 10, 2009, published in La Gaceta No. 147 of July 30, 2009, agreed to include within all the scopes established in this agreement those laborers or assistants of fishing vessel owners belonging to the Small-Scale Artisanal Fleet who are affected by the closure (veda) declaration agreed upon by the Board of Directors in the Gulf of Nicoya, during the period from October 1 to November 15, 2009)\n\n \n\n \n\n \n\nSECRETARIAT\nOF THE BOARD OF DIRECTORS\n\n \n\nAJDIP/200-2009.-Puntarenas, on the twelfth day of\nthe month of June of 2009.\n\n \n\nConsidering:\n\n \n\n1º-That in accordance with Law No. 7384, Law Creating INCOPESCA, and Law No. 8436, Fisheries and Aquaculture Law, it is the authority and competence of INCOPESCA to establish, based on technical, scientific, economic, and social criteria, closure zones or seasons (zonas o épocas de veda), whether by area or by specific species, in order to protect and utilize hydrobiological resources in a sustainable manner.\n\n2º-That it has been technically demonstrated that one means of conserving hydrobiological resources and guaranteeing sustainable utilization is by establishing closure periods and areas (periodos y áreas de veda), which it is therefore appropriate to define for their application.\n\n3º-That the Gulf of Nicoya is a natural refuge for a great variety of species and considered one of the most important fishing zones in the country.\n\n4º-That in accordance with the results of the research that, in recent years, has been carried out by researchers from the Research and Development Department of INCOPESCA, the School of Biological Sciences of the Universidad Nacional, and the Center for Marine Research of the Universidad de Costa Rica, it is urgent and necessary to implement management measures for the principal species of commercial value that have the Gulf of Nicoya as their habitat.\n\n5º-That in accordance with Article 36 of Law No. 8436, Fisheries and Aquaculture Law, the Executive Branch may authorize the allocation of funds from the National Budget in favor of the Joint Institute for Social Assistance (Instituto Mixto de Ayuda Social, IMAS), for the purpose of developing socioeconomic assistance programs specially designed for that purpose, in favor of fishermen who are affected by closure periods, provided it is proven that they have no other sources of income and are in a condition of poverty. These programs will necessarily involve community work services (servicios de trabajo comunal) by the beneficiaries.\n\n6º-That in accordance with Article 133 of Law No. 8436, Fisheries and Aquaculture Law, it is the responsibility of the National Coast Guard Service authorities to carry out operations aimed at arresting and seizing goods, equipment, fishing gear, or fishery products used to commit crimes and infractions against fisheries legislation or obtained as a product of such acts. The National Coast Guard Service shall act ex officio or at the request of accredited inspectors of INCOPESCA or of third parties. For the better fulfillment of the purposes of this Law, INCOPESCA shall establish the necessary coordination agreements or mechanisms with the National Coast Guard Service. Therefore:\n\n \n\nAGREES:\n\n \n\nArticle 1º-Fishing is totally prohibited for all Commercial Fishing Fleets with any type of fishing gear from October 1 to November 15, 2009, in the area lying within an imaginary straight line running from Punta Torres, known as Peñón (84º43'52\" West Longitude, 09º53'31\" North Latitude) to the Lighthouse of Islas Negritos Afuera (84°49'35\" West imaginary straight line running from Punta Torres, known as Peñón (84º43'52\" West Longitude, 09º53'31\" North Latitude) to the Lighthouse of Islas Negritos (84º49'35\" West Longitude, 09°49'14\" North Latitude) and from that line, offshore.\n\nArticle 5º-Those owners of vessels belonging to the Small-Scale Artisanal Fleet of the Gulf of Nicoya who wish to avail themselves of the provisions of the preceding article must declare so in writing before INCOPESCA prior to August 15, 2009, for the purpose of being authorized, by way of exception, for fuel at a preferential price, and consequently, they will not be subject to assistance from the IMAS nor to performing community work (trabajo comunal).\n\nArticle 6º-INCOPESCA shall coordinate in a timely and proper manner with the Joint Institute for Social Assistance (IMAS), so that the condition of the fishing vessel owners belonging to the Small-Scale Artisanal Fleet, affected by the closure (veda) declaration in the Gulf of Nicoya, who hold a valid Commercial Fishing License as of August 31, 2009, is declared a situation of circumstantial poverty.\n\nArticle 7º-INCOPESCA must certify before IMAS those commercial fishing vessel owners of the Small-Scale Artisanal Fleet who are affected by the closure (veda) established for the Gulf of Nicoya and who are determined to lack other complementary income, so that said Institution may grant an unemployment economic benefit commensurate with the real situation of that sector and in compliance with the requirements and conditions established for these purposes.\n\nArticle 8º-To receive the economic benefit granted by IMAS, the commercial fishing vessel owners of the Small-Scale Artisanal Fleet must submit to the Community Work Service Program (Programa de Servicio de Trabajo Comunal) that INCOPESCA shall develop for this purpose, in coordination with other governmental or non-governmental institutions.\n\nArticle 9º-In accordance with Article 133 of the Fisheries and Aquaculture Law, Law No. 8436, INCOPESCA, for the better fulfillment of the purposes of this agreement, shall establish in a timely and proper manner the necessary coordination agreements or mechanisms with the Ministry of Public Security, the Public Force, and the National Coast Guard Service.\n\nArticle 10.-Let it be published.\n\nFirst Transitory Provision: The Extension and Training Department of INCOPESCA, no later than one calendar month from the publication of this agreement in the Official Gazette La Gaceta, must prepare and submit to the Board of Directors of INCOPESCA for its approval, a proposal to regulate the work through the Community Work Service during Closures (Servicio de Trabajo Comunal durante las Vedas), as established in Article 36 of Law No. 8436, Fisheries and Aquaculture Law, as an indispensable requirement for the socioeconomic assistance funds of the Joint Institute for Social Assistance (IMAS) to be disbursed in favor of the fishermen affected in the closure periods.\n\nSecond Transitory Provision: The Extension and Training Department of INCOPESCA, for the purposes of certifying before IMAS the Community Work Service performed by fishermen affected in the closure periods, shall coordinate solely with those fishing organizations that are previously registered with that Department and insofar as they remain active and have valid legal status (personería jurídica)."
